Subject: NRH Centre Construction Update (15 Minutes)
Summarv:
This item is to provide a report on the recent progress and work activities associated
with the construction of the NRH Centre.
General Descrir)tion:
Construction of the NRH Centre began in late November 2010. The Constructor
Manager at Risk, Byrne Construction, has been working to recover lost time resulting
from the winter weather earlier in the year.
Grading and site work has been completed and pier drilling and the majority of the
perimeter grade beam are also near completion. Off -site utility work is complete, as is
installation of site water lines and storm sewer lines. The structural wall between the
banquet space and the gym is being erected. Block work on this wall section is nearing
completion and the first structural steel is being installed. The progress of the project
can be viewed from the site webcam 24 hours a day.

Summarv:
Staff will provide a construction progress update on the Viper, NRH2O's newest
attraction, as well as operational enhancements for the upcoming 2011 Season.
General Descrir)tion:
The Viper, NRH20's newest attraction, will be making its debut appearance in the
United States right here in North Richland Hills. The multi - person tube slide is currently
under construction and is expected to be completed by .tune 1, 2011. The project
includes grading, site work, associated infrastructure, filtration system, catch pool,
pathways, and landscaping. Guests will experience a multi- sensation of twists, turns
and drops when they take a ride on the Viper. The new attraction is a thrill ride that the
entire family will enjoy together. High banking turns and a heart- pounding drop into the
MEGAtube will create a one -of -a -kind attraction and ride experience for all of our
guests! Adding to the overall experience will be a lighting and sound package attached
to the MEGAtube.
Chris Swartz, NRH20 Park Manager will present an overview of the features of the
Viper, as well as an update on some overall operational enhancements for the
upcoming 2011 Season. Joe Pack, Senior Park Planner will finish the presentation with
an update on the construction progress.

Prevention Month presented by Councilman Barth
The Alliance for Children is a nonprofit organization that operates three child friendly
centers in Tarrant County, located in Arlington, Fort Worth, and Hurst. Within each of
the centers, police detectives and Child Protective Services investigators work together
to protect children who are victims of abuse. As a team they piece together what has
happened and take steps to ensure that the child is not victimized again.
Alliance for Children also offers a variety of educational programs that teach both
children and adults how to recognize, resist„ and report child abuse„ whether it is
occurring in the home, the community or on the Internet. As part of this educational
effort, Alliance for Children and the City of North Richland Hills will recognize the month
of April as Child Abuse Prevention Month.
The City of North Richland Hills has been a supporter and partner of the Alliance for
Children for many years and Police Captain Ken Bounds currently serves on the 'board
of this organization.
Nancy Hagan, Executive Director for Alliance for Children, will attend the City Council
Meeting to accept the Child Abuse Protection Month proclamation.

PROCLAMATION
WHEREAS, 169,583 investigations regarding reports of child abuse or neglect
were completed in Texas in 2010, with 13,046 of those being completed in Tarrant
County; and
WHEREAS, 6,222 cases of child abuse or neglect were confirmed in Tarrant
County in 2610; and
WHEREAS, Alliance for Children provided child- focused services to 2,513
children in 2010; which includes 452 children in the Northeast community; and
WHEREAS, child abuse prevention is a community responsibility and finding
solutions depends on involvement among all people; and
WHEREAS, communities must make every effort to promote programs that
benefit children and their families; and
WHEREAS, effective child abuse prevention programs succeed because of
partnerships among agencies, schools, religious organizations, law enforcement
agencies, and the business community; and
WHEREAS, everyone in the community should become more aware of child
abuse prevention and consider helping parents raise their children in a safe, nurturing
environment;
NOW, THEREFORE, I Oscar Trevino, Mayor of the City of North Richland Hills,
Texas, and on behalf of the North Richland Hills City Council, do hereby proclaim the

Summarv:
Each April since 1981, the Office for Victims of Crime has helped lead communities
throughout the country in their annual observances of 'National Crime Victims' Rights
Week by promoting victims' rights and honoring crime victims and those who advocate
on their behalf. This week celebrates more than thirty years of progress in establishing
crime victims' rights.
General Descriration:
Until the last few decades, victims and their families were regularly excluded from
courtrooms, received no notifications about court proceedings or perpetrators'
whereabouts, and had few rights to speak at sentencing. Every state has now passed
victims' rights laws, every state has a victim compensation program, and more than
10,000 victim assistance programs have been established throughout the country. New
laws give victims the right to be present in court, to apply for compensation, to be heard
at parole and sentencing hearings, to be notified when offenders were released, and to
receive information about their rights and available services.
The North Richland Hills Police Department is joining forces with victim service
programs, criminal justice officials, and concerned citizens throughout Tarrant County,
the State of Texas and America to raise awareness of victims' rights and observe
National Crime Victims' Rights Week.

WHEREAS, 20 million Americans are victims of crime each year and each crime affects
many more, including families, friends and communities; and
WHEREAS, crime exacts an emotional, physical, psychological, and financial toll on
victims as they have lost loved ones, life savings, physical and mental health, and often their
sense of security that has the potential to irrevocably change the course of their lives forever;
and
WHEREAS, more than 30 years of progress for crime victims stands on the shoulders of
dedicated advocates and brave victims who overcame shame, isolation, and indifference to gain
a voice, rights, and respect; and
WHEREAS, we applaud the progress that our nation has made in recognizing crime's
impact on victims and celebrate advocates and survivors who through their determination
brought rights and resources for victims and have changed the course of history; and
WHEREAS, victim assistance programs across the country are reaching more victims
and criminal justice officials are honoring victims' rights more consistently, public understanding
of victims' rights remains minimal, and our nation's victim services system remains fragmented,
underfunded, and uncoordinated; and
WHEREAS, more work remains to be done to address the mental health impact of
crime, and to meet the needs of victims of non - violent crime, victims of terrorism, and other
underserved victims; and
WHEREAS, our history teaches us that, by working together, we can help victims of
crime reshape their destinies and ensure that they receive the support they need, the respect
they deserve, and the rights they have earned; and
WHEREAS, National Crime Victims' Rights Week, April 10 — 16, 2011, provides an
opportunity for us to reshape the future for victims by honoring the past and reflecting on hard -
won victories, and to recommit to working together to insist on better treatment for victims to
help them overcome the harm caused by crime; and
WHEREAS, the North Richland Hills Police Department is joining forces with victim
service programs, criminal justice officials, and concerned citizens throughout Tarrant County,

Summarv:
Geoff Sherman, Landscape Horticulturalist with the Parks and Recreation Department,
will recognize the Common Ground Founding Committee and the partners and
sponsors that contributed to the project.
General Descrir)tion:
The Common Ground Community Garden is a cooperative project between the City of
North Richland Hills Parks and Recreation Department and the Davis Memorial United
Methodist Church. The garden was constructed in November 2010 with the help of
volunteers, corporate sponsors and other partners. The Founding Committee, made of
enthusiastic volunteers, created the bylaws, policies, and rules for the garden. They
also created the Common Ground website which provides details and helpful
information about the project and organic gardening.
The garden has attracted tremendous community attention with all 72 garden plots filled
and crops already in bloom. Heavy tomato and pepper planting is going on right now,
and there is an abundance of lettuce, onions, cabbage and other mature, cool season
crops. Plot holders have also planted an array of herbs and colorful spring and summer
flowers. As the soil temperature increases this spring, the gardeners will also begin
planting melons and squash. The spring produce should be ready for harvest in mid to
late June.
The official ribbon cutting for the Common Ground Community Garden is scheduled for
Saturday, April 30, at 10:00 a.m.
Geoff Sherman and Councilman Turnage will recognize the Founding Committee,
partners and sponsors of the project including Davis Memorial United Methodist Church,
the Founding Committee, 'Birdville Independent School District, Keep NRH Beautiful,
and Alpine Materials.

Mayor Trevino called the work session to order at 5:16 p.m.
A.1 Discuss Items from Reaular Citv Council Meetina
There were no questions from the Council.
A.2 Update on Retainina Wall and Water Level at the Lake Adloinina the #2 Tee Box
at Iron Horse Golf Course
Mr. Jared Miller, Assistant City Manger, updated the City Council on the retaining wall
and water level at the lake adjoining the #2 tee box at Iron Horse Golf Course. A citizen
at the March 7 council meeting expressed concerns during Citizen Presentation with the
structural integrity of the retaining wall and fluctuating water level in the lake. Mr. Miller
advised that the retaining wall at #2 tee box was evaluated by an engineer in 2007 and
2010. The wall is not a load- bearing wall and the engineer found that the retaining wall
did not appear to have any structural damage, and is only aesthetically impacted by the
deteriorated or missing railroad ties. The wall has been identified as a future capital
project but based on severity of need is prioritized lower than several other scheduled
future improvements with higher needs. Council was advised the two lakes at
Meadowlakes were designed to irrigate Iron Horse. Water from the lower lake is used
to irrigate a portion of the course. The lower lake is replenished from two wells that
pump into the upper lake that then flows over the upper spillway into the lower lake.
The lower lake is constructed with an 18 inch high wall at the spillway. The lake is
designed so that the water levels will fluctuate within the 18 inches. Actual levels rarely
vary more than 6 to 8 inches. Mr. Miller advised that Staff has explained to the citizen
the irrigation procedures and fluctuation of lake levels. The citizen was also informed of
the integrity of #2 tee box and future improvement plans.

Mayor Trevino announced that items C.1 Public Hearing ZC 2010-05 Changes to the
Town Center Regulating Plan and Zoning - Ordinance No. 3133, C.2 Public Hearing ZC
2010 -05 amending the Thoroughfare Plan within the Home Town - Ordinance No. 3134
and Executive Session Item B.1 Consultation with Attorney regarding Pending Litigation
including Possible Settlement were related and Council would be discussing all three
items together. Mayor Trevino opened the public hearing on ZC 2010 -05 Ordinance
No. 3133 and ZC 2010 -05 Ordinance No. 3134 and called on John Pitstick to come
forward.
Mr. Pitstick, Director of Planning and Development summarized the item. The City
Council voted unanimously at the May 24, 2010 City Council meeting to direct staff to
draft updated regulations and set public hearings before the Planning & Zoning
Commission on amendments to the Town Center zoning district. The Council
requested that all areas of the ordinance be reviewed and for the Planning & Zoning
Commission to recommend changes to the TC District. Recommended changes could
include but not be limited to the creation of density caps, clarifying mixed use building
types, defining minimum building standards, clarifying architectural elements and
removing requirements for Special Use Permits for multifamily development. The
Council also stressed that the public was to be fully involved with Town Center zoning
changes. The Planning & Zoning Commission has conducted eight work sessions,
seven formal public hearings and four citizen stakeholder meetings over the past ten
months.
Mr. Pitstick presented the comparison of density requests including the original special
use permit request in 2008 by the developer that was denied and the recent developer
compromise with the latest City compromise regarding total remaining allowed
residential units for the east side of Horne Town.

Public input and concerns also prompted staff to search for consultants in the areas of
traffic congestion, school impacts and impacts of the proposed development on existing
single family home values.
The following consultants performed the community impact studies:

Mr. Pitstick introduced Craig Hulse, Economic Development Director. Mr. Hulse
advised that during the public hearings concerns were raised regarding impacts on
property values. After a careful search, GideonToal was selected to perform the
economic impact study. Mr. Hulse introduced Mr. David Pettit and Mr. Steven Pepper
from GideonToal who gave a brief PowerPoint presentation regarding review of national
studies and a multiyear Tarrant County wide analysis regarding the affects of
apartments on surrounding single family neighborhoods.
Summary conclusion of propertv value impact study:
• The proposed expansion to Horne Town would successfully fill gaps in the
current real estate market.
- With the exception of retail, which would have to be supported financially by
the multifamily development.
• Updates to the proposed zoning ordinance would provide the City of North
Richland Hills and Home Town residents with significant protection against
substandard housing development.
• No evidence was found that the development of multifamily housing has a
detrimental effect on adjacent property values.
- In relation to Home Town, the addition of 293 townhomes priced at an
estimate of $155,000 and the 950 multifamily units with an average rental
rate of -$1,000 per month would not meet any threshold criteria to reduce
the quality of life and thereby property values in the neighborhood.
Mayor Trevino called on Mike Curtis, Managing Director of Development Services to
come forward. Mr. Curtis spoke on traffic impact study performed by consultant Kimley
Horn & Associates. The consultant reviewed the proposed Thoroughfare Plan which
includes similar street types and sections that were approved with the original
Thoroughfare Plan for Home Town however; there are two (2) significant differences.
The two differences are associated with the minimum "on street" parking widths and
street widths. The original Thoroughfare Plan included minimum residential two -way
street widths of 24 feet. The proposed plan has increased the minimum widths of
residential two -way streets to 27 feet wide (3 feet wider than what was previously
approved). The minimum "on street" parking width was increased from fi feet to a
minimum of 7.5 feet and as much as 8 feet wide (depending on the street section). Mr.
Curtis introduced the consultant Brian Shamburger with Kimley Horn & Associates. Mr.
Schamburger presented a PowerPoint presentation summarizing the traffic analysis
performed.
Traffic Impact:
• The proposed development will generate approximately 15,200 trips per
weekday
• With the exception of the intersection of Hawk Ave. and Ice House Dr., the
internal Home Town roadway system (per the proposed Thoroughfare Plan) will
adequately serve the development at build out
• Street and Intersection impacts are measured by Level of Service (LOS)
• Current signalized intersections will see no significant change in LOS
- Bridge Street & Davis Blvd.
— Mid Cities Blvd. & Winter Park
— Blvd. 26 & Walker
• The following un- signalized intersections will be affected:
— Blvd. 26 & Parker Blvd.
— Mid Cities Blvd & Cardinal Ln.

— Per the elementary school's current traffic plan, pick -up and drop -off for the
existing elementary school should occur on the east side of the school
along Hawk Ave
— The existing elementary school does not have sufficient parking to
accommodate special events (e.g., recent Grandparents Day before
Thanksgiving)
— Utilize the BISD High School parking lot or parking from adjacent future
developments for overflow parking and shuttle attendees to and from the
school using Ibuses
Mayor Trevino called on Mr. Pitstick to discuss the impact on the elementary school.
Mr. Pitstick stated that there was no impact to the elementary school. The school had
adequate space to accommodate the possible addition of students.
Mr. Pitstick continued with the recommendation of the Planning & Zoning Commission
and how it varied from staffs recommendation. Both recommendations approved the
Town Center zoning revisions, regulating and thoroughfare plans and density caps with
the exception that P &Z is recommending a reduction of 130 apartments within Tract 1
and Tract 4.

It is important to note that the Planning & Zoning Commission has not been involved in
any negotiations or legal settlement issues and made their recommendations solely
from public hearing input. The Planning & Zoning Commission also made their decision
without knowing of any potential concerns regarding development controls as a result of
property owner opposition. Staff is recommending approval of the Town Center zoning
revisions with the density caps as presented.
Staff recommends approval of ZC 2010 -05 with the proposed text revisions and density
caps as presented by City Staff which will require a simple majority approval. Any vote
approving the P &Z Commission's recommendation will require a 314ths vote by City
Council to approve based on protest letters from the affected property owners.
Mayor Trevino called on Art Anderson representing the developers to come forward.
Mr. Art Anderson, 1201 Elm Street, Dallas came forward. Mr. Anderson represents the
owners of the undeveloped land in Home Town. He advised that the zoning at Home
Town had been under dispute for the last three years. He stated that after notifying Mr.
Staples, City Attorney that pursuant to Rule 408 the corrected density rules which were
transmitted to the firm on March 23, 2011 and the staff recommendation as presented
by Mr. Pitstick this evening are acceptable in settling the pending 'lawsuits. Any
changes to the recommendation are not acceptable and will not resolve the litigation
between the parties.
Mr. Dan Quinto, 602 Northwood Trail, Southlake came forward to speak on behalf of the
developers. He thanked the Council and staff for their patience and commitment in
bringing this issue to a conclusion. Mr. Quinto stated that Realty Capital called him
three years ago to assist them with a project but really this began thirteen years ago
when a proposal was presented and enthusiastically endorsed by the community. For
several years this worked very well, but with a difference in market conditions, private
perceptions and public perception created conflict. Mr. Quinto commented that good
developers are not those that do what others ask them to but are those that use the
market forces to squeeze out an exceptional project without going broke. Arcadia has
delivered just that and the current plan before Council is a good one. The combination
of current regulations, plus the past track record of these developers plus the City's
commitment to quality will prove to be a winning combination making this a new and
vibrant phase of Home Town.
Mayor Trevino called for anyone wishing to speak on the requests to come forward.
Mayor Pro Tern Sapp advised that there were requests to speak and called on each to
come forward and speak..
The following individuals spoke in opposition of staff recommendation but were in favor
of upholding P &Z's recommendation citing the original Home Town concept did not
include that many apartments, increase of traffic through the neighborhoods, increase in
crime, lower property values and a waste of time attending city public hearings if the
recommendation made would not be upheld.

Mayor Trevino again called for anyone wishing to speak for or against the requests to
come forward.
Max Jennings, 8632 Riverdale Drive, came forward. Mr. Jennings asked for clarification
on why staff chose to make a different recommendation to Council and not uphold the
P &Z recommendation. Mayor Trevino advised that at the closing of the public hearings
he would have Mr. Hindman, City Manager answer the question.
Kathy Jennings, 8632 Riverdale Drive, came forward. Ms. Jennings wanted Council to
clarify how a developer could have so much power against the city government that has
zoning regulations and still get their way. Mayor Trevino advised that once the public
hearings were closed he would have Mr. Staples answer her question.
Jennifer Mathews, 5813 Lake Way, came forward. Ms. Mathews stated that the
difference between the two recommendations was only off by 130 apartments and
would like to hear from the developer if any concessions could be made to reduce
staff's recommendation by 10, 20 or 30 units. Mayor Trevino stated that after the
closing of the public hearings he would have Mr. Hindman comment on the additional
concessions the developer is willing to make and what it would cost the City for those
concessions.
Mayor Trevino closed both public hearings and called on George Staples.
Mr. Staples gave a basic understanding of what is called Vested Rights law. Mr.
Staples advised that municipal law is very difficult because the Legislature is constantly
changing it. Texas is the most developer friendly state in the nation. The Vested Rights
Statute states that if a preliminary plat is filed you cannot change the regulations that
apply to that plat. The City of North Richland Hills has one of the very first of the type of
ordinances that Home Town represents. It is missing many of the controls and
provisions that are in ordinances drafted later. An example of this is density controls -
there are no density controls in the current ordinance, which is a major problem the City
has to work with. If the City approves the settlement agreements, this will provide that
the developers vested rights are waived for anything that existed prior. All their vested
rights will exist by virtue of the ordinances that are approved tonight. If the City does
not approve the settlements that has been worked out through staff's recommendation
and decides to approve P &Z's recommendation then the developers will not settle.
Under the Texas Vested Rights Statute, the developers will have the opportunity to pick
and choose from the existing regulations and the amended regulations basically giving
them the best of both to pick from.
Mr. Mark Hindman, City Manager stated that there had been a significant amount of
compromise on both sides of this issue. He briefly spoke on reasons for those
compromises and stated that staff liked the P &Z recommendation but if having to
choose between the P &Z's recommendation and continuing on with the lawsuit the City
would strongly recommend that Council consider adoption of the staff recommendation.
The City did not feel like the trade of 130 units for the loss of quality controls would be a
good trade for the neighborhood. The City has been discussing this for last four years
and would Like to see the project move forward.
Mayor Trevino called on Mr. Art Anderson to answer Ms. Mathews question.
Mr. Anderson came forward and stated that his clients have given significantly in order
to make this compromise happen and where they are today is the best we are going to
get.
Councilman Whitson left the Council Meeting at 9:06 ,p.m. and returned to the dais at
9:09 P.M.
Mayor Trevino announced that he wanted to take a few minutes to thank the residents
who have participated in the process over the past ten months. The residents have
spoken at public hearings, sent emails, sent letters, taken surveys, made phone calls,
had small group meetings, and spoken directly to himself and other members of City
Council. He acknowledged that their comments and concerns have been heard and
appreciates their participation and patience. He wanted to thank the Planning and
Zoning Commission and City staff for all their hard work during this process and helping
bring this to a solution. Mayor Trevino advised that he also liked the P &Z
recommendation but Council needed to keep in mind the lawsuit. The risk of spending
more tax payer money and the possibility of the court system siding with the developer
was to great of risk to gamble on.
Mayor Trevino called for a motion.

Backaround
The Texas Election Code requires that election orders and notices list each early voting
location. At the time the City Council approved Resolution No. 2011 -003 ordering the
election, the early voting locations to be used throughout Tarrant County for the joint
elections were tentative. The locations could not be finalized by Tarrant County until
after the March filing deadline to allow those entities with unopposed candidates the
opportunity to cancel their elections. Tarrant County has now finalized the list of early
voting locations. Resolution No. 2011 -020 amends Resolution No. 2011 -003 by listing
all early voting locations to be used throughout Tarrant County for the May 14, 20111
joint election.

Summarv:
At the March 28, 2011 City Council Meeting, Council formally approved a settlement
agreement between the City and Arcadia Land Partners 25 LTD /Arcadia Holdings. One
of the items included in the settlement agreement provides for the City to purchase a
4.793 acre tract of land in the Town Center District as a future location for the Tarrant
County College performing arts center
General Descriration:
The City of North Richland Hills agreed to several conditions as part of the lawsuit
settlement agreement approved by Council on March 28, 2011. In order to meet
several of these conditions it is necessary to revise the current year operating budget.
One of the conditions in the settlement was the purchase of the land where the future
Tarrant County College performing arts center is planned to be located. This property is
identified as Tract 6alb on the attached Town Center District map. According to the
agreement, Arcadia will sell the City this 4.793 acre tract for $887,328. In addition to
the land price the City will incur some customary closing cost expenses, bringing the
total estimated cost to $900,000.
Funding of $8,213,279 for the performing arts center is designated in the financing plan
for Tax Increment District #2. In conjunction with construction of the performing arts
center, part or all of this property will be resold to Tarrant County College. Funds for
this purchase may come either from the TIF or other TCC funding sources. According
the settlement agreement, property that is not needed for the performing arts center
may be repurchased by Arcadia for commercial development purposes at the same
price that it is being sold to the City. This repurchase option for Arcadia will expire in
seven years.
It is recommended that Gas Development Fund reserves be used to meet this financial
obligation. Sufficient reserves have been accumulated in the Gas Development Fund
over the last four or five years. This type of expenditure meets the guidelines that have
been established for uses of gas development revenues. Once the performing arts
center property is sold the funding can be returned to the Gas Development Fund.
Recommendation:
Revise the FY 2010111 Operating Budget by appropriating $900,000 in Gas
Development Fund reserves to acquire a 4.793 acre tract located in the Town Center
District as a future location for the Tarrant County College performing arts center.

Summary: The applicant, Ben Johnson of Johnson Diversified Enterprises, Inc., is
requesting an amended plat for West Hightower Place to change the side yard setbacks
from 1 and 9 foot setbacks to 5 and 5 foot side setbacks as a follow up to recent zoning
approval for a R -PD Residential Planned Development revision which allowed front
entry garages.
Background: West Hightower Place was originally approved in 2007 under a "R -PD"
Residential Planned Development for 96 lots with some alley served and a majority of
rear detached garages. Mr. Johnson recently received approval from City Council to
allow a change for a total of 59 out of the total of 96 lots to have front entry garages. As
a result of this zoning approval, Mr. Johnson is requesting to change the side yard
setbacks to 5 and 5 feet on the 59 lots and also incorporate a small amount of common
open space on 5 corner lots to allow for side entry garages on these lots. The major
open space common areas would still be maintained, including 17% of the subdivision.
Section 110 -291 of the City of North Richland Hills Subdivision Regulations requires all
amended plats to first be approved by both the Planning and Zoning Commission and
the City Council. The section does not provide for any administrative authority on behalf
of the staff to circumvent this process. This is being considered as an amended plat
because there is no change to the total lots, only to the setback lines.

The application has included a stipulation in the revised R -PD for all front entry garages
to be setback a minimum of 5 feet behind the main building and that all front entry
garages have two single garage doors with doors made of wood or simulated wood with
raised decorative accent panels to mitigate the front entry product.

WHEREAS, notice of a hearing before the Planning and Zoning Commission was sent

Chairman Shiflet opened the Public Hearing and asked the applicant to come forward.
John Kemp, 4905 Nevada Trail, NRH, came forward stating a request to rezone from
Agricultural to Residential to build a future home there.
Chairman Shiflet asked if he planned on building the home soon?
Mr. Kemp said yes, as soon as he gets everything approved he plans on building.
John Pitstick came forward stating this is less than a half acre changing from AG to R -2.
This parcel previously had a manufactured home on it and he wants to build a typical
modern single family home. Our Comprehensive Plan shows R -2 so we are in support
of the request. This request encompasses two adjacent platted lots for the application
and there is also a replat with this. This parcel is currently platted as Lots 18 and 19 of
the Thomas Peck Subdivision and Staff recommends approval of this request.
Chairman Shiflet asked if anyone else wished to come and speak for or against. Seeing
none he closed the Public Hearing and entertained a motion.

Summary: Mr. Pritesh Patel has purchased 8 acres on Clay Hibbins in order to build a
large residential estate and is requesting a zoning change from R -2 to RI -PD to allow for
proposed improvements of a large Mediterranean style stucco home with a pool house,
greenhouse and guest quarters.
Background: Don Phifer is the applicant representing T Pearl Real Estate and Mr.
Pritesh Patel in a zoning case from R -2 to RI -PD. Mr. Patel wishes to build a large
residential compound with guest quarters on 8 acres on Clay H'ibbins with several
amenities including a guest house, green house, large pond and volleyball court. This
residential use would typically be allowed in the R -2 single family zoning district.
However, Mr. Patel wants to build a Mediterranean style stucco house which does not
meet our current masonry standards; wants to build guest quarters to allow for
additional temporary living and also needs a building height variance. Staff was
encouraged about the potential construction of quality residential development and
encouraged the applicant to consider a planned development that could be considered
on its merit with the provision of a site plan, building elevations and listed amenities to
mitigate any requested variances. Since the property is residential and under 10 acres
the applicant chose to request a RI -PD Residential Infill Planned Development.
The purpose of the residential infill (RI) PD district is to encourage residential
development of small and otherwise challenging tracts of land by offering incentives that
encourage creative and inventive development scenarios. Residential Infill (RI) PD
Districts shall be limited to residential development or redevelopment of less than ten
acres and shall not be allowed without an approved site plan. Developments shall not
vary from R -2 residential district standards unless amenities and design elements are
provided in lieu of such standards and are reflected on the required site plan.

In evaluating this request based on the R2 standards, the applicant is clearly exceeding
the typical residential home and providing significant improvements in quality and value.
The 8 acre site will be surrounded by a masonry and wrought iron screening fence with
concrete and stamped concrete entryway and circle. There is an existing rock water fall
that will be removed and the reduction of an existing pond adjacent to the Steeple Ridge
subdivision. The applicant is proposing to build a 3 story Mediterranean style stucco
home with a Spanish tile roof. The main house is a three story, 26,000 square foot
home with an indoor courtyard. The site plan indicates an 8,000 square foot pool house
with guest quarters and 12 car garage. All structures will be 100% stucco with tile roofs.
Building articulation is being provided and window headers and sills will have an
appearance of cast stone.
The proposed development is a high quality development with substantial open space
and setbacks from surrounding residential properties. While this is a different
residential development than is typical for our community, staff feels that the proposed
development will provide value for the area.
Because of the size of the main house and the number of multiple bedrooms (16
proposed bedrooms), staff has also requested that a maximum number of unrelated
guests that would be allowed to temporarily occupy the residence be specified as part of
this planned development. Current regulations stipulate that any number of persons
related to each other by blood, marriage or adoption is allowed in a single family
residence. In addition not more than four persons unrelated can live together in a single
family residence. The applicant has stated that no more than 4 unrelated guests would
be allowed to temporarily occupy the residential compound in compliance with the
definition for family. This should clarify that the primary use is for single family
occupancy with limited guest quarters. The applicant will have to comply with all
improvements listed on the site plan and would not be able to make changes without a
revised site plan which would require additional notifications and public hearings.
Public Hearing input: Two area residents spoke at the P &Z public hearing with
opposition to the large residential compound being proposed and concerns about the
general upkeep of the area (high grass and weeds); concerns over the need to improve
the existing deep drainage structure adjacent to Steeple Ridge; and the condition of the
pond.
Planning & Zoning Recommendations: The P &Z Commission met on March 17,
2011 and recommended approval by a 5 -0 vote.
Staff Recommendation: Approval of ZC- 2010 -11 and Ordinance No. 3136.

PD Single Family. It is the intent of the Applicant to rezone the property for the development of a single
family residence for Mr. Patel similar to the estates seen around Westlake, Keller, 5outhlake and
Colleyville.
The property is to be developed with a single family resident of approximately 25,000 square feet with a
stucco finish and tile roof (Santa Barbara or Mediterranean Style Architecture) that will be 3 stories with
a height of 44 feet from the finished floor to the peak of the roof. There will also be 2 additional
structures a combination garage /indoor pool being approximately 7,950 sq. feet that will he attached to
the house by spray of a breeze way and a future accessory building that will have guest quarters, storage
and an area to entertain being approximately 6,545 sq. foot Along with the 3 structures, the property
will have a lighted volleyball court and a future green house to be located on the southern end of the
property.
Currently the property has an old stone column and wrought iron fence that will be replace with an 8
foot screening wall along Clay Hibbins Road. The screening wall will be constructed as a solid masonry
wall along the west property line with a secondary gate on to Clay Hibbins. The fence along the north
property line will he constructed with masonry columns and wrought iron which will also be 8 foot in
height. In addition there will be evergreen landscaping spread among the wrought iron sections of the
fence. The north property line will also have the main entrance gate that will be set back as to allow
vehicles entering the property to pull off the road. The gates will also be equipped with the necessary
access devises required by the Fire Department
Currently the property has a large pond of approximately 1.2 acres that will be reduced In size to
approximately .78 acres and the waterfall will also be removed. A circulation system with a sprayer will
be installed to prevent any stagnation In the pond. In additional the owner has agreed to lower the
water level by approximately 2 feet due to City and adjacent neighborhood concerns.

The applicant is asking at this time that he be exempt from submitting a landscape plan since the tract is
8 acres and the considerable open space and the majority of the trees are being preserved. It is the
owners intent to Landscape extensively, but a landscape architect has not been retained as of yet to
develop a plan. I would also like to add that the site is being developed in such away to retain much of
the run off in the pond and utilize the pond and the water well on site to irrigate the entire 8 acre site.
Regarding property lighting, the property will have the necessary lighting at the entrance gate and along
the driveway and around the garage. in addition the property will have lighting around the volleyball
court and the pond. A Iighting plan will be developed and submitted to the city for approval, but is not
available at this time. The property owner is certainly aware of concerns from the neighboring property
so all the lighting will be in such a way as to not to intrude on the neighboring properties.

Public Hearing and Consideration of a Request from Don Phifer for a Zoning
Change from R -2, Single 'Family, to RI -PD, Residential Infill - Planned
Development, on Tracts 13A1 & 13B1, Abstract 1209 (located at 8700 Clay Hibbins
Road — 8.001 acres.)
Don Phifer, 8360 Thornhill Drive, NRH came forward on behalf of T Pearl Real Estate to
request a zoning change from R -2 to RI -PD, 8700 Clay Hibbins Road. He said they had
originally suggested rezoning to R -1 S, but due to the unique nature of the property and
the requirement for the Special Use Permits, the Staff and City Attorney suggested they
request RI -PD.
Don Phifer said the property is located on the far northwest corner of the City on Clay
Hibbins, one side abutting Steeple Ridge and the City of Keller. The property was
previously proposed as a subdivision at 19 lots, that developer dropped it and his client
bought it. He looked at doing an eight lot subdivision, then a four lot subdivision, but
after we worked with Staff and looked at the issues affecting the property we finally
yielded to a one lot subdivision with a very large house unique in its nature.
The site plan shows the house at 12,000 sq. ft. but that is the ground floor and not the
square footage of the Ihouse. The total square footage of the house 26,688 which
includes a 3 story home, stucco with a Mediterranean style with red clay tile roof. It will
have about a 7,980 sq. ft. garage for twelve cars, swimming pool, sauna, volleyball
court and other amenities. In addition, we are proposing a future guest house /storage
facility that can go up to 6,545 sq. ft. but all we are requesting at this time is the City
approve that we can build it. No elevations are being submitted at this time. We realize
at the time we want to build it, we will come back to the City with all the architectural
renderings for the approval at that time. The proposed construction of the guest house
would also be of Mediterranean style with stucco and red tile roof. The proposed
driveway has three concrete crossings stamped in colored concrete which includes a
stamped and colored concrete circle drive leading up to the front over to the garage
area. The fence will be an 8 ft. masonry wall around the west property line along Clay
Hibbins to provide barrier between house and garage and street. Along the north side
there will be masonry columns with 8 ft. wrought iron fence with gated entrance.
Around the south and east there is currently a pipe fence in place, he is proposing to
keep the fence and heavily landscape with evergreens along the two property lines to
provide site barrier for neighbors. There will be a drainage swale going in that will be
landscaped with evergreens.
Don Phifer said the large stock pond on the property was not constructed by his client.
There is some history on the pond; it was constructed without City approval or
supervision along with a massive waterfall. The City has had considerable concern
about the pond and the quality of the dam because the drop inlets elevation is two foot
higher than the finish floors of the houses to the east. His client is proposing to go in
and take out the entire south end of the pond and fill it in. A new dam will be created on
the south border and drop inlet will be lowered two foot to get to satisfactory level for the
City, the waterfall will be removed. Once the waterfall is removed, sprayers will be
installed for circulation, the island will stay with bridge going over to it.
The existing barn on the property is going to be left during the construction phase of the
house for storage of materials, once the house and garage completed, the barn will go
away, as will the pump house on the front of the property on Clay Hibbins next to the
pond.
Don Phifer said we have maintained a lot of open space on the property, there are a
large number of trees on the building pad, almost all the trees will be maintained. The
last grading plan he saw that the engineer prepared had a total of 12 trees will be
removed and all due to construction for transitioning the grades. But we are working
very diligently to maintain every tree on the property.
Regarding the drainage, most of it drains to the pond, the pond catches a lot of the
water. Though there is water that drains to the south of the pond and comes down
towards the homes in Steeple Ridge, there is also water coming from the south heading
north that gets into Steeple Ridge. The draining plan we are creating will have a swale
between the property line east of the proposed future guest house and it will catch the
majority of the water and take straight into the pond. For overflow there is a large inlet
in the pond that is piped out to another drop inlet in the Steeple Ridge subdivision. So
any excess water will have relief if the pond fills up to keep it off the neighbor's property.
The culverts and drains around the street will also be improved.
Don Phifer showed pictures of the house and elevations which has a 44 foot roof from
the finish floor. The primary residence will be located 280 foot from the eastern property
line so it is well away from the houses in Steeple Ridge and will not impede upon them
or their backyards. The proposed guest house is 120 foot from the east property line,
well away from the houses and will not impede upon their privacy. It is 150 foot from
the south property line and the land is undeveloped at this time. The house will have a
lot of glass and windows and be in creme color.
Steven Cooper asked about the pump on the south end of the property and if there was
an old well on the property?
Don Phifer said there are two separate issues. There is an old deep well we intend to
maintain as support for the pond because the property will be irrigated by the pond and
we need the well to make sure the pond stays full. It is located near the barn on the
property. He said the pump house is absurd as there is a 50 horsepower pump in the
house that pumps water into a 24 inch pipe for that waterfall.
John Pitstick said this is an 8 acre development request from R -2 to RI -PD with several
amenities including guest house, green house, large pond and volleyball court. The
purpose of the residential PD is to encourage residential development of otherwise
challenging tracts of land by offering incentives that encourage creative and inventive
development scenarios. Staff felt this was the best way to handle that. It would be
limited to residential development or redevelopment of less than 10 acres and not be
allowed without an approved site plan. The development shall be based on the R -2
residential standards unless amenities and design elements are provided in lieu of such
standards and are reflected on the required site plan. There are three specific
variances from the R -2 standards. The building height of 44 feet, typically we only allow
35 feet. All stucco buildings whereas typically we would required all brick or stone, and
a residential compound with guest quarters. The City considers this not a multi - family
district but to allow for the guest quarters. The applicant is clearly exceeding the typical
residential home providing significant improvements and quality and value. The 8 acre
site will be surrounded by masonry and wrought iron fence with stamped concrete entry
way. The existing rock water fall will be removed and reduction of existing pond
adjacent to the Steeple Ridge subdivision. All structures will be 100 percent stucco with
tile roofs typical for the Mediterranean style, building articulation being provided with
window headers and seals with an appearance of cast stone. The proposed
development is a high quality development with substantial open space and setbacks
from surrounding residential properties. Staff feels it will provide value for the area and
does not consider this a multi- family request, but a large single family home with the
ability to have guest quarters for temporary residence of guests. The applicant will have
to comply with all improvements listed on the site plan and not make changes without a
revised site plan which would require additional notifications and Public Hearings. Staff
recommends approval.
Chairman Shiflet said he wanted to clarify the 38 ft. for maximum?
Steven Cooper asked if the guest house would be built later?
John Pitstick said yes he has to provide everything and build to these standards
presented, but it the guest quarters would not have to be built immediately.
Chairman Shiflet asked when would be green house be built?
John Pitstick said he didn't know, they intend to do it but no elevations are available.
Chairman Shiflet opened the Public Hearing and asked if anyone wished to speak for or
against?
Greg Powell, 8801 Trails Edge Drive, NRH at the property to the immediate northeast
corner of the proposed property. He opposes the property development because he
thinks the home looks like a hotel, box structure, 3 stories tall, 38 feet high and the roof
possibly 44 feet tall. He feels for this type of structure in this community is more
overpowering than any commercial building in the area. He has concerns with the
drainage easement because it is a twenty foot wide by close to 18 foot open pit with 4
foot open pipe which allows animals or 'kids to go into. The only reason this was left
when Steeple Ridge was developed was for the property behind us to tie into and
provide drainage. He feels all of the drainage from this lot will go into the pond and to
the channel; it is a health and safety issue for the City that needs to be addressed.
They have talked with the City Staff a few years ago when this was rezoned and was
supposed to be addressed with that development. This is the only opportunity to
eliminate this problem. He said if you don't have a rope to pull yourself out you cannot
get out of the pit. He said this development will cause the pond behind them to funnel
more water into it, reduced size to about half of what is currently is, causing to overfill
faster than ever before and all coming out of the two pipes that were bootlegged in by
the previous owner to fill into the pit. He feels it is very dangerous and not engineered
properly. The pit should be enclosed and covered up, connected to by the pipe and
extend to their property.
Steven Cooper asked for clarification where the pit was located?
Greg Powell said the pit has no drainage that goes to it across the back of his lot except
for water that comes off of the property behind me through a little swale. All the water
comes down Clay Hibbins and currently channels past it so that all the water coming in
is going to that pond. It was said that area of the existing pond will be filled in so the
volume of water and levies will be reduced by half. He said he works for a developer
and has been in this field for thirty something years and has some experience here
knowing what can happen. Other issues exist with water coming between the houses in
Steeple Ridge and needs to be addressed.
Don Bowen asked Staff who owns the pit in question?
Mike Curtis said he was here when the Steeple Ridge development went in and the pit
belongs to the City of North Richland Hills. At the time of the subdivision went in it was
planned and anticipated that the property in question would develop as a typical
residential subdivision so there would be no pond. The requirement when Steeple
Ridge went in was they needed to put in a drainage system that would be able to accept
the future drainage. What is happening in this situation is that it is not developing like
Steeple Ridge and the detention pond will remain. From an engineering standpoint
there is no need to reconstruct and enclose it. iPart of the final construction plans for
this development will be for the engineer to prove up that the amount of water that is
discharged to the detention pond will be able to accommodate the water and no more or
additional runoff from the pond is going to occur than what the system was designed to
carry. With it being a closed system it was designed to carry the 100 year storm. The
system that it is going into has the capacity and for the benefit of those not here today,
the size of the pond isn't the main issue, it is the capacity of the pond. One of the things
they are talking about doing is lowered the spillway elevation by two feet and it will lower
the water surface elevation but does not mean it will reduce the capacity of what the
pond can handle. The difference between the spillway elevation and what the additional
runoff that the pond can handle is what would be discharged into the system. As long
as that does not exceed what the system is designed for it would work. It is completely
fenced and is steep just as the pictures show. When it was put in, it was not the final
plan. The final plan was there would not be the detention pond.
Chairman Shiflet asked when this came up a few years ago and discussed then, was
there something that we were doing to make that safer? What if anything was done
after those discussions?
Caroline Waggoner answered and said there are two issues, one is the pit. When the
previous developer was coming forward with the proposed 19 lots we met with everyone
and that was in the wake of the 2007 storms and flooding. At that time with the
development they were talking about enclosing the pit. The pond there was never
intended to be a detention pond, it developed as a pond for aesthetic reasons, the storm
drain system in Steeple Ridge at the northwest corner was designed for the 100 year. It
has the capacity it is just the matter of getting it into that system. What is happening
over time is even though Steeple Ridge is designed to intake the 100 year, at some
point the water is not getting to the pond. It is bypassing the pond to the south and
getting to Saddle Ridge Trails through some flumes. One of the things we talked about
doing a few years ago was putting in some flumes to intercept that run off that is not
making it to the pond that would carry the water into the flumes and get them more
safely into Saddle Ridge Trail instead of through the back yards. We have been
working on this from an in -house design standpoint throughout this process and in order
to construct those we needed easements from the Steeple Ridge residents. Something
that has happened in the past is the property to the south of this 8 acre tract came in
and platted last year, when the plat occurred we were able to obtain a drainage
easement on that property. Now as this property is coming in we are looking at getting
a drainage easement on this which would allow us to potentially move forward with
those intercepting flumes which will help ease some of the drainage concerns of the
Steeple Ridge to the south of the pond.
Don Bowen asked does this applicant have any responsibility to get rid of the pit?
Caroline Waggoner said because the pond is not going away, there are some
modifications that are absolutely going to happen. Since it was put in without
supervision and it has pipes not up to standard, it will have to be upgraded. As is sits
today, we do not have final plans approved, so we don't know if they will include
enclosing the structure at this point. They don't have to from a drainage standpoint; it
would not be required to convey the runoff from the pond through an enclosed pipe and
essentially serves as an open junction box.
Chairman Shiflet asked if it was fenced?
Greg Powell said yes, with a chain link fence and the homeowners have put wooden
fences around the chain link to screen it from kids. He said the Staff has been great to
work with and correct. When saying it doesn't have to be enclosed for the pond to
dump into it and flow out, there is a large open pipe. He feels the best scenario from a
safety standpoint is extend the pipe and come to inlet structure on the new property and
close in the pit, it is not needed for volume.
Mr. Skiles, 8633 Saddle Ridge Trail is located directly behind the pond where the island
is and has an issue with the strip of land where the pond meets the fence that is not
maintained. There are many rodents and snakes that have been an issue in the past.
He asked when the dam would be coming down? They have had no issues with
drainage at their home.
Chairman Shiflet said they didn't know when the dam was coming down. If this is
recommended to go forth, then Staff will help work with the residents to help not add to
the existing problems.
Steven Cooper asked who owns the strip that is not being maintained?
Mr. Skiles said it was the property owner of this development.
Chairman Shiflet asked Caroline Waggoner about the small tract of land and drainage
easement through there been resolved?
Caroline Waggoner said it has not been resolved and it actually in a location not quite
as critical. It is south of the area suffering the most at that point the drainage is heading
north mostly and once you get past the small stock tank the topography shifts from a
south to north slope to west to east slope and at that point it is really trying to enter the
yards. She said this issue does not come into play on this request.
Chairman Shiflet asked if anyone else wished to speak for or against? Seeing none he
closed the Public Hearing and entertained a motion.

Chairman Shiflet said he wanted everyone to understand the proposed main structure is
almost a football field away from the property line and they are only requesting to go six
feet taller than what they can build if they were building a subdivision directly adjacent to
the houses. The distance is not that noticeable.

Committee has reviewed the plat and has determined that it complies with both the

The developer is required to extend a public water main to within the frontage of the lot
per City of North Richland Hills design standards. The applicant is requesting to waive
the water main extension requirement in order to pursue a tap onto the City of Keller's
existing 2" water main. Because this request is not in conformance with the subdivision
requirements, and involves connection to the water distribution system of another
municipality, City Council must approve this appeal.
Note that as an alternative to the applicant hiring a bonded contractor to install the new
6" water main, the Public Works Department provided an option wherein the applicant
would pay for materials Oat a cost of approximately $3,400) and the Public Works
{operations forces would install the water main. The applicant has indicated that he
does not wish to pursue this option and has included a letter requesting to tie to a 2"
Keller water line. Staff is supportive of the requirement to tie to the NRH water system
to encourage the conversion of manufactured homes to the continued building of single
family homes along Franklin Court with a long term reliable water system.
Planning & Zoning Commission Recommendation: The P &Z Commission met on
March 17, 2011 and voted 5 -0 to recommend approval of RP 2010 -07 as recommended
by staff.
Staff Recommendation: Approval of replat request RP 2010-07 with the stipulation to
tie onto the City of North Richland Hills water main. (Kemp's providing cost of materials,

In regards to the water supply for 8432 Franklin Court, we understand we have
two options. First, to use the current water source that is already on the property
provided by Keller. Second, we have been provided with an estimate and plan for
installing a water main from Shady Grove to the property line at 8432 Franklin Court that
is to be constructed in May 2011.
We would like to use our first option and use the Keller water source. We do not
plan on waiting until May (or possibly much later by the end of construction) to initiate
our building permit and begin the building process. We want to get started as soon as
possible and feel the only sensible option is to use the line that is already serviced to
the property. We do understand that if using the Keller water source is not approved
then we are required to go with the North Richland Hills plan, which is less than optimal.

John Kemp came forward and addressed that there is already as existing tap and meter
located on the property belonging to the City of Keller. With permission he is requesting
to use that meter to save money and start building immediately as opposed to waiting
on Public Works scheduling for installation of a new meter.
There was a discussion and clarification about the applicant and the Public Works
Department working out an agreement with the tie on.

These two projects will consist of drainage improvements such as expanding and re-
grading barrow ditches and the replacement of existing culvert pipe along both
roadways. Some minor pavement improvements will also be necessary to match the re-
graded barrow ditch elevations. Attached is a map of the project locations.
The current drainage systems have been in place since the 1960's. The existing culvert
pipe and ditches are inadequate in size to carry the storm water runoff. As a result
several properties along both of the roadways have experienced flooding.
Staff followed the city's policy for procuring professional services for the design of these
two projects. Requests for Qualifications (RFQ 11 -014) were advertised and sent to
local engineering firms; 26 firms responded by submitting Statements of Qualifications
(SJQ's) to the City. The selection committee reviewed the SQQ's and is
recommending Teague Nall and Perkins (TNP) for this project.
TNP has over 34 years of municipal engineering experience and has extensive
experience in the design of drainage improvements. They have put together a design
team with a project manager that has over 25 years of experience. The firm is
committed to delivering a design that meets the city's expectations.
The scope of work for this project is outlined in the engineering agreement in Exhibit B
(Basic Engineering Services) and Exhibit C (Special Engineering Services). Listed
below is a summary of the key items identified in the scope of work:
1. Preliminary Drainage Analysis and Concept Phase — Includes data acquisition
and preliminary drainage analysis. Collecting existing data concerning hydraulic
analysis and record drawings. Identifying existing drainage patterns and
calculating existing storm drain peak runoff rates using 2, 5, 10, 25, 50 and 100
year storm events.
2. Preliminary Design Phase — Includes preparing preliminary design plans for the
culvert and borrow ditch system improvements. Meeting with property owners in
a public forum to discuss the project.
3. Final Design Phase — Incorporate City comments and directives for the final
preparation of construction plans, specifications and bid documents.
4. Construction Phase — Provide assistance during bidding phase and the actual
construction phase.
5. Surveying — Establishing survey controls along each street. Establishing
benchmark loops. Profiling and cross sectioning existing streets, driveways, and
borrow ditches. Identifying and locating all utilities for the project. Identifying and
measuring all existing storm sewers and culverts.

The Public Works Department negotiated compensation for the Basic Engineering
Services (Design and Construction Phases) and Survey Services for a grand total of
$61,300 for the two drainage projects. The combined design budget for these two
projects totals $75,000 so sufficient funds are available.
Recommendation:

AND
TEAGUE NALL AND PERKINS, INC.
This Agreement is executed by and between the City of North Richland Hills, a
municipal corporation located in Tarrant County, Texas, acting by and through Mark
Hindman, its duly authorized City Manager (hereinafter called "CITY "), and Teague Nall
and Perkins, Inc., a Texas corporation, acting by and through Greg D. Saunders, P. E.; its
duly authorized Principal (hereinafter called "ENGINEER").
WITNESSETH, that CITY desires professional engineering services in connection with
the Meadow Road Drainage Projects.
NOW, THEREFORE, CITY and ENGINEER., in consideration of the mutual covenants
and agreements herein contained, do mutually agree as follows:
IL PROJECT
In this Agreement, the "PROJECT" means the engineering design of the Meadow Road
Drainage Projects in accordance with the Public Works Design Manual, applicable CITY
codes, regulations and standards.
III. BASIC AGREEMENT
ENGINEER is an independent contractor and undertakes and agrees to perform
professional engineering services in connection with the PROJECT, as stated in the
sections to follow. It is understood and agreed that ENGINEER is not and will not by virtue
of this contract be deemed to be an agent or employee of CITY and that CITY will not be
entitled to direct the performance by ENGINEER's employees or subcontractors of the
tasks contemplated by this contract, All engineering services shall be performed with
diligence and in accordance with professional standards customarily obtained for such
services in the State of Texas. For rendering such services CITY agrees to pay
ENGINEER as set forth in Section VIII: "Compensation" and Exhibit F: "Compensation'.

IV. SCOPE OF ENGINEEWS SERVICES
ENGINEER shall render the professional services necessary for development of the
PROJECT, in accordance with the schedule in Exhibit A: "Project Schedule" and as
detailed in Exhibit B: 'Basic Engineering Services ", said exhibits being attached hereto and
incorporated herein for all purposes. ENGINEER shall be responsible, to the level of
competency presently maintained by other practicing professional engineers in the same
type of work in the Dallas/Fort Worth Metroplex area, for professional and technical
soundness, accuracy, and adequacy of all designs, drawings, specifications, and other
work and materials furnished under this Agreement.
V. SPECIAL ENGINEERING SERVICES
The CITY will pay the ENGINEER for Special Engineering Services as indicated in
Exhibit C: Special Engineering Services ", attached hereto and made a part of this
Agreement.

The CITY will pay the ENGINEER for Additional Engineering Services as indicated in
Exhibit D: "Additional Engineering Services" attached hereto and made a part of this

'Will. SCOPE OF CITY SERVICES
The City will furnish items and perform those services as identified in Exhibit E:
"Services to be provided by the City ", attached hereto and made a part of this Agreement.
Vlll. COMPENSATION
A. In consideration of the services described herein, CITY shall pay and ENGINEER
shall receive compensation in accordance with Exhibit F: "Compensation ".
B. Total payments including without limitation salary and reimbursable expenses, to
ENGINEER by CITYfor the services stated in Section IV and Section V above shall
not exceed Sixty -One Thousand Three Hundred Dollars and 001100
($61,300.00).
C. CITY may authorize additional services to be provided by ENGINEER as mutually
agreed upon by the parties. Any authorization for additional services shall be given
to ENGINEER by CITY in writing and approved by CITY.

D. CITY and ENGINEER understand that the variables in ENGINEER's cost of
performance may fluctuate. The parties agree that any fluctuation in ENGINEER's
costs will in no way alter ENGINEER's obligations underthis Agreement norexcuse
performance or delay on ENGINEER's part.
IX. OWNERSHIP OF DOCUMENTS
All completed or partially completed evaluations, reports, surveys, designs, drawings
and specifications prepared or developed by ENGINEER underthis Agreement, including
any original drawings, computer disks, mylars or blue lines, shall become the property of
CITY when the Agreement is concluded or terminated, and may be used by CITY in any
manner it desires; provided, however, that ENGINEER shall not be liable for the use of
such drawings for any project other than the PROJECT described in this Agreement.

ENGINEER SHALL INDEMNIFY AND HOLD HARMLESS CITY AND ITS OFFICERS,
AGENTS, SERVANTS AND EMPLOYEES FROM ANY LIABILITY ON ACCOUNT OF ANY
INJURIES OR DAMAGES RECEIVED OR SUSTAINED BY ANY PERSON OR
PROPERTY, INCLUDING COURT COSTS AND REASONABLE ATTORNEYS' FEES
INCURRED BY CITY, PROXIMATELY CAUSED BY THE NEGLIGENT ACTS OR
OMISSIONS OF ENGINEER OR ITS OFFICERS, AGENTS, SERVANTS,
CONTRACTORS, OR EMPLOYEES IN THE EXECUTION, OPERATION, OR
PERFORMANCE OF THIS AGREEMENT.
Approval by CITY of contract documents shall not constitute or be deemed to be a
release of the responsibility and liability of ENGINEER, its officers, agents, employees and
subconsultants, for the accuracy and competency of the services performed under this
Agreement, including but not limited to evaluations, reports, surveys, designs, working
drawings and specifications, and other engineering documents. Approval by CITY shall not
be [teemed to be an assumption of such responsibility and liability by CITY for any error,
omission, defect, deficiency or negligence in the performance of ENGINEER's professional
services or in the preparation of the evaluations, reports, surveys, designs, working
drawings and specifications or other engineering documents by ENGINEER, its officers,
agents, employees and subconsultants, it being the intent of the parties that approval by
CITY signifies CITY's approval of only the general design concept of the improvements to
be constructed.
In this connection, ENGINEER and its subconsultants shall indemnify and hold CITY
and all of its officers, agents, servants, and employees harmless from any loss, damage,
liability orexpenses, on account of damage to property and injuries, including death, to any

and all persons, including but not limited to officers, agents or employees of ENGINEER or
its subconsultants, and all other persons performing any part of the work and
improvements, which may arise out of any negligent act, error, or omission in the
performance of ENGINEER's professional services or in the preparation of evaluations,
reports, surveys, designs, working drawings, specifications and other engineering
documents incorporated into any improvements constructed in accordance therewith;
ENGINEER shall defend at its own expense any suits or other proceedings brought against
CITY and its officers, agents, servants and employees or any of them on account of the
foregoing described negligent acts, errors or omissions, and shall pay all expenses and
satisfy all judgments which maybe incurred by or rendered against CITY, its officers,
agents, servants and employees or any of them, in connection with the foregoing described
negligent acts, errors, or omissions; provided and except however, that this indemnification
provision shall not be construed as requiring ENGINEER to indemnify or hold CITY or any
of its officers, agents„ servants or employees harmless from any loss, damages, liability or
expense, on account of damage to property or injuries to persons caused by defects or
deficiencies in design criteria and information furnished to ENGINEER by CITY, or any
deviation in construction from ENGINEER's designs„ working drawings, specifications or
other engineering documents.
XL INSURANCE
For the duration of this Agreement, ENGINEER shall maintain the following minimum
public liability and property damage insurance which shall protect ENGINEER, its
subcontractors, its subconsultants and CITY from claims for injuries, including accidental
death, as well as from claims for property damage which may arise from the performance
of work under this Agreement. ENGINEER shall provide a Certificate of Insurance
verifying that the following minimum limits of coverage are provided:
A. Worker's Compensation Insurance:
Statutory requirements ($ 300,000 minimum)
B. Comprehensive General Liability and Bodily Injury:
Bodily Injury $ 500,000 per person, or
$ 1,000,000 per occurrence; and
Property Damage $ 100,000 each occurrence; or
Combined Single Limit $ 1,000,000 aggregate
C. Comprehensive Automobile Liability:
Bodily Injury $ 500,000 per person, or
$ 1,000,000 per occurrence; and
Property Damage $ 100,000 each occurrence; or
Combined Single Limit $ 1,000,000 aggregate

D. Professional Liability:

The Certificate of Insurance shall contain a provision that such insurance cannot be
canceled or modified without thirty (30) days prior written notice to CITY.
XII. ARBITRATION
No arbitration arising out of or relating to this Agreement shall occur without both
parties' written approval.
XIII. TERMINATION AND SUSPENSION
A. CITY may terminate this Agreement at anytime for convenience or for any cause by
a notice in writing to ENGINEER. Either CITY or ENGINEER may terminate this
Agreement in the event the other party fails to perform in accordance with the
provisions of this Agreement. Upon receipt of such notice, ENGINEER shall
immediately discontfnue all services and work and the placing of all orders or the
entering into contracts for supplies, assistance, facilities, and materials, in
connection with the performance of this Agreement and shall proceed to cancel
promptly all existing contracts insofar as they ar+e chargeable to this Agreement.
t3. If CITY terminates this Agreement under the foregoing Paragraph A, CITY shall
pay ENGINEER a reasonable amount for services performed prior to such
termination, which payment shall be based upon the payroll cost of employees
engaged on the work by ENGINEER up to the date of termination of this
Agreement and for subcontract and reproduction in accordance with the method
of compensation stated in Section VIII: "Compensation" hereof. In the event of
termination, the amount paid shall not exceed the amount appropriate for the
percentage of work completed.
XIV. SUCCESSORS AND ASSIGNS
CITY and ENGINEER each bind themselves and their successors, executors,
administrators and assigns to the other party of this Agreement and to the successors,
executors, administrators and assigns of such other party in respect to all covenants of this
Agreement; except as above, neither CITY nor ENGINEER shall assign, sublet ortransfer
its interest in this Agreement without the written consent of the other. Nothing herein shall
be construed as creating any personal liability on the part of any officer or agent of CITY.

XV. AUTHORIZATION, PROGRESS, AND COMPLETION
CITY and ENGINEER agree that the PROJECT is planned to be completed in
accordance with the Exhibit A: "Project Schedule" which is attached hereto and made a
part hereof. ENGINEER shall employ manpower and other resources and use professional
skill and diligence to meet the schedule; however, ENGINEER shall not be responsible for
schedule delays resulting from conditions beyond ENGINEER 's control. With mutual
agreement, CITY and ENGINEER may modify the Project Schedule during the course of
the PROJECT and if such modifications affect ENGINEER's compensation, it shall be
modified' accordingly, subject to City Council approval.
For Additional Engineering Services, the authorization by CITY shall be in writing and
shall include the definition of the services to be provided, the schedule for commencing
and completing the services and the basis for compensation as agreed upon by CITY and
ENGINEER.
It is understood that this Agreement contemplates the full and complete Engineering
services for this PROJECT including any and all services necessary to complete the work
as outlined in Exhibit I3. 'Basic Engineering Services Nothing contained herein shall be
construed as authorizing additional fees for services to provide complete services
necessary for the successful completion of this PROJECT.
XVI. SUBCONTRACTS
ENGINEER shall be entitled, only if approved by CITY, to subcontract a portion of the
services to be performed by ENGINEER under this Agreement,
XVII. RIGHT TO AUDIT
ENGINEER agrees that CITY shall, until the expiration of three (3) years after final
payment under this Agreement, have access to and the right to examine and photocopy
any directly pertinent books, design calculations, quantity take -offs, documents, papers and
records of ENGINEER involving transactions relating to this Agreement. ENGINEER
agrees that CITY shall have access during normal working hours to all necessary
ENGINEER facilities and shall be provided adequate and appropriate work space in order
to conduct audits in compliance with the provisions of this section. CITY shall give
ENGINEER reasonable advance notice of intended audits.
ENGINEER further agrees to include in all its subconsultant agreements hereunder a
provision to the effect that the subconsultant agrees that CITY shall, until the expiration of
three (3) years after final payment under the subcontract, have access to and the right to

XIX. MISCELLANEOUS
A. Authorization to Proceed. Signing this Agreement shall be construed as
authorization by CITY for ENGINEER to proceed with the work, unless otherwise
provided for in the authorization.
B. Legal Expenses. In the event legal action is brought by CITY or ENGINEER against
the other to enforce any of the obligations hereunder or arising out of any dispute
concerning the terms and conditions of this Agreement, the losing party shall pay
the prevailing party such reasonable amounts for fees, costs and expenses as may
be set by the court.
C. Notices. Any notice or correspondence required under this Agreement shall be
sent by certified marl, return receipt requested, or by personal delivery and shall be
effective upon receipt, if addressed to the party receiving the notice or
correspondence at the following address:

D. Independent Contractor. ENGINEER shall perform services hereunder as an
independent contractor, and not as an officer, agent, servant or employee of the
CITY and ENGINEER shall have the exclusive right to control services performed
hereunder by ENGINEER, and all persons performing same, and shall be
responsible for the negligent acts and omissions of its officers, agents, employees,
and subocnsultants. Nothing herewith shall be construed as creating a partnership
or joint venture between CITY and ENGINEER, its officers, agents, employees and
subconsultants; and the doctrine of respondent superior has no application as
between CITY and ENGINEER.
E. Venue. This Agreement shall be governed by the laws of the State of Texas, and
venue in any proceeding relating to this Agreement shall be in Tarrant County, .
Texas.
F. Entire Agreement, This Agreement represents the entire and integrated agreement
between CITY and ENGINEER and supersedes all prior negotiations,
representations or agreements, either written or oral. This Agreement may be
amended only by written instrument signed by both CITY and ENGINEER.
G. Severability. If any provision in this Agreement shall be held illegal by a valid final
judgment of a court of competent jurisd icUon, the remaining provisions shall remain
valid and enforceable.
H. Assionment. CITY and ENGINEER each bind themselves, their heirs, successors
and assigns, to the other party to this Agreement and to the successors and assigns
of each other party in respect to all covenants of this Agreement. This Agreement is
not to be assigned, sublet or transferred, in whole or in part, by either CITY or
ENGINEER without the prior written consent of the other party.
I. Disclosure. By signature of this Agreement, ENGINEER warrants to CITY that it
has made full disclosure in writing of any existing conflicts of interest or potential
conflicts of interest, including personal financial interests, direct or indirect, in
property abutting the PROJECT and business relationships with abutting property
owners. ENGINEER further warrants that it will make disclosure in writing of any
conflicts of interest which develop subsequent to the signing of this Agreement and
prior to final payment under this Agreement.

SCOPE OF BASIC ENGINEERING SERVICES
FOR
MEADOW ROAD DRAINAGE PROJECTS
The scope of work for BASIC engineering services involves Preliminary Drainage Analysis,
Engineering Design, Project Plans, Specifications and Opinions of Probable Construction Cost for
the Meadow Road Drainage Project Area. The "project area" shall consist of Meadow Road and
Meadow Creek Road from Hightower Drive to North Forty Road, and North Forty Road from
Meadow Road to drainage channel CB -2, The Scope of Engineering Services is further outlined
below.
PRELIMINARY DRAINAGE ANALYSIS & CONCEPT PHASE
A. Data Acquisition
I . Collect and review existing property owner drainage complaints, and meet
with City staff to further define project requirements and objectives.
2. Obtain and review the current City Drainage Master Plan, City storm drain
hydraulic analysis for CB -2, and other previous storm drain record drawings
and/or analysis for the project area.
1 Obtain topographic maps, subdivision plats and other available mapping
information.
4. Obtain existing and proposed plans and profiles for water, sewer, streets,
storm drainage, and underground utilities adjacent to the project area.
5. Obtain existing ownership data and research existing plats for easement and
right -of -way data on properties adjacent to the project area. Right -of -way
and easement information shown on plans shall be approximate.
B. Preliminary Drainage Analysis
Identify existing drainage patterns using available topographic maps and field
research and delineate a drainage area map forthe current condition project
area.

4. Prepare a summary of findings and recommendations with an opinion of
probable cost. Exhibits will be provided depicting proposed culvert

FOR

The scope of work for SPECIAL Engineering Services involves Design Surveys to tie
existing features within the PROJECT area and generate 1 -foot topographic contours.
Survey efforts do not include property research, easement research, or Surveying for the
sale or purchase of right -of -way or easements. It is understood that the City does not
intend to purchase right -of -way or easements for the drainage improvements required by
this PROJECT, and that the limits of existing right -of -way and easements identified on the
plans are approximate. The scope of work for the Special Engineering Services is more
generally described as follows;
I. SURVEYING
A. Design Surveys
1, Establish Survey Control
Establish survey control along each street or intersecting streets as necessary.
These control points will be established based on and tied to established City
horizontal and vertical control paints. The horizontal control for each street in
the PROJECT will be established on the State Plane Coordinate System
(NAD'83 Surface Coordinates) from CITY monumentation. Control' points will be
established using 518" iron rods, 18" long. These control points will be
established using GPS and conventional surveying methods.
2, Benchmark Loop
A benchmark circuit will be established, based on the vertical control points
provided. These benchmarks will be located outside of the construction limits
and put in such a place so that they may be easily found for future use.
Benchmarks will be located at about 1,000' intervals and will be referenced.
Benchmarks shall be looped in accordance with good surveying practice priorto
field surreys. All control leveling work will be performed using appropriate
modified second order procedures with closed loops into the PROJECT vertical
control,
3, Existing Streets and Driveways

Property owners will be notified prior to surveying through private property.
Existing streets and driveways will be profited and cross - sectioned at 50'
intervals and to a point at least 40' outside of the existing edge of pavement.
Low points, high points and other unique features will be noted. Pavement
surfacing will be determined by visual inspection only. Intersecting streets will
be .profiled and cross - sectioned to a point at least 100' beyond the PROJECT
roadway.
4. Existing Borrow Ditch Channels and Other Features
Property owners will be notified prior to surveying through private property.
Existing borrow ditch channels and swales wilt be profiled and cross sectioned
within the limits of the PROJECT. Low points, high points and any other unique
features will be noted. Other features will be tied including landscaping, trees,
bushes, retaining walls, flower beds, mailboxes, fences, sidewalks, utility
markers and power poles within 40' of the edge of pavement. Offsite drainage
areas contributing to the PROJECT will be determined through field
investigations and available topographic mapping.
5. Existing Underground and/or Overhead Utilities
Utility owner's will be contacted, on an as- needed basis, and requested to assist
in locating existing utilities identified for the PROJECT. Above ground features
of existing utilities within the PROJECT will be field located, including elevations
of sanitary and storm sewer manhole flowlines and waterlgas valve stems. The
location of utilities between above ground features will be determined from visual
inspection, utility records, and/or from locations determined by the respective
utility companies. The utilities will be tied to the PROJECT control points and
depths determined in sufficient detail to identify potential conflicts with proposed
construction. The excavation and other casts required to expose or probe the
underground utilities will be the responsibility of others.
6. Existing Storm Sewers and Culverts
The size of existing culverts will be measured and tied along with existing
headwalls, channels and aprons. The size, length, and flowline elevation of
existing storm sewers, inlets and manholes will be surveyed. Drainage areas
contributing to the PROJECT or conveying water from the PROJECT will be
determined through field investigations and available topographic mapping.

Documents when such revisions are required by changes in laws, rules, regulations,
ordinances, codes or orders enacted subsequent to the preparation of such studies,
reports or documents, or are due to any other causes beyond ENGINEER's control.
II. ADDITIONAL Engineering Services not included in the scope of work, also include
assistance to the CITY in connection with bid protests, rebidding or renegotiating

serving as a consultant or witness for CITY in any litigation, arbitration or other legal
proceeding involving the PROJECT.
Ill, ADDITIONAL Engineering Services not included in the Scope of Work also include
construction staking, surveying for Right -of -Way or property corners, setting of
Easement/Right -Of -Way acquisition parcels, and preparation of Right -of -Way or
Easement documents and/or exhibits.
IV. ADDITIONAL Engineering services in connection with the PROJECT, including services
which are to be furnished by the CITY and services not otherwise provided for in this
Agreement will be at the following !rates:
Staff Member and Resident Project Representative - Salary Cost Times Multiplier of
1.15.
Salary Cost is defined as the cost of payroll of ENGINEER's, draftsmen, stenographers,

COMPENSATION
FOR
MEADOW ROAD DRAINAGE PROJECTS
I. COMPENSATION
For and in consideration of the services to be rendered by the ENGINEER, the CITY shall
pay, and the ENGINEER shall receive the compensation hereinafter set forth for the
Design and Construction Phases of the work and additionally for 'Special Engineering
Services and/or Additional Engineering Services that are in addition to the Basic
Engineering Services. All remittances by CITY of such compensation shall either be
mailed or delivered to the ENGINEER's home office as identified in the worts authorization.
"Salary Cost" used herein is defined as the cost of salaries of ENGINEER's, draftsmen,
stenographers, survey men, clerks, laborers, etc. for time directly chargeable to the
PROJECT plus social security contributions, unemployment, excise and payroll taxes,
employment compensation insurance, retirement benefits, medical and insurance benefits,
sick leave, vacation, and holiday pay applicable thereto.
A. Compensation for the Basic Engineering Services (Design and Construction
phases) shall be a lump sum fee of Forty -One Thousand Five Hundred and 001100
($41,500.00).
Basic Engineering Services shall be computed as fellows:
Preliminary Drainage Analysis $ 11,500.00
Preliminary Design Phase $ 18,000,00
Final Design Phase $ 8,000.00
Construction Phase $ 4,000.00
Payment for the Analysis and Design Phases of the Basic Engineering Services
shall be due in monthly installments in the proportion to that part of the service
which has been accomplished. Final payment for services authorized shall be due
at the completion of these services.
Payment for the Construction phase of the Basic Engineering Services shall be due
in monthly installments in proportion to the construction work completed on the
basis of the Contractor's monthly payment estimates. Upon completion of all work

For all direct non -labor and/or subcontract expense, including mileage, travel and
living expenses at invoice or internal office cost times a multiplier of 1.10.
Payments to the ENGINEER for authorized Additional Engineering Services will be
due monthly, upon presentation of monthly statement by the ENGINEER for such
services.
II. AUDIT AND SCOPE CHANGE
Cost budgets are setforth above and are subject to the audit provisions of this Agreement,
Section XVII: "Right to Audit ". It is also understood that the cost budgets are based upon
ENGINEER's best estimate of work and level of effort required for the proposed scope of
services. As the PROJECT progresses, it is possible that the level of effort and/or scope
may differ up or down from that assumed. If there are no scope changes, the ENGINEER
shall receive the full amount of lump sum and unit price fees, regardless of the cost. If at
any time it appears that the cost budget may be exceeded, the ENGINEER shall notify the
CITY as soon as passible in writing.

If there is a scope change, the ENGINEER shall notify the CITY as soon as possible in
writing and shall include a revised scope of seances, estimated cost, revised fee schedule,
and a revised time of completion. Upon negotiation and agreement via a signed
amendment by both parties, the cost budget, fee schedule, and total budget will be
adjusted accordingly.
CITY shall not be obligated to reimburse the ENGINEER for costs incurred in excess of the
cost budget. The ENGINEER shall not be obligated to perform on any change in scope of
work or otherwise incur costs unless and until the CITY has notified the ENGINEER in
writing that the total budget for Engineering Services has been increased and shall have
specified in such notice a revised total budget which shall thereupon constitute a total
budget for Engineering Services for performance under this Agreement.
A detailed scope of work, total budget, and schedule will be prepared by the ENGINEER
and executed by the CITY if the ENGINEER is authorized to perform any Additional
Engineering Service(s).
III. PAYMENT
Payments to the ENGINEER will be made as follows:
A. Invoice and Time of Payment
Monthly invoices will be issued by the ENGINEER for all work performed underthis
Agreement. Invoices are due and payable on receipt. Invoices will be prepared in a
format approved by the CITY prior to submission of the first monthly invoice. Once
approved, the CITY agrees not to require changes in the invoice format, but
reserves the right to audit. Monthly payment of the fee will be in proportion to the
percent completion of the total work (as indicated in Exhibit. B: "Basic Engineering
Services ", Exhibit C: "Special Engineering Services" and Exhibit ❑: "Additional
Engineering Services ").
B. Upon completion of services enumerated in Exhibit B: "Scope of Basic Engineering
Services ", the final payment of any balance will be due upon receipt of the final
invoice.

Summarv: Council is being asked to amend Section 54 -166 of the Code of Ordinances
for prohibiting parking on Booth Calloway Road. Section 54 -156 currently prohibits
parking along certain portions of Booth Calloway Road. Amending this section will add
additional no parking areas as shown on the attached map.
General Description: The Public Works Department received a letter from the North
Hills Hospital Administration requesting additional no parking areas along Booth
Calloway Road. The parking of cars along the west side of Booth Calloway Road is
causing sight visibility problems for motorists leaving the hospital parking lot. The
parked cars prevent people from seeing oncoming traffic as they pull out onto Booth
Calloway Road. The Limited site visibility has resulted in complaints to hospital and city
staff.
In order to eliminate the sight visibility problem and to prevent future parking problems,
additional no parking areas are being recommended for both the east and west sides of
Booth Calloway Road. Extending the no parking area on the west side of the street
could possibly shift the parking problem to the east side of the street; therefore staff is
recommending additional no parking areas along the east side to prevent any parking of
vehicles that could block the view of residents pulling out of their driveways onto Booth
Calloway Road.
Staff contacted the residents who will be impacted by the no parking area and the
residents are in support of adding additional no parking areas. Hospital administration
has also informed staff that ample parking is available at their campus for visitors and
employees of the hospital.
Staff is recommending the following for no parking on Booth Calloway Road:
• On the west side of Booth Calloway Road from the center line of Rodger Line
Drive south for 800 feet to the center line of Rogan Drive and 145 feet north of
Rodger Line Drive.
• The 4300, 4400, 4500 and 4600 blocks on the east side of Booth Calloway Road
from the intersection of Rogan Drive north to the south access road of Interstate
Highway 820.
This parking restriction will provide adequate sight visibility for motorists and visitors of
the hospital who access Booth Calloway Road.
Recommendation: Approve Ordinance No. 3137 Amending Section 54 -166 of the North
Richland Hills Code of Ordinances and Prohibiting Parking on Portions of Booth
Calloway Road.

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS.
Section 1: THAT Subsections 54 -166 (2) and (3) of the North Richland Hills Code of
Ordinances are hereby amended to read as follows:
"Sec. 54 -166 On- Street Parking Prohibited.
(a) The parking of any vehicle at the following location is prohibited:
(2) Booth Calloway Road, along the east side of the 4366, 4400, 4500
and 4660 blocks, from its intersection with Rogan Drive, north to
the south access road of Interstate Highway 820.
(3) Booth Calloway Road, along the west side, from the intersection of
Rodger Line Drive for 145 feet north and 800 feet south of such
intersection, measured from the centerline of Rodger Line Drive."
Section 2: Any person, firm or corporation violating Subsections 54- 166(a) (2) or (3)
of the North Richland Hills Code of Ordinances shall be deemed guilty of a
misdemeanor and upon final conviction thereof fined in an amount not to
exceed Two Hundred Dollars ($200.00). Each day any such violation shall
be allowed to continue shall constitute a separate violation and punishable
hereunder.
Section 3: The City Secretary is hereby authorized and directed to cause the
publication of the descriptive caption and penalty clauses of this ordinance
as an alternative method of publication provided by law.
Section 4: This ordinance shall be in full force and effect immediately upon passage.

Subject: PU 2011 -012 Award of contract to Ford Audio -Video Systems, Inc. in the
amount of $241,496 for the purchase and installation of the Audio Visual System for
NRH Centre.
Summarv:
This item is to award the contract for the purchase and installation of the audio visual
system as a part of the NRH Centre. The system to be installed throughout the facility
includes LCD displays, digital signage, projectors, tuners, mixers, microphones.,
amplifiers, speakers, control panels, equipment racks and associated cabling.
General Description:
Construction of the NRH Centre is progressing. While the design and installation of the
audio visual system throughout the building is a separate component from the building
construction, the installation of the system is coordinated to coincide with the
construction schedule. A budget of $300,000 has been allocated to the audio visual
system.
The Texas Procurement and Support Services (TPASS) has established, as an
alternative purchasing method, the use of Texas Multiple Award Schedule (TXMAS)
contracts that have been developed from contracts awarded by the federal government
or any other governmental entity of any state. TXMAS has contracts in place for the
design and purchase of audio visual systems and for the installation of audio visual
systems and equipment (Contract # TXMAS -8- 581030). The Local Government Code
states that purchases made through a cooperative purchasing agreement satisfy any
state law that would require the city to solicit competitive bids.
Our architect, Brinkley Sargent Architects, has been working with Ford AV, relying on
their professional design expertise during the preparation of the building design and
preparation of the construction documents, to build the project. Our contractor, Byrne
Construction, also has extensive experience working with Ford AV. Ford AV employs 35
degreed engineers and over 200 Job Center personnel. They have worked closely with
Brinkley Sargent Architects and Byrne Construction to tailor the building design and
construction to their specifications.
Ford AV submitted a proposal for the design of the audio visual system, purchase of
equipment and installation of the audio visual system in the amount of $241,496. Staff
and Brinkley Sargent Architects have evaluated the proposal and recommend awarding
a contract to Ford Audio -Video Systems, Inc.
Recommendation:
To award a contract to Ford Audio - Visual Systems Inc., in the amount of $241,496, for
the purchase and installation of the Audio Visual System in the NRH Centre.

NRH2O to D.C.0 Inc.
General Descrir)tion:
Staff has requested and received bids for the supply of pool chemicals for NRH20
Family Water Park. The chemicals are utilized for sanitizing and balancing the
approximately 925,040 gallons of treated pool water at NRH20. The two major
chemicals utilized for sanitation are Sodium Hypochlorite (NaGCI) and Muriatic Acid
(HCI). An additional minor chemical, Calcium Hypochlorite (CaQCI) is also included in
the bid.
Notice of the city's intent to bid was advertised in the local newspaper as required by
State Statute, and posted on the city's website. Notice of the city's intent to bid was sent
to seven (7) vendors requesting them to participate in this bid process. The Purchasing
Department only received one bid on March 10. Per policy, the bid was not opened and
we extended the due date to March 17 at 10:00 A.M. We did not receive any further
response and proceeded to open the bid submitted by D.C.C. Inc.

FSTI Inc. was awarded this bid in 2009 and we renewed the contract with them for the
2010 season. Throughout the 20110 season we experienced delivery issues with this
company prompting the City to go out to bid for the 2011 season.
Staff projects that approximately 58,000 gallons of Sodium Hypochlorite, 2,300 gallons
of Muriatic Acid, and 700 pounds of Calcium Hypochlorite will be used during the 2011
season.
Recommendation:
Award Bid # 11 -020 for Aquatic Chemicals to D.C.C., Inc. in an amount not to exceed
$70,000.

This item is to award a contract for the fabrication and installation of shade structures
over the bleachers at the baseball fields at Cross Timbers Park.
General Descrir)tion:
The approved Parks & Recreation Capital Improvement Program provides funding for
the installation of attractive shade structures over the bleacher areas at Cross Timbers
Park (PKII105). This project supports the recommendation of providing shade
structures throughout the park system as identified in the Parks, Recreation and Open
Space Master Plan. The total approved funding for this project is $100,000.
The Local Government Purchasing Cooperative (BuyBoard) has contracts in place for
the purchase of shade structures and the installation for the shade structures. The Local
Government Code states that purchases made through a cooperative purchasing
agreement satisfy any state law that would require the City to solicit competitive bids.
Staff met with vendors, some who supply material and installation of shade structures,
and some who provide either only material or only installation through direct purchase
on the BuyBoard contract 346 -10. All submitted a response to our request for offer and
the pricing and options were evaluated by the Purchasing and the Parks and Recreation
Departments. Pricing from USA Shade and Fabric Structures, Inc., Recreation Builder,
and Victory Awning was considered.
After comparing design options and the price of each proposal, staff recommends USA
Shade and Fabric Structures, Inc. for the purchase of materials and installation of the
shade structures at Cross Timbers Park, as follows:

The Sounds of Spring Concert Series will be held each Friday from April 15th through
May 6th at NRH20 Family Water Park. Gates open at 6 p.m. and the concerts begin at

On Saturday, April 16th, residents can get rid of unwanted bulky items during the annual
Spring Community Cleanup. Items can be dropped off from 9 a.m. to noon in Parking

The NRH Youth Advisory Committee is hosting a Dog Show on May 1st at Tipps Canine
Hollow Dog Park. Several contests will be held including Best Small Dog, Best Large
Dog, Best Costume, Best Trick, Most Unusual and more. Registration forms are
available at the Animal Adoption & Rescue Center, City Hall and the Library.
Registration forms can also be downloaded from the city's website at nrhtx.com. The
entry fee is $5 per category or $10 for 3 categories. All proceeds will go to the Animal
Adoption & Rescue Center.

Department - A card was received from a resident thanking this crew for their
outstanding response to her 911 call. The resident needed assistance because her
mother had fallen and broken her wrist and hip. "'Everyone showed exceptional care and
compassion and we are so grateful for your help," the resident stated.
