CALL TO ORDER Mayor Trevino called the meeting to order March 7, 2011 at 7:49 p.m. 2. GN 2011-020 PUBLIC HEARING AND CONSIDERATION OF SIGN VARIANCE REQUEST SRB 2011-02 REGARDING SECTION 106(12) OF THE CODE OF ORDINANCES BY GOLDEN CORRAL RESTAURANT LOCATED AT 7660 BOULEVARD 26 APPROVED Mayor Trevino opened the public hearing. Mr. Rick Dobbyn 318 Forest Lane, Dallas, applicant representing Golden Corral, presented the request. Golden Corral is proposing to expand and renovate the restaurant located at 7660 Boulevard 26. The applicant advised they are requesting to install a new pole sign visible from IH 820 that will be located outside of the 200-foot freeway overlay district. Mr. Dave Pendley, Building Official, presented the Staff's report. The applicant proposes to install a new 60-foot tall, 250 square foot pole sign near the northwest corner of their property along Boulevard 26. The applicant is requesting a variance to allow the proposed sign to be located approximately 75 feet to the south of the existing freeway overlay district. The current 20 foot tall, non -conforming sign on the southwest corner of the property will be removed. The applicant has also indicated they will commit approximately $500,000 towards major improvements to the building's interior, exterior, and equipment. The applicant has agreed to make the improvements prior to constructing the new pole sign and has agreed to relocate/modify the new pole sign should it be discovered that it obscures or hinders the viewing of future businesses constructed in the Calloway Creek commercial area. Staff recommends approval of the sign variance subject to the following conditions: 1. A permit to construct the new pole sign cannot be approved by staff until the remodeling project which is currently under plan review and all upgrades and improvements that are planned that do not need plan review are complete and total approximately $500,000. 2. At the direction of the Sign Review Committee, the pole sign must be relocated or modified at the owner's expense should it become necessary to maximize visibility of any future development at the Calloway Creek Commercial Area. 3. This is the Golden Corral at 7660 Boulevard 26 only. Any different use at this address would not be permitted under this variance request. Council questioned whether the cost of the improvements would be close to $500,000 or a much lesser amount. Council requested Golden Corral to provide the Planning & Inspections Department with an itemized list of improvements. Council questioned the second condition recommended by Staff and discussed the moving of the pole sign by reduction in elevation or size or to another location if it became necessary in the future to relocate the pole sign to maximize visibility. Mr. Dobbyn advised Council they would be spending very close to $500,000. The applicant has applied for a building permit. The application filed with the Planning and Inspections Department is for approximately $250,000 in improvements and does not include equipment. Mr. Dobbyn advised Council of the additional expenses that would be incurred, i.e., equipment, furniture, flooring, interior painting. Mr. Dobbyn advised a detailed list would be provided to the Planning and Inspections Department. Mayor Trevino called for comments in favor or opposition to come forward. There being no one wishing to speak, Mayor Trevino closed the public hearing. The proposed sign modification is located approximately 255 feet south of Loop 820 (which is approximately 55 feet outside the 200 foot freeway overlay district limits) and is situated on a lot that does not have direct freeway frontage. As a result, the project is not eligible to receive a sign permit by right. The applicant is requesting a sign variance in order to provide relief from these restrictions and to allow them to exchange the existing sign assembly currently affixed to the top of the pole with a new 206 square foot sign. General Description: The applicant currently has a 65 foot tall, non -conforming pole sign near the center of their property that cannot be reutilized per city ordinance. Given the unique cuisine and new brand, the applicant believes that reuse of the sign will provide visibility from Loop 820 to attract the number of customers needed to offset the remodel cost. The applicant has recently obtained a building permit to make significant improvements that include new flooring, fire sprinklers, roofing, decorative doors, a large outdoor patio area, landscaping, and interior and exterior paint. The applicant has committed to investing over $400,000 into their remodeling project as indicated in their building permit issued on January 26t", 2011 that does not include another $300,000 investment in furniture, fixtures and equipment. The applicant has also agreed to make the above improvements prior to constructing the new pole sign. The Sign Ordinance authorizes the Sign Review Board to grant variances to the Ordinance that will not be contrary to the public interest and where, because of special conditions, the enforcement of the ordinance would result in an unnecessary hardship. Staff is of the opinion that the reuse of an existing pole sign would not be contrary to the public interest and that conditions exist which warrant the approval of this request under several restrictions. Recommendation: Approve SRB 2011-03 subject to the following conditions: 1. A permit to construct the new pole sign cannot be approved by staff until the remodeling project, which is currently underway, is completed with all upgrades and improvements totaling over $400,000. 2. CITY OF NORTH RICHLAND HILLS SIGN REVIEW BOARD Department: Planning and Development Meeting Date: 6-13-2011 Presented by: Dave Pendley Agenda No. 4 Subject: SRB 2011-04 Public Hearing to Consider Digital Billboard Request per Section 106(12)b of the Code of Ordinances by Lamar Outdoor Advertising Near the 8700 Block of Airport Freeway/SH-121 Summary: Pursuant to Section 106-12(b) of the North Richland Hills Code of Ordinances, the applicant, Lamar Outdoor Advertising, has requested permission to modify an existing non -conforming conventional billboard with digital technology. The proposed project is located west and adjacent to the Best Western Hotel (8709 Airport Freeway) on the north side of the freeway and will be visible to west -bound traffic only. General Description: Several months ago, the City Council approved an ordinance that afforded existing billboards the opportunity to be converted to digital technology provided they met the conditions set forth in the Code of Ordinances and they are approved by the Sign Review Board. The digital billboard will meet the requirements established by the Code of Ordinances and state law by adhering to the limitations on height, size, message refresh rate, brightness control, etc.; however, the following variances have been requested by the applicant: 1. Request to maintain the current separation of 170 feet from the nearest freestanding general business sign. Current ordinance requires a minimum separation of 200 feet from the nearest freestanding sign. Compliance with the 200 foot separation would force the applicant to negotiate the purchase and/or lease of additional property in order to move the billboard and additional 30 feet away from the Best Western Hotel sign. 2. Request to maintain the current separation of 750 feet from the nearest conventional or digital billboard on the same side of the freeway. Current ordinance requires a minimum separation of 1,500 feet. This billboard is located approximately 750 feet away from another conventional billboard. On February 15, 2011, the City of North Richland Hills officially became a TxDOT "Certified City" and assumed the responsibility to enforce outdoor advertising regulations along Texas freeways within our city. This designation allows the city to self -regulate outdoor advertising requirements along state and federal roadways; including authorization to grant variances to size, height, and separation. Variances may be granted provided the billboard meets the minimum requirements of the Highway Beautification Act of 1965. Staff has reviewed the application and visited the site, and has determined that the requested variances will not cause the billboard to be in violation of the Highway Beautification Act of 1965. As such, the Sign Review Board is within their authority to grant relief to the applicant by approving the requested variances. According to the sign regulations, the applicant must also demonstrate that any net area increase in the advertising area caused by the conversion will be removed from other billboard locations within the city. In this case, the conversion is not causing an increase to the current sign area; plus, it's the only billboard owned by applicant within the city.
