CALL TO ORDER The meeting was called to order by Chairman Tom Duer at 6:30 p.m. 2. Greg Lindsey Recording Secretary Teresa Koontz 3. Approval of July 8, 2010 Gas Board of Appeals Meeting Minutes. APPROVED Marty Kusmierski, seconded by Garry Cope, motioned to approve the minutes from July 8, 2010. The motion carried unanimously (3 -0). 4. GB2010 -06 Public hearing and consideration of a request from Chesapeake Energy Corporation for a deviation from distance requirements from existing structures to gas wellheads at the proposed TCCD South 3H & Leaf 1H gas wells located at 828 W Harwood Road. Distance requirements are established in Section 104 -6 of the City of North Richland Hills Code of Ordinances. Page 1 of 3, 09/09/10 GBA minutes John Pitstick gave a presentation regarding the two well sites at Tarrant County College. He said the Board recently approved a well site within 600 sq ft. at the college. South 3H and Leaf 1 H has one well that has been drilled and now they are coming back with two more wells. This site was part of a Special Use Permit for permanent concrete access road, all fracting operations be contained in the drill site. The recent change is an acquisition to build a fracting pond within the City of Hurst. So the Hurst site and NRH will be fractured from the pond on Harwood and Precinct Line Prior to the commencement of drilling there was a permanent masonry wall with landscaping. Additional landscaping and dust control measures were provided on Harwood Road. The TCCD South2 H well has been drilled and now this is a variance for two more wells on that side. They are within 600 ft of structures which includes the Race Trac and Villas on the Green. Both were notified and have not received any requests or letters from anyone. Since there are no structures less than 300 to 150 ft, there are no letters of permission required from the property owners. This is a request from deviations under 1046 1 1 D for the two locations. Scott Casenada with Chesapeake Energy, 100 Energy Way, Ft. Worth, TX came forward with a power point presentation of the overview of the drilling and production process for overview. Chairman Duer asked if the other sites have been producing other than Graham? Also he asked for a copy of the presentation via email for the notebooks. Mr Casenada said if it can be fractured, they will do so to get it off the schedule, but then it is shut in. John Pitstick clarified that the Graham site is the only producing area. We have chosen to test all active producing wells. The other wells with no pipelines have basically been shut in. There is water testing of the tank batteries after fracturing and air samples that have been testing recently. The tests have ail been well below any health standards. There have been very few complaints because the Fire Department is there to respond immediately. Recently City Council approved Texas Midstream to tie into the gathering lines to tie all six wells sites and bring to production. They are hoping that Chesapeake can stop drilling over the next few months in order to have controlled sites. Chairman Duer asked if Chesapeake has had any increase of health hazards to their employees working onsite as apposed to any other industry. Mr. Casenada said no, they have not. Marty Kusmierski asked if the natural occurring and health standard level the same numbers? Lt. Greg Lindsay answered there are some processes that we do not allow in the City of North Richland Hills. One is salt water injection; it goes into the tanks and hauled off. We do not allow compressor stations. Page 2 of 3, 09/09/10 GBA minutes The amount of benzene in the produced water is below the percentage the water is capable of holding in solution. We do see some in the head space of the tanks but those are low pressure tanks so they vent only as necessary as they are filling with water. We are working with an independent lab to conduct a long term time waiting study so we can see how it compare with the short term testing. John Pitstick said this part of the metroplex or Barnet Shale is more of a dry area with lesser levels of benzene occurring in this area. We feel that we have a good ordinance and the Gas Board and Inspectors help with that. There was a discussion about taking the Board to onsite inspections in the near future. The Public Hearing was opened and there was no one to speak for or against the hearing. APPROVED Marty Kusmierski, seconded by Garry Copy, motioned to approve GB 2010 -06.
