HomeMy WebLinkAboutCIV 1975-11-19 Minutes MINUTES OF THE APPEAL HEARING FOR CLYDE CAFFEY CIVIL SERVICE COMMISSION CITY OF NORTH RICHLAND HILLS NOVEMBER 19, 1975 CALL TO ORDER: Chairman Green called the special meeting of the Civil Service Commission to order at 7:30 p.m. ROLL CALL: COMMISSION MEMBERS PRESENT Mr. John Green, Chairman Mr. W. C. Moore Mr. Denver Mills OTHERS PRESENT Mr. Ray Britton, Director of Public Works Mr. Clyde Caffey, Appellant Helen Cline, Deputy Secretary APPROVAL OF MINUTES: The meeting was opened by reviewing the Minutes of the Johnny W. Howard appeal hearing which was held November 12, 1975. Mr. Mills made the motion which was seconded by Mr. Moore, that the Minutes be approved as written. The vote was 3- 0 for approval. The Minutes of the last regularly scheduled meeting dated November 11, 1975 were reviewed. Mr. Moore made the motion for approval of the minutes; motion was seconded by Mr. Mills and vote was 3- 0 for approval. PROCEEDINGS CS-75-6: Chairma.n Green opened the hearing with statements pertaining to the purposes and procedure to be followed in appeal hearings held by the Civil Service Commission. The hearings are conducted in an orderly, informal manner; all relative documents are read into the record which is tape recorded. Witnesses were sworn in and the Appellant, Clyde Caffey, representing himself, presented his case. Questions and discussion followed. Mr. Britton presented his case and also questioned the Appellant. A study (of the City map area which was involved in the incident) was made by both witnesses and the Commissioners. Motion was made by Mr. Moore "that the Commission overturn Mr. Britton's decision to suspend Mr. Caffey for 3 days without pay. The Co~ission assess a 1-day suspension without pay and the record of suspension will be retained in the personnel file. No change in class as a result of this action will occur." Minutes - Clyde Caffey Appeal Hearing November 19, 1975 This motion was seconded by Mr. Mills. A roll call vote was taken with the follawing result: Mr. Moore, "for"; Mr. Green, "against"; Mr. Mills, "against". The motion failed 2 - 1. A new motion was made by Mr. Mills "that the Commission overturn Mr. Britton's decision to suspend Mr. Caffey for 3 days without pay. The letter of suspension together with a copy of this decision shall be placed in Mr. Caffey's personnel records. Any back pay lost as a result of this incident shall be restored. No change in classification as a result of this incident shall occur." The motion was read into the record by Mr. Green. Again, a roll call vote was taken. The result was a unanimous DECISION: vote in favor of the motion. The decision of the Commission was properly signed and notarized; a copy was given to the Appellant.
