The meeting was called to order at 1:00 p.m.

CONSIDERATION OF MINUTES FROM JUNE 30, 2008
Garry Cope: The first order of business is the consideration of the minutes from
our last meeting which was on June 30 2007. Are there any questions or
comments about the minutes? If not, do I hear a motion?
John Larriviere: I make a motion that we accept the minutes.
Philip Orr: I second the motion.
Garry Cope: I have a motion and a second to accept the minutes of our last
meeting. All those in favor? Let the record show that it was a unanimous aye.

SSB2008-15
PUBLIC HEARING FOR ABSTRACT 1150 TRACT 3A1A &3A6 HILLVIEW
ADDITION KNOWN AS 7400 EDEN ROAD.
Garry Cope: Our first hearing for consideration today is SSB2008-15., Abstract
1150, Tracts 3A1A &3A6, David Moses Survey, known as 7400 Eden Road. I'd
like to hear the City's presentation.
Debbie Heizer: I am Debbie Heizer. I work in the Code Enforcement Division of
Neighborhood Services. I am here to present case SSB2008-15
located at 7400 Eden Road. This property is zoned agriculture and is currently
vacant. An aerial map showing the general location is included in your
presentation. A vacate, repair or demolish letter dated May 18, 2008 was mailed
certified and the return receipt of delivery was received. The owner of record was
notified by certified mail of this hearing on June 16, 2008. The return or receipt
was received. At this time we have no permits on file. The photos I'm about to
present to you are true and accurate photos taken by myself and the director of
neighborhood services Jo Ann Stout. A brief history of the property. 03/27/08 -
Title Search requested. On 04/18/08 -Title Search received
On 04/28/08 -Notice sent to property owner requesting to inspect property. On
05/07/08 -Search warrant requested and obtained. On 05/08/08 -Interior and
Exterior inspection conducted by Building Official and Director of Neighborhood
Services. On 05/14/08 -Notice and Order sent to property owner and other
interested parties via certified and regular mail as well as posted on the property.
06/18/08 -Notice of Hearing sent to property owner and other interested parties
via certified and regular mail as well as posted on the property. Photo #1 and
Photo #2 taken June 30, 2008 show Inadequate weatherproofing and
General dilapidation. Photo # 3 taken June 30, 2008 and Photo # 4 taken May 8,
2008 are more examples of faulty weather protection and general dilapidation.

shows the air conditioning unit not properly installed and has not been properly
maintained. Photo #15 taken May 8, 2008 shows the gas furnace not properly
installed and not properly maintained. Photo #16 and Photo #17 taken June 30,
2008 Show a dilapidated accessory building. Photo #18 taken May 8, 2008
And photo #19 taken June 30, 2008 are photos of the Second accessory
building and show improper maintenance.
Philip Orr: Is this property vacant?
Debbie Heizer: Yes Sir.
Garry Cope: Any other questions?
George Staples: In your opinion is this property a substandard building within
the definition with the City's ordinance?
Debbie Heizer: Yes Sir they are.
John Larriviere: How much property is involved?
Debbie Heizer: An acre and a half.
Garry Cope: Do we have any questions for the board? We have some
representatives of the property here. If anyone wishes to speak please come up
to the podium.
Philip Blakeman: I purchased this property Thursday. Friday, Tony the current
owner signed his end of the closing. I bought it through the bank as an
investment property. I couldn't get a home loan because it wouldn't pass. My
fiance and I will move into the property once it's completed. We are getting
married on the 12'h of July. The first thing I plan to do is put a construction
dumpster in front and get rid of the junk. Tony has asked for some time to claim
some items he has on the property. I'm hoping to get rid of the school bus. I'm
going to demo one of the accessory building. The second accessory building, I
plan to repair the tin and use it as hay storage for 2 horses. It needs a new skin
on the outside. I plan to put a new roof on it. That's the first thing I'm going to do.
The second thing I'm going to do is put new vinyl siding on the outside. I plan to
put new doors and repair the rotten wood and put a new eave on the house. I'm
going to put a front porch on the property as well. On the inside, I'd like to refinish
the flooring and keep as much as I can. I'm going to have to replace the kitchen
flooring.
Brian Crowson: Give us a timeline.
Philip Blakeman: I'll be able to start when I get back from my honeymoon on the
20th. I'm going to have about 3 months of work to get the property up to code.
Jo Ann Stout: Are you going to personally do the work?
Philip Blakeman: Yes I am. I'm a general contractor. I work with my father. I'll be
working full-time on this property.
Jo Ann Stout: One thing that we are going to be interested in, is for you to
provide us with a scope and schedule for work. We'll have Dave Pendly the
building official look over it. We're going to hold you to it. If at anytime you don't
meet a deadline that was given we will meet again and re-evaluate.
George Staples: I'd like to point out that we can't give him that much time
without that schedule. Remember 90 days is all we can do without a schedule.
Perhaps we make sure he provides the schedule. Perhaps some flexibility is in
order since he just got into it. What would you think about continuing it till next
month?
Jo Ann Stout: Will you be able to provide a scope and schedule?
Philip Blakeman: Absolutely. I'm moving as fast as I can. I tired to apply for the
permits to get some stuff done but I didn't own the property yet. I couldn't do
anything till I owned the property which was Friday.
Jo Ann Stout: Our meeting will be the 3~d week of July.
Philip Blakeman: I can get the scope to you before I leave on the honeymoon.
George Staples: Can you get it done within 90 days once you get us that
schedule?
Philip Blakeman: Yes I can.
George Staples: The scope and schedule will need to identify all the things that
are going to happen and the deadline dates that you will accomplish these. This
is the hearing, there's not going to be another one. What we will be doing on this
one is staff will be in position to recommend this schedule to the board and they
can just adopt it and you can live with that. For that reason t'm suggesting you try
to meet with these folks and make sure it's going to work.
Jo Ann Stout: When we obtained the search warrant the house was open. We
need to get any broken glass repaired and get the house boarded up and
secured.
Garry Cope: Is there anyone else who wishes to speak?
Tom Pate: I've lived across from the property for the last 3 years. He's indicated
that he wants to get the house fixed up and livable. I live at 7401 Eden. I'm going
to do my best to help Philip. I'm going to mow the property for him. I'd be glad to
help out with anything while he's away.
Jo Ann Stout: Decide what you are going to do with that bus.
Philip Blakeman: I do not want that bus. I'll have it donated.
Garry Cope: Anyone else want to speak? Let's discuss this gentleman. We'd like
to continue this till the next meeting, which will be the 21St of July. If you provide
the City with a Scope and Schedule we'll decide on it at that time. Nothing will
happen until our next meeting. If you have not produced a schedule that the City
approves by that time, then we will go on with demolition.
Philip Orr: We don't want to have to buy that house, so we will be very
reasonable.
Philip Blakeman: I can't get rid of the bus until I get back from the honeymoon.

Garry Cope: We will continue this case until next month. Do I hear a motion of
