MINUTES OF THE APPEAL HEARING

CITY OF NORTH RICHLAND HILLS
NOVEMBER 12, 1975
CALL TO ORDER: The special meeting of the Civil Service Commission of
the City of North Richland Hills was called to order
at 7:30 p.m. on November 12, 1975, by the Chairman,
Mr. John Green.

Johnny Howard, Appellant
Helen Cline, Deputy Secretary
PROCEEDINGS: Opening statements were made by the Chairman, John Green,
defining the purpose and function of the Civil Service
Commission at grievance appeal hearings. The Commission
assures both management and the employee of an impartial
hearing in a court of last resort, serving as an arbitrator
to settle such disputes going beyond the department level.
All_relevant documents were read into the record.
WITNESS: Robert Madrid

Mr. Madrid was sworn and was the only witness called for
the appellant. He was examined by Mr. Howard and cross-
examined by Chief Gertz and the Co~ission.
Chief Gertz presented his basis for the action taken,
explaining the damages to the door of the Fire Department
which resulted from the incident.
A brief recess was called at approximately 8:30 p.m.
and the hearing resumed with all of the same Commission
members, appellant and representatives present. During
the recess the Commission members observed the actual
damage to the above mentioned door.

Both parties summarized their case before the Commission.
After all questions and discussion was concluded, the
hearing was closed for deliberation by the Commission.
Deliberations were open, public and recorded. Mr. Moore
made the motion that the action letter from Chief Gertz,
dated October 20, be sustained. The motion was seconded
by Mr. Mills and discussion followed. A roll call vote
was taken resulting in a vote of 2- 1 de£eating the
moCion.
A new motion was made by Mr. Mi11s, stating that the
letter of reprima.nd remain in Howard's personnel file
and that the suspension for one day be overturned aad
restored to Mr. Howard. Mr. Green seconded the motion.
A roll call vote was again taken and the motion passed
unanimously, 3 - 0.
The Appellant received a copy of the Decision.
The meeting was adjourned.
