LOOP 820 1. CALL TO ORDER Chairman George Pederson called the meeting to order at 6:30 p.m. 2. ROLL CALL Members Present: George Pederson, Chairman Jeff Newsom, Commissioner Sally Hackfeld, Commissioner Marie Hinkle, Commissioner Others Present: Ron McKinney, Personnel Director Rex McEntire, City Attorney Jimmy Cates, Public Works Superintendent Conrad Spangler, Asst. Superintendent Vicky Craven, Employee Benefits Clerk 3. APPEAL HEARING 92-01 The witnesses were sworn in. Mr. Maenner represented himself. The decision was made not to invoke the rule, and the witnesses were allowed to be present. Mr. Maenner explained that on February 10, 1992, he was assigned the duties of patching potholes on Precinct Line Rd. He stated that he patched the holes that he knew to be in the boundaries for North Richland Hills, but did not patch holes outside the boundaries. He also worked on Lola, but was interrupted due to mechanical problems. He was called into Mr. Cates' office and disciplined because he did not patch all the holes on Precinct Line Rd. Mr. Maenner stated he patched the holes in North Richland Hills, not in Colleyville or Hurst. Mr. Cates stated that Mr. Spangler brought to his attention that the holes on Precinct Line Rd. had not been patched. When they asked Mr. Maenner if he had patched the holes, Mr. Maenner stated he had. Mr. Cates stated since he had seen holes that had not been patched, he prepared the letter of one day suspension. In the letter, Mr. Cates cited insubordination, incompetence, and failure to do as he was told. Mr. Cates entered as evidence pictures of holes on Precinct Line Rd. that were not patched. Mr. Maenner stated that he felt that if the crews were to work on streets outside of the city limits, they should be told specifically. He offered to show a video taping of the street that he had made, showing the street was patched. Ms. Hinkle asked Mr. Cates if his crews were aware that our city maintains all of Precinct Line Rd. He stated they may not be aware that the city maintains the entire road as a courtesy, not a policy. He further stated that even considering that, the holes in our city limits were not patched. There was general discussion concerning Mr. Maenner's work history. Mr. Spangler verified he instructed Mr. Maenner to patch Precinct Line Rd. In general discussion, he verified that Mr. Maenner did not call him to tell him he couldn't find holes to patch. Closing statements were made, and the Commission adjourned for deliberation. Upon return, Commissioner Hackfeld made the motion that the Commission finds that Mr. Maenner exhibited incompetence under the circumstances, but was not guilty of insubordination. The punishment is reduced to a written reprimand. Commissioner Newsom seconded the motion. Motion carried by unanimous vote. 4. APPROVAL OF MINUTES Commissioner Newsom made the motion to FOR AUGUST 7, 1991 approve the minutes, seconded by Chairman Pederson. Chairman Pederson and Commissioner Newsom voted yes, and Commissioners Hackfeld and Hinkle abstained since they were not on the Commission at the time of the meeting. Motion carried. 5. SELECTION OF Chairman Pederson nominated Commissioner CHAIRMAN AND Newsom for the position of Chairman. VICE-CHAIRMAN There were no other nominations. The 2 nomination received unanimous approval. Chairman Newsom nominated Commissioner Pederson for the positian of Vice- Chairman. There were no other nominatians. The nomination received unanimous approval. 6.
