HomeMy WebLinkAboutZBA 1993-08-19 MinutesMINUTES OF THE REGULAR MEETING OF THE BONING BOARD OF ADJUSTMENT OF THE CITY OF NORTH RICHLAND HILLS, TEXAS August i9, 1993 - 7:30 p.m. CALL TO ORDER The meeting was called to order by Chairman Tom Duer at 7:30 p.m. ROLL CALL PRESENT Chairman Tom Duer Members Robert Skinner Perry Christensen Jim Grant Bill Schopper Building Official Steve Pence PZ Coordinator Clayton Husband ABSENT Steve Ingham CONSIDERATION OF MINUTES OF JULY 15, 1993 Mr. Skinner made the motion to approve the minutes. The motion was seconded by Mr. Christensen, and the motion carried 4-0, with Mr. Grant abstaining due to absence at the previous meeting. Chairman Duer stated that the Board's rules are a tittle different than normal in that four affim~ative votes are required to approve a variance. 1. BA 93-17 Reconsideration of the request of Richard H6nko for a variance from the Zoning Ordinance No. 1874 on Lot 10, Block 2, Valley Park Estates, to vary from the minimum square footage requiremen# in the R-1 district. This propefty is located at 6509 Valley View Drive. Chairman Duer opened the Public Hearing and called for those wishing to speak in favor of the request to come forward at this time. Ms. Jill Lancaster, 7717 Brandi Phase, came forward to speak. She stated she is the purchaser of the bt. She stated the first request was denied. She stated the proposed size at that time was 1,861 square feet. Ms. Lancaster stated that the size has been increased to 1,917 square feet. She stated she has the plates with her far the Board to review. She stated the builder, Loy McDonald, is also here and can answer any questions. Chaimtian Auer stated the Board would have to keep the plans if she submits them for review. Mr. Husband stated they would not necessarily need to keep the building prints since they will be submitted when an application for a building permit is filed. He stated they woukd keep a copy of the prints at that time. There was general discussion regarding the floor plan and house layout. Board member Billy Cypert joined the Board at 7:46 p.m. He stated he would serve as the attemate member since the other members have already heard input in the case. Ms. Lancaster stated the house is entirely brick except for a small ZBA Minutes -Page 2 19 Augus# 1993 portion of the patio wail. Chairman Duer asked if a side or rear entry garage is required in the R-1 district now. Mr. Husband stated yes. Mr. Cypert asked if the 2,000 square foot minimum was livable area, or does it include garages arxt porches. Mr. Pence stated it is air-cond~ioned area. Chaim~an Duer asked what was the estimated range of house sizes in this neighbort~ood. Mr. Pence stated anywhere from 1,800 to 2,000 square feet. Chairman Doer asked if the major>~y was over or under 2,Q00 square feet. Mr. Pence stated probably under 2,000 square feet Ms. Lancaster stated the lot itsself does not meet the minimum square footage required in the R-1 zoning district. Mr. Husband staled the Ordinance allows a legal non-conforming lot to be used provided aN the required setbacks can be met. Chairman Duer asked if the minimum iot size in the R-1 district was 13,000 square feet. Mr. Husband stated yes. He stated that would be a minimum bt size if the person were subdividing the tend to create new Ihts. There being no one else wishing to speak in favor of the request, Chairman Duer called for those wishing to speak against the request to come forward at this time. Ms. Pam Cartwright, 8516 Val~y View Drive, carne forward to speak. She stated she has lived there for four years, and bui{t a house of 2,077 square feet. She stated when she came here she was agair~t the request, but she Mas seen the plans and do not have any problem with her house. Ms. Cartwright stated her concern was wdi the next person to request this in the area be granted the same thing. Chairman Duer stated they would have to come before the Board for each individual lot. He stated the Board can t~ the variance to a spec~ic floor plan. Mr. Christensen stated she would be notified of any future requests. Ms. Cartwright asked if the Board sets preaBdermts in approving cases like this. Chairman Duer stated each case is considered individuaNy on its own merits. He stated the Board does not set precedents. ZBA Mimes -Page 3 19 August 1993 Mr. Schopper stated they had already turned this request down once Mr. Skinner asked Ms. Cartwright to show him where her house was on the map. Mr. Joel Allen, 6508 Valley View Drive, came forward to speak. He stated he was concerned about the bwer square footages, but the house is fine ih his opinion. Chaim~an Duer asked Mr. Allen how large his house was. Mr. Alien staled right at 1,900 square feet. Mr. Skinner asked how long fie has lived there. Mr. Alien stated ten years. There being no one else wishing to speak, Chairman Duey cbsed the Public Hearing. Mr. Cypert stated his support for the request. He stated he offered a compromise at the previous hearing that was not accepted, He stated this house would be an exceHer~t addition to the area, Chairman Duer stated he has a hard time requiring that the house conform to R-1 regulations when the bt does not even c~nfcxm. He stated if they approve the request ~ will be tied to the fbor plan. Mr. Schopper made the motion to approve BA 93-17 subject to the updated foot plans showing the square footage at 1,917 square feet and the rtew garage configuration. The motion was seconded by Mr. Skinner, and the motion carried 5-0. CITIZEN COMMENTS None.
