ORDINANCE NO. 1411
AN ORDINANCE REZONING PROPERTY IN ACCORDANCE
WITH SECTION XXVIII, AMENDMENTS, OF ZONING
ORDINANCE #1080 OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS, PASSED, APPROVED, AND ADOPTED
BY THE PLANNING AND ZONING COMMISSION AND THE
CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, JANUARY 9, 1984
AFTER APPROPRIATE NOTICE AND PUBLIC HEARING THE FOLLOWING RECOMMENDATION
IS SUBMITTED TO THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS BY
THE PLANNING AND ZONING COMMISSION:
RESOLVED that on Case No. PZ-86-37 the following described property shall
be rezoned from R-7-MF to C-1.
BEING 2.43 acres, more or less, out of the John Condra Survey, Abstract
311, being located in the City of North Richland Hills, Tarrant County,
Texas and being a part of the 31.599 acres conveyed to Richland Village
Joint Venture as recorded in Volume 7779, Page 1643 of the Deed Records of
Tarrant County, Texas;
BEGINNING at a 5/8 inch iron rod at the southeast corner of Lot 1, Block
45, Foster Village, Section 14, as recorded in Volume 388-127, Page 67 of
the Deed Records of Tarrant County, Texas and being the northeast corner of
a tract described in the deed to the City of North Richland Hills recorded
in Volume 7311, Page 1126 of the Deed Records of Tarrant County, Texas and
being the northwest corner of said 31.599 acre tract;
THENCE South 89 degrees 43 minutes 30 seconds East with the north line of
said 31.599 acre tract and the south line of said Block 45 of Foster
Village, Section 14 a distance of 222.03 feet to a point for corner;
THENCE South 00 degrees 36 minutes 34 seconds East 475.65 feet to a point
in the north line of a tract conveyed to Jubilee's Prime Blessings
Investment, Inc., Trustee as recorded in Volume 7872, Page 2034 and in
Volume 7872, Page 2041 of the Deed Records of Tarrant County, Texas;
THENCE South 89 degrees 56 minutes 50 seconds West with the north line of
said Jubilee's Prime Blessings tract a distance of 222.01 feet to a point
in the east line of said City of North Richland Hills tract, same being the
east right of way line of Rufe Snow Drive;
THENCE North 00 degrees 36 minutes 34 seconds West with the west line of
said 31.599 acre tract and the east line of said City of North Richland
Hills tract and the east line of Rufe Snow Drive a distance of 476.92 feet
to the place of beginning and containing 2.43 acres or 105,735 square feet
more or less.

This property is located on the east side of Rufe Snow Drive, north of
Hightower Drive.

THAT THE UNDERSIGNED, Tompkins Development Company and DK
Partners, (hereinafter called the "Declarants") are owners of that
certain real property situated in North Richland Hills, Tarrant
County, Texas, (the "Property") being more particularly described
as follows:
SEE ATTACHED EXHIBIT I
THAT Declarants desire to construct a first class retail
development upon the Property and, to this end, Declarants have
made application to the City of North Richland Hills, Texas, to
rezone the Property from the R-7 Multi-Family classification to
a C-l Commercial classification in order to utilize said Property
to its highest and best use and to permit the aforesaid development
to the Property; and
THAT as a material inducement to the Homeowners as listed
below: Mr. & Mrs. Barry McHenry, Owner of 6720 Ridgetop, North
Richland Hills, Texas, Mr~ & Mrs. Jerry Wofford, Owner of 6713
Ridgetop, North Richland Hills, Texas, Mr. & Mrs. Joe Lopez, Owner
of 6709 Ridgetop, North Richland Hills, Texas, Mr. & Mrs. Victor
Harvey, Owner of 6712 Ridgetop, North Richland Hills, Texas, Mr &
Mrs. Donald Wood, Owner of 6716 Ridgetop, North Richland Hills,
Texas, Mr. & Mrs. Charles Salmon, Owner of 6701 Ridgetop, North
Richland Hills, Texas, and Mr. & Mrs. Marlin Fravert, Owner of
6717 Ridgetop, North Richland Hills, Texas, who are the owners
of the following properties respectively: Lot 6, Block 45, Foster
Village, Section 14, located in the City of North Richland Hills,
according to plat r~cords in Volume 388-127, page 67, Plat records,
Tarrant County, Texas; Lot 3, Block 6, Foster Village, Section 14,
located in the City of North Richland Hills, according to plat
records in Volume 388-127, page 67, Plat records, Tarrant County,
Texas; Lot 2, Block 6, Foster Village, Section 14, located in the
City of North Richland Hills, according to plat records in Volume
388-127, page 67, Plat Records, Tarrant County, Texas; Lot 4, Block
45, Foster Village, Section 14, located in the City of North Rich-
land Hills, according to plat records in Volume 388-127, page 67,
Plat Records, Tarrant County, Texas; Lot 5, Block 45, Foster Village,
located in the City of North Richland Hills, according to plat
records in Volume 338-127, page 67, Plat Records, Tarrant County,
Texas; Lot 36, Block 6, Foster Village, Section 14, located in
the City of North Richland Hills, according to plat records in
Volume 388-127, page 67, Plat Records, Tarrant County, Texas; Lot
4, Block 6, Foster Village, Section 14, located in the City of
North Richland Hills, according to plat records in Volume 388-127,
page 67, Plat Records, Tarrant County, Texas; the Declarants have
represented that they will subject the Property to the covenants,
conditions, and restrictions hereinafter set forth in order to
insure the development of the Property as a first-class retail
facility; and
THAT in reliance upon the Declarants' representations, the
Homeowners as listed herein have supported the Declarants' applica-
tion to rezone the Property as aforesaid, and the City Council of
the City of North Richland Hills, Texas and the Zoning Commission
of the City of No-th Richland Hills have approved the Delarants'
application to rezone the Property to the C-l Commercial classifi-
cation;

NOW, THEREFORE, the Declarants, Tompkins Development Company
and DK Partners, do hereby declare that the Property shall be held,
sold and conveyed subject to the following restrictions, covenants,
and conditions, which are for the purpose of protecting the value
and desirability of, and which shall run with, the Property and
shall be binding upon all parties having any right, title, or
interest in or to said Property, or any part thereof, and their
heirs, executors, successors and assigns.
ARTICLE I
GENERAL RESTRICTIONS
Section l. All buildings constructed on the Property shall be
single story buildings; provided, however, nothing contained herein
shall limit the peak or pitch of the roof of any building or the
height of the buildings facade or parapet.
Section 2. No building may be constructed or placed within
60 feet of the northernmost boundary line of the Property.
Section 3. A "screening wall" eight (8) feet in height and
constructed of concrete block or other acceptable masonry construction
shall be erected and maintained along the northernmost boundary
line of the Property, prior to construction of any building or
structure on the Property and shall extend from Rufe Snow Drive
to the east end of Lot six (6), Block 45, Foster Village Addition
to City of North Richland Hills, on the northernmost property
boundary and shall be in conformance with the regulations and
ordinances of the City of North Richland Hills regarding setbacks
and otherwise. In addition, the Declarants or their heirs, executors,
successors or assigns shall be responsible to maintain and keep in
good repair the "screening wall" for the term of this Declaration.
LANDSCAPING
Section l. A "greenbelt" of landscaping at least forty (40)
feet in width and running the entire length along the northernmost
boundary of the Property. Trees with a minimum of three-inch
caliper trunks shall be installed or maintained in such greenbelt
at a frequency of at least one (1) per 20 feet per attached Exhibit
I. All landscaping shall be maintained in a good, healthy condition.
Should any plant material utilized in landscaping die, the owner
of that portion of the Property containing such plant material shall
have sixty (60) days to remove the said dead plant material and,
weather conditions permitting, to install a suitable replacement.
ARTICLE III
GENERAL PROVISIONS
Section 1. The covenants, conditons, and restrictions of
this Declaration shall run with and bind the Property and shall be
effective for a term of twenty (20) years from the date this Declara-
tion is recorded, whereupon same shall terminate and be of no further
force and effect. These covenants, conditions, and restrictions shall
inure to the benefit of the Homeowners and the properties owned by
them as listed herein, who,together with their successors in title,
shall have the right to enforce all of said covenants, conditions,
and restrictions of this Declaration against the person or persons
violating or attempting to violate same. Any failure to enforce
any covenant, condition, or restriction herein contained shall in
no event be ~ a waiver of the right to do so thereafter.

Section 2. The covenants, conditions, and restrictions of
this Declaration may be abolished, amended and/or changed in whole
or in part, by the then owner of the Property only upon obtaining
the consent or approval of the Homeowners as listed herein. The
agreement, consent or approval of the City of North Richland Hills,
the City Zoning Commission or any other person or entity (other
than the Homeowners as listed herein) to any such abolition, amend-
ment or change of these covenants, conditions, and restrictions is
specifically not required.
Section 3. Enforcement of these covenants, conditions, and
restrictions (and any amendments or supplements thereto) shall be by
any proceeding at law or in equity against any person or persons
violating or attempting to violate any covenant, condition, or
restriction either to restrain violation or to recover damages.
Section 4. Invalidation of anyone of the covenants, conditions,
or restrictions or any provision of this Declaration by judgment,
court order, or otherwise shall in no way affect any other provision
which shall remain in full force and effect.

certain real property situated in North Richland Hills, Tarrant
County, Texas, (the "Property") being more particularly described as

located in the City of North Richland Hills, according to plat records
in Volume 388-127, page 67, Plat Records, Tarrant County, Texas;
Lot 3, Block 6, Foster Village, Section l4, located in the City of
North Richland Hills, according to plat records ~n Volume 388-l27,
page 67, Plat Records, -Tarrant County, Texas; Lot 2, Block 6, Foster
Village, Section 14, located in the City of North Rich1and Hills,
according to plat records in Volume 388-127, page 67, Plat Records,
Tarrant County, Texas; Lot 4, Block 45, Foster Village, Section 14,
located in the City of North Richland Hills, according to plat records
in Volume 388-127, page 67, Plat Records, Tarrant County, Texas; Lot 5,
Block 45, Foster Village, Section l4, located in the City of North
Richland Hills, according to plat records in Volume 388-l27, page 67,
Plat Records, Tarrant County, Texas; Lot 36, Block 6, Foster Village,
Section 14, located in the City of North Rich1and Hills, according to
plat records in Volume 388-127, page 67, Plat Records, Tarrapt County,
Texas; and Lot 4, Block 6, Foster Village, Section 14, located in
the City of North Rich1and Hills, according to plat records in Volume
388-127, page 67, Plat Records, Tarrant County, Texas. The Dec1arants
have represented that they will subject the Property to the covenants,
conditions, and restrictions hereinafter set forth in order to insure
the development as a high quality multi-family property; and
THAT in reliance upon the Declarants' representations, the
Homeowners as listed herein, have supported the Declarants' application
to rezone the adjacent, westernmost 2.43 acres from R-7 Multi-Family
to C-l Commercial, and the City Council of the City of North Richland
Hills, Texas and the Zoning Commission of the City of North Richland
Hills have approved the Declarants' application to rezone the adjacent
2.43 acres to the C-l Commerical classification;
NOW, THEREFORE, the Declarants, Tomkins Development Company
and DK Partners, do hereby declare that the Property shall be held,
sold and conveyed subject to the following restrictions, covenants,
and conditions, which are for the purpose of protecting the value and
desirability of, and which shall run with, the Property and shall be
binding upon all parties having any right, title or interest in or to
said Property, or any part thereof, and their heirs, executors, suc-
cessors and assigns.

ARTICLE I
GENERAL RESTRICTIONS
Section l. All buildings constructed on the Property
within 60 feet of the northernmost boundary line shall be single
story buildings; provided, however, nothing contained herein shall
limit the peak or pitch of the roof of any building or the height
of the buildings facade or parapet.
Section 2. No surface parking or parking facility may be
constructed or placed within 60 feet of the northernmost boundary
line of the Property.
Section 3. A IIscreening wall" eight (8) fee in height and
constructed of concrete or other acceptable masonary construction
shall be erected and maintained along the northernmost boundary line
of the Property and shall extend from the westernmost property line
of Lot 4, Block 45, Foster Village Addition to the City of North
Richland Hills to the easternmost property line of Lot 6, Block 45,
Foster Village Addition of North Richland Hills, Such IIscreening
wall II shall be erected prior to construction of any buildings or
structures within sixty (60) feet of the property lines of Lots 4,
5, and 6, Block 45, Foster Village Addition of North Richland Hills.
ARTICLE II
GENERAL PROVISIONS
Section l. The covenants, conditions, and restrictions of
this Declaration shall run with and bind the Property and shall be
effective for a term of twenty (20) years from the date this Declara-
tion is recorded, whereupon same shall terminate and be of no further
force and effect. These covenants, conditions, and restrictions shall
inure to the benefit of the Homeowners and the properties owned by
them as listed herein, who, together with their successors in title,
shall have the right to enforce all of said covenants, conditions, and
restrictions of this Declaration against the person or persons violat-
ing or attempting to violate same. Any failure to enforce any cove-
nant, conditions, or restriction herein contained shall in no event
be deemed a waiver of the right to do so thereafter.
Section 2. The covenants, conditions, and restric~ions of
this Declaration may be abolished, amended and/or changed in whole
or in part, by the then owner of the Property only upon obtaining
the consent or approval of the Homeowners as listed herein, or their
successors in title. The agreement, consent or approval of the City
of North Richland Hills, the City Zoning Commission or any other person
or entity (other than the Homeowners listed herein) to any such aboli-
tion, amendment or change of these covenants, conditions, and restric-
tions is specifically not required.
Section 3. Enforcement of these covenants, conditions, and
restrictions (and any amendments or supplements thereto) ,shall be by
any proceeding at law or in equity against any person or persons
violating or attempting to violate any covenant, condition, or restric-
tion either to restrain violation or to recover rlamages.
Section 4. Invalidation of anyone of the covenants, condi-
tions, or restrictions or any provision of this Declaration by judgment,
court order, or otherwise shall in no way effect any other provision
which shall remain in full force and effect.
