MINUTES OF THE REGULAR MEETING OF THE
ZONING BOARD OF ADJUSTMENT OF THE
CITY OF NORTH RICHLAND HILLS, TEXAS
May 22, 2008

CALL TO ORDER
The meeting was called to order by Chairman Tom Duer at 7:00 p.m.

CONSIDERATION OF MINUTES FROM FEBRUARY 27, 2008 ZONING
BOARD OF ADJUSTMENT MEETING.
APPROVED
Leslie Jauregui, seconded by Bill Gibbs, motioned to approve the minutes
from February 27, 2008. The motion carried unanimously (5-0). Jerry Henry
was absent.

BA 2008-01
A Public Hearing to Consider a Request from Matthew and Michelle Cline
for a variance to construct a six foot privacy fence beyond the building
setback line adjacent to the street at 7729 Grace Drive.
Mr. Duer explained to the audience that the State Statute requires the Zoning
Board of Adjustment to have a super majority vote, seventy-five percent. Mr.
Duer stated that they are a five member voting board therefore four affirmative
votes are needed to pass.
Matthew Cline came forward to give the Board Members packets of letters from
neighbors in favor of the fence.
Mr. Duer swore in Michelle Cline.
Michelle Cline stated the purpose of the fence as explained in their response to
the Development Review Committee was to plan for exterior enhancements to
their home. The Cline's are considering a pool in the future and are aware that
the four foot wrought iron fence presently on the property line would not be
sufficient for the pool fencing requirement. At the present time the wrought iron
fence limits personal privacy and security for the Cline's. Mrs. Cline said that
they have spoken to the neighbors who would be most impacted; those who back
to the property at 9200 Grace Court. Mrs. Cline said the neighbors at 9200
Grace Court give their full support providing that the Cline's use the similar
composition materials and finish to the fence at 9200 Grace Court and the Cline's
are willing to agree to that. Mrs. Cline said they are willing to observe the
present clearance and that they are not asking to extend the privacy fence past
where the wrought iron fence is now. Mrs. Cline said that of all the letters sent
out to neighbors, they had received all but one letter back favoring the fence with
the stipulation that the fence had to match the Hardcastle's fence.
Leslie Jauregui asked Mrs. Cline how long that they have lived in the house and
if they were the original owners?
Mr. Cline said two years and that they are the original owners.
Mr. Duer reiterated the question of where the fence would be placed?
Mrs. Cline said that they are asking for the fence to be placed where the wrought
iron fence is now.
Jim Kemp asked if the neighbor's fence sloped?

Mr. Cline said yes and that they will take the slope out and make the fence all
uniform.
Mrs. Jauregui asked if they were planning on using the same materials?
The Cline's said yes and that they were willing to agree to the stipulation of the
materials.
Mr. Cline added that they were also going to stain the fence to match their
neighbor's existing fence.
Mrs. Jauregui commented that the lot had a unique configuration and for safety
and personal security she would move to grant BA 2008-01.
Mr. Duer asked City Staff whether or not proportions or measurements needed to
be in the motion, or could they just state that the fence needs to be replaced
where the existing wrought iron fence is right now?
Mr. Wilhite answered that they can just state where the existing wrought iron
fence is right now because the fence is on the property line. Mr. Wilhite
suggested that they stipulate in the motion that the fence be a maximum of six
feet and the fence needs to be constructed in like materials and color as the
existing neighbor's fence.
Mrs. Jauregui stated that she would like to amend her motion to include that the
fence be constructed of like materials and fashion of that of their neighbors.
APPROVED
Leslie Jauregui, seconded by Jim Kemp, motioned to grant BA 2008-01.
The motion carried unanimously (5-0). Jerry Henry was absent.
ADJOURNMENT
There being no other business, the chairman adjourned the meeting at 7:15 p.m.
