MINUTES OF THE SPECIAL CALLED MEETING
OF THE BUILDING CODE & ORDINANCE
COMMITTEE OF THE CITY OF NORTH RICHLAND
HILLS, TX, JANUARY, 28, 1986.- 7:00 P.M.
The meeting was called to order by
Chairman Joe Coulson at 7:00 P.M.

Request of David Barfield to use wood
shingles and/or shakes on a commercial
building.
Chairman Joe Coulson called David
Barfield to come forward.
David Barfield came forward,stated his
case, and showed his plans to the
committee. He requested that the
existing protion of the building come
under the grandfather
clause. Mr. Barfield stated that the
existing shingles would be treated
with fire coating. The shingles that
are being added would be brought up to
code with fire treated shingles.
Chairman Joe Coulson asked Mr.
Barfield how much square footage was
being added to the existing building.
Mr. Barfield stated that they would be
adding 1500 square feet.
Robert Skinner asked how old the house
was.
Mr. Barfield stated that the house was
twenty years old. The roof is two
years old. He said that the roof
was not something that they could not
live without, it was just a matter of
economy. It would cost several
thousands of dollars to replace it and
they liked the looks of the shingles.
Robert Skinner L ~ed Mr. Barfield if
this would become an office space for
him.
Mr. Barfield stated that it was set up
for Hanson Properties.
Robert Skinner asked of it was for the
development of residential in the
immediate area.
Mr. Barfield stated that it would be
the home office unless something
better came along.
Robert Skinner asked of the other
properties, that would be built in the
future, would have wood shingles.
Mr. Barfield stated that none of their
other buildings did.
Chairman Joe Coulson asked how many
squares of shingles they were adding
to the roof.
Mr. Barfield stated that there would
be twenty squares added.
Chairman Joe Coulson asked the
committee of anyone wanted to take a
look at the plans or discuss it in
private.
Greg Wheeler stated that everything
would have to be in the open, that if
he had been aware that the plans were
going to be brought in, he would have
made them available for the committee
in the pre - council meeting. He said
that it was apparent what the question
was, but for the record that the wood
shingle ordinance did not allow wood
shingles on commercial buildings. Mr.
Wheeler also said that ordinance No.
1217 and the Fire Department Code do
not get grandfathered unless
specifically designated by the City
Council. The codes are only
grandfathered with the buildings
started under the old codes and then
new codes are adopted during
construction only then do they allow
the old code. Any new construction
would then fall under the new
ordinance.
Mr. Barfield sti...__~d that the only
reason the shingles were being
replaced was because of hail damage.
He said that he was not sure whether
they were fire treated or not. Mr.
Barfield asked Greg Wheeler if there
was a way to tell.
Greg Wheeler stated that there could
be a way of it being tested, but on
the job treating by painting or
spraying was no longer acceptable
because Class C or better has to be
factory treated before it is brought
on the job.
Chairman Joe Coulson stated that
basically what they could do is go
back to the original owner and find
out if the shingles were a Class C
type and get a letter stating that,
but they would still have the
twenty-five percent requirement for
remodeling. He informed Mr. Barfield
that it was not the committee's job to
grant variances; they can deny and he
could appeal to the City Council, but
it would involve a time span.
Mr. Barfield stated that it was his
understanding that the committee could
grant a variance or there would not
have been any reason to come. He had
been aware that they were in violation
of City Code, and after meeting with
the City Staff they suggested that he
go before this board, so they could
make their recommendation on this.
Chairman Joe Coulson stated that the
main objective of the committee was to
stay within the building codes because
if they went against it, they were
liabling themselves as a committee. He
said that a vote would need to be
taken whether to approve or deny it,
then the next course of action would
be to appeal it to the City Council
because the committee can not refute a
building ordinance.
Mr. Barfield asked even if there was a
question in this request to the
existing building.
Chairman Joe COL.ðon stated that of
the board could not settle the problem
then the appeal would go to the City
Council. As far as commercial
building were concerned or wood
shingles, the ordinance stated that
wood shingles can not be allowed.
Greg Wheeler stated that he did not
know that the meeting between the City
Manager Roger Line, Richard Royston,
and the Fire Marshall was so
extensive. When he was told to have
the committee meet, it was to decide
what the possibilities were according
to the Uniform Building Code.
Mr. Barfield stated that he had no
problem with that. He knew the code.
But after meeting with the City
Manager, Richard Royston, and the Fire
Marshall, there was some doubt because
of this being an existing building
that was in the process of being
remodeled.
Greg Wheeler said that it was
surprising to him that it was sent to
the committee because all the other
houses that come to them to be turned
onto commercial buildings had no wood
shingles. This problem had never come
up before.
Mr. Barfield stated that when he asked
the City Manager, Richard Royston, and
the Fire Marshall if this board could
make the decision, he was told that it
could.
Greg Wheeler stated that the main
focus of this committee was not to
grant variances.
Chairman Joe Coulson asked Mr.
Barfield the total square footage
being added.
David Barfield stated that there was
1500 square feet being added.
Robert Skinner made the motion to take
a vote to approve or disapprove the
request being as it may that the
ordinance reads that it is a violation
to use wood shingles on multi family
or commercial buildings, or extend it
to the City Council for approval.
ADJOURNMENT
and Ordinance Committee
Chairman Joe COL ~on seconded the
motion.
Orville Baker also seconded the motion
and stated that under the rules there
was no alternative but to agree that
it should be carried on to the City
Council since the committee did not
have the authority to discontinue or
disregard the rules.
Chairman Joe Coulson asked John
Larriviere if he had any rebutal on
this.
John Larriviere stated that he did
not. He agreed with everything.
Chairman Joe Coulson made the motion
to deny the request of David Barfield
to use wood shingles on the house at
9224 Amundson Rd.
John Larriviere seconded the motion
and the motion to deny carried 4-0.
The meeting adjourned at 7:30 P.M.
