CALL TO ORDER Chairperson Sally Hackfeld called the meeting to order at 7:00 p.m. 2. ROLL CALL Members Present: Sally Hackfeld, Chairperson Bill Biggers, Commissioner Larry Bracke, Commissioner Dennis York, Commissioner Others Present: Ron McKinney, Director of Human Resources Linda Cast, Human Resource Specialist Rex McEntire, City Attorney David Botvidson, Appellant Stan Gertz, Fire Chief 3. APPROVAL OF MINUTES Commissioner Biggers made the motion FOR DECEMBER 7, 1993 to approve the minutes of the meeting held December 7, 1993, seconded by Commissioner York. Motion passed unanimously. 4. APPEAL HEARING 93-03 Firefighter David Botvidson filed an appeal that he be reinstated as an eligible employee for the position of Fire Lieutenant, and be permitted to advance to the Assessment Center phase of the promotional testing procedure. City Attorney Rex McEntire made his opening remarks. He explained that the top nine people on the eligibility list had signed an agreement, asking that the appeal of Mr. Botvidson be sustained, and that the Commission issue an order waiving the "eight person rule" in connection with this vacancy only, and to allow the nine to advance to the Assessment Center Exercise. By this agreement, they each waive the right to insist on the limitation of the Assessment Center Exercise to eight persons. Mr. McEntire stated that he, Fire Chief Stan Gertz, and Human Resource Director Ron McKinney are in favor of approving the agreement. Mr. Botvidson made his opening remarks to the Commission in the form of a written statement. When asked by the Commission about the possibility of allowing nine people to proceed to the Assessment Center Exercises, he stated he is in agreement with Mr. McEntire's remarks. Chairperson Hackfeld addressed remarks to the nine people involved, who were in attendance at the hearing. She asked if they were in complete agreement on this, and stated that this was the time to make any statements. None came forward. The Commission adjourned for deliberation. After deliberation, the Commission reconvened. Commissioner Larry Bracke made the motion to sustain the appeal of David Botvidson, and to issue an order waiving the "eight person rule" in connection with this vacancy only, and to allow the first nine names on the eligibility list to advance to the Assessment Center Exercise.
