CALL TO ORDER: The Civil Service Commission of the City of North
Richland Hills, Texas, was called to order by the
Chairman, Mr. John Green at 7:30 p.m., in the
Council Chambers of the City Hall.

APPROVAL OF MINIJTESs Minutes of the September 23, 1975 Commission meeting
were read and approved as written.
AGENDA
Item 1. The Commission agreed by a motion that the revised
Class 122 Job Description be accepted in place of
the PAS 122 ~ob description for fire inspector/
invesfiigator. The motion was made by Mr. Moore
and seconded by Mr. Churchman. A copy of the
Minutes with the revised Class 122 Job Description
attached will be sent to the Fire Department.

PROCEEDINGS: Chairman John Green read the grounds for action by
Chief Gertz, the letter of September 8, 1975.
The Grievance Form filed by Marvin Carter was also
read aloud. Mr. Green explained that the Civil
Service Commission serves an investigatory role
as a court of iast resort for the City.
Chief Gertz asked to invoke the Rule of Witnesses
and presented a copy of an area map as an Exhibit.
(Recess was called at 8:30 p.m.)
During this recess period the Commission went to
the Fire Department and examined maps which are
carried on the fire engine and also the wall map
inside the station which delineates district
boundaries.
(The Appeal Hearing reconvened inside the Council
Chambers.)
• Chief Gertz summarized by stating that he felt it
was his duty to provide the best possible fire
~ protection to the citizens within his districts and,
that his actions toward that end were proper in
this particular situation.
In conclusion, a motion was ma.de by Mr. Churchman
to set aside the 24-hour suspension by Chief Gertz
and that the Appellant should receive his back pay.
Mr. Moore seconded the motion. Ugon roll call
Mr. Moore voted "for"; Mr. Green voted "against"
and Mr. Churchman voted "for".
The Chief's letter to Marvin Carter, Jr., dated
September 8, 1975, regarding Violation of Department
Policy will remain in the personnel file with a
copy of the Decision.
ADJOURNMENT: The Hearing was closed at 10:20 p.m.
