CALL TO ORDER
On the 24th day of August, 2009 at 6:40 p.m. the North Richland Hills Crime Control
and Prevention District convened in the City Council Chambers at the North Richland Hills City

the August 26, 2008 meeting.

CCD 2009-01 PUBLIC HEARING ON CRIME CONTROL & PREVENTION
DISTRICT PROPOSED 2009-2010 BUDGET AND AUTHORIZE ADOPTION

President Trevino opened the Public Hearing on the proposed 2009-10 budget for the Crime
Control & Prevention District.
Finance Director Larry Koonce presented a PowerPoint presentation giving an overview of the
2009-2010 Crime Control & Prevention District Budget. The proposed budget for 2009-2010 is
$4,450,764 and the revised budget for 2008-2009 is $4,504,445. Mr. Koonce reviewed the
District's financial history, programs and accomplishments since inception. The proposed
budget includes the continuation of Alliance for Children and the Special Investigations Unit.
Revenues for 2009-10 include $200,000 from the General Fund in the 2009 revised budget
and in 2010 an approximate $190,000 increase from additional electric & gas sales taxes as a
result of legislation changes in 2009. Expenditures of $4.45 million include CCD personnel
costs, and direct costs to the General Fund, and supplies, maintenance and sundry. All goals
and objectives as set out in the original CCD proposal and renewal referendum have been met
and are being maintained.
President Trevino called for public comments on the proposed budget. There being no one
wishing to speak, President Trevino closed the Public Hearing.
Board Member Welch moved, seconded by Board Member Whitson, to approve CCD 2009-01,
approving the revised 2008-2009 budget and the proposed 2009-2010 budget and authorize
adoption by Council.

CCD 2009-02 PUBLIC HEARING ON IMPOSITION OF CRIME
CONTROL & PREVENTION DISTRICT SALES TAX ON
RESIDENTIAL GAS AND ELECTRIC USE -
RESOLUTION NO.2009-A.

President Trevino opened the public hearing on the imposition of the sales tax on residential
gas and electricity.
Ms. Karen Bostic, Assistant City Manager, presented the item. Senate Bill passed during the
2009 Texas Legislative Session allows for the imposition of crime control district sales tax on
the residential use of gas and electricity. The sales tax was discussed by the Council at their
August 7 budget work session and Council consensus was to move forward with approval of
the tax. To impose the tax, a public hearing is required by the Crime Control & Prevention
District Board of Directors along with some other procedures to be followed.
President Trevino called for public comments on the imposition of the sales tax on residential
gas and electricity.
There was no one present wishing to comment.
Board Member Turnage moved, seconded by Board Member Sapp, to approve Resolution No.
2009-A.
Motion prevailed by the following vote:

Senate Bill 575 was passed during the 2009 Texas Legislative Session. This bill allows for
the imposition of fire control or crime control district sales tax on the residential use of gas
and electricity. Until this law passed, the Crime Control District sales tax could not be
applied on residential gas and electricity usage like the General Fund and Park and
Recreation Facilities Development Corporation.
This item was previously discussed with the Crime Control & Prevention District Board of
Directors on August 24, 2009. The belief was that the public hearing could be held at that
time with an effective date of January 1, 2010. However, based on information received
from the Texas Comptroller, all actions necessary to implement this sales tax must occur
after January 1, 2010, the effective date of the bill. The earliest date that a tax adopted in
the first calendar quarter of 2010 will become effective is July 1, 2010.
In order to implement this sales tax the Crime Control & Prevention District Board of
Directors is required to:
• Hold a public hearing;
• Adopt a resolution, by majority vote, approving the imposition of this sales tax;
• Send a copy of the resolution to the comptroller by certified or registered mail;
• Send a copy of the resolution and a copy of the district's boundaries by certified or
registered mail to each gas and electric company whose customers are subject to the
tax;
• Publish notice of the resolution in a newspaper of general circulation in the district.
It is estimated this sales tax could generate over $200,000 per year for the Crime Control
and Prevention District.
Recommendation:
Open the public hearing, receive comments on the Crime Control District sales tax on
residential gas and electricity, approve Resolution No. 2010-A and close the public
hearing.

RESOLUTION NO. 2010-A
NORTH RICHLAND HILLS CRIME CONTROL
AND PREVENTION DISTRICT
WHEREAS, on the 11t" day of January, 2010, the Board of Directors of the North
Richland Hills Crime Control and Prevention District met and a public
hearing was held pursuant to a Notice and Agenda and,
WHEREAS, a quorum of the members was being present, and
WHEREAS, a Motion was duly made, seconded and passed.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF
THE NORTH RICHLAND HILLS CRIME CONTROL AND PREVENTION
DISTRICT that:
Section 1. That pursuant to the authority granted by 81St Legislature in the
enactment of Section 321.1055, Texas Tax Code, a sales tax of '/~
cent is hereby imposed on receipts from the sale, production,
distribution, lease, or rental of, and the use, storage, or other
consumption within the district of, gas and electricity for residential
use.
