During the Work Session staff will show an example of the new e-newsletter and will demonstrate how to subscribe to it. General Description The new e-newsletter will be distributed twice each month. It will include highlights from City Council Meetings, reminders about upcoming events, information on City awards and accomplishments, and other news from City Departments. Residents can sign up for the e-newsletter by clicking on the "Subscribe" button on the City's web page. Those residents who have already subscribed to "City Highlights" on the web site will automatically be signed up for the new e-newsletter. The e-newsletter will be created and distributed using the Constant Contact service that is already used by the Parks & Recreation Department. The Communications Department will share the Constant Contact account with the Parks & Recreation Department, which means there will be no additional cost to the City for this e- newsletter. We believe the e-newsletter will enhance our current communication efforts and provide residents with another way to stay informed about their local government. It will not replace our printed publications; we will continue to print and mail to residents our NRH Newsletter and the monthly NRH News & Notes (water bill inserts). Respectfully submitted, Mary Peters Public Information Officer ISSUED BY THE CITY MANAGER NORTH RICHLAND HILLS, TEXAS ~ INFORMAL REPORT TO MAYOR AND CITY COUNCIL No. IR 2010-043 Date: June 14, 2010 ` ~ Subject: New Recreation Center Design Development Update Summary: Brinkley Sargent Architects will provide an update on design development of the Recreation Center including proposed building finishes. The construction documents are being prepared in anticipation of releasing the sub-contractors bid package at the end of August. The project is proceeding on schedule with construction expected to begin in October. Staff will also review with Council the amendment to the professional services agreement with Brinkley Sargent for additional services related to the senior center, LEED Certification, Bud Jensen Street improvements and site work associated with the ten acre site. General Description: The project architect, Brinkley Sargent Architects, has completed a design development package based on the schematic design that Council reviewed at their February 22, 2010 meeting. The design development package includes: • 50% complete construction plans • 50% complete construction specifications • Exterior renderings showing proposed building finishes • Interior renderings demonstrating interior spaces and relationships • Cost evaluation The project construction manager, Byrne Construction, has reviewed and evaluated the design development package and has been an active participant in the design progress meetings as we have transitioned into the construction document phase of the project. During the construction documents phase of the project, the architect will prepare working drawings, specifications, and bidding documents. Also during this phase, building materials, colors, finishes and interior design will be considered. The preparation of construction documents will continue through August, when the construction manager will solicit individual bids for all of the subcontracts to construct the project. Based on the final pricing from the bids received, the construction manager will prepare the Guaranteed Maximum Price (GMP) for Council consideration. ISSUED BY THE CITY MANAGER NORTH RICHLAND HILLS, TEXAS ~ The City's contract with BSA is also being amended to include the professional services necessary to accomplish the additional work associated with previous Council direction to include the senior services and secure LEED certification, along with performing work to engineer the improvements to Bud Jensen and related off-site drainage. Staff has continued to keep the Park and Recreation Board, the Senior Exploratory Committee and the Development Review Committee updated on the progress of the recreation center. A.2 IR 2010-040 Update on Sign Topper Program as part of Neighborhood Initiative Efforts Mr. John Pitstick, Director of Planning, presented a PowerPoint presentation on a proposed pilot sign topper program as part of the Neighborhood Initiative Program. The program would be implemented in target area one (south of Northeast Loop 820, west of Boulevard 26 and east of Rufe Snow Drive). Mr. Pitstick presented to Council the program's purpose, guidelines and initial costs. Council concurred with the information presented and directed staff to proceed with the pilot program as part of the Neighborhood Initiative Program. A.3 IR 2010-042 Police Department's Implementation of Nixle Messaging Service Chief Perdue and Captain Rick Scott presented a new community notification service, Nixle, being launched by the Police Department. The messaging service is designed to deliver to the community neighborhood-level public safety and community event notifications by web, email and cell phone. The service will provide geographical based alerts, advisories, community information and localized traffic information to service subscribers. Council expressed their support of the new service and asked about the possibility of using Code Red to inform citizens of the new service. The original Town Center zoning district was created in 1998 as part of a master planned development by Arcadia Development intended to create an integrated mixed use town center with four character subzones emphasizing a transect of less urban to more urban uses on approximately 290 acres of land. A pedestrian friendly environment was to be encouraged with new street-types including alleys, on-street parking, wide sidewalks and building setbacks closer to the street. A significant part of the developer's plan included the creation of a Tax Increment Financing District (TIF #2) to finance public improvements including a recreation center, public library and county college performing arts/conference center. Most of the Home Town development west of the Home Town Lakes has been developed with a majority of single family detached homes and townhomes. The Venue was built in 2007 as part of the initial commercial core development including residential lofts with first floor commercial uses. The Home Town Regulating Plan was last updated in 2004. The neo-traditional mixed use developments have become more popular and more detailed regulations have acquired over the last decade in several other cities throughout the state and throughout the nation. Staff is requesting approval to begin the process of drafting updated regulations and to set public hearings before the Planning & Zoning Commission and City Council on possible amendments to the Town Center zoning district. The sale of $23,740,000 in Tax and Waterworks and Sewer System (Limited Pledge) Revenue Certificates of Obligation for the recreation center construction, utility water and wastewater projects, drainage projects, NRH2O strategic plan projects, Boulevard 26 improvements and equipment replacement was completed on May 24, 2010. The City received Certificates of Obligation ratings from both Moody's Investors Service and Standard and Poor's. Moody's rating is Aa2 and Standard and Poor's has upgraded the AA rating to AA+. The proposed development will have twenty-four (24) pumps and is located at the southwest corner of Rufe Snow Drive and the NE Loop 820 service road. LOT SIZE: 1.56 acres COMPREHENSIVE PLAN: The Comprehensive Plan indicates retail uses for this area. These uses include establishments and retail stores. The applicants proposed use is automobile-related in nature. This level of use is usually associated with commercial uses that are more intensive than those depicted by the Comprehensive Plan. The existing structure and lot used by Sam Pack 5-Star Ford use will be removed. EXISTING ZONING: Existing zoning is "C-2" -Commercial. An SUP is required for the type of land use being requested in which nine or more pumps are planned. EXISTING PLATTING: The site is currently platted as part of the Five Star Ford Addition. Upon zoning approval, the property will be replatted and this portion separated from the current, larger lot. The existing private drive indicated along the south boundary will remain to serve both lots. ADJACENT ZONING/LAND USE: North: NE Loop 820 Interstate East: LR/ Local Retail South: C-2/ vehicle sales storage lot West: C-2/ vehicle sales dealership and lot THOROUGHFARE PLAN: The site has primary frontage along NE Loop 820 east bound service road, along with multiple access points along Rufe Snow Drive. SITE DESIGN FEATURES: Building Design and Materials • The building is orientated towards the NE Loop 820 service road R.O.W. • The site plan proposes asingle-story building of approximately 4,902 square feet in size. • Building materials consist of a brick masonry exterior and split-face stone. The pump canopy will consist of a "pitched" parapet design with standing metal seam roof material. • The building design attempted to somewhat match not only the typical QT style, but also the design of materials in the NRH City Image study by using stone accent columns. • The canopy columns will be brick clad matching the exterior of the main building. Access and Parking • This site will have access from the NE Loop 820 access road as well as two entrances from Rufe Snow Drive. The northern entrance will be a right-in/right-out only due to the planned road improvements to Rufe Snow by the City in this area. A third entrance further to the south will allow for both south and northbound access from Rufe Snow Drive. • An existing private access drive that currently serves the dealership will also serve as access along the south for QT. • Sidewalks will be included on both the access road frontage and Rufe Snow Drive. • The parking located on the rear (south side) of the structure will be used by the auto dealership for storage of vehicles. The SUP site plan includes a note that this area is only for use by QT customers or automobiles directly related to the dealership. This access drive also allows for an entrance from the southwest portion of the QT development. Landscaping and Screening • A 15 foot landscape setback along all street frontages is provided as well as landscaping to the south along the extension of the drive to the south off of the QT site. This will add to the screening of the vehicle storage lot that the dealership will still have. • Total site landscaping meets the minimum 15% of area required by ordinance. Signage The Site Plan notes a monument sign location along the Rufe Snow Drive frontage in the northeast corner of the lot. Because the site has freeway frontage, a large "high rise" pole sign on the frontage road is permitted. The elevation indicates that the proposed sign will have a high sign as well as a lower "monument" style sign nearer to ground level. This lower sign area was required as part of the SUP to be surrounded by masonry matching the brick used on the structure and canopy columns as well as the monument sign on Rufe Snow Drive. STAFF RECOMMENDATION: The site is appropriate and all access and site circulation issues have been addressed. The type of land use fits into this setting and will function well adjacent to an auto dealership. J.D. Dudley, Real Estate Project Manager, 1120 N. Industrial Blvd., Euless, TX 76039. Mr. Dudley stated that Quick Trip is very excited about this project. The building articulation will be different on this site from others they have done. The roof pitch on the canopy will be metal seam as opposed to the shingled roof done on Davis Blvd. The building will model the one in Keller on Bear Creek with increased stone and the HVAC will not be visible at all, it will be bricked and screened on all four sides. If in the future the parking spaces are acquired behind the store to open the double sided store, then only a sign and a door would be required for completion. He stated they have worked with Staff regarding the deceleration lane left turn bay provided to the Corona Drive to avoid stacking on Rufe Snow. The original drive between the building and the canopy has been removed and we added a few additional parking spaces and a row of screening. There have been a few additional trees added to the site plan. Full engineering and architectural plans will be submitted as soon as possible once the SUP has been approved. Once approved, Five Star Ford has 90 days to vacate and then the demolition and grading can occur. Eric Wilhite said this is a Special Use Permit for Quick Trip with 24 pumps and a 4,902 sq. ft. retail convenience store with a primary access point off of 820 and a shared private drive with Five Star Ford. In order to get northbound access from the QT site, they are also putting in another drive from Corona. The intersection design with the median is being designed by the City and QT has worked with Staff on the traffic impact analysis on turn lane movements and access for their use going in. QT has worked with Staff to add more stone to the columns and HVAC equipment is screened from all sides. Once more engineering has been done and zoning is in place, Staff will bringing forward a plat for consideration, since the property purchased from Five Star will be purchased and replatted. This SUP meets all the regulations and Staff recommends approval. Mike Benton asked if QT would be required to come back for the back door entrance. Eric Wilhite said no, it would not since the SUP does not have any significant impact from surrounding properties or the site itself. It also has to do with the parking spaces from Five Star. The parking spots, while on the QT lot, will be utilized primarily by Five Star for vehicle storage and there is a note on the SUP exhibit because if people see vehicles stored out there, we want it known it is only for Five Star Ford vehicles. Chairman Shiflet asked for clarification on the landscape requirement, stating it looks like they exceeded the required amount by 31 %. Also included is a replat of Lot 7, Block 8 and Lot 5, Block 9, Thornbridge East Phase III Addition into Lot 7R, Block 8, and Lot 5R, Block 9, Thornbridge East Phase IV Addition (located in the 8900 block of Glendara Drive - 6.791 acres.) (Continued from May 10, 2010; Public Hearing held & closed on May 10, 2010) Case Summary: J & J NRH 100, FLP (John Barfield) is proposing to plat a 6.791 acre tract for development of 22 single family residences. Two new residential streets and an extension of the existing Glendara Drive are proposed. The streets will form a loop configuration. This replat falls within 600 feet of the Morrow-Stevens gas well site and also within 150 feet of the Little Bear Creek Corridor. Several concerns were brought up at the replat public hearing on May 10, 2010. Because of these concerns the developer's representative requested to continue considerations on the Thornbridge East Phase III and IV. City Council honored the request from the developer and voted to continue deliberations. Council instructed staff to provide a report addressing the issues raised during the public hearing when deliberations are continued. Since the public hearing portion of the meeting was closed it is not necessary to open the meeting back up for public comment but Council does have the option of inviting anyone to speak during the deliberations. Below is a summary of the key concerns mentioned during the public hearing. Staff will provide Council a detailed presentation addressing all concerns during the introduction of the case at the council meeting. Summary of Concerns: 1) Little Bear Creek Corridor limits During the public hearing a resident indicated that the proposed replat was located within the Little Bear Creek Corridor. This is not the situation; the proposed replat is located entirely outside of the Little Bear Creek Corridor. The resident was making this determination based on an outdated map that was inadvertently provided to him by staff. The current Little Bear Creek boundary map (Ordinance No. 2849 approved by Council on September 12, 2005) clearly indicates the proposed replat being outside of the corridor. Compliance with City Ordinances for the proposed replat A concern was brought up during the public hearing that the City and/or the developer did not follow the City's ordinances. City staff has gone back and looked at the process of this replat and can not find any situation where either the City or the developer did not comply with the City ordinances. The property being replatted is located outside of the Little Bear Creek Corridor therefore it does not violate any of the boundary limits as mentioned in #1 above. 2) Purpose of the Little Bear Creek Ordinance is to preserve natural beauty and protect environmentally significant areas While this is one of the major benefits resulting from implementation of the Little Bear Creek Ordinance, the primary purpose of the Ordinance is flood plain management. This ordinance allows for the management of the flood plain through the preservation of the fully developed 100-year flood plain as determined by acceptable engineered hydraulic analysis. If the corridor boundary limits are determined by anything other than the approved hydraulic studies then the city attorney has indicated that we run into the potential issue of a "taking" of property. 3) Maximizing public exposure and public access While one of the objectives of the Ordinance is to encourage parkways to run along the floodplain for public access and to maintain views, Sec.102-261, Maximizing public exposure and providing public access to the floodplain, states that "to the maximum extent feasible, subdivisions shall be designed so as to maximize public exposure and provide access to the floodplain corridor." The Little Bear Creek Ordinance indicates that the City Manager shall appoint a committee, the Development Review Committee (DRC), to review proposed subdivisions and replats for consistency of the development guidelines outlined in the ordinance and the approved boundary map. The DRC would then make a recommendation to the Planning and Zoning Commission and the City Council. This is the process that was followed for this replat. DRC recommended that the open space connection for this replat be located along the section of Glendara Drive where a future trail connection is also proposed. It is important to note that this was a staff recommendation to the Planning and Zoning Commission, Council does have the authority per the ordinance to accept or deny the open space connection at Glendara Drive or could request additional open space access. 4) Un-natural debris in Little Bear Creek Public Works and Planning staff have visited the site where un-natural debris is present. There are three sections of concrete culvert pipe (ranging in size from a 24" to a 42" diameter) and some plastic buckets in Little Bear Creek. It appears that the pipe sections have been there for a number of years. It is difficult to determine exactly where the pipe sections have come from but based on their location and how long it looks like they have been there it is not believed that they are the result of any construction activity from the development of Thornbridge. They appear to have been used as a low water crossing many years ago. Public Works employees will be attempting to remove the concrete pipe sections but access for the necessary equipment may be a challenge. The plastic buckets will be removed from this site. 5) Erosion control Concerns of excessive erosion were also mentioned during the public hearing. Staff agrees that erosion is taking place but does not observe that any more erosion is taking place than what naturally occurs along unimproved drainage corridors. Staff has compared the velocities of the water in this section of Little Bear Creek and has found that they are very similar to the velocities found in the other major tributaries located in the city. Gas Well adjacency All 22 of the proposed lots are within 600 feet of the Morrow-Stevens gas well pad site, located to the south of the subject development. 600 feet is the community standard established within the Gas Drilling ordinance for initial establishment of a gas well site and a gas well vicinity notice is also required to be filed by gas well operators for future title search purposes to alert future property owners of existing gas sites. Several lots are also within 300 feet of the actual drill holes. The City's gas drilling ordinance requires the permission from the property owners of lots within this 300 feet grant permission for drilling. Based on the timing of construction and completion of street and lot infrastructure, building permits could be applied for to construct new homes prior to Chesapeake completing its drilling operations. This could effect the drilling operations at this pad site. Both the developer and Chesapeake Energy are aware of the circumstances and the provisions in the City of North Richland Hills Gas Drilling ordinance as it pertains to residential building permits occurring and how this could effect the drilling operations at the site. Current Zoning: R-2 (Single Family Residential) Thoroughfare Plan: Phase IV of the Thornbridge East development will include the addition of two new streets and the extension of an existing street. Souththorn Drive and Wentworth Drive are the proposed new streets and the existing Glendara Drive will be extended toward the southwest from its current terminus. All of these streets are classified as R2U Residential and contain 50 feet of ROW. Comprehensive Plan: The Comprehensive Plan depicts low density residential uses for this area. The lots proposed by this plat are consistent with the plan. Staff Review/Rough Proportionality Determination: The Development Review Committee has reviewed the plat and has determined that it complies with both the Zoning and Subdivision Ordinances. The city's engineer has determined that, based on the public improvements indicated on the construction plans, the developer will be 100% responsible for the improvements. General Comments from Staff: All subdivision regulations have been met for this replat and the Planning & Zoning Commission and staff have recommended approval of the plat for Thornbridge East Phase III & IV. According to the City Attorney the only justification for denying this replat would be if it does not meet all of the platting requirements specified in Chapter 110 Subdivisions or the Little Bear Creek Corridor regulations. Even though this subdivision is outside of the current Little Bear Creek Corridor boundary the regulations include properties within 150 feet of the Little Bear Creek Corridor. This is related to Section 102-261 of the Little Bear Creek Corridor regulations "requiring to the maximum extent feasible for subdivisions within 150 feet of Little Bear Creek Corridor to provide for public street access along the frontage of the Corridor." The ordinance indicates that the evaluation of Section 102-261 be done by DRC and that a recommendation be made to both the Planning and Zoning Commission and the City Council. All previous subdivisions developed under the terms of the Little Bear Creek Ordinance have been required to provide for public access to the floodplain and open space by the alignment of parallel streets and cul-de-sac's and loop streets opening onto the floodplain. It is the position of the DRC that Glendara Drive as a part of this subdivision has access to the Little Bear Creek Corridor through frontage on the floodway easement; therefore, requiring street access at the location requested during the public hearing is unnecessary and provides no real benefit. However, if City Council determines that the plat does not provide the maximum public street frontage feasible to the Little Bear Creek Corridor then this plat could be denied. Denial of this plat could require the loss of three lots and the reconfiguration of the street to have direct access to the Little Bear Creek Corridor as determined by Council. Staff Recommendation: Approval of the final plat request FP 2009-09 based on the Development Review Committee's recommendation that reasonable access is provided to the Little Bear Creek Corridor from Glendara Drive frontage. Planning & Zoning Commission Recommendation: Approval by a 4-0 vote. GENERALLY Secs.102-201--102-220. Reserved. DIVISION 2. PURPOSE AND INTENT Sec. 102-221. Goals and objectives. The city recognizes the natural landscape along Little Bear Creek floodplain as a unique setting distinct to the city. To ensure that this characteristic and quality are maintained and enhanced, these guidelines and this articl a are established: (1) To enhance drainage functions of the corridor while preserving the natural qualities of the creek. (2) To create a linear greenbelt system that will complement and enhance adjacent development. (3) To support the objective of maintaining a balanced and diverse landscape which promotes a rural character. (4) To encourage parkways to run along the floodplain for public access and to maintain views. (Code 1975, app. A, art. 14, § 1400) Sec. 102-222. Compliance with flood damage prevention ordinance (article II of this chapter). Nothing contained herein shall exempt any development from the requirements contained in the flood damage prevention ordinance (article II of this chapter), as adopted and amended by the city. The requirements contained herein shall be in addition to any requirements contained in the flood damage prevention ordinance (article II of this chapter). The regulations of this article shall be applicable to all new subdivisions and resubdivisions within the corporate city limits which are located in and within 150 feet of the Little Bear Creek fully developed 100-year floodplain limits and its tributaries as identified on the Little Bear Creek Boundary Map. The city manager shall appoint a development review committee comprised of representatives of the public works department, planning department, parks and recreation department, and other staff as deemed appropriate, to review proposed subdivisions or resubdivisions for consistency with this article and the development guidelines identified in the Little Bear Creek Corridor Study and the Little Bear Creek Boundary Map, and make recommendations to the planning and zoning commission. (Code 1975, app. A, art. 14, § 1415) Secs. 102-225--102-240. Reserved. DIVISION 3. RECLAMATION OPTIONS WITHIN THE FULLY DEVELOPED FLOODPLAIN Sec. 102-241. General requirement. (a) The base flood elevation and floodplain used for design and planning shall be evaluated upon total stormwater discharge quantities that will, through future urbanization, be generated from a fully developed watershed. Reclamation of land areas located within the fully developed floodplain of the Little Bear Creek Corridor and its tributaries are discouraged by these regulations. The drainage way of the creek and its major tributaries shall be left in a natural state where possible to control erosive velocities, prevent excessive downstream discharges and preserve the natural effect of the stream. (b) When a development is proposed in the platting process, which intends to reclaim any portion of the fully developed 100-year floodplain, the requirements of this article shall apply. (Code 1975, app. A, art. 14, § 1420) Sec. 102-242. Reclamation of floodplain. No portion of the fully developed 100-year floodplain shall be reclaimed unless all of the following criteria have been satisfied: (1) It can be demonstrated that there will be no rise in the 100-year frequency flood elevation for a fully developed watershed. (2) No environmentally significant area, as established in the Little Bear Creek Boundary Map, will be adversely impacted. (3) Any floodplain remaining after final reclamation shall be designated in accordance with section 102-243. (Code 1975, app. A, art. 14, § 1425) Sec. 102-243. Designation of fully developed 100-year floodplain. Where land is considered for development and reclamation or partial reclamation has been approved and accepted, or where no reclamation of the fully developed 100-year floodplain is proposed, the following alternatives shall apply: (1) Any floodplain remaining after final reclamation shall be dedicated as a drainage and public access easement to the city to prevent further encroachment, allow public access, and ensure proper drainage maintenance. (2) Any floodplain remaining after final reclamation, if so desired by the applicant, may be dedicated by plat or fee simple title to the city. (3) When a portion of the fully developed 100-year floodplain is contained within the limits of a subdivision plat, it shall be designated on the plat as a "drainage and public access easement" or, if so desired by the applicant, may be designated on the plat as dedicated to the city. (4) Floodplain designation, as described in this division, shall be concurrent with the approval of final plat or replat in the statutory platting process. (Code 1975, app. A, art. 14, § 1430) Secs. 102-244--102-260. Reserved. DIVISION 4. DEVELOPMENT STANDARDS Sec. 102-261. Maximizing public exposure and providing public access to the floodplain. (a) To the maximum extent feasible, subdivisions shall be designed so as to maximize public exposure and provide access to the floodplain corridor. Every new subdivision or resubdivision shall provide for public access to the floodplain and open space by the alignment of streets along the frontage of the corridor as demonstrated in Figure 1 on Exhibit C. When it is not possible to align streets along the corridor, access points shall be provided through the use of culs-de-sac opening onto the floodplain and loop streets paralleling the floodplain. (b) Lots shall either front or side the floodplain. Culs-de-sac shall open onto the floodplain, providing maximum public access. No lot shall back to the floodplain, unless when absolutely necessary due to engineering constraints or upon recommendation of the development review committee. (Code 1975, app. A, art. 14, § 1435) Editor's note: Exhibit C is not set out in this section but is available at the office of the city secretary. Sec. 102-262. Residential street, access, and visibility easements. The development requirements of this division shall apply to every new subdivision or resubdivision of property located within the Little Bear Creek Corridor. (1) Lots located on residential streets and minor collector streets shall provide a minimum 25-foot front building line to retain and enhance the natural qualities of the corridor, reinforce the development image, and create a continuous road edge. (2) Visibility sight triangles, as shown in Figure 2 on Exhibit C are required. No fence, screening wall, sign, structure, hedge, tree, or shrub shall be erected, planted or maintained in such a manner so as to obstruct or interfere with a clear line of sight of the drivers of approaching motor vehicles within a visibility sight triangle. Within this triangle, vision shall be clear at elevations between 30 inches and nine feet above the average curb grade. On corner lots where two C-2-U minor collector streets intersect, or where a C-2-U minor collector street intersects with a R-2-U residential street or larger, the triangular area shall be formed by the greater of either extending the two curblines from an imaginary point of intersection a distance of 35 feet and connecting these points with an imaginary line, thereby making a triangle, or extending the property lines, from their point of intersection, a distance of 15 feet and connecting these points with an imaginary line, thereby making a triangle. In cases where streets do not intersect at approximately right angles, the publi c works director shall have the authority to vary these requirements as deemed necessary to provide safety for both vehicular and pedestrian traffic. (3) North Tarrant Parkway and Davis Boulevard shall have a minimum 30-foot visibility and access triangular easement, as shown in Figure 3 on Exhibit C, adjacent to the right-of-way line within the limits of the corridor as described in section 102-223. (Code 1975, app. A, art. 14, § 1440) CITY OF NORTH RICHLAND HILLS Department: City Secretary Council Meeting Date: 6-14-2010 Presented by: Agenda No. E.0 Subject: PUBLIC WORKS CITY OF NORTH RICHLAND HILLS Department: Public Works Council Meeting Date: 6-14-2010 Presented by: Gregory Van Nieuwenhuize Agenda No. E.1 Subject: PW 2010-022 Award a Professional Services Agreement to PBS&J, Inc. in the amount of $79,738 for the Starnes Road Street Improvements (Rufe Snow Drive to Crosstimbers Lane) Project (ST1001) Summary: Council is being asked to award a professional services contract for the CIP Project identified as "Starnes Road Street Improvements (Rufe Snow Drive to Crosstimbers Lane)" in the Capital Projects Budget. The contract will include the design of both the roadway and the replacement sanitary sewer. General Description: This project will consist of the engineering design of Starnes Road from Rufe Snow Drive to Crosstimbers Lane. The estimated cost of the entire project is $600,000. This project was identified in the 2003 Bond Program. The project's design will include reconstructing approximately 1,300 lineal feet of the existing 40 foot wide asphalt roadway with concrete pavement. The roadway design will include concrete sidewalks on both sides of the street and the appropriate drainage improvements. All design work will be in compliance with the Public Works Design Manual. Within the last year, staff has taken an in-depth look at the condition of the utilities (sanitary sewer and water) when these utilities are within the right-of-way (ROW) of a street identified for reconstruction. In many instances the sanitary sewer mains are made of clay and have become exceptionally problematic within the last few years. While the water mains have not generally shown this same increase in maintenance, their material composition and maintenance history is reviewed to determine if they should be considered for replacement as well. Because of the current economic climate, in most cases, there is enough individual project funding to replace a bond program street's sanitary sewer and/or water main if staffs review of the utility identifies a problem situation. Consequently, the City's policy regarding the replacement of utilities within the ROW of streets identified in the bond program has changed. In the future staff will highlight the utility that is proposed to remain and as such, the utility will not be included as part of the design or reconstruction of the bond program street. For the portion of Starnes Road from Rufe Snow Drive to Crosstimbers Lane, the existing water main is proposed to remain. Staff followed the City's policy for procuring professional services for the design of this project. Requests for Qualifications (RFQ 10-022) were initially sent to 52 local engineering firms; 35 firms responded by submitting Statements of Qualifications ("SOQs") to the City. Five (5) North Richland Hills' staff members (Assistant Director of Public Works, two Public Works Civil Engineers, Parks & Recreation Parks Planner, and Planning & Development Assistant Planner) comprised the selection committee. The selection committee interviewed the seven (7) most qualified SOQs for this size and type of project. The shortlisted firms were selected based on each firm's design experience on similar projects, current work load, proposed project approach and estimated design schedule. After each of these firms provided presentations to the committee, PBS&J, Inc. was unanimously chosen as the top firm for the Starnes Road Street Improvements Project. PBS&J is a national engineering firm that has been established in the Dallas-Fort Worth Metroplex since 1983 and currently has a local staff of over 100 professionals. The firm has 10 offices throughout Texas with over 550 professionals that can support the Dallas office if needed. PBS&J is currently celebrating its 50th year in business. The PBS&J Public Works Team specializes in providing services to municipalities including paving and drainage design, water and wastewater design, hydraulic and hydrology, and environmental and construction services. PBS&J's goal is to establish long term relationships with its clients and to become a trusted advisor; the firm is committed to delivering a design that meets the needs and expectations of North Richland Hills. The engineering agreement outlines the scope of work in Exhibit B (Basic Engineering Services), Exhibit C (Special Engineering Services) and Exhibit D (Additional Engineering Services). S~. ;- 1 -. , AGREEMENT FOR ENGINEERING SERVICES BETWEEN THE CITY OF NORTH RICHLAND HILLS AND PBS&J This Agreement is executed by and between the City of North Richland Hills, a municipal corporation located in Tarrant County, Texas, acting by and through Mark Hindman, its duly authorized City Manager (hereinafter called "CITY"), and PBS&J, Inc., a Texas corporation, acting by and through Scott A. Smiley, P.E.; its duly authorized Principal (hereinafter called "ENGINEER"). WITNESSETH, that CITY desires professional engineering services in connection with the Starnes Road Street Improvements (Rufe Snow Drive to Crosstimbers Lane) Project (ST1001). NOW, THEREFORE, CITY and ENGINEER, in consideration of the mutual covenants and agreements herein contained, do mutually agree as follows: II. PROJECT In this Agreement, the "PROJECT" means the engineering design of the Starnes Road Street Improvements (Rufe Snow Drive to Crosstimbers Lane) Project (ST1001) in accordance with the Public Works Design Manual, applicable CITY codes, regulations and standards. III. BASIC AGREEMENT ENGINEER is an independent contractor and undertakes and agrees to perform professional engineering services in connection with the PROJECT, as stated in the sections to follow. It is understood and agreed that ENGINEER is not and will not by virtue of this contract be deemed to be an agent or employee of CITY and that CITY will not be entitled to direct the performance by ENGINEER's employees or subcontractors of the tasks contemplated by this contract. All engineering services shall be performed with diligence and in accordance with professional standards customarily obtained for such services in the State of Texas. For rendering such services CITY agrees to pay ENGINEER as set forth in Section VIII: "Compensation" and Exhibit F: "Compensation". IV. SCOPE OF ENGINEER'S SERVICES ENGINEER shall render the professional services necessary for development of the PROJECT, in accordance with the schedule in Exhibit A: "Project Schedule" and as detailed in Exhibit B: "Basic Engineering Services", said exhibits being attached hereto and incorporated herein for all purposes. ENGINEER shall be responsible, to the level of competency presently maintained by other practicing professional engineers in the same type of work in the Dallas/Fort Worth Metroplex area, for professional and technical soundness, accuracy, and adequacy of all designs, drawings, specifications, and other work and materials furnished under this Agreement. ENGINEER is performing its work exclusively for CITY, and no contractor or other third party is the intended beneficiary of ENGINEER's documents, reports, or services. V. SPECIAL ENGINEERING SERVICES The CITY will pay the ENGINEER for Special Engineering Services as indicated in Exhibit C: "Special Engineering Services", attached hereto and made a part of this Agreement. VI. ADDITIONAL ENGINEERING SERVICES The CITY will pay the ENGINEER for Additional Engineering Services as indicated in Exhibit D: "Additional Engineering Services", attached hereto and made a part of this Agreement. VII. SCOPE OF CITY SERVICES The City will furnish items and perform those services as identified in Exhibit E: "Services to be provided by the City", attached hereto and made a part of this Agreement. VIII. COMPENSATION A. In consideration of the services described herein, CITY shall pay and ENGINEER shall receive compensation in accordance with Exhibit F: "Compensation". B. Total payments including without limitation salary and reimbursable expenses, to ENGINEER by CITY for the services stated in Section IV and Section V above shall not exceed seventy-nine thousand seven hundred thirty-eight dollars ($79,738). C. CITY may authorize additional services to be provided by ENGINEER as mutually agreed upon by the parties. Any authorization for additional services shall be given to ENGINEER by CITY in writing and approved by CITY. ENGINEER is entitled to rely on the accuracy of CITY-furnished information and any changes or errors in such information shall entitle ENGINEER to an equitable adjustment in the contract sum to account for any additional work that ENGINEER must perform. D. CITY and ENGINEER understand that the variables in ENGINEER's cost of performance may fluctuate. The parties agree that any fluctuation in ENGINEER's costs will in no way alter ENGINEER's obligations under this Agreement nor excuse performance or delay on ENGINEER's part. IX. OWNERSHIP OF DOCUMENTS All completed or partially completed evaluations, reports, surveys, designs, drawings and specifications prepared or developed by ENGINEER under this Agreement, including any original drawings, computer disks, mylars or blue lines, shall become the property of CITY when the Agreement is concluded or terminated, and ENGINEER receives payment for services, and may be used by CITY in any manner it desires; provided, however, that ENGINEER shall not be liable for the use of such drawings for any project other than the PROJECT described in this Agreement, and CITY will indemnify and hold ENGINEER harmless from any claim, loss, judgment, costs, damage, or liability that results from the use of the ENGINEER's work product on any other project. X. INDEMNITY ENGINEER SHALL INDEMNIFY AND HOLD HARMLESS CITY AND ITS OFFICERS, AGENTS, SERVANTS AND EMPLOYEES FROM ANY LIABILITY ON ACCOUNT OF ANY INJURIES OR DAMAGES RECEIVED OR SUSTAINED BY ANY PERSON OR PROPERTY, INCLUDING COURT COSTS AND REASONABLE ATTORNEYS' FEES INCURRED BY CITY, PROXIMATELY CAUSED BY THE NEGLIGENT ACTS OR OMISSIONS OF ENGINEER OR ITS OFFICERS, AGENTS, SERVANTS, CONTRACTORS, OR EMPLOYEES IN THE EXECUTION, OPERATION, OR PERFORMANCE OF THIS AGREEMENT. Approval by CITY of contract documents shall not constitute or be deemed to be a release of the responsibility and liability of ENGINEER, its officers, agents, employees and subconsultants, for the accuracy and competency of the services performed under this Agreement, including but not limited to evaluations, reports, surveys, designs, working drawings and specifications, and other engineering documents. Approval by CITY shall not be deemed to be an assumption of such responsibility and liability by CITY for any error, omission, defect, deficiency or negligence in the performance of ENGINEER's professional services or in the preparation of the evaluations, reports, surveys, designs, working drawings and specifications or other engineering documents by ENGINEER, its officers, agents, employees and subconsultants, it being the intent of the parties that approval by CITY signifies CITY's approval of only the general design concept of the improvements to be constructed. In this connection, ENGINEER and its subconsultants shall indemnify and hold CITY and all of its officers, agents, servants, and employees harmless from any loss, damage, liability or expenses, on account of damage to property and injuries, including death, to any and all persons, including but not limited to officers, agents or employees of ENGINEER or its subconsultants, and all other persons performing any part of the work and improvements, which may arise out of any negligent act, error, or omission in the performance of ENGINEER's professional services or in the preparation of evaluations, reports, surveys, designs, working drawings, specifications and other engineering documents incorporated into any improvements constructed in accordance therewith; ENGINEER shall defend at its own expense any suits or other proceedings brought against CITY and its officers, agents, servants and employees or any of them on account of the foregoing described negligent acts, errors or omissions, and shall pay all expenses and satisfy all judgments which maybe incurred by or rendered against CITY, its officers, agents, servants and employees or any of them, in connection with the foregoing described negligent acts, errors, or omissions; provided and except however, that this indemnification provision shall not be construed as requiring ENGINEER to indemnify or hold CITY or any of its officers, agents, servants or employees harmless from any loss, damages, liability or expense, on account of damage to property or injuries to persons caused by defects or deficiencies in design criteria and information furnished to ENGINEER by CITY, or any deviation in construction from ENGINEER's designs, working drawings, specifications or other engineering documents. XI. INSURANCE For the duration of this Agreement, ENGINEER shall maintain the following minimum public liability and property damage insurance which shall protect ENGINEER, its subcontractors, its subconsultants and CITY from claims for injuries, including accidental death, as well as from claims for property damage which may arise from the performance of work under this Agreement. ENGINEER shall provide a Certificate of Insurance verifying that the following minimum limits of coverage are provided: A. Worker's Compensation Insurance: Statutory requirements ($ 300,000 minimum) B. Comprehensive General Liability and Bodily Injury: Bodily Injury $ 500,000 per person, or $ 1,000,000 per occurrence; and Property Damage $ 100,000 each occurrence; or Combined Single Limit $ 1,000,000 aggregate C. Comprehensive Automobile Liability: Bodily Injury $ 500,000 per person, or $ 1,000,000 per occurrence; and Property Damage Combined Single Limit D. Professional Liability: Errors and Omissions $ 100,000 each occurrence; or $ 1,000,000 aggregate $ 1, 000, 000 The Certificate of Insurance shall contain a provision that such insurance cannot be canceled or modified without thirty (30) days prior written notice to CITY. XII. ARBITRATION No arbitration arising out of or relating to this Agreement shall occur without both parties' written approval. XIII. TERMINATION AND SUSPENSION A. CITY may terminate this Agreement at any time for convenience or for any cause by a notice in writing to ENGINEER. Either CITY or ENGINEER may terminate this Agreement in the event the other party fails to perform in accordance with the provisions of this Agreement. Upon receipt of such notice, ENGINEER shall immediately discontinue all services and work and the placing of all orders or the entering into contracts for supplies, assistance, facilities, and materials, in connection with the performance of this Agreement and shall proceed to cancel promptly all existing contracts insofar as they are chargeable to this Agreement. B. If CITY terminates this Agreement under the foregoing Paragraph A, CITY shall pay ENGINEER a reasonable amount for services performed prior to such termination, which payment shall be based upon the payroll cost of employees engaged on the work by ENGINEER up to the date of termination of this Agreement and for subcontract and reproduction in accordance with the method of compensation stated in Section VIII: "Compensation" hereof. In the event of termination, the amount paid shall not exceed the amount appropriate for the percentage of work completed. XIV. SUCCESSORS AND ASSIGNS CITY and ENGINEER each bind themselves and their successors, executors, administrators and assigns to the other party of this Agreement and to the successors, executors, administrators and assigns of such other party in respect to all covenants of this Agreement; except as above, neither CITY nor ENGINEER shall assign, sublet or transfer its interest in this Agreement without the written consent of the other. Nothing herein shall be construed as creating any personal liability on the part of any officer or agent of CITY. XV. AUTHORIZATION, PROGRESS, AND COMPLETION CITY and ENGINEER agree that the PROJECT is planned to be completed in accordance with the Exhibit A: "Project Schedule" which is attached hereto and made a part hereof. ENGINEER shall employ manpower and other resources and use professional skill and diligence to meet the schedule; however, ENGINEER shall not be responsible for schedule delays resulting from conditions beyond ENGINEER's control. With mutual agreement, CITY and ENGINEER may modify the Project Schedule during the course of the PROJECT and if such modifications affect ENGINEER's compensation, it shall be modified accordingly, subject to City Council approval. For Additional Engineering Services, the authorization by CITY shall be in writing and shall include the definition of the services to be provided, the schedule for commencing and completing the services and the basis for compensation as agreed upon by CITY and ENGINEER. It is understood that this Agreement contemplates the full and complete Engineering services for this PROJECT including any and all services necessary to complete the work as outlined in Exhibit B: "Basic Engineering Services". Nothing contained herein shall be construed as authorizing additional fees for services to provide complete services necessary for the successful completion of this PROJECT. XVI. SUBCONTRACTS ENGINEER shall be entitled, only if approved by CITY, to subcontract a portion of the services to be performed by ENGINEER under this Agreement. XVII. RIGHT TO AUDIT ENGINEER agrees that CITY shall, until the expiration of three (3) years after final payment under this Agreement, have access to and the right to examine and photocopy any directly pertinent books, design calculations, quantity take-offs, documents, papers and records of ENGINEER involving transactions relating to this Agreement. ENGINEER agrees that CITY shall have access during normal working hours to all necessary ENGINEER facilities and shall be provided adequate and appropriate work space in order to conduct audits in compliance with the provisions of this section. CITY shall give ENGINEER reasonable advance notice of intended audits. ENGINEER further agrees to include in all its subconsultant agreements hereunder a provision to the effect that the subconsultant agrees that CITY shall, until the expiration of three (3) years after final payment under the subcontract, have access to and the right to examine and photocopy any directly pertinent books, design calculations, quantity take-offs, documents, papers and records of such subconsultant, involving transactions to the subcontract, and further, that CITY shall have access during normal working hours to all subconsultant facilities, and shall be provided adequate and appropriate work space, in order to conduct audits in compliance with the provisions of this article. CITY shall give subconsultant reasonable advance notice of intended audits. XVIII. EXHIBITS Both parties agree to the following exhibits and as such, the following exhibits are made a part of this Agreement: Exhibit "A" Project Schedule Exhibit "B" Basic Engineering Services Exhibit "C" Special Engineering Services Exhibit "D" Additional Engineering Services Exhibit "E" Services to be Provided by the City Exhibit "F" Compensation Exhibit "G" Conflict of Interest Questionnaire XIX. MISCELLANEOUS A. Authorization to Proceed. Signing this Agreement shall be construed as authorization by CITY for ENGINEER to proceed with the work, unless otherwise provided for in the authorization. B. Legal Expenses. The parties hereto waive any claim they may have for attorney fees in any litigation arising out of this contract or the failure of either party to comply with the terms of such contract. C. Notices. Any notice or correspondence required under this Agreement shall be sent by certified mail, return receipt requested, or by personal delivery and shall be effective upon receipt, if addressed to the party receiving the notice or correspondence at the following address: If to ENGINEER: PBS&J, Inc. ENGINEER shall perform services hereunder as an independent contractor, and not as an officer, agent, servant or employee of the CITY and ENGINEER shall have the exclusive right to control services performed hereunder by ENGINEER, and all persons performing same, and shall be responsible to the CITY for the negligent acts and omissions of its officers, agents, employees, and subconsultants. Nothing herewith shall be construed as creating a partnership orjoint venture between CITY and ENGINEER, its officers, agents, employees and subconsultants; and the doctrine of respondent superior has no application as between CITY and ENGINEER. E. Venue. This Agreement shall be governed by the laws of the State of Texas, and venue in any proceeding relating to this Agreement shall be in Tarrant County, Texas. F. Entire Agreement. This Agreement represents the entire and integrated agreement between CITY and ENGINEER and supersedes all prior negotiations, representations or agreements, either written or oral. This Agreement may be amended only by written instrument signed by both CITY and ENGINEER. G. Severability. If any provision in this Agreement shall be held illegal by a valid final judgment of a court of competent jurisdiction, the remaining provisions shall remain valid and enforceable. H. Assignment. CITY and ENGINEER each bind themselves, their heirs, successors and assigns, to the other party to this Agreement and to the successors and assigns of each other party in respect to all covenants of this Agreement. This Agreement is not to be assigned, sublet or transferred, in whole or in part, by either CITY or ENGINEER without the prior written consent of the other party. Disclosure. By signature of this Agreement, ENGINEER warrants to CITY that it has made full disclosure in writing of any existing conflicts of interest or potential conflicts of interest, including personal financial interests, direct or indirect, in property abutting the PROJECT and business relationships with abutting property owners. ENGINEER further warrants that it will make disclosure in writing of any conflicts of interest which develop subsequent to the signing of this Agreement and prior to final payment under this Agreement. The parties' rights under this Agreement and limitations on liability apply regardless of any claimed default by either party, and they shall survive the completion or termination of the Agreement. Conceptual Engineering 1. Kick Off Meeting -ENGINEER will attend a project kick-off meeting with the City project manager and the City staff to identify and clarify issues and concerns on the project so all parties have a clear understanding of the goals and objectives of the project. 2. Data Collection -ENGINEER will collect all available relevant data regarding the project site including City record drawings, existing drainage studies, thoroughfare plans, master plans, and franchise utility information. 3. Site Investigation -ENGINEER will conduct a thorough field investigation of the project site to help identify utilities, drainage issues, and general project issues that should be accounted for in the design of the project. 4. ENGINEER shall prepare the concept engineering plans including layouts, typical sections, and preliminary right-of-way needs. 5. ENGINEER will evaluate drainage improvements for the project and develop preliminary recommendations for modifications to the existing drainage system. 6. ENGINEER shall provide the CITY with two (2) copies of the concept plans and meet with the CITY to discuss the conceptual design of the project. B. Preliminary Engineering Upon approval of Conceptual Engineering Plans, ENGINEER will prepare preliminary construction plans as follows: 1. Preliminary Project plan and profile sheets showing curb lines, driveways, sidewalks, elevations at all PVI's and PI's; high and low points, vertical curve information, and pertinent AASHTO calculations. Profiles for existing ground at the right-of-way lines shall be shown. Existing found property corners (e.g. iron pins), along the existing right-of-way shall be shown on the plans. 2. Existing utilities and utility easements will be shown on the roadway plan and profile sheets. ENGINEER will coordinate with utility companies and the CITY to ascertain what, if any, future improvements are planned that may impact the Project. Submit pertinent plan sheets to private and public utility companies for review and utility clearance. Such plan sheets shall clearly identify potential utility conflicts. 3. ENGINEER will review and document the watershed area and calculate existing street, right-of-way and storm sewer capacities for the Project. A drainage area map will be drawn from available contour maps. Calculations regarding street and right-of-way capacities and design discharges at selected critical locations will be provided. Capacities of existing storm drains will be calculated and shown. Profiles of proposed storm drain lines will be prepared. 4. ENGINEER shall deliver two (2) sets of preliminary construction plans to CITY for review. Generally, plan sheets shall be organized as follows: Cover Sheet General Notes Typical Sections Paving Plan and Profile Sheets Drainage Area Map and Computations Drainage Plan and Profile Sheets Sanitary Sewer Plan and Profile Sheets Standard Details of Construction Sheets 5. ENGINEER shall submit a preliminary estimate of probable construction cost with the preliminary plans. 6. ENGINEER shall meet with the CITY to discuss review comments for preliminary submittal. The CITY shall direct ENGINEER in writing to proceed with Pre-Final Design for Review. C. Pre-Final Phase Upon approval of Preliminary Engineering Plans, ENGINEER will further develop the plans and provide the following additional tasks for the pre-final construction plans: 1. ENGINEER will prepare a horizontal control sheet with any required easements or right-of-way shown. 2. ENGINEER will prepare a horizontal and vertical control plan that locates all proposed and existing facilities. Legal descriptions (Lot Nos., Block Nos., Addition Names and/or Abstract & Survey Information) along with property ownership shall be provided on the plan view. 3. Engineer shall prepare plan and profile design sheets for the replacement of the sanitary sewer along the alignments. Plans shall show depth of pipe, horizontal and vertical PI's, pipe FL elevations, slope, size, material, embedment, service line connections, and manhole locations. Design of the sanitary sewer will be performed as an Additional Service. 4. ENGINEER will prepare a construction sequencing plan in accordance with CITY requirements. Engineer will provide a narrative for the construction sequencing including any detours. It is the contractor's responsibility to prepare and submit for approval a traffic control plan. If the City deems the project will require the ENGINEER to prepare a detailed traffic control plan, this will be done as an additional service. 5. ENGINEER will prepare an Erosion Control Summary and erosion control plan. It is the contractor's responsibility to prepare and submit the SWPPP and the NOI. 6. ENGINEER will develop preliminary roadway cross-sections from the survey notes, at intervals not to exceed 50 foot along the Project length and will extend 10' past the right-of-way line on both sides of the street. Additional cross- sections at important features including driveways, PI's of intersecting streets, (minimum distance of 100' along cross-street at each PI), walks, retaining walls, etc., will also be provided. Scale will be 1" = 20' horizontal and 1" = 5' vertical. 7. ENGINEER shall deliver two (2) sets of pre-final construction plans to CITY for review. ENGINEER shall submit a preliminary estimate of probable construction cost with the plans. 9. ENGINEER shall attend one (1) plan review meeting. The review meeting will be conducted to address review comments and to take action on items to produce the final construction documents. Three (3) sets of review plans and specifications will be provided for the review meeting. The plans will be marked "Review Plans" and will be for review purposes only. D. Final Engineering Following CITY approval of the pre-final plans, ENGINEER shall prepare final plans with the following additional tasks: 1. Address all CITY comments and finalize all engineering drawings. 2. Prepare final cross-sections on 22" x 34" sheets. Information on these sheets will include centerline station, profile grades and centerline elevations, roadway section (existing and proposed), right-of-way limits. Scale will be 1" = 20' horizontal and 1" = 5' vertical with cross sections plotted with stationing from the bottom of the sheet. Excavation and embankment volumes and end area computations shall also be provided. 3. Prepare the bid proposal forms (Project quantities) of the improvements to be constructed. 4. Compile specifications and prepare any special specifications required for the project. The construction contract documents (front end documents) will utilize the CITY's standard documents. Construction specifications will utilize CITY standards and NCTCOG specifications. 5. Submit a final estimate of probable construction cost. 6. Prepare complete contract documents and specifications for Bidding Phase. 7. Furnish CITY two (2) sets of drawings, specifications, and bid proposals marked "Preliminary" for approval by CITY. Upon final approval by CITY, ENGINEER will provide four (4) sets of plans, stamped "Final" drawings. E. Bidding Phase 1. ENGINEER shall assist CITY in securing bids and issue a Notice to Bidders to selected plan rooms. ENGINEER will provide a copy of the Notice to Bidders for CITY to use in notifying construction news publications and publishing appropriate legal notice. The cost for publications shall be paid by CITY. 2. ENGINEER shall send non-certified letters /faxes / e-mails and/or the Notice to Bidders to contractors known to perform this type of work. 3. ENGINEER shall be responsible for printing Bid Documents and distribution to selected plan rooms, and to prospective bidders that respond to the Notice to Bidders. Engineer shall collect anon-refundable deposit from plan holders to cover the cost of reproduction of the plans. ENGINEER shall maintain information on entities that have been issued a set of Bid Documents. ENGINEER shall distribute information on plan holders to interested contractors and vendors on request. 4. ENGINEER shall attend a Pre-Bidders Conference and assist CITY by responding to questions and interpreting Bid Documents. ENGINEER shall aid CITY in the preparation and issuance of addenda to the Bid Documents to plan holders, if necessary. 5. ENGINEER will assist CITY in the opening, tabulating, and analyzing the bids received. ENGINEER will review the qualification information provided by the apparent low bidder to determine if, based on the information available, they appear to be qualified to construct the Project. ENGINEER will recommend award of contract(s) or other actions as appropriate to be taken by CITY. F. Construction Phase Upon completion of the bid phase services, ENGINEER will proceed with the performance of construction phase services as described below. ENGINEER shall endeavor to protect CITY in providing these services however, it is understood that ENGINEER does not guarantee the Contractor's performance, nor is ENGINEER responsible for supervision of the Contractor's operation and employees. ENGINEER shall not be responsible for the means, methods, techniques, sequences or procedures of construction selected by the Contractor, or any safety precautions and programs relating in any way to the condition of the premises, the work of the Contractor or any Subcontractor. ENGINEER shall not be responsible for the acts or omissions of any person (except its own employees or agents) at the Project site or otherwise performing any of the work of the Project. 1. ENGINEER shall assist in the preparation of the formal Contract Documents and in coordinating their execution by the respective parties. 2. ENGINEER shall assist CITY in conducting pre-construction conference(s) with the Contractor(s), review construction schedules prepared by the Contractor(s) pursuant to the requirements of the construction contract. 3. ENGINEER shall review Contractor's submittals, including, requests for information, modification requests, shop drawings, schedules, and other submittals in accordance with the requirements of the construction contract documents for the Project. 4. Based on ENGINEER's observations as an experienced and qualified design professional and review of the Payment Requests and supporting documentation submitted by Contractor, determine the amount that ENGINEER recommends Contractor be paid on monthly and final estimates, pursuant to the Construction Contract. 5. ENGINEER shall consult and advise the CITY; issue such instruction to the Contractor as in the judgment of the ENGINEER are necessary; and prepare routine change orders as required. 6. ENGINEER will make five (5) visits to the site to observe the progress and the quality of work and to attempt to determine in general if the work is proceeding in accordance with the Construction Contract Documents. In this effort ENGINEER will endeavor to protect the CITY against defects and deficiencies in the work of Contractors and will report any observed deficiencies to CITY. Visits to the site in excess of the specified number are an Additional Service. 7. ENGINEER shall conduct, in company with CITY's representative, afinal review of the Project for conformance with the design concept of the Project and general compliance with the Construction Contract Documents. Prepare a list of deficiencies to be corrected by the Contractor before recommendation of final payment. Assist the CITY in obtaining legal releases, permits, warranties, spare parts, and keys from the contractor. Review and comment on the certificate of completion and the recommendation for final payment to the Contractor(s). Visiting the site to review completed work in excess of two (2) trips is an Additional Service. 8. ENGINEER shall revise the construction drawings in accordance with the information furnished by construction Contractor(s) reflecting changes in the Project made during construction. The ENGINEER shall submit three (3) sets of prints of "Record Drawings" and one CD-ROM (in both AutoCAD and pdf format) to CITY EXHIBIT C SPECIAL ENGINEERING SERVICES FOR STARNES ROAD STREET IMPROVEMENTS (ST1001) (Rufe Snow Drive to Crosstimbers Lane) A. Topographic Design Survey ENGINEER shall be responsible for the following: 1. Research Existing Public Records -Obtain all subject and adjoining boundary, subdivision, right-of-way alignments, etc. from Tarrant County Appraisal District, Real Property Records of Tarrant County, and City of North Richland Hills Public Works Records. Contact Abstract Company for additional research as needed. 2. Boundary Sketch - Obtain Computer Aided Design and Drafting (CADD) standards from the City of North Richland Hills. Prepare boundary sketch in Microstation V8i, or AutoCAD, of record information obtained by research of public records. Sketch to be used in boundary determination for guidance for the field crews and office personnel. 3. Right of Entry Letter -Prepare and send letters by Regular US Mail with a return envelope to adjoining land owners to obtain permission to enter private property. 4. Horizontal Control and Vertical Control Datum -All horizontal and vertical project data will be based upon the City of North Richland Hills Geodetic Monumentation System. The horizontal datum is the Texas State Plane Coordinate System, North Central Zone, North American Datum of 1983 (NAD83). All vertical data will be based upon the North American Vertical Datum of 1988 (NAND 88). All horizontal data will be represented as surface distances. All horizontal coordinates will be represented as surface coordinates with a surface adjustment or combined scale factor. 5. Horizontal Control and Vertical Control Procedures -All Horizontal Control will be by GPS methods and Vertical Control by conventional methods along the entire length of the project. Horizontal and Vertical Control Benchmarks will be established at a maximum interval of 500 feet. Every attempt will be made to place the horizontal and vertical control outside the limits of construction. A minimum of three benchmarks will be established for the project area. GPS data will be obtained utilizing the Western Data Systems RTK Network. A minimum of three (3) City of North Richland Hills Geodetic Monuments surrounding the Project will be observed and used to derive calibration parameters for the observation and establishment of the horizontal coordinates. All vertical data will be collected utilizing differential leveling techniques with a digital level. A minimum of two (2) City of North Richland Hills Geodetic Monuments will be incorporated into a closed benchmark loop. All Horizontal and vertical control will be established with a minimum of a 5/8-inch iron rod 18-inches in length. All field data and office data will be tied to the project control. 6. Contact Digress -Provide Digress information for instruction to locate all underground existing private utilities in the project area. 7. ROW Survey -The field work necessary to determine the right-of-way that bounds the project area will be performed. This included the location of boundary corner monumentation, natural monumentation (creeks, etc.), and other items required for the determination of the right-of-way. 8. Topographic Mapping -Cross sections will be obtained along the roadway (top of curbs, gutters, centerline, sidewalks, natural ground, etc.) at a maximum spacing distance of 50 feet. The topographic survey will extend 50 feet in all directions from the intersections and 10 feet past the limits of the right-of-way. Locate all topographic features such as pavement, bridges, railroads, buildings, utilities, traffic signage, mail boxes, trees, fences, shrubs, breakline features, natural ground, drainage channels, etc., that affect the design and construction of the roadway. Existing driveways will be located up to the face of the garage. Flowlines will be obtained for sanitary and storm water manholes. Top of valve elevations will be obtained for water and gas valve stems where possible. Top of pipe will be obtained on water vaults and water meters along with service sizes. Drainage structures will be tied at the flowline and the sizes of all piping recorded. Trees greater than 6 inches as measured at chest height will be located and the size and species recorded. Subsurface utility engineering services and field location are not included in this scope. All mapping will be provided in either Microstation V8i or AutoCAD format. 9. Topographic Map -Preparation of topographic map will begin by computing a digital terrain model from the data collected in the field. Contours will be produced showing 1-foot minor contours and 5-foot major contours. All physical features (pavement, bridges, utilities, etc.) will be shown on the topographic survey. Easements within the project area and immediately adjoining the right-of- way of the project will be shown. Easements required to be shown for additional easements or right-of-way preparation will require additional fees provided by an Abstractor. 10. Prepare Easement Exhibits - If required field notes and exhibit drawings for additional easements and or rights-of-way will be prepared in City of North Richland Hills format. The field notes and exhibits will be signed and sealed by a Registered Professional Land Surveyor in the State of Texas. All required monumentation will be established with a minimum of 5/8-inch iron rods with caps. 11. Flag and or Re-Establish Horizontal & Vertical Control -The existing horizontal and vertical control will be flagged and or re-established prior to construction per the scope above. EXHIBIT D ADDITIONAL ENGINEERING SERVICES FOR STARNES ROAD STREET IMPROVEMENTS (ST1001) (Rufe Snow Drive to Crosstimbers Lane) I. ADDITIONAL Engineering Services, not included in the scope of work, include those services that may result from significant changes in the general scope, extent or character of the PROJECT or its design including, but not limited to, changes in size, complexity, CITY's schedule, character of construction or method of financing; and revising previously accepted studies, reports, design documents or Contract Documents when such revisions are required by changes in laws, rules, regulations, ordinances, codes or orders enacted subsequent to the preparation of such studies, reports or documents, or are due to any other causes beyond ENGINEER's control. II. ADDITIONAL Engineering Services not included in the scope of work, also include assistance to the CITY in connection with bid protests, rebidding or renegotiating contracts for construction, materials, equipment or service, or preparing to serve or serving as a consultant or witness for CITY in any litigation, arbitration or other legal proceeding involving the PROJECT. III. ADDITIONAL Engineering Services not included in the Scope of Work, also include setting of Easement/Right-Of-Way acquisition parcels with the exception of two right-of-way parcels and two easement parcels within the limits of the project. IV. ADDITIONAL Engineering Services not specifically indicated in the Scope of Work, but are actually included in the Scope of Work for BASIC Engineering Services include the performance of Sanitary Sewer Design services. The scope of services for Sanitary Sewer Design services is described under the "Water and/or Sewer" section of BASIC Engineering Services. V. ADDITIONAL Engineering Services, if approved by the CITY, will include the preparation of a detailed Traffic Control Plan. VI. ADDITIONAL Engineering services in connection with the PROJECT, including services which are to be furnished by the CITY and services not otherwise provided for in this Agreement will be at the following rates: Staff Member and Resident Project Representative -Salary Cost Times Multiplier of 2.5. Salary Cost is defined as the cost of payroll of ENGINEER's, draftsmen, stenographers, survey men, clerks, laborers, etc., for the time directly chargeable to the PROJECT, plus social security contributions, unemployment compensation insurance, retirement benefits, medical and insurance benefits, longevity payments, sick leave, vacation and holiday pay applicable thereto. EXHIBIT F COMPENSATION FOR STARNES ROAD STREET IMPROVEMENTS (ST1001) (Rufe Snow Drive to Crosstimbers Lane) COMPENSATION For and in consideration of the services to be rendered by the ENGINEER, the CITY shall pay, and the ENGINEER shall receive the compensation hereinafter set forth for the Design and Construction Phases of the work and additionally for Special Engineering Services and/or Additional Engineering Services that are in addition to the Basic Engineering Services. All remittances by CITY of such compensation shall either be mailed or delivered to the ENGINEER's home office as identified in the work authorization. "Salary Cost" used herein is defined as the cost of salaries of ENGINEER's, draftsmen, stenographers, survey men, clerks, laborers, etc. for time directly chargeable to the PROJECT plus social security contributions, unemployment, excise and payroll taxes, employment compensation insurance, retirement benefits, medical and insurance benefits, sick leave, vacation, and holiday pay applicable thereto. A. Compensation for the Basic Engineering Services (Design and Construction phases) shall be a lump sum fee of $51,685. The Design phase portion of the Basic Engineering Services shall be computed at 90% of the total Basic Services Charge; and the Construction phase portion of the Basic Engineering Services shall be computed at 10% of the total Basic Engineering Services Charge. Payment for the Design phase portion of the Basic Engineering Services shall be due in monthly installments in the proportion to that part of the services in the Design phase which have been accomplished. Final payment for services authorized in the Design phase shall be due at the completion of these services. Payment for the Construction phase of the Basic Engineering Services shall be due in monthly installments in proportion to the construction work completed on the basis of the Contractor's monthly payment estimates. Upon completion of all work authorized in the Construction phase, the ENGINEER will be paid the remainder of the charge for this phase. B. Sanitary Sewer Design Services The lump sum fee below assumes that Sanitary Sewer Design Services can be performed in conjunction with the performance of the scope for Basic Engineering Services and incorporated into the plans for the overall project. This fee does not anticipate the preparation of a separate plan set prepared independently from the overall project. Sanitary Sewer Design Services: Lump Sum Fee of $ 9,924 2. Traffic Control Design Services I if approved by the CITY, ENGINEER will prepare a detailed Traffic Control Plan showing the placement of traffic signs and barricades necessary for the contractor to construct the project while marinating access to residents and business in the area. Traffic Control Plan Design Services: Lump Sum Fee of $ 3,684 3. For all of ENGINEER's personnel time applied to the Additional Engineering Services, Salary Cost times a multiplier of 2.50. 4. For all direct non-labor and/or subcontract expense, including mileage, travel and living expenses at invoice or internal office cost times a multiplier of 1.15 Payments to the ENGINEER for authorized Additional Engineering Services will be due monthly, upon presentation of monthly statement by the ENGINEER for such services. II. AUDIT AND SCOPE CHANGE Cost budgets are set forth above and are subject to the audit provisions of this Agreement, Section XVII: "Right to Audit". It is also understood that the cost budgets are based upon ENGINEER's best estimate of work and level of effort required for the proposed scope of services. As the PROJECT progresses, it is possible that the level of effort and/or scope may differ up or down from that assumed. If there are no scope changes, the ENGINEER shall receive the full amount of lump sum and unit price fees, regardless of the cost. If at any time it appears that the cost budget may be exceeded, the ENGINEER shall notify the CITY as soon as possible in writing. If there is a scope change, the ENGINEER shall notify the CITY as soon as possible in writing and shall include a revised scope of services, estimated cost, revised fee schedule, and a revised time of completion. Upon negotiation and agreement via a signed amendment by both parties, the cost budget, fee schedule, and total budget will be adjusted accordingly. CITY shall not be obligated to reimburse the ENGINEER for costs incurred in `~ excess of the cost budget. The ENGINEER shall not be obligated to perform on any change in scope of work or otherwise incur costs unless and until the CITY has notified the ENGINEER in writing that the total budget for Engineering Services has been increased and shall have specified in such notice a revised total budget which shall thereupon constitute a total budget for Engineering Services for performance under this Agreement. A detailed scope of work, total budget, and schedule will be prepared by the ENGINEER and executed by the CITY if the ENGINEER is authorized to perform any Additional Engineering Service(s). The committee recommended approval of the program and requested staff to present to the City Council for approval. The recommended program consists of an Asphalt Overlay on 14 streets, a Slurry Seal on 24 streets, and Crack Sealing 24 streets. Attached you will find a listing of the streets being proposed for this year's program. Because of the success of targeting and concentrating the program in specific neighborhoods, this year's program for selecting streets is similar. This year's program will again focus on two neighborhoods. One of the neighborhoods is north of Mid-Cities Boulevard, essentially in the middle section of the City and the other section is in the northwestern area of the City, north of Hightower Drive and south of Bursey Road. Staff is recommending these neighborhoods because there is a large concentration of street pavement deterioration. The street pavement condition ratings for the two neighborhoods meet the criteria established by staff for selecting streets for the Annual Preventive Street Maintenance Program. In addition to the streets in these two neighborhoods, there are various streets being recommended for an overlay or slurry seal that are not part of a targeted neighborhood. They are recommended based upon their low condition ratings, concerns from residents, motorists complaints, and/or the rate of pavement deterioration that is occurring. The streets recommended for an Overlay that are separate from the targeted areas are North Richland Boulevard, Oakland Lane, Caton Drive and Steven Street. The streets recommended for Slurry Sealing that are separate from the target areas are Green Castle Court and Windsor Court. The Police Department plans to use the funds to enhance the safety and presence of our police officers through the modernization of our current police uniform. The City of North Richland Hills will receive $22,671 and there is no requirement for a cash match under the terms of the program. General Description: The U.S. Department of Justice, Bureau of Justice Assistance has notified the Police Department that grant funds have been allocated to assist in funding law enforcement programs in the City of North Richland Hills under the 2010 Byrne Justice Assistance Grant program for local solicitation. To receive the grant funds, the Bureau of Justice Assistance has required the City of North Richland Hills, other cities in the county and Tarrant County to file a joint application after negotiating the sharing of funds with Tarrant County. The City of Fort Worth has agreed to act as the official filing agent for the other cities and Tarrant County. The municipalities involved agreed to confer 16% of their total allocated funds to Tarrant County to satisfy the disparate certification imposed on the group by the Texas Attorney General. Under the terms of the Memorandum of Understanding the City of North Richland Hills will receive $22,671. There is no requirement for a cash match under the terms of the Byrne Justice Assistance Grant program. The Police Department plans to use the funds from this grant award to enhance the safety and presence of our police officers through the modernization of our current police uniform. Specifically, the JAG/Uniform grant will: • Allow officers a more contemporary and professional appearance to the public; • Provide officers greater comfort and enhanced weather protection; • Provide light reflection option for enhanced officer safety in low lighting; and • Allow reduced maintenance costs over the current uniform configuration. The attached resolution will authorize application for the grant and appoint the City Manager as the agent to act for the City relative to the grant. Recommendation: Approve Resolution No. 2010-022. NCH RESOLUTION NO. 2010-022 WHEREAS, The City of North Richland Hills, Texas possesses legal authority to apply for the Justice Assistance Grant Program -Local Disbursement and make appointments for the conduct of business relative to the Grant; and WHEREAS, The City Council of North Richland Hills finds it in the best interest of the citizens of North Richland Hills that we request the funds available under this Grant; and WHEREAS, The City Council of North Richland Hills designates City Manager Mark Hindman as the grantee's authorized official. The scope of services for the project has been revised to include additional site work required for the ten acre site and professional services related to the addition of the Senior Center, LEED certification and Bud Jensen Street roadway and drainage improvements. General Description The City Council, at its March 24, 2008 Regular Meeting, awarded the professional services contract for the design and engineering of the new Recreation Center to Brinkley Sargent Architects (BSA). The process for beginning the design and engineering of the facility began a year later in March, 2009 so that issues related to the Recreation Center site could be resolved. The contract, in the amount of $1,780,385, included: - Project Administration Service - Landscape Design - Construction Procurement Services - Construction Administration and Observation - Civil Engineering - Accessibility Consulting - Public Input - Design Services - Business Modeling - Interior Design - Cost Estimating - Equipment/Furniture Selection - Aquatics Consultant Services A Reimbursable Budget of $74,500 was also included in the contract; however, survey work and geotechnical reports were anticipated to be performed by separate contract. Although the geotechnical work is being performed by separate contract, the best value for securing the necessary topography and survey work was to employ the civil engineer sub-consultant, Halff Associates, as a part of the professional services contract with BSA. Additionally, during the preliminary design phase of the project, staff began evaluating the potential to include senior services. City Council, at its October 26, 2009 Regular Meeting, provided direction to staff to include the senior component in the building program. Also at the October 26 meeting, Council provided direction to staff to proceed with securing LEED certification. The City's contract with BSA will need to be revised to include the professional services necessary to accomplish the additional work described above. Staff negotiated the fees for the additional services as follows: Original Contract Amount $1,780,385 Site Boundary/Tree Survey $10,500 Platting of Site & Off-site Easements $14,500 Storm Retention Analysis $10,000 Senior Component Design Services $162,500 LEED Certification $186,320 Bud Jensen Street Widening 5 000 Revised Contract Amount $2,169,205 Engineering and Design Services for the Recreation Center is budgeted at $2.5 million in the FY 2009/2010 Capital Projects Budget. Although the Bud Jensen Street roadway widening and drainage project is a Public Works funded project (2003 Bond Program), it has been included in the revised scope of services with BSA. Combining the widening and drainage project with the Recreation Center project will be helpful in coordinating design and construction efforts with the road improvements and the adjacent Recreation Center parking lot and drive entry. The original professional services contract amount equaled 9.3% of the construction budget or 8% of the total project budget. The revised contract amount represents 9.2% of the construction budget and 7.7% of the total project budget. The reimbursable expenses and the LEED certification are typically not considered basic design services and are not included in the percentage calculation. While work is progressing on the construction document phase of the project, approving the amendment to the professional services contract with BSA is critical to completing the design and proceeding with the construction phase of the project. Following Council's direction, staff is proceeding with amending the TIF #2 Financing Plan to include the necessary funding to accomplish the senior component. Recommendation: To amend the professional services contract with Brinkley Sargent Architects to the revised amount of $2,169,205 for the design of the new Recreation Center to include the additional requested services.
