COLE MAY 28, 1975 The special meeting of the Civil Service Commission of the City of North Richland Hills, was called to order by the Chairman, Mr. John H. Green, at 7:30 p.m. on May 28, 1975. Britton, Public Works Department supervi.sor Janell Green, secretary PRESS REPRE5ENTATIVE Don Harrison, Fort Worth Star Telegram The meeting was called in consideration of Case CS-75-2 for Mr. Ernest A. Cole. Mr. Cole was represented by councel, Mr. Britton presented his own case. Attorney Johnson invoked The Rule. The witnesses were presented before the Commission and sworn. Mr. Green requested the witnesses not discuss their testimony or the facts of the case and they were dismissed from the Council Chambers. Mr. Green read the letters from Mr. Britton which he had written to Mr. Cole and Che Commission. He then read the Grievance Form which Mr. Cole had filed as an appeal to Mr. Britton's action. Mr. Green presented the guidelines which would be followed during the hearing. Attorney 3ohnson asked the Commission which of Mr. Britton's letters would be the basis for the case to be presented. It was mutually agreed the letter writeen to Mr. Cole would be the letter the case would be based on. Mr. Johnson voiced an ob~ection for the record of the appeal hearing procedure stating he felt it forced Mr. Cole to come forward and lay out a basis far charges against him before he can deny or rebutt the charges. He objected to the appellant having to present his case first. His ob~ection was overruled, and the outlined procedure would be followed. Attorney Johnson presented his first witness. SECOND WITNESS - presented testimony for the appellant Pete Pistole 2440 Jackson Hill THIRD WITNESS - presented testimony for the appellant Thomas Owens 3712 Earle Dr. The meeting recessed at 9:43 to change the tape with the witness resuming his testimony at 9:46. Attorney Johnson stated he would try to finish the case as soon as possible. Mr. Britton presented his witness. FIRST WITNESS - presented testimony for the city John L. Taylor 6432 Davis Blvd. Mr. Britton summarized his case. Attorney Johnson summarized his case. The hearing closed for the Commission to deliberate at 11:30 p.m. Mr. Churchman made a motion that Mr. Cole be te~minated as an employee for the City of North Richland Hllls. The secretary poled the Commission. Mr. Moore - for, Mr. Churchman - for, Mr. Green - abstained. Motion carried. The decision was rendered in public and the meeting ad3ourned following the reading of the decision at 11:45 p.m. ~ JOHN H.
