Consideration of September 10, 2013 Gas Board of Appeals Meeting Minutes APPROVED Kathy Luppy motioned to approve the minutes of the September 10, 2013 Gas Board of Appeals minutes, the motion was seconded by Marty Kusmierski and it passed unanimously (4 -0). Consideration of September 12, 2013 Gas Board of Appeals Meeting Minutes APPROVED Marty Kusmierski motioned to approve the minutes of the September 12, 2013 Gas Board of Appeals minutes, the motion was seconded by Randal Shiflet and it passed unanimously (4 -0). Chairman Duer led the Pledge of Allegiance. 5. GB 2013 -08 Public Hearing and Consideration of a request from Chesapeake Energy Corporation for a deviation from distance requirements from existing structures to eight (8) gas wellheads at the proposed Engler 1 H, 2H, Engler -Mann 1 H, 3H, C Station 1 H, 3H, Kyle 2H, 3H gas wells at 7300 Mid Cities Boulevard 6. GB 2013 -09. Public Hearing and Consideration of a request from Chesapeake Energy Corporation for an appeal to Section 104 -13 (kk) to allow 24 hour water hauling at the Engler gas well site at 7300 Mid Cities Boulevard 7. GB 2013 -10 Public Hearing and Consideration of a request from Chesapeake Energy Corporation for an appeal to the Gas Board to allow a permanent above- ground lift compressor site at the Engler gas well site at 7300 Mid Cities Boulevard. Delores Garza, 100 Chesapeake Way, Fort Worth, TX came forward with a request for the distance requirements from the existing structures to the proposed gas well heads, allowing 24 hour water hauling, and to allow a permanent above ground lift compressor at the Engler site. The current site is located at 7300 Mid Cities Blvd with the landscaping and masonry wall already installed. The initial drilling at this pad site took place in 2010 and to date there are five wells. There are 19 to possibly 20 total wells for this site. There are no protected use structures within the 300 foot set -back, but there are four protected uses structures within the 600 foot set -back with no objections to this to date. We are requesting the variance for the four protected use structures which are single family homes on Luther Court to allow us to develop these wells. The drill holes are between 464 and 594 from the protected uses. We are also requesting a pad expansion of approximately .61 of an acre for the drilling and production purposes. This will give additional benefits to the City of North Richland Hills, BISD, churches and approximately 2800 residents and businesses within the units. Page 3 of 6; 10/10/13 GBA minutes In addition, we are asking for a variance in water hauling waivers. Currently, the water hauling hours are from 7:00 a.m. to 7:00 p.m. requiring at least two trucks a day at this time. With a waiver for the 24 hour water hauling is to handle the production of the proposed eight wells and fully utilize the capacity of the holding tanks and lessen well shut in time. Without the 24 hour water hauling opportunity, the well shut in time is increased significantly. Chesapeake is proposing to construct 13 containment tanks on the pads northeast area to hold produced water for hauling. Prior experience with the BISD well site 24 hour water hauling was a positive experience. The transportation route is 820 to Rufe Snow, Mid Cities to Iron Horse. Ms. Garza continued with the final request for permanent above ground compressors with the following provisions: a 3 db above ambient sound at 300 feet, a ten foot height gas lift units and twelve foot height for fit for purpose sound walls with slight visibility above the masonry walls, and approval for the number of gas units required on site to maximize the well production. The importance of the compressors is so the wells will not under perform and shut in for economic purposes if they are not viable. The recent sound survey results illustrated that the compressor sounds mirror the ambient sounds and the fit for purpose sound walls are slightly visible above the masonry walls, but are effective in the sound mitigation. Marty Kusmierski asked if the 24 hour water hauling goes on just when the wells are being drilled. Delores Garza said yes, while it is in production is in place. John Pitstick gave a staff presentation on the requests for deviation from distance requirements, 24 hour water hauling and proposed lift compressor. The Engler pad expansion is also being expanded, but not required for GBA approval. There are four current residential lots between 464 and 595 feet on Luther Court. There have been no calls that the city is aware of from the citizens. There were no issues with the five previous wells at that location and Staff is supportive of this request. In the Gas Board ordinance there is a requirement for work activity for 24 hour water hauling. When they are drilling, it goes on 24 hours, but that only occurs about 25 to 30 days, fracturing about 4 -5 days. Under production, the typical work hours are 7:00 a.m. to 7:00 p.m. Monday through Saturday. Randal Shiflet suggested that we open all the Public Hearings since they are all on the same site and we will consider three separate motions. Chairman Duer opened the three Public Hearings. Meg Fulkerson, 6301 Dorchester Trail, NRH, came forward stating she was only notified less than a week ago and feels like she has not had enough time to look into these concerns. She feels only a small percentage of citizens have been notified and has complaints of noise and decreased property values. Page 4 of 6; 10/10/13 GBA minutes Chairman Duer made clarification that 600 square feet from the drill site would not necessarily have surrounding houses outside the boundaries. There was a general discussion about the notifications and the process of drilling. Rosa Alvarado, 7309 Luther Court, NRH, came forward with noise complaints, late night work continuing after construction hours, foundation issues, odor from the site, too much lighting and stated has called the offices several times with no response from staff on these issues. There was a discussion between staff regarding the activity going on at this location. Greg Lindsey came forward and commented on work hours but did not have information on after hours activities. He gave Mr. Alvarado his cell number and told her to contact him at any time. Randal Shiflet asked Greg Lindsey if there was any odor associated with the fracturing going on. He replied mainly soaps and waters that is being injected into the hole. Mark Stonitsch, 6312 Buckingham Trail, NRH, came forward with questions on water hauling and how many trucks will be actually going at one time. Delores Garza stated with 5 wells there would be 2 trucks per day. There was a general discussion about how the water is being emptied into the storage tanks and what process is being used for emptying the tanks. Julie Jones with Chesapeake said there is a noise associated with pulling the water into the trucks, similarly with BISD wells. Mark Stonitsch asked if this would affect the commercial businesses that are proposed to go in around the well site. John Pitstick said once all 20 wells are drilled, then they will build the garden offices at the locations around the well site. There was a general lengthy discussion and about the ordinances and gas well sights in regards to the requests made. Chairman Duer closed the Public Hearings and asked for motions for all cases. Page 5 of 6; 10/10/13 GBA minutes APPROVED Randal Shiftet motioned to approve GB 2013 -08. Kathy Luppy seconded the motion. The motion passed unanimously (4 -0). APPROVED Randal Shiflet motioned to approve GB 2013 -09. Kathy Luppy seconded the motion adding the stipulation that the Gas Inspector has the authority to revoke approval after hours water hauling if there are unresolved nuciences at the Engler Pad sight. The Board was in agreement. Marty Kusmierski opposed. The motion passed unanimously (3 -1). APPROVED Kathy Luppy motioned to approve GB 2013 -10 with stipulations of the 10 foot high lift compressors with 12 foot sound walls and effective noise abatement housing that provides no more than 3 decibels above the ambient noise level at 300 feet from the compressor sight. Marty Kusmierski seconded the motion. Randal Shiflet said he would like to add a 2 year review instead of 3 years, the Board concurred and the motion passed unanimously (4 -0). 8.
