CALL TO ORDER: Chairman Leslie Trotter called the meeting to order
at 7:30 p.m. in Room 100 of the Municipal Complex
Building located at 7301 Northeast Loop 820.

Y APPROVAL OF MINUTES: Minutes of the October 10th meeting were approved
by a motion from Mr. Moore, seconded by Mr. Betts;
voting was unanimous.
AGENDA Item I. Case No. CS -78 -3, Grievance Appeal Hearing Regarding
Prorating Vacation Pay Upon Separation
Chairman Trotter read the Grievance Appeal into the
record and explained the procedure for making appeals
to the Commission. He expressed that the Civil Service
Commission's role is one of viewing both sides whenever
an employee is aggrieved. The Chairman then asked
Sergeant McCleskey to present his case.
Sergeant McCleskey stated that management had denied
his request for a pro rata share of earned vacation
for the period from his anniversary date to his date
of termination. This denial was based on the past
manager's interpretation of the Rules. McCleskey
submitted a voucher as evidence that payment had been
made on a pro rata basis for employees who left the
City during a period of time after July 19, 1976
when the Rules were adopted. He showed that this
practice was discontinued in December of 1976.
Mr. Moore read Section 25a of Article XVII in the
Charter and expressed that his view on the subject
was to deny the request, because of the absence of
any specific provision for vacation pay at the time
of separation.

The last sentence in the same section was discussed;
regarding "pay in lieu of vacation ". Pete said he
had asked for either credit or pay and had been
denied both.
Les Trotter explained that his understanding of the
intent of that particular sentence was that department
heads could not arbitrarily pay in lieu of vacation
and allow their employees to work through vacation
period. Neither. the Charter nor the Rules address
themselves to subject of "pay upon separation ".
Bill Betts expressed his understanding of the Charter
on the "pay in lieu of vacation" was a stop gap
on allowing the employee to take the money instead of
using his /her vacation. He was in agreement with
Mr. Trotter that there i -s nothing in the Charter to
prohibit management's paying a pro rata share of
vacation upon separation.
Pete said he believes that "credit annually" means
you earn it monthly but are not allowed to use it
until after your anniversary date.
(The Commission went off the record for deliberations.)
(The Hearing was reconvened for further discussion.)
Records of the Civil Service Commission meetings were
submitted and brought out evidence of the intention
to revise the Rules to provide for prorating vacation
pay upon separation. On December 1, 1976, Item 7 on
the Agenda the Minutes show that the Commission was
considering such a change. Again on March 1, 1977,
Agenda Item 2 stated the Commission was in fact
recommending a Charter revision effecting this specific
change to be put before the voters.
The Chairman called for a motion from the Commission.
Bill Betts offered the following motion:
"I move this Commission allow P. R. McCleskey vacation
pay accumulated from July 25 to termination date,
10- 31 -78, a total of three and three - fourths days."

order, following the Grievance Hearing.

APPROVAL OF MINUTES: Minutes of the October 10, 1978 meeting were approved
prior to the Grievance Hearing. (Agenda Item 1 )
AGENDA Item 2. Consider procedures for Hiring CETA Employees.
The Commission asked that it be informed of the
hiring of new employees under the CETA Program.
Since CETA employees are paid through County Funds,
their requirements are different and the benefits
also differ from the regular employee. In order to
maintain equity in hiring practices the Commission
feels it would be beneficial to acquire a more
complete understanding of the Manpower requirements
and regulations regarding CETA personnel.
Mr. Moore made a motion to table this item for a
later date. Mr. Betts seconded the motion; voting
was unanimous in favor of the motion.
AGENDA Item 3. Letter to Employees Regarding Purposes of the
Civil Service Commission.
The Commission feels that there are many new employees
since their letter was sent in 1976 and wishes to
have a closer communication with all the employees.
Mr. Betts made a motion that a letter be drafted
and approved by all members of the Commission.
Mr. Moore seconded the motion; motion carried by
unanimous vote.
Mayor Faram said he would like to see a handbook for
employees published also. Sample handbooks are to be
reviewed and discussed soon.

(The regular meeting was adjourned and the "closed"
portion continued with the same people present.)
AGENDA Item 4. Personnel Action for Considering Base Pay for the
Position of Civil Service Secretary -
Chairman Trotter explained that an error had been
made by setting a base pay for this position because
it is not a classified position. Jim Cato explained
the system for figuring salaries for classified
personnel. Non - classified personnel are figured
differently. They are set at the discretion of
the City Council.
ADJOURNMENT: Mr. Moore made a motion to adjourn the meeting
at 9:30 p.m. Mr. Betts seconded the motion;
the meeting was adjourned.
