Councilman Wood moved that the minutes from the 2/5/96 CIP Meeting be approved. Councilman Phifer seconded. Motion carried. No Action Minutes of CIP Meeting 9/24/96 Teakwood Court To assist the citizens having flooding problems on Greg Drainage Teakwood Court, the Council approved this project on Dickens/ Improvements, Phase II 2/12/96 as part of the 1996 Drainage Improvement Mike Curtis Program. Initially, the project was to consist of a 6' x 5' box culvert behind some of the houses. However, some property owners are now indicating they do not want the box culvert behind their houses. Mark Berry (Teague Nail and Perkins) explained there were two alternatives which could be considered. These were included with the agenda. The major difference between the two was cost and alignment constraints. Councilman Welch, CIP Committee Chairman, asked the residents present if they had any questions or comments. Two residents (7509 and 7501 Teakwood Court) voiced concerns about possible damage to pools during construction and future problems which might not be obvious for several years. The property owner at 7216 Plumwood expressed concerns about possible foundation problems, since construction would be within 5 feet of his home. Questions were asked about the City taking additional easement from backyards, which could possibly prevent installation of any pools for those that do not have one at this time. Rex McEntire, Attorney for the City, responded to questions concerning the legality of the City pursuing the different alternatives. He basically told the Committee the City can legally choose to do whichever alternative it decided was appropriate. Also discussed were other possible solutions including the purchase of 1-2 lots which could be used for a detention basin. Councilman Wood asked Mr. McEntire if this could be taken to Executive Session at the next Council Meeting for discussion by all members of Council due to the threat of legal action and possible condemnation. Mr. McEntire stated this could be done. Councilman Wood then moved that this be taken to Execution Session at the next City Council Meeting. Councilman Don Phifer seconded the motion. Motion carried.
