CALL TO ORDER The meeting was called to order by Randy Shiflet at 7:00 p.m. 2. PLEDGE OF ALLEGIANCE Steven Cooper led the pledge of allegiance. 4. Approval of Minutes from the August 6, 2009 Planning & Zoning Commission Meeting. Public Hearing and Consideration ofa Request from River for a Replat of Lots 14-22, Block 4 and Lots 12-14, Block 5, R chlaestments LLC Addition into Lot 3R, Block 1, Rivercrown Addition (located in the nd Terrace Nancy Lane & Susan Lee Lane - 2.928 acres.) 4800 Blocks of Chairman Shiflet opened the Public Hearing and asked the applicant to Ernest Hedgecoth, 5701 C Midway Road, Haltom come forward. City, representing Rivercrown Investments and Huggins Honda in this replat request. He stated abo this case was brought in for a rezoning request m order to get theseur a. month ago under Heavy Commercial zoning. Once the replat is a esidential lots in about a month to rezone the planned development otr nvordeh to bull de coming back expansion. the proposed Eric Wilhite said the dealership has purchased these lots which were rec from residential to commercial. It will take the 12 ently rezoned combine them into one lot. There is a previously residential lots and abandonment enclosin pproximately 17,160 sq ft. of right of way g portions of Susan Lee Lane where the applicant will be purchasing from the City. The purchase price of $17,877.62 has been a reed appraisal and the City. Once it is purchased it will be transferred to the ap Ic ant b n by claim deed. The plat meets all the subdivision rules and regulations y quit recommends approval. and Staff Steven Cooper asked for clarification for the record whether it is 12 or 13 lots. Eric Wilhite said it was stated 13 on the staff report, but the correct number is 1 2. Don Bowen asked for clarification if the lots to the east on Nanc Lane residential. Y were all Eric Wilhite said yes, they are residentially occupied and most of them properties. The Comprehensive Land Use Plan shows them to go Heavy Commerntal as were the ones that Mr. Huggins purchased. He opened the Pubic Hearing and asked the applicant to come forward. Ernest Hedgecoth, 5701 C Midway Road, Haltom City, TX came forward representing Galen and Jane Dinkel on the zoning and replat requests. He said it is a vacant lot where they want to build their residence including adding the water and sewer across Rumfield. He mentioned that the non-compliant fence will be removed after the construction is completed and replaced with whatever meets the code. Don Bowen asked if this was the property that had the old barn and stock pond on it at one time? Ernest Hedgecoth said yes, there was still a barn on it, but no pond. Eric Wilhite said the zoning change request is from AG to R-1-S and is 1.93 acres. This is nearly an acre larger than the minimum requirement for R-1-S zoning. Mr. Wilhite stated the Comprehensive Land Use Plan does identify this area for low density residential. There have been other cases across Rumfield Road that have come before P & Z and City Council to build their primary residences there. Staff has reviewed the Zoning Change and recommends approval. Mr. Wilhite stated that the Zoning Change and the Final Plat meet all the subdivision rules and regulations and Staff recommends approval. Chairman Shiflet asked if there was anyone wishing to speak for or against in the Public Hearing. Seeing none he closed the Public Hearing and entertained a motion. Bill Schopper seconded by Mike Benton motioned to approve ZC 2009-07. The motion was carried unanimously (6-0). 8. FP 2009-02 Consideration of a Request from Galen and Jane Dinkel to Approve a Final Plat of Lot 2, Block 1, James Addition (located at 8936 Rumfield Road -1.930 acres.) Steven Cooper, seconded by Bill Schopper motioned to approve FP 2009-02. The motion was carried unanimously (6-0). 9. ZC 2009-06 Public Hearing and Consideration of a Request from David Thorne for a Zoning Change from AG Agricultural to R-1-S Special Single Family on Tract 7B, Abstract 1055 (located at 6525 Crane Road - 2.437 acres.) Page 3 of 4 09-17-09 P & Z Minutes Chairman Shiflet opened the Public Hearing and stated that there was a letter submitted requesting that the case be opened and continued until the next meeting. Ernest Hedgecoth came forward stating that they are working with the Public Works Department on the drainage for the preliminary and final plat and wish to run the cases at the same time. Dianna Madar motioned to continue ZC 2009-06 until the next meeting. Don Bowen seconded the motion and it was carried unanimously (6-0). 10. TR 2009-05 Consideration of Amending Chapter 102: "Floods and Stormwater Management" of the North Richland Hills Code of Ordinances by adding a new article, Article V: "Erosion and Sediment Control". Greg VanNeiuwenhuize came forward stated that this ordinance was necessary with the adoption of the Clean Water Act. The State of Texas was able to successfully negotiate with the EPA which administers the national program. The State of Texas could enforce their regulations in the state without having federal authority. It was successfully transferred from the federal government to the state in 1998. The state is so large there was no possible way to have state wide adoption of all the regulations. The Texas Commission on Environmental Quality allowed cities to adopt a five year program allowing us to slowly adopt, then at year five be in complete compliance with the pollution elimination system. One of the items the City of North Richland Hills has to adopt is an ordinance that would regulate erosion and sediment control. The ordinance will include the following: properties that are going to disturb 500 square foot of ground or more, complying with TECQ regulations, developers to initially get a site development permit along with erosion control plan, inspection requirements and enforcement vision. Bill Schopper, seconded by Steven Cooper, motioned to approve TR 2009-05 as proposed. The motion carried unanimously (6-0). 11.
