ZONING CASE ZC 2013 -11
AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN AND THE
COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF NORTH
RICHLAND HILLS; AMENDING THE ZONING MAP OF THE CITY OF
NORTH RICHLAND HILLS, TEXAS, AND REZONING A 1.604 ACRE
TRACT OF PROPERTY FROM AG (AGRICULTURAL) AND 0- 1 -NR -PD
(NONRESIDENTIAL PLANNED DEVELOPMENT) TO NR -PD
(NONRESIDENTIAL PLANNED DEVELOPMENT) ZONING;
ESTABLISHING A PENALTY; PROVIDING FOR PUBLICATION; AND
PROVIDING AN EFFECTIVE DATE.
WHEREAS, notice of a hearing before the Planning and Zoning Commission was sent
to real property owners within 200 feet of the property herein described at
least 10 days before such hearing; and,
WHEREAS, notice of a public hearing before the City Council was published in a
newspaper of general circulation in the City at least 15 days before such
hearing; and,
WHEREAS, public hearings to zone the property herein described were held before
both the Planning and Zoning Commission and the City Council, and the
Planning and Zoning Commission has heretofore made a
recommendation concerning the zone change; and,
WHEREAS, the City Council is of the opinion that the zone change herein effectuated
furthers the purpose of zoning as set forth in the Comprehensive Zoning
Ordinance and is in the best interest of the citizens of the City of North
Richland Hills; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS:
Section 1: THAT the Comprehensive Plan, the Comprehensive Zoning Ordinance
and the zoning map of the City of North Richland Hills are hereby
amended by rezoning a 1.604 acre tract of land located at 8301 and 8309
Davis Boulevard in the City of North Richland Hills, Tarrant County, Texas,
more particularly described in the legal description attached hereto as
Exhibit A from AG (Agricultural) and 0- 1 -NR -PD (Nonresidential Planned
Development) to NR -PD (Nonresidential Planned Development) zoning
and approving the site plan attached hereto as Exhibit B.
Section 2: Any person, firm or corporation violating any provision of the
Comprehensive Zoning Ordinance as amended hereby shall be deemed
guilty of a misdemeanor and upon final conviction thereof fined in an
Ordinance No. 3267

amount not to exceed Two Thousand Dollars ($2,000.00). Each day any
such violation shall be allowed to continue shall constitute a separate
violation and punishable hereunder.
Section 3: The City Secretary is hereby authorized and directed to cause the
publication of the descriptive caption and penalty clauses of this ordinance
as an alternative method of publication provided by law.
Section 4: This ordinance shall be in full force and effect immediately after passage.
AND IT IS SO ORDAINED.

WHEREAS Russell E. Johnson and Nisher Operations, LP are the owners
of that certain lot, tract or parcel of land situated in the S. Richardson
Survey, Abstract Number 1266, City of North Richland Hills, Tarrant
County, Texas, and being that certain tract of land described: by deed
to Nisher Operations, LP, recorded under Document Number D206326239
of the Official Public Records of Tarrant County, Texas and being all of
Lot 1, Block A, Munsell Subdivision, on addition to the City of North
Richland Hills, Tarrant County, Texas; according to the plat thereof
recorded in Cabinet A, Slide 10827 of the Plat Records of Tarrant
County, Texas, and being more particularly described as follows:
BEGINNING at a }1/ inch iron rod found for the south corner of said Lot
1, Block A and the southeast corner of that certain tract of land
described by deed to the City of North Richland Hills Tarrant County,
Texas — Park Department, recorded under Document Number
D204065839 of the Official Public Records of Tarrant County, Texas,
being in the northwest line of Davis Boulevard, a public roadway,
THENCE North 00 degrees 24 minutes 27 seconds West, with the east
line of said Pork Department tract, a distance of 354.93 feet to a
inch iron rod with a yellow cap stamped `ARTHUR SURVEYING COMPANY"
set for the northwest corner of said Munsell Subdivision;
THENCE North 88 degrees 20 minutes 57 seconds East, with the north
line of said Munsell Subdivision and passing a )� inch iron rod found at
a distance of 1.23 feet and continuing for a total distance of 17.36
feet to a / inch iron rod found for the southwest corner of said Nisher
Operations tract;
THENCE North 00 degrees 38 minutes 21 seconds West, with the west
line of said Nisher Operations tract, a distance of 85.11 feet to a X
inch iron rod with a cap stamped 'hook" found for the southwest
corner of that certain tract of land described by deed to 8. H. & L. JV
of Hurst, recorded in Volume 7761, Page 1532 of the Deed Records of
Tarrant County, Texas;
THENCE North 88 degrees 16 minutes 43 seconds East, with the south
line of sold 8. H. & L. JV of Hurst tract, a distance of 282.92 feet to
a g inch iron rod found for the southeast corner thereof and being in
the northwest tine of sold Davis 8oulevord
THENCE South 29 degrees 43 minutes 57 seconds West, with the
northwest line of said Davis Boulevard and passing a 9 inch iron rod
found for the southeast corner of sold Nisher Operations tract and the
northeast corner of said Munsell Subdivision at a distance of 100.08
feet and continuing for a total distance of 177.03 feet to a X inch iron
rod with a yellow cap stamped `ARTHUR SURVEYING COMPANY" set for
corner at the beginning of a curve to the left having a radius of
1849.86 feet;
THENCE continuing with the northeast line of said Davis Boulevard and
with said curve an arc length of 362.64 feet, having a delta angle of 11
degrees 13 minutes 55 seconds, whose chord bears South 35 degrees
20 minutes SS seconds West, at a distance of 362.06 feet to the
POINT OF BEGINNING, and containing 1.604 acres of land, more or less.

Nonresidential Planned Development (NR -PD District No. 50)
Land Use and Development Regulations
North Richland Hills, Texas
This Nonresidential Planned Development (NR -PD) District shall adhere to the conditions of the
North Richland Hills Code of Ordinances, as amended, and adopt a "base district' of "O -V
Office District. In addition to the attached Site Plan, Landscape Plan, and other exhibits, the
following regulations shall be specific to this NR -PD District. Where these regulations conflict
with, or overlap another ordinance, easement, covenant or deed restriction, these regulations
shall prevail.
ZONING
Permitted Land Uses. Uses in this NR -PD shall be those permitted in the "O -V Office
District and shall also include the following:
a. Pet Day Care
b. Pet Lodging
c. Veterinary Clinic with enclosed kennels
2. Development Regulations. This NR -PD shall follow the development regulations of the
"0-1" Office District.
3. Effectiveness of attached Site Plan exhibits. Site plans and site plan revisions which
comply with all development related ordinances and this Ordinance, including its
attached exhibits, shall be administratively approved by the staff Development Review
Committee. Major deviations from the regulations provided herein or the exhibits
attached hereto, as determined by the Development Review Committee, shall require
City Council approval of a zoning change to revise this Nonresidential Planned
Development.
