The meeting was called to order by Chairman Tom Duer at 6:30 p.m.

Approval of August 11, 2011 Gas Board of Appeals Meeting Minutes.
APPROVED
Garry Cope, seconded by Kathy Luppy, motioned to approve the minutes from
August 11, 2011. The motion carried unanimously (4 -0).

GB 2011 -05
Public Hearing and consideration of a request from Chesapeake Energy
Corporation for a deviation from distance requirements from existing structures
to gas wellheads at the proposed Graham B4H & B5H Gas Wells, 7000 Hightower
Drive. Distance requirements are established in Section 104 -6 of the City of North
Richland Hills code of Ordinances.
Greg VanNeiuwenhuize came forward for a request from Chesapeake to approve a
deviation from the cities distance requirements for gas wells relative to residential

structures. This request is for Graham B4H and B5H as you had indicated in the 7000
block of Hightower Drive. The cities requirements are that the gas wells must be 600
feet from certain types of structures and residential structures meeting that criteria.
Similar to the other Graham gas wells that have drilled to date or are requesting to be
drilled. This sits within a couple different subdivisions and presently there are 6
structures that are within 600 feet. All of these structures are in excess of 300 feet. The
reason this is important is between 300 -600 feet we don't necessarily need any
approval from the affected property owners however that is nice to have. Between 150-
300 feet those property owners must be in favor. That condition does not exist as I
indicated there are 6 structures that are within 600 feet. The residential structures for
the 6 are all in excess of 400 feet from the 2 proposed gas wells. Staff has reviewed
the application and recommends approval of the deviation request. I would be happy to
answer any questions.
Scott Castaneda, 100 Energy Way, Fort Worth, TX 76102, came forward representing
Chesapeake Energy. The request here is actually just a name change for the existing
wells.
Tom Duer asked if this was something that was approved before but with a name
change you had to come before the Gas Board of Appeals?
Scott Castaneda said no. It is part of the development plan.
Greg VanNeiuwenhuize said that they are requesting to be able to build these two wells
within the 600 foot threshold. One of the wells B5H will have a name change however
that can be handled at the staff level. So what is being requested of you tonight is to
approve the location of these two wells.
Garry Cope asked if the people within the 600 feet had been contacted?
Scott Castaneda said that those people have been contacted previously.
Garry Cope asked about the homeowners in the new addition on the west side?
Scott Castaneda said that he believe that they have been contacted as well.
Greg Lindsey said that they had been contacted.
Garry Cope said that this is the first time we have had people affected on that side.
Greg VanNeiuwenhuize said yes.
Tom Duer said that we knew that this was going to happen as soon they decided that
they were going to build residential there. We knew that with the additional wells that
there may be aspects that we didn't have before. They have been notified by the city.
Greg VanNeiuwenhuize said yes.

Scott Castaneda said that he believes that the gentleman that owns that development
has also notified those people as well.
Marty Kusmierski said that they are not here and they were notified about the meeting.
Garry Cope said that these houses are all new enough that they have to be notified at
closing also.
Greg VanNeiuwenhuize said yes. There is a Gas Well vicinity notice.
Tom Duer said of the previous drilled wells. This is a new request that has to come
from the city.
Public Hearing opened 6:38 pm
With no one wishing to speak the public hearing was closed at 6:38pm
APPROVED
Kathy Luppy, seconded by Marty Kusmierski, motioned to approve GB2011 -05.
The motion carried unanimously (4 -0).

There being no further business, the meeting was adjourned at 6:39 p.m.
