Consideration of Minutes from the March 7,
2013 Planning & Zoning Commission

TR 2013 -02 Public Hearing and Consideration of Amendments to Article VIII
"Screening And Fencing Regulations" and Section 118 -001 "Definitions" of the
North Richland Hills Zoning Ordinance.
Clayton Comstock came forward with a presentation of a proposed amendment to the
City's Screening and Fencing Regulations. The primary purpose is two -fold: to provide
greater flexibility for rural fence types and to address minimum standards for dumpster
enclosures which will implement a component of the 2001 City Image Study. Article VIII
of the ordinance includes masonry screening walls,
screening wall and fence criteria,
screening of outdoor refuge, and mechanical equipment screening standards. The

The only changes to front yard fences will be spacing of brick or stoned columns 20 -50
feet on center, 200 foot frontage lots has more flexibility of the spacing of 20 -50 feet on
center. We have added a section of rural fence types for AG or R -1 S with a minimum of
one acre and 150 feet of street frontage to include mortised split rail and the use of
cable can be used in conjunction with steel pipe fencing. The ordinance was changed
about 5 or 6 years ago to include the wrought iron, but since a lot of existing front yard
fences have been deemed non - conforming, we are now going back and making them
conforming to allow for the rural fence types. This will allow certain properties with no
fences to have the rural fence option.
Maintenance of screening walls and fences have been extensively updated to include
repair, braces, bolts, structure, rust, infestation, rot, loosening, support and paint, stain
of new or existing screening. This information was borrowed from the Architectural
Standards to ensure they are primary in color.
Steven Cooper asked if a homeowner association considered the property owner
regarding fences.
Clayton Comstock said yes, if there is fence /screening easement and the fence is a
perimeter fence for the subdivision, the HOA's typically maintain those. They are not
ultimately responsible for them, but they maintain them if there is an easement. If it is on

their property, it is their responsibility. It there is a maintenance issue, we will go to the
homeowner first.
Clayton Comstock said the screening of outdoor refuge containers is a major part of the
revision because of the Scenic City Certification Program which recommended that we
incorporate them into our ordinance to help us achieve the gold level standard. The
containers shall be brick or stone installed in a craftsman like manner, a minimum
internal dimension of twelve feet by twelve feet which comes from our waste
management guidelines which we are in a contract with. There must be a pedestrian
access on at least one side and must have metal gates with spring loaded or self -
closing hinges. The minimum height is six feet or one foot in height above the container.
Gates shall be metal with 20 gauge metal deck supported by frame or spring loaded or
self- closing hinges. Container locations shall minimize visual impact from adjacent
properties and rights of way and set back twenty five feet from all property zoned for
residential use, designated on the Comprehensive Land Use Plan for residential use or
used for subdivided or residential use. The landscape screening is required where
possible or to soften the edges of the dumpster.
Chairman Shiflet asked if the dumpster in the Power Point met the requirements as far
as the bollards.
Clayton Comstock said no, it did not, but these are design specifications for instances
with enclosures adjacent to a fire lanes. This will most likely be on a case by case
basis.
Chairman Shiflet asked about the dumpster enclosure on Rufe Snow for Firestone and
if it met the requirements?
There was a general discussion about the required maintenance on existing dumpsters
and how this change would implement the new requirements.
Clayton Comstock continued discussion about fences and walls along thoroughfares
stating the regulations are already on the books in the subdivision ordinance, but not in
the zoning code where it belongs. Changes include where a residential subdivision
masonry screening wall is provided adjacent to a C -4 -U collector street or larger as
identified on the Master Thoroughfare Plan, the height of a fence adjacent or
perpendicular to the screening wall shall not exceed the height of the subdivision's
screening wall. In addition, the finished side or smooth side shall face the thoroughfare
and metal poles are required. There is a new provision regarding auto repair businesses
stating masonry screening walls have to screen the vehicles waiting repair at the side or
rear of the business. Chain link fences are not allowed in any front yard or street
frontages. Masonry columns may not exceed the height of more than 8 inches.
Chairman Shiflet asked the chain link applied to only residential?
Clayton Comstock said no, it applies to all businesses as well. But it only applies where
there is a street frontage and for a principal building on a lot. There are number of
fences on the south side of town along a street, but replacing them would have to be
wrought iron or wood privacy.

Chairman Shiflet said he did not like that and along the older side of town where there
are side yards.
Don Bowen asked if this affected anything in place now or if it was only if the fences are
being replaced?
Clayton Comstock said that is correct, only if the fence is being replaced. The other
existing chain link fences are "grand- fathered" or legal non - conforming.
This applicability of the article is only going to apply to new construction or where fifty
percent or more of an existing screen, fence or wall requires replacement. The
masonry screening applicability is being decreased from 75% to 50 %.

There was a general discussion about chain link fences and how it is applicable to the
current provisions.

at 7608 Boulevard 26.
Craig Hulse, 8159 Westwind Ct, NRH came forward on behalf of the City of North
Richland Hills for a replat application for the new City Hall Municipal Complex. There
will be a ground breaking on April 5 at 3:00 p.m. signifying the start of construction.
This is an action item for a replat for a piece of property that City Council authorized for
purchase at the corner of Road to the Mall and Boulevard 26. It is an access piece of
property currently owned by Sonic. We are in the closing period currently and will close
upon completion of this replat.
APPROVED
Don Bowen motioned to approve RP 2013 -01 as proposed. The motion was
seconded by Mark Haynes. The motion passed unanimously (6 -0).
