CALL TO ORDER The meeting was called to order by Chairman Tom Duer at 6:33 p.m. 2. ROLL CALL PRESENT Chairman Tom Duer Garry Cope Randy Shiflet CITY STAFF Director of Planning & Dev. John Pitstick Asst Dir of Public Works Greg VanNeiuwenhuize Fire Marshal Lt. Greg Lindsey Recording Secretary Gina Pastre 3. Approval of November 11, 2010 Gas Board of Appeals Meeting Minutes. APPROVED Garry Cope, seconded by Randy Shiflet, motioned to approve the minutes from November 11, 2010. The motion carried unanimously (3 -0). 4. GB 2010 -08 Public Hearing and consideration of a request from Chesapeake Energy Corporation for a deviation from distance requirements from existing structures to gas wellheads at the proposed C station 3H, 4H, 5H, 6H, 7H & Engler 1 H gas wells located at 7300 Mid Cities Boulevard. Distance requirements are established in Section 104 -6 of the City of North Richland Hills Code of Ordinances. Public Hearing opened at 6:40 pm John Pitstick said that we have a request from Chesapeake for a deviation on distance requirements for C station 3H,4H,5H,6H,7H. The Engler 1 H gas well is actually located greater than the 600 feet. There are 4 residents within 600 feet from 494 to 595 feet from the well. These residents have been previously notified for appeals and we have Page 1 of 3; 12/09/10 GBA minutes not received any correspondence from these individuals at this time. We went out on site with Chesapeake and they are going to stain the wall to match the city facility. The temperature needs to be 50 degrees for 6 days in order to stain the wall. There is one rent house and 3 other homeowners affected. Tom Duer asked if the previous wells incorporated only one resident for the ones we have approved in the past? John Pitstick said no. Those included the other two homes as well. Randy Shiflet said that some of them had residential property and some were actually houses. Tom Duer said that it might have just been one residential building. Garry Cope asked that since we didn't receive any correspondence from the homeowners that staff is recommending approval. John Pitstick said yes. These are pretty much the same homeowners that have been notified in the past. They were sent notices and we have had no communication. We encourage Chesapeake to contact any homeowners affected. Tom Duer said that the packet said that those 4 residents were part of the mineral rights agreements so they are familiar with what is going on. John Pitstick said yes. We have Scott Castaneda here with Chesapeake and we also have Ron Underwood with Gateway Permit Services. He has a presentation after the public hearing if you are interested regarding seismic activity. Scott Castaneda, 100 Energy Way, Fort Worth, TX 76102 came forward representing Chesapeake Energy. The Engler pad site is located on private property at 7300 Mid Cities Blvd. just east of Rufe Snow. This location does have a frac pond and fencing and landscaping has already been installed. Previously we did drill the Engler Mann 2H in early November and we are here tonight seeking 6 well variances for the C station 3H, 4H, 5H, 6H, 7H and the Engler 1 H. Tonight we are seeking 1 well variance for the Engler unit and 5 variances in the C station The transportation route is the same route that we used for our initial well that we drilled at this site. It comes on a commercial route from Loop 820 north onto Rufe Snow, east to Mid Cities Blvd and south onto Iron Horse Blvd. We have no protected structures within the 300 foot setback. There are 4 protected structures within the 600 foot setback. We have not received any objections. I have been in contact with these residences previously and continuously throughout this process. Some of the key beneficiaries for these additional wells include the City of North Richland Hills and BISD and over 1700 residents and businesses. These include the Evangelical Lutheran Church and the North Park Baptist Church. The potential economic benefit of these 6 wells include close to 9 million local royalties, 4 million in increased tax revenue to the city and to the state and more than 11 million to local workforce and businesses. Through letters to neighbors and online updates Chesapeake maintains open communications with its neighbors and we also Page 2 of 3; 12/09/10 GBA minutes have a website at Chesapeake.com where any resident can go in and maneuver through the webpage and find their local pad site and get daily online updates. We remain active in North Richland Hills. This year we were key sponsor in the 4 of July Family Fireworks and also for the Night of Holiday Magic. It has also allowed us to provide educational grants and scholarships through the local school systems. In conclusion Chesapeake respectfully asks that the North Richland Hills Gas Board of Appeals to unanimously approve the gas well variances for the C station 3H -7H and the Engler 1 H. I would be happy to answer any of your questions at this time. Public Hearing Closed at 6:44 p.m. APPROVED Randy Shiflet, seconded by Garry Cope, motioned to approve GB2010 -08. The motion carried unanimously (3 -0). Ron Underwood with Gateway Permit Services gave a presentation on the Seismic Testing that will be going on in the city after the first of the year. 5.
