CALL TO ORDER
The meeting was called to order by Chairman Tom Duer at 7:00 p.m.

CONSIDERATION OF MINUTES FROM MAY 22, 2008 ZONING BOARD OF
ADJUSTMENT MEETING.
Jim F~emp, seconded byLesfie Jauregui, motioned to approve the minutes
from May 22, 2008. The motion carried unanimously (4-OJ. Jerry Henry
abstained.

A Public Hearing to Consider a Request from Bonnie and Clyde's Pools for
a variance to build ~ swimming pool beyond the 'building setback line at
7328 Oakland Lane.
Chairman Duer explained to the audience that the State Statute requires the
Zoning Board of Adjustment to have a super majority vote, seventy-five percent.
Mr. Duer stated that they are a five member voting `board therefore four
affirmative votes are needed to pass.
The Public Hearing was opened at 7:03 p.m. Chairman Duer swore the applicant
in. Dan Aleksandrovvicz vvith Bonnie and Clydes came forward representing Jack
Renshaw. He stated that the Renshaws are requesting a variance to construct a
swimming pool within the 15 ft street side setback dine.
Bill Gibbs asked why did they abandon the position of the pool in the back of the
house other than the Oncor easement?
Mr. Aleksandrowicz stated .there were on going :flooding issues due to drainage
and sewer backups in that area of the yard. If the pool were located closer to the
patio, it would require'a complete sewer re-route because the sewer comes out
under the patio.
Jerry Henry asked the applicant if it mattered whether the pool was on the side or
the back?
Evelyn Prescott, daughter of Jack Renshaw said she preferred the pool to be
located on the side due to afety issues with their grandchildren. The backyard
is already separated by a fence and this would allow a safer play environment for
them.
Chairman Duer asked for clarification if this was a non comer lot, then would they
be allowed to put the pool within the six feet building line?
Dave Pendley answered that is allowed for the decking to be in the six foot area.
Dave Pendley stated for the record there is a 4 ft. chain link fence on the south
side of the property separating the two properties.. if this pool is approved, the
chain link fence would 'have to be removed and replaced with a 6' fence to
comply with city code.
Mr. Aleksandrowicz stated -that before the final inspection of the pool, the 4'
stockade fence will be replaced with a 6' stockade along the property line to
include an old fence on the side street. This will enhance the look of the property
and the pool will be hidden.

Jerry Henry asked whose sewer line is backing up? Ms. Prescott stated it
belongr?d to the city. She stated the city had been out in May and they think it
could be a grease .blockage from up the street which caused the backup.
Chairman Duer asked if anyone wishing to speak in favor of or against
BA 20b8-02 to come forward There being none, the Public Hearing was closed
at 7:16 p.m.
Jerry Henry asked Dave Pendley about ordinance as it ,pertains to hardship for
practical difficulty.
After much discussion on the side building lines and location of the pool, Dave
Pendley explained what the ordinance allows for that pool location.
:APPROVED
Jerry Henry, seconded by Jim Kemp, motioned to grant BA 2008-02. The
motion carried unanimously (5-0).
Leslie Jauregui suggested that someone from the City .help the homeowner
contact the correct department to assist in taking care of the `sewer issues in their
yard. She also commented on the excellent work .City Staff does in order to
provide the :Committee with the background .and materials needed to make
competent decisions on behalf of the community.
It was also suggested that the overhead equipmenf be in place next time there is
a meeting to help in case .presentations.
ADJOURNMENT
There being no other'busness, the chairman adjourned the meeting at 7:25 p.m.
