COUNCILMAN RODRIGUEZ MOVED TO APPROVE THE MINUTES OF THE SEPTEMBER 10, 2012 SIGN REVIEW BOARD MEETING. COUNCILMAN TURNAGE SECONDED THE MOTION. MOTION TO APPROVE CARRIED 7 -0. B.1 SRB 2012 -04 PUBLIC HEARING TO CONSIDER A REQUEST FROM THE HILLS SURFACE RIGHTS FOUNDATION FOR PERMISSION TO RECONSTRUCT A FORMERLY EXISTING 370 SQUARE FOOT, ON- PREMISE, POLE SIGN AS PER 106 -15 OF THE NORTH RICHLAND HILLS CODE OF ORDINANCES APPROVED Mayor Trevino opened the public hearing and called on the applicant to come forward. Mike Washburn, President of The Hills Surface Rights Foundation, came forward. Mr. Washburn explained that due to the widening of 820 an on- premise pole sign had to be removed. The Church is requesting a two -sided digital sign to replace the one that was removed. Dave Pendley, Building Official, summarized the item. The land where the sign formerly existed was acquired by TxDOT during right -of -way acquisition and was removed for the construction of North Tarrant Express. The sign is not eligible for replacement because it will not comply with the current sign regulations. Prior to the expansion of the roadway, The Hills Church had a legal non - conforming status of having two on premise pole signs. The Development Review Committee reviewed the request and found that the Church has two contiguous parcels along Loop 820 containing over 2,000 linear feet of freeway frontage. The location of the sign was moved approximately 1,000 feet from the existing pole sign and masonry surround added to the main support structure. Freeway frontage dealerships are allowed to put separate pole signs in areas with less frontage than The Hills property. As such, staff does not feel the continuation of this non - conformity will be detrimental to the surrounding area and recommends approval of the request. Mayor Trevino called for anyone wishing to speak for or against the request to come forward. There being no one wishing to speak, Mayor Trevino closed the public hearing and called for the motion. COUNCILMAN RODRIGUEZ MOVED TO APPROVE SRB 2012 -04. COUNCILWOMAN WRIGHT OUJESKY SECONDED THE MOTION. MOTION TO APPROVE CARRIED 7 -0. C.0 ADJOURNMENT Mayor Trevino adjourned the meeting at 8:11 p.m. Oscar Trevino — Mayor ATTEST: Patricia Hutson, City Secretary NRH SIGN REVIEW BOARD MEMORANDUM From: The Office of the City Manager Date: 4 -22 -2013 Subject: Agenda Item No. A.3 SRB 2013 -01 Public Hearing to Consider Relocation of Former Billboard with Digital Conversion by Clear Channel Outdoor at 7000 NE Loop 820 per Code of Ordinances Section 106 -9, 106- 12(b), and 106 -15 Presenter: Dave Pendley, Building Official Summary: Pursuant to Section 106 -12(b) of the North Richland Hills Code of Ordinances, the applicant, Clear Channel Outdoor, has requested permission to relocate an existing non - conforming conventional billboard and convert it to digital technology. The proposed project is located at 7000 NE Loop 820 on the south side of the freeway and will be equipped with digital faces on both sides of the sign. The proposed billboard was removed from the vicinity of the former Furr's Restaurant at 8612 Airport Freeway due to the North Tarrant Express widening project. General Description: According to the sign regulations, the Sign Review Board may authorize the issuance of a sign permit to reconstruct or relocate a non - conforming billboard, including its conversion to digital technology, provided the billboard is later approved by TxDOT. The applicant has indicated the existing office building located at 7000 NE Loop 820 will be razed and the new billboard will be installed on the vacant lot. The billboard will contain a masonry surround, be equipped with digital faces on both sides, and equipped with mandatory fail -safes and dimmers as required by the sign regulations. No variances from the digital billboard regulations are being requested. According to the sign regulations, the applicant must also demonstrate that any net area increase in the advertising area caused by the conversion will be removed from other billboard locations within the city. In this case, the conversion is not causing an increase above the former sign area; therefore, no additional billboard area will be removed from other locations within the city. During preliminary review of the applicant's documentation, staff encouraged the applicant to consider relocating the billboard on the property of the former site. However, the applicant indicated that the sign's former location is no longer viable based on highway reconstruction. As a result, the applicant was requested to provide documentation supporting the obstruction for presentation to the Sign Review Board. Staff is of the opinion that eastbound traffic would be relatively free of obstructions if relocated on the former site. Concerns Staff has three primary concerns regarding this application. 1. The first concern is that this does not meet the intent of a "relocation" of an existing billboard. The proposed billboard is being requested to move from one highway (Tx183/US120) to a different highway (US Interstate Loop 820) over a direct distance of approximately 2.0 miles. Not only is it proposed on a different highway but it is being proposed in an area with completely different surroundings. The previous location was in an area surrounded by retail and commercial development and the requested new location is in an area close to a residential subdivision. The Applicant is saying this is considered a billboard relocation due to the fact that no new billboards are being added to the city. Staff's intent of a relocation is that relocated billboards are in close proximity of the original billboard and in comparable locations. The requested location seems too far away and would change the landscape along the Loop 820 corridor. An aerial photograph has been provided below Titled Staff Concern #1 depicting the proximity. 2. Secondly, staff believes the billboard will be located too close to occupied residential property. An aerial photograph is provided below Titled Staff Concern #2 that indicates a separation of 82 to 187 feet between the billboard and the five closest residences. Staff's concerns are that the neighboring residences will be subject to evening light intrusions and light fluctuations every time the sign changes messages at eight second intervals. 3. The third reason is some reservations that the proposed relocation will be too close to the Rufe Snow on /off ramps and could cause safety hazards to travelers negotiating the ramps. Staff has asked the applicant to provide documentation supporting the traffic safety at this location for presentation to the Sign Review Board. An aerial photograph is provided below that depicts approximately 250- 350 feet of separation between the billboard and the exchange lanes. Although this is not one of the major reasons it is something to review. Recommendation: Due to the concerns mentioned above, staff is not in support of this request and recommends disapproval of SRB 2013 -01. If the Applicant presents sufficient justification for their request and the Sign Review Board wishes to consider this request that certainly is within the rights of the Sign Review Board. The Board also is authorized to designate conditions that provide for the maintenance, integrity, and character of the area per 106 - 15(1). As such, staff recommends the following conditions to be considered if the Sign Review Board wishes to consider the request: 1. Existing office building, foundation, and parking lot are removed in their entirety. 2. The proposed lot (including the triangular parcel to the east of this location owned by the same corporation - 7000 Investors, L.P.) is landscaped and irrigated per the North Richland Hills Landscape Regulations. 3. An eight foot masonry screening wall is installed along the adjacent residential properties; including the triangular parcel to the east of this location owned by the same corporation (7000 Investors, L.P.). 4. Billboard is positioned in such a way that both faces will form an angle greater than 90 degrees to the adjacent residential property line. 5. Billboard must be served with electricity by an underground service. 6. Billboard must have an approved masonry surround and meet the requirements of section 106.12(b). 7. The proposed lot (including the triangular parcel to the east of this location owned by the same corporation - 7000 Investors, L.P.) is equipped with landscape monuments consistent with other recent developments along Loop 820 (i.e. Taco Cabana and Huggins Honda). 8. Sidewalks are installed along the Loop 820 right -of -way.
