For the Meeting conducted at the North Richland Hills City Hall Council Chambers, 7301 Northeast
Loop 820 immediately following the 7:00 p.m. City Council meeting. The below listed items are
placed on the Agenda for discussion and/or action.

CALL TO ORDER
On the 8th day of January, 2001 at 8:05 p.m., the North Richland Hills Crime Control
and Prevention District convened in the City Council Chambers at the North Richland Hills City
Hall, 7301 Northeast Loop 820, North Richland Hills, Texas with the following members

APPROVAL OF MINUTES OF THE AUGUST 28, 2000 MEETING
APPROVED
Board Member Mitchell moved, seconded by Board Member Phifer, to approve the minutes of
the August 28, 2000 meeting.

CCD 2001-01 CALLING REFERENDUM ELECTION FOR CONTINUATION
OF CRIME CONTROL & PREVENTION DISTRICT -CCD RESOLUTION NO. 2001-A
Mayor advised that the Board needed to make a motion regarding the City Manager's
recommendation and recommendation made by the City Council at their 7:00 p.m. meeting on
January 8, 2001.
Board Member Mitchell moved, seconded by Board Member Trevino, to approve referendum
of election for the continuation of Crime District as proposed by the City Council.
The Mayor asked the City Manager to summarize the resolution and the approach of the City
in regards to the election.
City Manager Cunningham reported to the Board that the City Council had approved a
resolution requesting the Crime Control and Prevention District Board of Directors to order a
referendum on the continuation of the district for a period of ten years. The Council is asking
that the election be held at the earliest possible date before June 30, 2001. Mr. Cunningham
advised that Staff would prefer a February election date, but if February is not possible, as
early as possible prior to June 30, 2001. The Board was advised that in the Fall of 2000 staff
conferred with the State about a late February election date. The State concurred with a
February date. Subsequently Staff wanted further assurances from the State on the election
date since this was not a uniform election date. Staff has further requested State's
consideration of this matter. Within the next ten days Staff anticipates a determination as to
whether February is an available date or if it should be some other date. If it can be a
February date then another CCD Board meeting will be set to request an election order. If the
election cannot be in February, then the CCD Board will be asked to meet within the next thirty
to forty-five days to order the election. Staff recommends, as Council has already indicated,
approval for an election under this arrangement.

Control & Prevention District -CCD Resolution No. 2001-B
At the January 8 City Council meeting, the Council approved Resolution No. 2001-02
requesting the North Richland Hills Crime Control and Prevention District to order a
referendum at the earliest possible date before June 30, 2001 to allow voting for or against
the continuation of the Crime Control and Prevention District and sales tax for ten years.
The attached Crime Control District Resolution orders the election to be held on May 5,
2001. The resolution calls for the election to be conducted in accordance with the Texas
Election Laws. It establishes the voting locations, provides for the appointment of election
officials and provides for early voting procedures.

RESOLUTION NO. 2001-B
NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE
NORTH RICHLAND HILLS CRIME CONTROL AND PREVENTION DISTRICT, that:
1.
A referendum is hereby ordered to be held on May 5, 2001 in the North Richland
Hills Crime Control and Prevention District wherein the eligible voters residing within the
District shall be permitted to vote for or against the proposition:
"Whether the North Richland Hills Crime Control and Prevention District should be
continued for ten years and the Crime Control and Prevention District sales tax of
one-half cent should be continued for ten years."
2.
Such election (referendum) shall be held at the following locations for the
following precincts:

Early voting by personal appearance shall be held at the North Richland Hills
City Hall, 7301 N. E. Loop 820, North Richland Hills, Texas between the hours of 8:00
a.m. and 5:00 p.m. Monday through Friday of each week beginning on Wednesday,
April 18, 2001 at 8:00 a.m. and ending on May 1, 2001 at 5:00 p.m.

Each presiding judge shall appoint not more than six election clerks. The
alternate election judge shall be one of the clerks. The presiding judge at Precinct One
and at least two election clerks shall also serve as the early voting ballot board.
6.
The referendum election shall be conducted pursuant to the election laws of the
State of Texas.
7.
The proposed continuation of the sales and use tax rate shall be one-half of one
percent.

Public Heanng To Consider and Act Upon Repealing
Application of Sales Tax Holiday Exemption -CCD Order No. 2001-01
If Council elects to continue participating in the sales tax holiday, this hearing does not
need to be held. The Mayor should also announce, if a hearing is held, that he is
convening a meeting of the Crime Control & Prevention District Board.
Section 326.003 of the Texas Tax Code states that a governing body of a taxing authority
may by a majority vote adopt an appropriate order to repeal participation in the sales tax
holiday held the first Friday, Saturday and Sunday of August. Before a vote is held, the
governing body must hold a public hearing.
Recommendation
Hold public hearing on the Crime Control and Prevention District opting out of the sales tax
holiday. If the Crime Control District Board majority vote is to opt out of the sales tax
holiday, approve Order No. 2001-01

ORDER NO. CCD 2001-C
WHEREAS, Texas Tax Code Section 326.003 makes it possible for a local taxing
authority to repeal the application of a sales tax exemption during the sales tax holiday held
the first Friday, Saturday and Sunday in August; and
WHEREAS, the North Richland Hills Crime Control and Prevention District Board of
Directors has duly held a public hearing to consider opting out of said sales tax holiday.
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF DIRECTORS OF THE
NORTH RICHLAND HILLS CRIME CONTROL AND PREVENTION DISTRICT, that:
1.
The Board of Directors, acting on behalf of such District, hereby repeals the application
of the sales tax exemption referred to in Section 326.002 of the Tax Code of the State of Texas
and by authority of Section 326.003 of said Tax Code said District repeals such sales tax
exemption for the year 2001 and future years.
PASSED by majority vote of the Board of Directors at a dully called and posted meeting
on March 26, 2001.
