ZONING CASE ZC 2013 -24
AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN AND THE
COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF NORTH
RICHLAND HILLS; AMENDING THE ZONING MAP OF THE CITY OF
NORTH RICHLAND HILLS, TEXAS, AND REZONING A 5.010 ACRE
TRACT OF PROPERTY FROM 1 -2 (MEDIUM INDUSTRIAL) TO 0-1
(OFFICE) ZONING; ESTABLISHING A PENALTY; PROVIDING FOR
PUBLICATION; AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, notice of a hearing before the Planning and Zoning Commission was sent
to real property owners within 200 feet of the property herein described at
least 10 days before such hearing; and,
WHEREAS, notice of a public hearing before the City Council was published in a
newspaper of general circulation in the City at least 15 days before such
hearing; and,
WHEREAS, public hearings to zone the property herein described were held before
both the Planning and Zoning Commission and the City Council, and the
Planning and Zoning Commission has heretofore made a
recommendation concerning the zone change; and,
WHEREAS, the City Council is of the opinion that the zone change herein effectuated
furthers the purpose of zoning as set forth in the Comprehensive Zoning
Ordinance and is in the best interest of the citizens of the City of North
Richland Hills; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS:
Section 1: THAT the Comprehensive Plan, the Comprehensive Zoning Ordinance
and the zoning map of the City of North Richland Hills are hereby
amended by rezoning a 5.010 acre tract of property on a portion of Tract
4131, NRH Industrial Park Addition, located in the 6700 Block of Iron
Horse Blvd., City of North Richland Hills, Tarrant County, Texas, more
particularly described in the legal description attached hereto as Exhibit A
and the site plan as Exhibit B from 1 -2 (Medium Industrial) to 0-1 (Office)
zoning.
Section 2: Any person, firm or corporation violating any provision of the
Comprehensive Zoning Ordinance as amended hereby shall be deemed
guilty of a misdemeanor and upon final conviction thereof fined in an
amount not to exceed Two Thousand Dollars ($2,000.00). Each day any

such violation shall be allowed to continue shall constitute a separate
violation and punishable hereunder.
Section 3: The City Secretary is hereby authorized and directed to cause the
publication of the descriptive caption and penalty clauses of this ordinance
as an alternative method of publication provided by law.
Section 4: This ordinance shall be in full force and effect immediately after passage.
AND IT IS SO ORDAINED.

EXHIBIT A
Being a tract of land out of the John C. Yates Survey, Abstract No. 1753 and situated in the City of North
Richland Hills, Tarrant County, Texas, said tract being a portion of the same tract of land described as
"Tract 4" in the deed to AG /IRG North Richland Hills, L.L.C. recorded as Document No. D207262117 in
the Deed Records of Tarrant County, Texas, and also being a portion of Tract 4B, N.R.H. Industrial Park
Addition, an addition to the City of North Richland Hills, Texas according to the plat thereof recorded in
Volume 388 -212, Page 77 of the Plat Records of Tarrant County, Texas and being more particularly
described by metes and bounds as follows:
Beginning at a 1/2 inch steel rod found for the most southerly southeast corner of said Tract 4 and said
Tract 413, said rod being the southwest corner of Block 34, Holiday West Addition, an addition to the City
of North Richland Hills, Texas according to the plat thereof recorded in Volume 388 -152, Page 94 of said
Plat Records and also being in the northerly right -of -way line of Trinidad Drive (a public right -of -way);
Thence South 89 degrees 47 minutes 12 seconds West with the southerly boundary lines of said Tract 4
and said Tract 413 and with said right -of -way line a distance of 226.87 feet to a 1/2 inch capped steel rod
found for the southwest corner of said Tract 4 and said Tract 46;
Thence North 00 degrees 11 minutes 55 seconds West with the westerly boundary lines of said Tract 4
and said Tract 4B a distance of 289.11 feet to a 5/8 inch capped steel rod found;
Thence South 89 degrees 50 minutes 17 seconds West continuing with said westerly boundary lines a
distance of 9.76 feet to a 5/8 inch steel rod with cap stamped "MSI RPLS 4224" found;
Thence North 39 degrees 29 minutes 39 seconds West continuing with said westerly boundary lines a
distance of 75.84 feet to a 5/8 inch steel rod with cap stamped "MSI RPLS 4224" found in the easterly
right -of -way line of Iron Horse Boulevard (a public right -of -way), said rod being in a curve to the left
whose center bears North 45 degrees 17 minutes 31 seconds West at 304.95 feet;
Thence northerly continuing with said westerly boundary lines and said easterly right -of -way line and
with said curve through a central angle of 44 degrees 46 minutes 18 seconds and an arc length of 160.15
feet to a 5/8 inch steel rod with cap stamped "MSI RPLS 4224" found for the end of said curve;
Thence North 00 degrees 03 minutes 49 seconds West continuing with said westerly boundary lines and
said easterly right -of -way line a distance of 294.83 feet to a 5/8 inch steel rod with cap stamped "MSI
RPLS 4224" set for the beginning of a curve to the right whose center bears North 89 degrees 57
minutes 34 seconds East at 299.16 feet;
Thence northeasterly continuing with said westerly boundary lines and said easterly right -of -way line
and with said curve through a central angle of 35 degrees 21 minutes 14 seconds and an arc length of
184.59 feet to a 1/2 inch "MILLER 5665' capped steel rod set for the end of said curve;

Thence North 89 degrees 45 minutes 46 seconds East a distance of 169.27 feet to a 5/8 inch steel rod
found for an inner corner of said Tract 4, said rod being the northwest corner of said Block 34;
Thence South 00 degrees 09 minutes 16 seconds East with the easterly boundary line of said Tract 4 (the
bearing basis of this tract) a distance of 959.85 feet to the point of beginning and containing 5.010 acres
of land, more or less, as surveyed by Miller Surveying, Inc. in October 2013.
