MINUTES OF THE APPEAL HEARING
FOR
T. R. SHOCKLEY
MAY 7, 1975
The special meeting of the Civil Service Commission of the City of North
Richland Hills, Texas was called to order by the Chairman, Mr. John H. Green
at 7:30 p.m. at City Hall, 4101 Morgan Circle 3n the Council Chambers.

The meeting was called in consideration of Case CS-75-1, for T. R. Shockley
on May 7, 1975.
Appellant was represented by council, Mr. Jerry Loftin, and the City was
represented by Attorney Tim Truman. Debbie Walls was present and acting
as reporter for the appellant's attorney.
Mr. Green read the attached statement written by Chief Scruggs. He continued
with the response submitted by Attorney, Jerry Loftin. This is also attached.
Attorney Loftin made an oral ob~ection for the record against Chief Scruggs
statement.
Witnesses for the defense and appell.ant were identified and sworn before
the Commission. The character witnesses for Mr. Shockley were introduced
but excused from being sworn with no ob3ections. Mr. Green informed the
witnesses not to discuss the testimonies with each other or the facts of
the case and dismissed them from the Council Chambers.
The Chairman presented the gu~.delines for the procedure that atould be followed.
There being no questions by either party, Attorney Truman presented his case.
His case would be three-fold as follows: (1) present the charge, (2) introduce
the two Shisler boys as witnesses, and (3) present 10 to 15 affadavits wxitten
by the witnesses and parties to the transaction, and furnish the opposing
~ council with a copy of such. The affadavits would stand in place of live
testimony to avoid lengthy question and answer to transactions sworn in an
af~adavit.

Attorney Loftin ob~ected to this procedure stating he felt this placed them
in a disadvantage as they had not had an opportunity to read the affadavits.
He wished the witnesses he called and questioned.
Mr. Green called a recess at 7:55 p.m.
Meeting resumed at 8:15 p.m.
Attorney L6~tin renewed his objection asking that each witness be called
for questioning. After the Comm3ssion came to a ma~ority decision, Mr. Green
asked Attorney Truman to bring forth the witnesses for questioning.
Attorney Truman read Ch~Eef Scrugg's statement. The first witness was called
for testimony.

city. Then a summary was presented by Attorney Loftin for the appellant.
The Commission closed the hearing and a recess was called at 12:45 a.m. for
the Commission to deliberate. The meeting was resumed at 12:55 a.m. for
their decision. Mr. Moore made a motion that Mr. Shockley be suspended
without pay for a period of thirty (30) consecutive days effective April 18,
1975. Mr. Green seconded the motion. The secretary poled the Commission.
Mr. Moore-for, Mr. Green-for, and Mr. Churchman-against. Motion carried.
A signed copy of this decision is attached. Mr. Shockley was informed he
had ten (10) days from the date of deliberation to appeal their decision
to the District Court of Tarrant County if he should chose to do so.
Meeting adjourned at 1:00 a.m.
