CALL TO ORDER Chairperson Sally Hackfeld called the meeting to order at 7:05 p.m. 2. ROLL CALL Members Present: Sally Hackfeld, Chairperson Bill Biggers, Commissioner Larry Bracke, Commissioner Dennis York, Commissioner Others Present: Ron McKinney, Director of Human Resources Linda Cast, Human Resource Specialist Rex McEntire, City Attorney David Simmons, Appellant David Burke, Appellant Marion Niblett, Appellant 3. APPROVAL OF MINUTES Commissioner Bracke made the motion FOR JANUARY 6, 1994 to approve the minutes of the meeting held January 6, 1994, seconded by Commissioner York. Motion passed unanimously. 4. APPEAL HEARING 94-01 The decision was made to not invoke the rule, therefore witnesses were allowed ta remain in the hearing. Firefighter David Simmons filed an appeal that the Civil Service Rules and Regulations were amended to accommodate one person in the Fire Lieutenant testing process. (Reference Appeal Hearing 93- 04, Appellant David Botvidson.} Mr. Simmons appealed that the amendment should be to allow all who passed the written exam to participate in the Assessment Center. City Attorney Rex McEntire made his opening remarks, followed by Mr. Simmons making his opening remarks. Mr. McEntire offered Exhibit A, the entire record of Appeal Hearing 93-04. He then called Fire Chief Stan Gertz, who stated he felt there had been no adverse action against Mr. Simmons. Fire Lieutenant Gary Ingram was the next witness. Exhibit B, a letter from Lt. Ingram, was offered to the Commission. He verified he had written the letter. Mr. Simmons was given the opportunity to cross-examine all witnesses. Mr. Simmons was the next witness. Upon questioning by Mr. McEntire, he verified he placed number 18 on the fire lieutenant test. Closing statements were given by both parties. Due to the other two scheduled hearings being on the same subject matter, adjournment for deliberation was delayed until all appeals had been heard. 5. APPEAL HEARING 94-02 Firefighter David Burke filed an appeal disagreeing with the Civil Service Commission's ruling in appeal hearing 93- 04. His appeal requested one of three remedies: 1) scrap the test; 2) allaw all that passed to proceed to the Assessment Center; 3) take only the top eight candidates. Mr. McEntire made his opening remarks, followed by Mr. Burke. Mr. McEntire proceeded to question Mr. Burke. He verified that Mr. Burke's placement on the list was number ten. He then waived calling Chief Gertz and Lt. Ingram to repeat their statements. Mr. Burke presented his closing statement. Adjournment for deliberation was delayed until the final appeal was heard. 6. APPEAL HEARING 94-03 Firefighter Marion "J.R." Niblett filed an appeal that the rules were changed to accommodate one person, setting a 2 precedent for future testing. He requested a remedy of either re-doing the lieutenant's testing, or allow all who passed to proceed to the Assessment Center. Mr. McEntire and Mr. Niblett each made opening remarks. Mr. McEntire then questioned Mr. Niblett. Mr. Niblett commented that he did not pass the test, so he had nothing to gain from the Commission's decision. His concern involves a precedent being set for future testing. Closing statements were made by Mr. McEntire, Mr. Simmons, Mr. Burke, and Mr. Niblett. After deliberation, the Commission reconvened. Regarding Appeal 94-01, Commissioner Dennis York made the motion to uphold the Commission's determination on January 6, 1994, and further that appellant David Simmons was not adversely affected by the Commission~s determination of January 6, 1994, and therefore deny the appellant's grievance. Commissioner Larry Bracke seconded the motion. Motion carried by unanimous vote. Regarding Appeal 94-02, Commissioner Dennis York made the motion to uphold the Commission's determination on January 6, 1994, and further that appellant David Burke was not adversely affected by the Commission's determination of January 6, 1994, and therefore deny the appellant's grievance. Commissioner Larry Bracke seconded the motion. Motion carried by unanimous vote. Regarding Appeal 94-03, Commissioner Dennis Yark made the motion to uphold the Commission's determination on January 6, 1994, and further that appellant Marion Niblett was not adversely affected 3 by the Commission~s determination of January 6, 1994, and therefore deny the appellant's grievance. Commissioner Larry Bracke seconded the motion. Motion carried by unanimous vote. 5. ADJOURNMENT Meeting adjourned at 8:17 p.m. J . .
