APPROVAL OF MINUTES OF AUGUST 24, 2009 MEETING APPROVED Board Member Turnage moved, seconded by Board Member Sapp, to approve the minutes of the August 24, 2009 meeting. Motion prevailed by the following vote: Aye: 8 votes No: 0 votes 3. CCD 2010-01 PUBLIC HEARING ON IMPOSITION OF CRIME CONTROL & PREVENTION DISTRICT SALES TAX ON RESIDENTIAL GAS AND ELECTRIC USE - RESOLUTION NO. 2010-A APPROVED President Trevino opened the public hearing on the imposition of the sales tax on residential gas and electricity. Ms. Karen Bostic, Assistant City Manager, presented the item. This item was previously discussed with the Crime District Board of Directors at the August 7 Budget Work Session and a public hearing was held on August 24, 2009. At that time the belief was that the public hearing could be held with an effective date of January 1, 2010. Since August the State Comptroller sent out information advising that all actions necessary to implement the sales tax must occur after January 1, 2010. To impose the tax, the Crime Control & Prevention District Board of Directors is required to hold a public hearing, adopt a resolution approving the imposition of the tax, send a copy of the resolution to the Comptroller, send a copy of the resolution and the district's boundaries to each gas and electric company located within the CCD and to publish notice of the resolution. The resolution will become effective on July 1. The Board was advised that if someone has an electric consumption that equates to a $150 electric bill, the additional sales tax will only equate to about 75 cents. President Trevino called for public comments on the imposition of the sales tax on residential gas and electricity. There was no one present wishing to comment. Board Member Sapp commented on an article in the Star Telegram and that he felt it was important to clarify that that the financial impact on an individual basis is relatively small, but the assistance of the CCD to the support of the Police Department makes it a worthwhile venture. Board Member Lombard moved, seconded by Board Member Sapp, to approve Resolution No. 2010-A. President Trevino advised that he had received two emails from citizens who were opposed to any additional taxes and that a response would be sent to the citizens. ADJOURNMENT There being no further business, President Trevino adjourned the meeting of the Crime Control and Prevention District at 5:37 p.m. APPROVED: Oscar Trevino -President ATTEST: Patricia Hutson -Secretary North Richland Hills Crime Control and Prevention District January 11, 2010 Minutes Page 3 of 3 CRIME CONTROL & PREVENTION UISIKIG- Department: Creme Control District Council Meeting Date: 02/08/2010 subject: Ordering Referendum Election for Continuation of Agenda Number: CCD 2010-02 Crime Control & Prevention District -Resolution No. 2010-B The North Richland Hills Crime Control and Prevention District referendum was passed in February of 1996 fora 5-year period and it was renewed in 2001 fora 10-year period. State law now allows voters to extend the Crime Control & Prevention District for up to 20 years. Since its inception in 1996, the Crime Control & Prevention District has generated approximately $51 million through the half-cent sales tax to fund law enforcement services and programs. This has allowed the Police Department to: • Hire 27 additional police officers, 2 detectives, 18 support personnel and 1 school crossing guard; • Instruct the D.A.R.E. Program at all NRH elementary schools; • Provide school resources ofFcers for the middle schools and high schools; • Continue the Neighborhood Watch and other crime prevention programs; • Establish new crime prevention programs including the Crime Free Multi Housing program, the "Lock, Take and Hide" program, and others; • Purchase 30 vehicles and refurbish 12 vehicles; • Upgrade emergency radio and computer systems; • Maintain competitive salaries for North Richland Hills police officers. Since the Crime Control & Prevention District was created, calls for service have increased from 97,038 to 123,877 per year while response times to Priority 1 emergency calls have decreased from an average of 9 minutes and 42 seconds to 5 minutes and 18 seconds; in addition, there has been an increase in the percentage of crimes cleared each year. The continuation of the Crime Control & Prevention District will allow the Police Department to continue with the progress that has been made and help to provide adequate funding. This will assist the City in continuing to provide the same level of law enforcement service without raising other fees and taxes. The Crime District will dissolve on July 1, 2011 unless it is reauthorized by the voters. The proposed resolution orders a referendum election for the voters to vote on the reauthorization of the CCD District and the CCD sales tax for 20 years. The City will be entering into a contract with the Tarrant County Elections Administrator to administer the joint election. North Richland Hills voters will be able to vote early at the Tarrant County Elections Center located at 2700 Premier, Fort Worth, at the North Richland Hills Recreation Center, 6720 Northeast Loop 820 and other additional branch early voting locations throughout Tarrant County. The County will be providing a final listing of all available branch locations at a later date. With the passage of SB 1970 during the last legislative session, the election order and notice must state the location of each early voting location. After Tarrant County has finalized all early voting locations, the Crime District Board will need to approve an amended resolution that lists the locations of each early voting location throughout the County. Recommendation: To approve Resolution No. 2010-B ordering a referendum election for May 8, 2010. Page 2 of 2 RESOLUTION N0.2010-B WHEREAS, the North Richland Hills Crime Control and Prevention District ordered the submission to the voters of the city a referendum on extending the Crime Control and Prevention District and the Crime Control and Prevention District sales tax for an additional ten years, which election was held May 5, 2001, and such measure was duly approved by a majority of the persons voting at such election; and, WHEREAS, the North Richland Hills Crime Control and Prevention District will expire unless reauthorized by the voters of the city; and, WHEREAS, the regular city election will occur on May 8, 2010 and the holding of the Crime Control and Prevention District reauthorization election simultaneously with the city election will reduce the cost to taxpayers of such election; NOW THEREFORE, BE IT RESOLVED BY THE BOARD OF DIRECTORS OF THE NORTH RICHLAND HILLS CRIME CONTROL AND PREVENTION DISTRICT: Section 1: A referendum is hereby ordered to be held wherein the eligible voters residing within the North Richland Hills Crime Control and Prevention District shall be permitted to vote for or against the proposition: Whether the North Richland Hills Crime Control and Prevention District should be continued for twenty years and the Crime Control and Prevention District sales tax of one half cent should be continued for twenty years. Section 2: Such election shall be held jointly with the joint election of the mayor and city council members and the election of other political subdivisions and shall take place on the 8th day of May, 2010, from 7:00 a.m. until 7:00 p.m. Section 3: The location of polling places for this joint election are located in North Richland Hills, Tarrant County Texas and are designated as follows: Resolution No. 2010-B Page 1 of 3 PRECINCT VOTING LOCATION Precinct One (includes County voting precincts City Hall, 7301 Northeast Loop 820 3214, 3324, 3333, 3041, 3364, 3366 & 3416) Precinct Two (includes County voting precincts Dan Echols Senior Adult Center 3032, 3140, 3215, 3289, 3325, 3326, 3399, 6801 Glenview Drive 3424, 3631, 3633, 3634, 4620 & 4629) Precinct Three (includes County voting Bursey Road Senior Adult Center precincts 3063, 3049, 3177, 3209, 3365, 3367, 7301 Bursey Road 3387,3507, 3527, 3543, 3580 & 3584) Section 4: All election officials, including the Early Voting Clerk shall be the officials appointed to such positions by Tarrant County and to the extent required by law, are hereby so appointed. The address of the Early Voting Clerk is: Steve Raborn, Early Voting Clerk, 2700 Premier Street, P.O. Box 961011, Fort Worth, Texas 76161-0011. Section 5: Early voting will be held jointly with other Tarrant County public entities at North Richland Hills Recreation Center, 6720 Northeast Loop 820, North Richland Hills, Texas, Tarrant County Elections Center, 2700 Premier Street, Fort Worth, Texas, and at the other locations established by Tarrant County beginning on April 26, 2010 and will continue through May 4, 2010 at the times as follows: April 26-30 Monday -Friday 8:00 a.m. - 5:00 p.m. May 1 Saturday 7:00 a.m. - 7:00 p.m. May 2 Sunday 11:00 a.m. - 4:00 p.m. May 3-4 Monday -Tuesday 7:00 a.m. - 7:00 p.m. Section 6: All resident qualified electors of the District shall be permitted to vote at said election and, on the day of the election, such electors shall vote at the polling place designated for the Election Precinct in which they reside. Section 7: The election shall be conducted pursuant to the election laws of the State of Texas. Ballots shall be canvassed by the Board of Directors on May 17, 2010 at such time as a meeting shall be posted. Section 8: The Tarrant County Elections Administrator is hereby appointed to serve as the Early Voting Clerk and the Elections Administrator's permanent county employees are appointed as deputy early voting clerks.
