HomeMy WebLinkAboutOrdinance 1237 ORDINANCE NO. 1237 BE IT ORDAINED by the City Council of the City of North Richland Hills, Texas, that Ordinance No. 873, adopted February 9, 1981, Plumbing Code for the City of North Richland Hills, be amended so that the following amendments to the said Plumbing Code be and they are hereby made as follows: Section 19-1. Adoption of Plumbing Code and Standards. The Uniform Plumbing Code, 1985, the IAPMO Installation Standards and amendments and revisions thereto as adopted by the International Association of Plumbing and Mechanical Officials, a copy of which is attached hereto is hereby adopted and designated as the plumbing code of the City, the same as though such code were copied at length herein except as amended, added to or deleted in this chapter. Three (3) copies of the code and amendments are on file in the office of the City Secretary. Section 19-2. Code construed as remedial. (to remain the same). Section 19-3. Scope; applicability. (to remain the same). Section 19-4. Violations and penalties. Any person, firm or corporation or agent who shall violate a provision of this code or fail to comply therewith or with any of the provisions thereof, or violate a detailed statement or plans submitted and approved thereunder, shall be guilty of a misdemeanor. Each such person shall be deemed guilty of a separate offense for each and every day or portion thereof during which any violation of any of the provisions of this code is committed or continued, and upon conviction in the court of jurisdiction for any such violation such person shall be punished by a fine of not less than fifty dollars ($50.00) and not more than one thousand dollars ($1,000.00). Each day the condition exists constitutes a separate violation. Section 19-5. Plumbing Official and Inspection Department. (to remain the same). Section 19.6 Right of entry. (to remain the same). Section 19-7. Liability of enforcement officers, board, etc. (to remain the same). Section 19.8. Requirements not covered by code. (to remain the same). Section 19-9. Licensing and bonding of plumbers. (to remain the same). Section 19-10 Section 19-11. Section 19-12. Section 19-13. Section 19-14. Section 19-15. Section 19-16. Section 19-17. Section 19-18. Allowing name, license or bond to be used to obtain permit fraudulently. (to remain the same). Illegal work; revocation of license. (to remain the same). Plumbing installation or maintenance by homeowner. (to remain the same). Alternate materials, methods of installations. (to remain the same). Maintenance. (to remain the same). Mandatory sewer connections. (to remain the same). Test of suspected defective plumbing. (to remain the same). Unsafe installations. (to remain the same). Floor drains required. All commercial businesses shall install a floor drain for both public and employee restrooms. They will be equipped with a P-trap as set forth in the Uniform Plumbing Code Section 706. Section 19-19. Approved materials for water service. Copper tube for water piping shall have a weight of not less than Type L. PVC Schedule 40 pipe may be used for the water service from the meter to within two (2) feet of the structure. Sections 19-20 ---- 19-34. Reserved. ARTICLE II. PERMITS Section 19-35. Required; exceptions. This section of Ordinance #873 paragraph 104.1, adopted on February 9, 1981 shall be amended to read: Permit required. (a) It shall be unlawful for any person to install, remove, alter, repair or replace or cause to be installed, removed, altered, repaired or replaced any plumbing, gas or drainage piping work or any fixture or water heating or treating equipment in a building or premises without first obtaining a permit to do such work from the Administrative Authority. (b) A separate permit shall be obtained for each building or structure. (c) No person shall allow any other person to do or cause to be done any work under a permit secured by a permittee except persons in his employ. (d) Ordinary minor repairs my be made with the approval of the plumbing official without a permit provided that such repairs shall not violate any of the provisions of this code. (e) Work not requiring a permit shall be subject to Part I, Administration, Section 20.5 of the Uniform Plumbing Code. Section 19-36. Application. (to remain the same). Section 19-37 Drawings and specifications. (to remain the same). Section 19-38. Fees. This section of Ordinance #873 paragraph 106.1, 106.3 (A) (B) adopted February 9, 1981 shall be amended to read: No permit shall be valid until the fees prescribed in this section shall have been paid. The City Council may increase these fees or establish such additional fees as it deems necessary. PERMIT ISSUANCE (1) For issuing permits (3) through (16) $15.00 2) For issuing each supplemental permit One bath 25.00 One bath with gas appliances 35.00 Two bath 35.00 Two bath with gas appliances 45.00 Three bath 45.00 Three bath with gas appliances 55.00 UNIT FEE SCHEDULE In addition to item (1) or (2): (3) For each plumbing fixture or trap or set of fixtures on one trap (including water, drainage piping and backflow protection therefore) 4.00 (4) For each building sewer and each trailer park sewer 15.00 (5) Rainwater systems, per drain (inside building) 6.00 (6) For each cesspool (where permitted) 25.00 (7) For each private sewage disposal system 35.00 (8) For each water heater and/or vent 7.50 (9) For each gas piping system of one to five (5) outlets 10.00 (10) For each gas piping system over five (5) outlets, per outlet 1.50 (11) For each industrial waste pretreatment interceptor including its trap and vent, excepting kitchen-type grease interceptors functioning as fixture traps 12.00 (12) For installation, alteration or repair of water piping and/or water-treating equipment, each 3.00 (13) For repair or alteration of drainage or vent piping each fixture 3.00 (14) For atmospheric-type vacuum breakers not included in item (4): 1 to 5 over 5, each 7.50 1.50 (15) For each backflow protective type vacuum breakers: 2 inches and smaller Over 2 inches device other than atmospheric- 7.50 15.00 (16) For each lawn sprinkler system on anyone meter including backflow protection devices therefor shall be fifteen dollars ($15.00) plus estimated cost based on Table No. 3-A of the Uniform Building Code. Section 19-39. Issuance or refusal. (to be the same) Section 19.40. Conditions of the permit; effective period shall be amended to read: A permit issued shall be construed to be a license to proceed with the work and shall not be construed as authority to violate, cancel, alter, or set aside any of the provisions of this code, nor shall such issuance of a permit prevent the plumbing official from thereafter requiring correction of errors in plans or in construction or of violations of this code. Any permit issued shall become invalid unless the work authorized by it shall have been commenced with six (6) months after its issuance, or if the work authorized by such permit is suspended or abandoned for a period of six (6) months after the time the work is commenced; provided, that for cause, one extension of time for a period not exceeding ninety (90) days, may be allowed in writing by the plumbing official. An extension may be granted if a request is submitted in writing to the plumbing official before the permit expires. After the permit expires a new, full permit fee must be paid before the permit is renewed. Section 19-41. Failure to obtain a permit. (to be the same) Section 19-42. Revocation. (to be the same) Sections 19-43----19-57. Reserved. ARTICLE III. INSPECTION AND TESTING OF WORK This section of Ordinance #873 adopted on February 9, 1981 is included in the Uniform Plumbing Code and need not to be repeated. This section or Ordinance #873 shall be amended to read: Section 19-58. Inspection and related fees. [The following shall be paid for inspection and related reviews] (1) Inspections outside of normal business hours, per hour 30.00 (Minimum charge-------Two (2) hours) (2) Reinspection fee assessed under provisions of Sec. 305(g) of the Uniform Building Code 30.00 (3) Inspections for which no fee is specifically indicated, per hour 30.00 (4) Additional plan review required by changes, additions, or revisions to approve plans, per hour 30.00 (Minimum charge----one half hour) Section 19-59. Stop-work orders. Upon notice from the plumbing official that work on any plumbing installation is being done contrary to the provisions of this code or in a dangerous or unsafe manner, such work shall be immediately stopped. Such notice shall be in writing and shall be given to the permit holder, or to his agent, and shall state the conditions under which work may be resumed. Where any emergency exists, oral notice given by the plumbing official shall be sufficient. That all Ordinances or parts of Ordinances in conflict herewith are hereby repealed. This Ordinance shall be in full force and effect from and after its date of passage and approval.
