Consideration of Minutes from the April 19, 2012 Planning & Zoning Commission
Meeting.
APPROVED
Kathy Luppy moved to approve the minutes from April 19, 2012, seconded by Don
Bowen. The motion passed unanimously (6 -0).

Consideration of Minutes from the May 3, 2012 Planning & Zoning Commission
Meeting.
APPROVED
Bill Schopper moved to approve the minutes from May 3, 2012, seconded by Mike
Benton. The motion passed unanimously (6 -0).
Chairman Shiflet said that there would be two cases moved ahead of the Public
Hearings as presented on the agenda. He thanked the representatives present but
since they are not public hearings they did not need to present the cases.

RP 2012 -06
Consideration of a Replat to create Tracts 2R -1, 2R -2, and 2R -3, NRH Industrial
Park on property currently described as Tract 2, of Tract 1, 2, and 3, NRH
Industrial Park; located on 3.275 acres in the 5700 Block of Rufe Snow Drive.
APPROVED
Mark Haynes moved to approve RP 2012 -06, seconded by Mike Benton. The
motion passed unanimously (6 -0).

RP 2012 -02
Consideration of a Replat to create Lot 1 R, Block A, College Hill Addition on
property currently described as Blocks A and B and Lot A, Block 28, College Hill
Addition; located on 41.07 acres at 6200 Holiday Lane.
APPROVED
Bill Schopper moved to approve RP 2012 -02, seconded by Don Bowen. The
motion passed unanimously (6 -0).
Chairman Shiflet said the following three cases are all related, therefore all public
hearings would be opened at this time.

ZC 2012 -04
Public Hearing and Consideration of a request from B.H.L. Joint Venture for a
Zoning Change from C -1 Commercial, 0-1 Office and R -2 Single Family
Residential to U Institutional on approximately 12.294 acres in the 8200 Block of
Davis Blvd.

ZC 2012 -05
Public Hearing and Consideration of a request from B.H.L. Joint Venture for a
Zoning Change from 0-1 Office and R -3 Residential to R -2 Residential on
approximately 1.836 acres in the 8200 Block of Davis Blvd.

RP 2012 -03
Public Hearing and Consideration of a request from B.H.L. Joint Venture for a
Replat to create Thornbridge West Addition, being a revision of a portion of
Holder Smithfield Estates and a tract of land out of the Stephen Richardson
Survey, Abstract No. 1266, containing 24.964 acres in the 8200 Block of Davis
Blvd.
Clayton Comstock came forward stating these cases are requests from B.H.L. Joint
Ventures for zoning changes and a replat for 37 Tots and 2 open space lots on 25 acres.
The property is located off Davis Boulevard on Timber Drive by the Little Bear Creek
Corridor property where the City does plan to have a hike and bike trail. This is a replat
because the area is currently platted as Holder Smithfield Estates. If the developer so
chose, he could go in today and develop 11 residential lots after public infrastructure
was put in. The zoning changes did come before this Commission on April 19, 2012
where it was recommended for approval 5 -0, "U" Institutional and "R -2" Residential. On
May 3, 2012, the P &Z considered and recommended approval of the replat with the
cul -de -sac at the end of Timber Drive to be defined by City Staff in cooperation with the
neighborhood so the new development was not connected by a through street. On May
14, 2012 the City Council heard all three cases and continued all items to the June 25,
2012 with direction to the developer to align with Shadywood Lane to create safer
conditions on Davis Boulevard. On April 19, 2012 the replat showed only one public
access for the entire development as well as the existing Timber Drive. There was a
proposed connection at the south end of Timber Drive to the new development off
Clearspring Drive and an emergency access easement which gave us the required two
entry points for a new residential subdivision of greater than 30 lots.
Clayton Comstock said with City Council's direction and working with Staff, the
developer did propose a new alignment of the entry to the subdivision at Davis
Boulevard and Shadywood Lane which will be a fully signalized intersection that also
has a pedestrian crossing for the hike and bike trail. The new hike and bike trail will
soon be installed with a grant received by the City should the developer dedicate the 12
acres for public use. With that change of the fully signalized intersection at Davis and
Shadywood, the developer has proposed —and City staff agrees —that the Timber Drive
intersection with Davis Boulevard would change to a right in -right out only, to minimize
safety concerns on Davis Boulevard. Regarding the zoning changes, there are a few

boundary changes which are very minimal on each of the zoning changes but everyone
was notified again for these changes. Staff does recommend approval of the replat and
zoning changes and sees it as mutually beneficial between all parties: the City,
developer and existing residents on Timber Drive. The existing residents on Timber
Drive now have access to a signalized crossing at Davis Boulevard; the City would have
a dedicated public use area for the hike and bike trail; and the developer does gain one
lot and with the infrastructure amount involved with this alignment, the addition of the lot
is helpful to the developer. The City is participating in the drainage and intersection
improvements at Davis Boulevard and Shadywood Lane.
Chairman Shiflet asked if the vote tonight would require a supermajority since there is a
petition from the residents.
Clayton Comstock said the supermajority is applicable only in the case where a replat
has a variance request attached to it, per state code section 212.015 of the Texas Local
Government Code. Regarding the zoning changes, we do not see the "U" Institutional
zoning boundary as having any kind of impact with the 20 %. The R -2 zoning request,
Staff is still doing the calculation so we are running the figures and will have them
available at the City Council meeting if this moves forward.
Charles Schultz, 700 Harwood Road, Hurst, TX came forward as the applicant stating
he has prepared all the documents and has done so with cooperation from the City
Staff.
Kelly Elliott, 8628 Timber Drive came forward stating he is puzzled at the point of the
meeting because on May 3, 2012 this Board recommended that a cul -de -sac be added
at the south end of Timber Drive to the City Council. But it was not presented to the
City Council that way so he does not understand what has happened. He said he met
with the City Planners about a week ago to review this plan and all changes are positive
except the cul -de -sac issue has not been resolved for the residents on Timber Drive.
Judy Showalter, 8624 Timber Drive came forward stating since everyone agreed to and
this P &Z recommended to City Council to add a cul -de -sac to the residents on Timber
Drive, but it still has not been resolved.
Clayton Comstock said City Staff has continued to support the connection. We have
met with the developer after City Council discussed the Shadywood Lane connection
which was their main recommendation. Regarding the Timber Drive connection, it has
always been the recommendation of Staff to connect through and with the added cost of
the alignment and drainage improvements at Davis and Shadywood, any kind of
decrease in the number of lots would affect their bottom line, so that has been their
argument of not losing any lots for the cul -de -sac.
Bill Schopper stated that he approves of the replat and intersection for the hike and bike
trail.
Clayton Comstock also said that that Staff agrees a cul -de -sac would create additional
trips per vehicle that may not know it is not a through street. Staff did meet with three
residents on Timber Drive the day before the notifications were set to go out for this

t meeting; our plan was to hold off on the notifications if there was any kind of resistance
from that meeting. But the meeting went very positively with the residents and
developer so we moved forward with the notifications and meeting after the feedback
from the residents.
Mike Benton asked about the right in -right out lane and there was some discussion
about the intersection.
Michael Bofrus, 6701 Pecan Park, Richland Hills, came forward speaking on behalf of
his father, 8632 Timber Drive with questions on drainage. He also has concerns about
traffic impact on right in — right out on Timber Drive because he thinks everyone will go
down Timber Drive to avoid a signalized intersection to save time.
Charles Schultz explained how the drainage was refigured on the replat. `
Kelly Elliot asked how the right in -right out would be constructed at Timber Drive and if
Timber Drive would be improved with the rest of the development.
Greg Van Niewenhuize said it would be a triangle only allows traffic to go right and is
usually not on a replat. There will probably still be people who try to go left because of
the width of Davis, but overall it will create a safer turn for the residents.
Mark Haynes asked is there a current plan to widen Timber Drive?
Greg Van Niewenhuze said no there is not.
Chairman Shiflet asked if anyone else wished to speak for or against, seeing none he
closed the public hearing and entertained a motion.

Don Bowen moved to approve ZC- 2012 -04, seconded by Kathy Luppy. The
motion passed unanimously (6 -0).

Mark Haynes moved to approve ZC 2012 -05, seconded by Don Bowen. The
motion passed unanimously (6 -0).
APPROVED
Mike Benton moved to approve RP 2012 -03, seconded by Don Bowen. The
motion passed unanimously (6 -0).
Don Bowen said this change solves all the problems regarding safety and
improvements.

Chairman Shiflet said he thinks with this proposal it allows another route for residents to
not be running up Timber Drive. If this consideration had been presented before, this
would have been the first choice.
