ADDITION, KNOWN AS 5212 COLORADO BLVD.
Garry Cope: Do we have anyone who wants to speak for this case? ff so let it be known now. Let the presentation
begin.
Andy Barbara: My name is Andy Barbara Code Enforcement Officer for the City of North Richland Hills. Here to
present case SBB 2005-01. This property is zoned R-1 Single family. In your packet you will find an aerial
indic~ung the location of the property. The owners of the propertty for our tax records are Ronald T. and Lisa R
Wirm. The deed from Tarrant County indicted the owner to be Ronald T. and Lisa R Winn. The Vacate or
Demolish letter dated December 7, 2004 was mailed certified and at this time we have no return receipt. Owner of
record was notified by certified mail of this hearing February 10, 2005 and we have no return of receipt as of this
date. At this time we also have no permits on file. The photos I am about to present to you are true and accurate and
taken by me. Brief history on November 5, 2004 an inspection of the exterior and interior of the struchrre was done.
December 7, 2004 notice of Order was sent to the homeowners, mortgage oomparry and insurance compa~.
February 10, 2005 a notice of hearing was sent to the homeowners, mortgage company and insurance company.
February 15, 2005 a warrant to search the property was obtained by me and pictures were taken and the properly
shows no changes.

John Larriviere: I have a question You mentioned information sent to the mortgage company. You get no response
from them?

John Larriviere: Is there a mortgage in fact left on the house?
Andy Barbara: That I do not know
John Larriviere: Because it seems like if they had some pictures of the outstanding mortgage someone is not making
payments or something.
Andy Barbara: Correct

Andy Barbara: Yes the fire occurred June 13, 2004
John Larriviere: Was it occupied at the time of the fire?
Andy Barbara: Yes
Andy Barbara: Photo 2 also taken November 5, 2004 is the exterior of the residence. Ineffective waterproofing on
the exterior walls, roof, foundation and floors including brolaen windows and doors throughout the strucbu~e. Photo 3
also taken November 5, 2004 is the main hallway ceiling and roof support damage, exposed ducts and electrical
wiring. The electrical wire that is not being used in a safe manner. Living area number 1. Ceiling and roof support
damage due to fire ineffective constructional scores. Photo munber 5 also taken November 5, 2004. This is the main
living area of the stnrcture walls, ceilings and roof supports are damaged. Supports cannot carry imposed loads
safely. Photo member 6 also taken November S, 2004. Main living area and hallway: `
John Larriveire :Andy, we never got arty response back from anybody? The homeowner, the insurance oompatry or
the mortgage company?
Dave Pendley. Andy you might wad to relay what's going on with the property.
Andy Barbara: Before the fire there were a few open cases on that property such as high grass and unpleasant
premises. These violations were abated and in compliance with City Ordinance. After the fire I did get one call from
Lisa R Winn saying that they were going to pick up what they could salvage finm the fire. After that I haven't heard
anything from the insurance compatry or mortgage company. On November 5 we did get verbal notification from
the insurance company that Dave Pendley and myself could enter the strucdn~e and take pictures after that we
haven't heard anything in writing or phone call.
John Larriviere: So we don't know if mortgage is still out on it.
Andy Barbara: No we don't
John Larxiviere: Assuming insurance callcd and let you know you can go on the property do you think it is still
insured? Here's what I am thinking...insurance paid out and everybody's gone. Nobody cares.
Andy Barbara: On January 18, I obtained information from the fire marshal this is an arsine case. The gentleman is
out on bond and they are awaiting trial.
John Lamiviere: The gentleman is a resident of the house?
Andy Barbara: Yes, Ronald T. Winn
John I.arriviere: Oh Ok
Andy Barbara: I know the fire Marshall wanted to bring charges also against his wife. I don't know if that has
happened. When we sent all these notifications out to these homeowners we sem them not just to 5212 Colorado
Blvd. but also the known address we have for them here in the City Of North Richland Hills which is 8517
Crestwood Drive. But since then they have left Crestwood drive and we don't know where they are.
John Larriviere: So it's still up in the air who owns the property and if the insurance compatry is going to pay or not
because it is an arsine situation?
Andy Barbara: That I do not know.
John I.arriviere: Can we legally go ahead and take care of business and not have any responsibility if the City comes
back?
Jo Ann Stout: I talked to our City Attorney about this and he said yes that this is a substandard case that we as a City
have the right to view as a substandard building.
John I.arrieviere: Ahight. I have heard and seen enough...I think we need to do what we need to do.
Garry Cope: In all fairness let him complete this.
Jo Ann Stout: We need to have this in the record so he does need to complete it,

2005. Bedroom #1 smoke damage to walls and ceiling. Photo 16-Bedroom #2 smoke and ceiling damage. Now the
pictures I am about to show you were taken on February 15, 2005. No conshuction or clean up started since original
pictures were taken on 11-5-04. The pictures include the backyard porch area and the fence on the property which
was also damaged in the fire. All nuisances on the property should be abated Photo 15 taken February 15, 2005.

Garry Cope: That concludes the City's presentation. I ask one more time are there arty citizens who want to speak on
this case? Once again no responses. I open it up to discussion of the board.
John Laniviere: Looks like we are in the no man's land. Nobody's claiming it. I don't know what kind of position
the mortgage or insurance company has on this but it seems like if they had any interest they would have said
something. So I don't see where we have anywhere to go except clean up the property for the neighbors.
Garry Cope: tiny other comments? Or there any motions fiom the board?
John Lamiviere: I make a motion that we proceed with cleanup or abatement. Bring it up to standard code.

Cheryl Iammonds: I have a question? Are you giving the City the go ahead to demolish and place a lien on this

John Larriviere: No I think demolish and place a lien would be the proper motion.

John Larriviere: I want to amend my motion. I'd like to motion that City members be able to take proper action to
demolish the property at 5212 Colorado Blvd. North Richland Hills, given fair warning concerning 30 day notice.

This brings us to our second case of the day. It is case 2005 21ot 6 of Thomas Peck Subdivisioq known as 8417
Franklin Ct Before the City makes its presentation I ask if there are any citizens here who have comments placed
before this board? You may begin.
Debbie Heizer: I am a Cede Enforcement Officer for the Neighborhood Services Department. I am here to present
case number 2005-02. The property is located at 8417 Franklin Ct. The property is zoned agriculture and currently
vacant In your packet you will find an ariel indicting the location of the property. The owner of the properly for
our tax records are Walter Coker and the deed for Tarrant County indicating the owner to be Walter Coker. A
Vacate Repair or Demolish letter dated January 21, 2005 was marled certified and as of today we have no return
receipt. The owner of record. was notificd by certified mail of this hearing on February 9, 2005 and we have no
return receipt. At this time a demo permit is on file and it was obtained February 4, 2005. The photos I am about to
present to you are trne and accurate taken by myself. A brief history of tbe property. Inspection request was sem to
the owner on December 13, 2004. Permission to enter was granted by the tenant who is also the daughter of the
property owner. Her name is Linda Coker, on January 6, 2005. Notice to demolish st~ucdue was sent on January 21,
2005. The properly owner called on February 3, 2005 to inquire about demolishing stnticture; he obtained his permit
on February 4, 2005. Notice of the hearing was issued on Febn~ary 9, 2005 and published on February 11, 2005. As
of Febrnary 14, 2005 demolition has begun by the owner. This is the front view of the a~ home. Roof has
missing sections and various missingand/or broken windows. That was photo 1 taken January 6, 2005. Photo two
taken January 6, 2005 is another example of ineffective waterpmofing/deteriorated soffit. Photo 3 also taken January
6, 20(?5 shows of roof constantly leaking. Photo 4 taken January 6, 2005 shows another example of ineffective
waterproofing. Photo 5 taken January 6, 2005 shows another example of faulty weather protection. Photo 6 taken
January 6, 2005 is another example of faulty weather proofing. Photo 7 taken January 6, 2005 shows the
disconnected meter box, hazardous electrical wiring; electrical is not maintained in a good condition. It is currently
disoonnec:ted from the pole and there are various exposed wires throughout the building. Photo 8 taken January 6,
2005 is another example of the hazardous wiring. Photo 9 was taken out after these packets were seirt. So I
apologize. Photo 10 was taken January 6, 2005 and show some inadequate heating facilities. Photo 11 taken January
6, 2005 is another example of inadequate heating facility. Photo 12 taken January 6, 2005 shows lack of, or
improper water closets, lavatories and bathtubs or showers. Photo 13 taken January 6, 2005 shows evidence of rat
harborage. Photo 14 also taken January 6, 2005 it is an example of the hazardous and unsanitary conditions of the
property's exterior. Photo 15 shows a dilapidated shed. Photo 16 shows junk and debris behind the shed inchuling
the inoperable vehicle. Photo 17 shows trash and junk thrown back there. Photo 18 is another inoperable vehicle.
This is what Tiffany handed to you guys. They have started to demolish it This is what is left.
John IJatriviere: So they started demolishing themselves?
Debbie Heuer: Yes Sir they have.
Jo Ann Stout: What we would like is for you to authorize us, give us the order in case they cease. So the City can
step in and take over with out starting the procxss all over.
John I.arriviere: When was the last action taken?
Debbie Heizer: Their second dumpster was removed yesterday.
Cheryl Hammonds: So they going slowly?
Debbie Heizer: Yes
Jo Ann Stout: There pretty much indigent. The owner is in very poor health and is living with his brother across the
stc+eet. They have a friend who is actually gutting and demolishing the manufactured home.
Cheryl Hammonds: Ok is its staffs feeling that we should give them 30 days? Or are they going to slow for staff s
what's the word I am looking for? Do we want to motivate them faster?
Debbie Heizer: They are going to do it as they can. They don't have a lot of help. They have completed their 2°a
dumpster two weekends in a roll. They are feeling them up as they get them. lZather they are going to continue that,
they told me they have another dnmpster Doming Friday. Being that they have followed through the past iwo
weekends I am c:oufident that they will follow through this weekend. After that I am not sure how they wiU. do. I
don't know what means they have to take care of this.
Phillip Om. Is the lot owned by the people who have the manufactured home there?
Debbie Heizer: Yes sir. It's owned by them. The brother lives across the street.
John Larriviere: Is the lot fi~ee and clear?
Debbie Belzer: From what I tmderstand yes.
Garry Cope: Now that the City is finished, I ask once more if there are any citizens who want to speak before this
board on this case? I open it for discussion to the board members. Airy discus,~ion or questions to ask?
Phillip Orr. If the City would go in and demolish this would their lien be the primary lien on the property. You said
there were already two liens on the property already.
Debbie Heizer; Tad shows that property to be valued at I;5700 dollars.
John Larriviere: On those two dumpsters I am curious as to how many more weekends would it take for that
property to be gone?
Jo Ann Stout: I would say that they would need at least 3-4 more dumpsters.
John Larriviere: 4 more weekends?
Garry Cope: At least these people are trying. We usually do not get this much corporation. I'd like to through out a
time for us to consider like about 60 days. I'd like to the City Staff members to let us know if that is enough time
also and for the board members. We have got to start somewhere. I'd like to give them more then 30 days. If we can
live with that and we can see it all gone in a couple of more months.

Cheryl Hammonds: I'll make the motion. I'd like to make a motion based on the evidence presented to us, today
February 22, 2005 for Sbb 2005-02, located at 8417 Franklin Ct. That we give the owners 60 days from today's date
to have the land or the property cleaned to grade and if the owner should fail to do this that the City have permission
to demolish this structure and access any liens that need to be on that property.

This brings us to our second case of the day. It is case 2005-21ot 6 of Thomas Peck Subdivision, lmown as 8417
Franklin Ct. Before the City makes its presentation I ask if there are any citizens here who have comments placed
before this board? You may begin.
Debbie Heizer: I am a Code Enforcement Officer for the Neighborhood Services Department. I am here to present
case number 2005-02. The property is located at 8417 Franklin Ct. The property is zoned agriculture and currently
vacant. ]n your packet you will find an ariel indicating the location of the property. The owner of the property for
our tax records are Walter Coker and the deed for Tarrant County indicating the owner to be Walter Coker. A
Vacate Repair or Demolish letter dated January 21, 2005 was mailed certified and as of today we have no retum
receipt. The owner of record was notified by certified mail of this hearing on February 9, 2005 and we have no
return receipt. At this time a demo permit is on file and it was obtained February 4, 2005. The photos I am about to
present to you are true and accurate taken by myself. A brief history of the property. Inspection request was sent to
the owner on December 13, 2004. Permission to enter was granted by the tenant who is also the daughter of the
property owner. Her name is Linda Coker, on January 6, 2005. Notice to demolish structure was sent on January 21,
2005. The property owner called on February 3, 2005 to inquire about demolishing structure; he obtained his permit
on February 4, 2005. Notice of the hearing was issued on February 9, 2005 and published on February 11, 2005. As
of February 14, 2005 demolition has begun by the owner. This is the front view of the manufactured home. Roof has
missing sections and various missing and/or broken windows. That was photo 1 taken January 6, 2005. Photo two
taken January 6, 2005 is another example of ineffective waterproofing/deteriorated soffit. Photo 3 also taken January
6, 2005 shows of roof constantly leaking. Photo 4 taken January 6, 2005 shows another example of ineffective
waterproofmg. Photo 5 taken January 6, 2005 shows another example of faulty weather protection. Photo 6 taken
January 6, 2005 is another example of faulty weather proofing. Photo 7 taken January 6, 2005 shows the
disconnected meter box, hazardous electrical wiring; electrical is not maintained in a good condition. It is currently
disconnected from the pole and there are various exposed wires throughout the building. Photo 8 taken January 6,
2005 is another example of the hazazdous wiring. Photo 9 was taken out after these packets were sent. So I
apologize. Photo 10 was taken January 6, 2005 and show some inadequate heating facilities. Photo 11 taken January
6, 2005 is another example of inadequate heating facility. Photo 12 taken January 6, 2005 shows lack of, or
improper water closets, lavatories and bathtubs or showers. Photo 13 taken January 6, 2005 shows evidence of rat
harborage. Photo 14 also taken January 6, 2005 it is an example of the hazardous and unsanitary conditions of the
property's exterior. Photo 15 shows a dilapidated shed. Photo 16 shows junk and debris behind the shed including
the inoperable vehicle. Photo 17 shows trash and junk thrown back there. Photo 18 is another inoperable vehicle.
This is what Tiffany handed to you guys. They have started to demolish it. This is what is left.
John Larriviere: So they started demolishing themselves?
Debbie Heizer: Yes Sir they have.
Jo Ann Stout: What we would like is for you to authorize us, give us the order in case they cease. So the City can
step in and take over with out starting the process all over.
John Larriviere: When was the last action taken?
Debbie Heizer: Their second dumpster was removed yesterday.
Cheryl Hammonds: So they going slowly?
Debbie Heizer: Yes
Jo Ann Stout: There pretty much indigent. The owner is in very poor health and is living with his brother across the
street. They have a friend who is actually gutting and demolishing the manufactured home.
Cheryl Hammonds: Ok is its staffs feeling that we should give them 30 days? Or are they going to slow for staff s
what's the word I am looking for? Do we want to motivate them faster?
Debbie Heizer: They aze going to do it as they can. They don't have a lot of help. They have completed their 2°d
dumpster two weekends in a roll. They are filling them up as they get them. Rather they aze going to continue that,
they told me they have another dumpster coming Friday. Being that they have followed through the past two
weekends I am confident that they will follow through this weekend. After that I am not sure how they will do. I
don't know what means they have to take care of this.
Phillip Orr: Is the lot owned by the people who have the manufactured home there?
Debbie Heizer: Yes sir. It's owned by them. The brother lives across the street.
John Larriviere: Is the lot free and clear?
Debbie Heizer: From what I understand yes.
Garry Cope: Now that the City is finished, I ask once more if there are any citizens who want to speak before this
board on this case? I open it for discussion to the boazd members. Any discussion or questions to ask?
Phillip Orr: If the City would go in and demolish this would their lien be the primary lien on the property. You said
there were akeady two liens on the property already.
Debbie Heizer: Tad shows that property to be valued at $5700 dollars.
John Larriviere: On those two dumpsters I am curious as to how many more weekends would it take for that
property to be gone?
Jo Ann Stout: I would say that they would need at least 3-4 more dumpsters.
John Larriviere: 4 more weekends?
Garry Cope: At least these people aze trying. We usually do not get this much corporation. I'd like to throw out a
time for us to consider like about 60 days. I'd like for the City Staff members to let us know if that is enough time
also and for the boazd members. We have got to start somewhere. I'd like to give them more then 30 days. If we can
live with that and we can see it all gone in a couple of more months.

Februazy 22, 2005 for Sbb 2005-02, located at 8417 Franklin Ct. That we give the owners 60 days from today's date
to have the land or the property cleaned to grade and if the owner should fail to do this that the City have permission
to demolish this structure and access any liens that need to be on that property.
