Staff is requesting direction from Council on their desire to cancel the November 28 and December 26 City Council meetings. General Description: In the past when Council meetings have fallen on or close to a holiday, Council has opted to cancel the meetings and directed Staff to notify Council if any significant issues arise warranting a special meeting. This year Staff is recommending that Council consider cancelling the November 28 and December 26 Council meetings. As in previous years, should there be unexpected business in November or December that cannot be handled at the remaining meetings, a special meeting would be scheduled. Staff is requesting Council direction on the cancellation of the November 28 and December 26 City Council meetings. The award was announced at the Texas Municipal League's Annual Conference on October 13 and will be presented it to the City Council during this City Council Meeting. General Description: The Scenic City Certification Program, sponsored by the Texas Municipal League and the Urban Land Institute, is the first in the United States to incorporate a comprehensive set of standards for design and development of public roadways and public spaces into one program. Applicant cities present their existing standards for assessment and scoring, where only cities with the highest evaluation scores are certified. Of the 1,200 Texas cities, only 30 are certified as a Scenic City. North Richland Hills was able to achieve Silver status in its first year and enjoys certification with the neighboring cities of Keller, Trophy Club, Roanoke, Westlake and Grapevine. It is our hope that the certification and program provides an incentive for others to adopt and implement the kind of criteria that is proven to enhance economic development, improve quality of life and foster a sense of place. This certification was made possible with the leadership of the City Council, who over time have adopted ordinances that enable North Richland Hills to not only qualify, but achieve Silver status in the first year. In addition to City Council, we would like to recognize the follow staff who contributed to the application: Dave Pendley, Joe Pack, John Pitstick, Caroline Waggoner and Craig Hulse. The items will be placed back on an agenda for Council approval after the other cities involved receive approval from their Councils. A.1 Discussion of Proposed Buildinq Standards Program for Rental Units Mr. Dave Pendley, Building. Official, presented a PowerPoint presentation highlighting a proposed building standards ordinance for single - family rental units. Council was advised of surrounding cities with rental programs and examples were given of rental units in need of repair. The ordinance would require a C.Q. prior to occupancy and inspections will be for minimum property maintenance issues only at the time of tenant turnover. Proposed program parameters include: • Program would be free with no registration or annual fees • Inspection triggered upon landlord request (tenant turnover) or water account application • January 1, 2012 effective date • Waiving of building permit fees until June 1, 2012 • Unit occupied by landlord's direct family member(s) would be exempt • First time rentals as a result of foreclosure (or similar hardship) would be exempt for first renter Mr. Pendley explained how the program was envisioned to work and some of the enforcement tools that would be used. Staff is requesting Council consensus on proceeding with the drafting of an ordinance with an effective date of January 1, 2012 and permit fees being waived until July 1, 2012. After discussion and questions by Council, the consensus of the Council was for Staff to move forward with drafting of the ordinance. The ordinance will be brought back for Council consideration at the next October council meeting or a November council meeting. A.2 Discussion of SB 1 and Amending Section 74 -38 of the North. Richland Hills Code of Ordinances Providing for Taxation of Goods in Transit Ms. Karen 'Bostic, Assistant City Manager, advised she was seeking Council direction on their desire to continue providing for taxation of goods -in- transit. In 2007 Council approved an ordinance providing for goods -in- transit exempted under section 11.253, subsection b of the Tax Code. During the last legislative session, Senate Bill 1 was enacted narrowing the definition of "goods -in- transit" and requiring Council to take action to continue taxing these goods. If Council chooses to continue taxing goods -in- transit, Council action must be taken between October 2, 2011 and December 31, 2011 and a public hearing must be held prior to passage of the ordinance. Staff is recommending that an item be placed on the October 24 council agenda for Council to consider continuing the taxing of goods -in- transit. The consensus of the Council was for Staff to proceed with placing the item on the October 24 council meeting for consideration. Mr. Hamilton stated that he was not the engineer on the project but was told that the replat met city requirements. He was available to answer any questions the Council might have. Clayton Comstock, Senior Planner, presented the item. The applicant, Brynwyck Equity Partners, Ltd., is requesting a replat of a 7.662 acre tract off of Martin Drive from 30 residential lots and 3 common areas to 36 residential lots with 2 common areas to conform to a recently approved revised Residential Infill Planned Development (RI -PD). The original Brynwyck planned development and plat was approved in 2007 and platted in 2008 with 30 front swing driveways. The revised RI -PD does allow some front entry garages but includes enhanced open space areas with pedestrian access to Mid- Cities Boulevard. A twenty -five foot emergency access and utility easement is being platted on the southern end of Brynwyck Lane which will be gated and serve as a secondary emergency -only ingress /egress. Adjacent to that, a five foot pedestrian access easement provides direct access to the commercially zoned lots along Mid- Cities Boulevard. The lots being created meet the recently amended minimum 0-1 office lot square footage and lot width requirements. The public improvements necessary for the Subdivision include the installation of a water, sewer, drainage, and street improvements. Therefore, the developer will be required to assume 100% of the amount required for such public infrastructure improvements which are indicated on the final approved construction plans for the subdivision. The Planning & Zoning Commission recommended approval by a 4 -0 vote. Mayor Trevino called for anyone wishing to speak for or against the request to come forward. The City of North Richland Hills and the City of Watauga desire to enter into an agreement for the provision of public safety services on a portion of Rufe Snow Drive that begins at the north side of Hightower Drive with such roadway traveling northbound to its termination at the southern boundary of Keller. The City of North Richland Hills and the City of Watauga have agreed that the City of North Richland Hills shall be responsible for providing police, fire, and emergency medical services on that portion of Rufe Snow Drive north of Hightower Drive regardless of municipal boundaries between the two cities. After some research, a replacement was located that is a product of the Police Research Center at Sam Houston State University. The software offered under their license name CRIMES has the functionality necessary to accomplish what is needed in terms of computer -aided dispatch, detention and records management. The Fire Department explored options for replacement software and during the research it was found that Richland Hills, Haltom City and Watauga are all currently utilizing Firehouse software for their FRMS software. All three other cities are very satisfied with this software vendor. After evaluating the Firehouse software and comparing the features to the new Tiburon software, the Fire Department chose Firehouse for the compatibility, low cost to purchase and lower maintenance costs. The utilization of the Firehouse software allows all 4 cities to share data and each city to serve as a disaster recovery site for each other. The Firehouse software also offers more features and additional service tools to the Fire Department. The total cost of $07,440 includes the conversion of all of the data from the Tiburon FRMS to the new Firehouse program so no historical data will be lost. Since 1991, the City of North Richland Hills has been part of the Fort Worth Public Safety Radio System. The Fort Worth City Council approved an upgrade of the radio system to a modern digital system. To continue to be part of the new radio system, a few changes will need to occur to the radio equipment owned by the City of North Richland Hills. One of the changes needed is the addition of flash P25 software to all 254 of the Public Safety radios. This software is proprietary to Motorola and must be added for the radios to work with the digital system. However, within the Keller Section the current Project plans call for a limited irrigation system to supply water to the trees only. In an effort to create a more consistent corridor, Keller has decided to expand their irrigation system to include irrigation coverage of their median areas as well. General Description: Staff is (bringing forth for consideration an ordinance that would require a Certificate of Occupancy (C.O.) be issued to a building owner prior to a tenant occupying a rental unit in any single - family, two- family, three - family, four- family, or townhome. The program is intended to protect the safety of our citizens by treating rental properties similar to other businesses and requiring a C.O. prior to occupancy. The program will also serve to promote the maintenance of single - family rental buildings, as well as offer incentives by waiving permit fees for building owners who wish to make improvements /repair prior to July 1 , 2012. The program is designed to be convenient, fair, and as inexpensive as possible by providing inspections within one business day, with no registration fees. Ordinance Provisions: The attached ordinance will require all rental units to pass an inspection for minimum maintenance /safety standards found in the city's substandard building provisions prior to a tenant occupying the living unit. The minimum standards can be found in section 98- 462(b) through 98- 462(n) of the North Richland Hills Code of Ordinances and include the following: • Inadequate sanitation. Buildings or portions thereof when they have faulty weather protection which shall include, but not be limited to, the following 1 . Deteriorated, crumbling or loose plaster. 2. Deteriorated or ineffective waterproofing of exterior walls, roof, foundations or floors, including broken windows or doors. 3. Defective or lack of weather protection for exterior wall coverings, including lack of paint, or weathering due to lack of paint or other approved protective covering. 4. Broken, rotted, missing, split or buckled exterior walls or wall coverings or roof coverings. • Fire hazard. Any building or portion thereof, device, apparatus, equipment, combustible waste or vegetation which, in the opinion of the chief of the fire department or the fire marshal, is in such a condition as to cause a fire or explosion or provide a ready fuel to augment the spread and intensity of fire or explosion arising from any cause. • Faulty materials of construction. The use of materials of construction except those which are specifically allowed or approved by the housing code, residential code, or the building code and which have been adequately maintained in good and safe condition. • Hazardous or insanitary premises. The accumulation of weeds, vegetation, junk, dead organic matter, debris, garbage, offal, rat harborages, stagnant water, combustible materials and similar materials or conditions on a premises constitutes a nuisance. • Inadequate exits. • Improper occupancy. All buildings or portions thereof occupied for living, sleeping, cooking or dining purposes which were not designed or intended to be used for such occupancies. The attached ordinance also includes provisions for the following: • No registration or annual fees. • January 1, 2012 effective date. • Provision waiving building permit fees for required repairs until June 1, 2012. • Provision exempting units occupied by the landlord's direct family member(s). • Provision exempting Vt time rentals to prevent foreclosure (or similar hardship). • Provision indicating that units must be inspected before a new water service account can be set up. Common Concerns and Questions: Below is a list of common questions concerning the proposed ordinance that have arisen over the previous weeks: 1. Why would the city want to pass an ordinance on Rental Inspection when most of the items on the check list for corrections are covered by other ordinances? It is true that many of the item are covered by other ordinances; however, there is currently not a way to verify if safety related items are being addressed before someone moves into the rental house. The ordinance being proposed would provide City Staff a method of making sure it is safe for someone to move in. 2. Will the rental property need to be brought up to current codes? The intent of the new ordinance is to only address minimum housing standards identified on a specific list. The ordinance will not require an older house to be brought up to current codes. For example, if an existing house was constructed when aluminum wiring was allowed, this ordinance will not require that the house be rewired to conform to current codes. However, if wire is exposed or an outlet is wired incorrectly, then the safety hazard will need to be corrected. 3. What process did the City go through in order to develop the Housing Standards for Rental Units ordinance? Several cities in the area currently have ordinances that address housing standards for rental units. As a result, staff began the process by reviewing what other cities were doing. Staff also conducted two stakeholder meetings. These meetings were conducted with property owners who rent out property (Landlords), Realtors, and Tenants. After receiving input from all parties, staff drafted a policy that it felt would work best for North Richland Hills. The ordinance being proposed is less restrictive than many of the ordinances adopted by other cities. 4. When did the process begin? Staff began the process in the summer of 2010. The first stakeholder's meeting was on August 25, 2010. There have been two City Council work sessions over the proposed ordinance Recommendation: On October 18"', 2011, the Construction Code Board of Appeals, who also acts as the city's Construction Advisory Board, was presented the parameters of the proposed ordinance and voted 5 to 0 to recommend approval to the City Council. Staff recommends approval of Ordinance Number 3162. Recent Correspondence Email from Councilman Ken Sapp, want to thank staff for the hard work on the rental ordinance. I know there are some members that are not enthusiastic about the ordinance but are being "good troupers" in moving it forward. must tell you, however, that I oppose the proposed ordinance. My opposition is based on principle. My rationale follows: 1. The ordinance inconveniences or punishes good landlords to get at the bad ones. 2. The ordinance discriminates against investor owned properties in favor of owner occupied homes even though the condition of the house may be the same. 3. The exterior of the house is most often a reflection of the interior of the house and according to some things I have read, a good exterior results in a good interior over 70% of the time. 4. it is very possible that property owners may have to repair a house to a condition better than the others in the neighborhood. This discriminates against rental property owners. 5. Some investor owners are there not by choice but as a result of the marketability of the house. This ordinance does not help those folks who find themselves in a property that can not be sold due to the condition of the owner occupied neighborhood and declining property values. These homes often have to be rented at near break even and little allowance to make expensive repairs and lose 2 months rent. I believe we would want to attract investors who would buy run down properties and fix them up for resale. This ordinance deters these investors. we cant fix it blitz enough to cover everyone. We need to attract investors and this ordinance works counter to this argument. do support ordinances that require all houses to be brought up to a common exterior standard. This would be non discriminatory and helps raise neighborhood values through improved appearance. It also will attract the right kind of investors. This ordinance is primarily due to our inability to effectively enforce external property standards city wide. why don't we fix the real problem? once we see the results of upgrading neighborhood exteriors, we can look at interiors of rental properties. Good looking neighborhoods attract higher value renters and therefore higher rent. Renters who pay more will not move into substandard housing. If we must have an ordinance and one is inevitable, one like Fort worth that focuses attention on violators is more desirable than one that affects all, good or bad. Lets put our economic development hat on and look at this again. Please feel free to share my response with others. Dear NRH Council, am writing to ask that you reject the idea of implementing a rental inspection ordinance. I believe this is just more government interference in the private business sector. assume you would charge a fee to cover the cost of the staff to do this, or you already have extra staff that need something to do. I have been a local Realtor since 1982 and a rental property owner and Property Manager since 1984. My husband and I lived in NRH for several years and we currently own 19 single family homes and duplexes and manage 54+ units for other owners. We have always believed NRH was a great area to invest in and we believe our properties are an asset the city can be proud of. believe the inspection of rental properties will have a negative impact on the city. We currently manage several properties in Hurst and Watauga and are familiar with the inspection ordinances. In both cities I can say it is cumbersome and time consuming for the landlord, expensive and unproductive for the city and unnecessary for all parties. Most owner occupants do not qualify for properties needing major repairs. Many do not want the hassle, don't have the skills to do the repairs or the additional funds to make the repairs. NRH needs investors to purchase the foreclosures, & distressed properties to get them off the market as quickly as possible, fix them up and maintain property values. Investors care about their properties and have the skills/financing required to make the repairs. We must maintain high standards based on the competition for the highest quality tenants. We want to achieve the highest possible rents and that requires an attractive, clean, well maintained property inside and out. The inspection ordinance will also not address the issue of run down owner occupied properties. I can name several locations where the rental property is being maintained in better condition than the neighbor that lives next door. Landlords are already held to a higher standard by the Texas Property Code. Tenants have many avenues of recourse if they feel their home is not well maintained by the landlord. Rick Perry was recently quoted as saying "Regulations strangle entrepenuership ". Is that what you want for your city? We do not need more regulations! This not the way to "Revitalize" N. Richland Hills. As a Realtor, II work with many investors. Most have refused to buy in Watauga and Hurst now and have purchased in NRH and Keller. Every property they /we have purchased has been improved due to an investor purchasing it. Keller, Haltom City, Ft. Worth, Grapevine, Colleyville, Southlake, Trophy Club do not have inspection ordinances. The images of Hurst and Watauga have not been improved by their inspection ordinances. A wiser choice is to focus on the "bad guys" rather than subjecting all investors to burdensome and unnecessary inspections. It appears that according to NRH staff, there are 19,000 single - family homes - 2,100 of which are rental, and of these, 200 are substandard. Inspecting all 2,100 units every time there is resident turnover is a lot of wasted time and money for about 1 % of the houses in NRH. Might be more effective and efficient to focus on the 200. This "inspection" process will only, make it more time consuming and costly to get a vacant unit re- leased. I personally own 11 rental units in North Richland Hills and manage many I have also looked at many of these properties and those in the neighborhood around them. Yes, several are duplexes that are in communities of duplexes, but many are single family homes and when looking at the homes around them, I find that many of those homes have more visible problems, i.e., rotted fascia, fences that are leaning, etc. These other homes are `owner occupied' homes and we see nothing being done about those homes. If your ordinance is strictly going to target rental properties, you will be missing the boat (so to speak). one additional item, when a home or duplex is offered for Lease, tenants are not going to lease a property that is unkempt or falling apart. They will move on to the next available property. We have seen this time after time when showing a property to a prospective tenant, they have remarked about having seen other homes that are messed up and therefore they are moving on to the next one on their list. I oppose the Certificate of Occupancy based on tenant turnover for several reasons. 1.) Texas already has laws on its books pertaining to tenant occupied rental properties. Tenants health and safety are already provided protection by the Texas State Property Code. This ordinance is redundant and unnecessary. a. Sec. 92.056. LANDLORD LIABILITY AND TENANT REMEDIES; NOTICE AND TIME FOR REPAIR. (b) A landlord is liable to a tenant as provided by this subchapter if: (2) the condition materially affects the physical health or safety of an ordinary tenant; 2.) Government is already overburdened with laws to enforce. City of NRH will also even if not initially (that seems unlikely), need to hire at least one full time person to do the inspections. Based on 2100 rentals, that is 40 hours a week if each unit changed out one time a year. Some will be less, but then, sometimes tenants don't last a year. Plus, there is likely to be some re- inspections. This may also add additional burden on the water department, and inconvenience tenants - turning away tenant water turn ons if they had lost or don't yet have the "green tag ". I predict the city will have to add additional staff, which in turn will affect the city budget, and potentially increase taxes, . or have to start charging for the Certificate of Occupancy, increasing costs to landlords! 3.) This will have the unintended consequence of causing landlord to avoid the city of NRH when buying potential rental properties. This will in turn cause foreclosed houses (usu. vacant!) to sit longer on the market, as well as abandoned properties staying vacant as well. These are the types of properties Landlords and Investors tend to buy. Landlords actually perform a good service for the community - improve the properties they buy, and provide homes for those who can't buy their own. [Let's not chase them away!] 4.) And lastly, if the city feels they still must create this ordinance, at least smart about use of people and resources to achieve your goals of making NRH a more attractive community, and create a complaint driven ordinance so that the city won't waste time with houses that are in decent shape, allowing adequate time to deal with the 'few' (?10%) that are actually problems. I do believe that Code Enforcement does have the ability to take care of many of the issues the city is facing and needs to do so. One idea that I can put forth to you is this: I do a monthly drive by of all 200 plus properties that we manage in Tarrant County (90 percent of which are single family units). When we see a yard that is not being maintained, or is simply put `junked up', we find a way to get inside of the home to see that the tenants are, or are not, maintaining the house. It may be that would be the way to approach this issue. Thanks for your time, John Stevens RE: Rental Home CO's First of all I am a Realtor and an Investor, it has come to my attention that our great City is looking at rental homes needing CD's. think CO's are a good thing, first of all, they keep the Crack Houses away, if a landlord does not keep the home up, the rent goes down, and then most good landlords do not want to buy in the area, on top of that home owners do not want to buy a home next to or in the same neighborhood of a Crack House. saw this happen in a small town (Blum, Texas - not far from here) to the point the city had to tear down several of the houses that would have leased for up to $800 a month, one landlord owner owned about 25 homes (inherited from her grandfather) she was getting only between $150 to $350 a month, bathrooms did not work, broken windows, bad roofs, no working AC and Heat and mold issues. Once they (the City) got rid of the bad homes, rental prices in a whole went up, crime went AWAY, by the way, the School was set on fire twice before this was put into place by people who lived in the low dollar rentals. own several Rentals in several City's and represent many investor clients who also own rentals throughout the Metro,plex, some City's (ie Hurst, River Oaks) require inspections and they are not a big deal, they give out a list of things that the property need to have, smoke detectors, GFCI plugs in 'Kitchen and Baths, no rotted wood, all safety items and items we need to have in place to keep our value to our asset. The City inspectors do not want to spend half their day crawling under home, they have better things to do, they know their list and spend in the most part 10 or 15 minutes on their inspection. make sure we do it. I even use this list on my homes that do not have a City inspection code, my handyman knows my list and does not even ask me if I want something fixed or upgraded, he just does it. The City inspector comes out once and walks through the home and lets me know if we missed anything, I fix it and he come back out, signs off and it is done until the property is vacant again, then they have to have a new CO. Once a year I send the City a report showing that it is still leased out to the same tenant and no inspection is needed... The owner of a residential rental unit must obtain a Certificate of Occupancy from the Building Official prior to the unit being occupied by a new tenant. The Building Official or Ihis designated representative will inspect the unit and premises for compliance with Sections 98- 462(b) through 98- 462(n) of the North Richland Hills Code of Ordinances and other applicable ordinances of the City. If deficiencies are found, the Building Official may prohibit occupancy of the unit and premises until such time as the owner takes action needed to bring the unit and premises into compliance. The inspection required by this section shall also be required for a dwelling unit and premises prior to its original occupancy as a rental unit. Exceptions: 1. Units provided to members of the building owner's immediate family. 2. Units that have entered the rental market in an effort to prevent foreclosure or similar economic hardship. This exception shall apply to the initial tenant of the rental unit only. R110.2.2.1 If the dwelling unit is found to be occupied prior to inspection, the Building Official shall assess an administrative fee, as indicated in the Fee Schedule found in Appendix A of the North Richland Hills Code of Ordinances. This fee shall be paid by the owner prior to any subsequent inspection or reinspection of the unit and shall be cumulative of all other fees or penalties provided in this code. 'Amend Section 110.3; change to read as follows: R110.3 Rental Certificate of Occupancy. When the Building Official or his representative determines that a rental dwelling unit and premises are in compliance with the provisions of this code and other applicable codes of the City of North Richland Hills, a Rental Certificate of Occupancy containing the following shall be issued 1 . The address of the structure; 2. A statement that the described portions of the structure have been inspected for compliance with the requirements of this code; 3. The name of the tenant (if known at the time of inspection) 4. The name of the building inspector; 5. The date the Rental Certificate of Occupancy was issued. No water service account to any single - family rental unit shall be established until the Building Official or his designated representative has issued a Rental Certificate of Occupancy for the unit. R110.3.2 Temporary Rental Certificate of Occupancy. In cases where violations are minor and will not affect the safety of the occupants), the Building Official is authorized to issue the owner a 60 -Day Temporary Rental Certificate of Occupancy. It is the responsibility of the building owner to correct all noted deficiencies and to obtain a reinspection prior to the expiration of the temporary rental certificate of occupancy. Failure to correct all deficiencies prior to the expiration of a temporary rental certificate of occupancy is considered a violation of this code and shall be subject to penalties as prescribed by ordinance. They were quiet, considering the job they had to do, and they were quick. The water was back on before his wife even knew there was a problem, the resident said.
