Agenda Item F.3 - Assistant Chief Hamlin advised of a couple of minor changes to the Sciens Technology consulting contract. A.1 Presentation and discussion regarding the addition of a Freeway Corridor Overlay District to the Zoning Ordinance and the removal of the Mid - Cities Overlay Zone. (15 Minutes) Clayton Comstock, Senior Planner, presented concepts for a Freeway Corridor Overlay District. The District would include the entirety of all properties which adjoin or are located within 200 feet of the ultimate right -of -way for Northeast Loop 820 (IH 820) and Airport Freeway (SH 121/SH 183) and are not planned for residential use or Transit Oriented Development as shown on the City's Comprehensive Land Use Plan. Mr. Comstock discussed with Council proposed concepts for architectural standards, corridor landscaping, screening and fencing, and land uses. The concepts presented were: • Architectural standards — would apply to all buildings in the District, removing the current 10,000 square foot applicability, and incorporate 5 to 10 % minimum use of limestone on the front and side building facades. • Corridor Landscaping - Matching deciduous canopy trees in strong geometric designs characterized by every spacing that create visual rhythm and repetition; Low limestone planter walls (limestone to match that used in NRH gateway pylons). Staff is proposing to keep current street landscape quantity requirements (1 large tree per 50 feet of frontage, 10 shrubs per 50 feet of frontage or solid parking lot screening), require 50 -foot spacing of select large trees, ornamental /small trees permitted at driveways only, and reduce required width to 10 feet. Option 1: 6% of property frontage's vertical plane shall be a limestone hardscape element, built in a broken or random- coursed ashlar masonry style 24" > 36" in height. Option 2: 36" bollards placed 50' on- center, off -set from canopy trees; shrubs between. • Residential screening - Increase minimum required residential screening wall from 6' masonry to 8' masonry and walls to have limestone element (i.e. columns or 100% of wall). • Land Uses — examples were given of uses that would be prohibited in the District. Council generally concurred with the concepts presented with the exception of incorporating 5 to 10% minimum use of limestone on the front and side 'building facades. Council supported the limestone markers and bollards but was not supportive of placing the limestone requirement on building facades. A.4 SPECIAL PRESENTATION AND RECOGNITION(S) Presentation of the Scenic City "Gold" Certification by Scenic Texas Margaret DeMoss and Judy Harman of the Scenic Texas Board of Directors presented the City Council with the Scenic City "Gold Certification ". Councilwoman Wright Oujesky received the award on behalf of the City. The Scenic City Certification Program is a project of Scenic Texas. The Program recognizes Texas cities that implement higih- quality scenic standards for public roadways and public spaces. Mayor Trevino recognized Clayton Comstock, Senior Planner, for his efforts in obtaining the certification for the City. DA RP 2013 -04 CONSIDERATION OF A REQUEST FROM JOHN SARGENT FOR A REPLAT FOR LOTS 4111 & 3112, BLOCK 1, TAPP ADDITION ON 1.083 ACRES LOCATED AT 5205 RUFE SNOW DR. APPROVED John Sargent, representing Oneida Realty Company and John Cordle, JEA HydroTech Engineering, came forward to request approval of a replat for two commercial lots. The replat will allow for the redevelopment of the property from one restaurant business into two separately platted restaurant 'businesses, including a new Grandy's in place of the existing one. Clayton Comstock, Senior Planner presented Staff's report and Planning and Zoning Commission's recommendation for approval. D.2 RP 2013 -07 CONSIDERATION OF A REQUEST FROM RSMC PROPERTIES FOR A REPLAT FOR LOT 2R1, BLOCK 1, TAPP ADDITION ON 1.181 ACRES LOCATED AT 5209 RUFE SNOW DR. ❑PPRnVPn Ron McFarland, 6553 Lakeside Circle, North Richland Hills, owner, came forward to request approval of the replat. Mr. McFarland purchased the property 8 years ago and it is the current location of Sparks Sports Bar 1 Dickey's BBQ. A portion of the property was conveyed to the property owner by metes and 'Founds and Mr. McFarland is requesting to replat the property into one lot. Clayton Comstock, Senior Planner presented Staffs report and Planning and Zoning Commission's recommendation for approval. The property is currently platted as Lot 2R and the northern portion of Lot 3R -1, Block 1 Tapp Addition. The original 3R -1 was subdivided by metes and bounds and conveyed to the property owners on either side. This plat along with Item D.1 (RP 2013 -04) will properly plat Lot 3R -1. E.0 PUBLIC WORKS F.0 GENERAL ITEMS F.1 DISCUSSION AND CONSIDERATION OF ORDINANCE NO. 3279 AUTHORIZING THE ISSUANCE OF "CITY OF NORTH RICHLAND HILLS, TEXAS, TAX AND WATERWORKS AND SEWER SYSTEM (LIMITED PLEDGE) REVENUE CERTIFICATES OF OBLIGATION, SERIES 2013" AND RESOLVING OTHER MATTERS INCIDENT AND RELATED THERETO APPROVED Mr. Larry Koonce, Director of Finance, presented the item. Council is being asked to consider the sale of $8,890,000 of Tax and Waterworks and Sewer System (Limited Pledge) Revenue Certificates of Obligation (C.O.$). The C.O.s will finance the following projects: $1,330,000 for Utility System Projects; $1,200,000 for the Animal Adoption and Rescue Center; $3,400,000 for Construction of City Point Drive; $860,000 for the replacement of an ambulance and a Fire Rescue Pumper; $100,000 for the replacement of a dump truck; and $2,000,000 for intersection improvements and utility burial on Boulevard 26 (TIF1). Debt service payments for the utility projects will be made from utility fund revenues and debt service payments for Boulevard 26 improvements will be made from TIF No. 1 taxes. The City's bond ratings were reaffirmed by both credit rating agencies. Moody's Investors Service reaffirmed the City's credit rating of Aa2 and Standard and Poor's has reaffirmed the City's credit rating of AA +. Mr. Koonce introduced David Medanich, First Southwest Company, Financial Advisory firm. Odell Addition on 0.661 acres located at 8321 Odell St. Caleb Mallete, 1137 Country Hill, Keller, TX came forward stating he and his wife have been wanting to purchase this property for over ten years to build their single family home on. The lots are being replatted to comply with the zoning regulations. Clayton Comstock said this replat to combine two lots into one lot for their single family residential building permit located at 8,321 Odell Street. He currently owns three lots but only combining the two for their home. The lots are in the Transit Oriented Development District which allows for much denser properties. The two lots combined will be 120 feet wide by 240 feet deep with a twenty foot build to zone. This is the first single family residential home in the TOD so it will be closer than others in the neighborhood. There was a general discussion about the past and current zoning of Odell Street. Chairman Shiflet opened the Public Hearing. Lloyd Autry, 8229 Odell came forward with drainage concerns from the new single family residence. Don Bowen asked to have a report from Public Works regarding the drainage concerns. Caroline Waggoner said she met with Mr. Autry last week and Public Works is aware of some drainage issues on Odell Street. There is a major undeveloped property to the north with a significant amount of drainage that comes through. There is the tail end of the improved drainage system to the north of the property. There is more drainage that needs to be done as the property develops. We do not have the easements need to put the infrastructure in place as of today, but it will be fixed over time as development occurs. The flow of water is from west to east across the rear of these properties, so the water Mr. Autry is referencing is flowing through his rear yard. Mr. Mallette's new proposed home to the east is up close to Odell Street, but his flow is going to be directed into the concrete channel at the northeast channel of his property as per his approved grading plan. His drainage is not impeding the flow of the water coming further from the west. Steven Cooper asked where Mr. Autry's property was in relation to Mr. Mallette's new home. Caroline Waggoner continued stating that currently the water behind the properties is flowing into the channel. Mr. Mallette's drainage will go to that channel. No fill will be allowed on the rear which would be of concern. Mr. Autry asked about the water culvert on Davis Boulevard that is blocked by a beaver's dam. The plat proposes to subdivide the 2.07 -acre Lot 1 R1 between the Taco Cabana restaurant and the old NRH Library into two lots of about an acre each. The City is currently in negotiations with another quick - service restaurant that would develop next to Taco Cabana. The proposed plat keeps all existing easements in place and simply introduces a subdividing lot line. CURRENT PLATTING: Lot 1 R1, Block 25, Snow Heights Addition. CURRENT ZONING: "RD -PD" Redevelopment Planned Development (PD 64) to allow for restaurant uses. COMPREHENSIVE PLAN: The Comprehensive Plan depicts Retail uses for this area. THOROUGHFARE PLAN: The lot fronts directly onto the Northeast Loop 820 eastbound service road; however a newly created connection to Corona Drive allows better ingress and egress to the property through signalized intersections on Rufe Snow Drive. PLANNING & ZONING COMMISSION: This plat is on an expedited approval track. The Planning & Zoning Commission meeting is scheduled for Thursday, November 7, 2013. Staff will update council on the Commission's recommendation at the November 11 City Council meeting. Drainage and Utility Easement and a Portion of a 10 ft. Utility Easement within Lot 29 of Block 1 of the Woodland Oaks Addition, Phase 2 - Ordinance No. 3283 Presenter: Gregory Van Nieuwenhuize, City Engineer Summary: The City Council is being asked to approve an Ordinance which abandons easements and authorizes the City Manager to execute a quitclaim deed on behalf of the City. General Description: The Woodland Oaks Addition, Phase 2, is located on the west side of Precinct Line Road, north of Nob Hill Drive. The construction of public infrastructure for this development was completed in June of 2006; however, shortly thereafter the economy changed and there was very little interest in home building within this subdivision. Presently, the situation has changed and the interest in this subdivision has substantially improved. The final plat for this development (Woodland Oaks Addition, Phase 2; Block 1) was approved in September 2005. At the time of final platting, various previously existing easements were designated for abandonment by separate instrument. These portions of easements could not be abandoned at time of final platting because some of these easements contained public infrastructure that was still active. The public infrastructure required of the final plat included the re- routings of this active infrastructure into new easements. The City accepted the new public infrastructure in June of 2006 and since that time the pre- existing easements are no longer necessary. Presently, Lot 29 is under contract and the buyer's title company has requested that these unnecessary easements across this lot be abandoned and that any right, title, and interest in and to the "easement properties" be quitclaimed. Recommendation: Approve Ordinance No. 3283 and authorize the City Manager to execute the appropriate Quitclaim Deed. Our next meeting will be held on Monday, December 9th. City Hall and other non - emergency offices will be closed on Thursday and Friday, November 28th and 29th for the Thanksgiving Holiday. Garbage and recycling collections will not be made on Thanksgiving Day. Thursday's collections will be made on Friday and Friday's collections will shift to Saturday. NRH Santa Cops and the NRH Firefighter's Association are holding a holiday toy and food drive to benefit those who are less fortunate in our community. Residents are encouraged to share in the holiday spirit by dropping off new, unwrapped toys and nonperishable food to the Police Department or any North Richland Hills Fire Station. Donations will be accepted from Thanksgivings through December 20th. We hope you will give to this worthwhile cause or to another local charity of your choice. Kudos Korner Every Council Meeting, we spotlight our employees for the great things they do. Tonight we recognize the. Fix It Blitz Volunteers — Several comments were received from residents expressing thanks for the work recently performed during the Fall Fix it Blitz. One gentleman even sent a letter to the newspaper to recognize "the most generous effort" by the volunteers who cleaned up the backyard of a 90 year old World War II Veteran.
