March 20, 2014 B. 0 Consideration of Minutes- None at this time C.0 Consideration of Planning & Zoning Requests CA ZC 2013-20 Pubic Hearing and Consideration of a Request by Robert Flynn for a Zoning Change from AG Agricultural and R-1 Single Family Residential to R-2 Single Family Residential on 4.53 acres on property described as Tract 4 of the John McCommas Survey, Abstract No. 1040; being located at 7509 Chapman Road. Robert Flynn, 7005 Whippoorwill Court, Colleyville came forward to present the proposed rezoning from AG Agricultural and R-1 Single Family residential to R-2 Single Family Residential at 7509 Chapman Road. Clayton Comstock came forward and stated that the future thoroughfare shows for four lane roadway on Chapman Road through the proposed area. Zoning today at 7509 Chapman road is AG Agricultural. Mr. Comstock explained staff's position for postponement of the hearing, and that staff is reviewing data. In response to commissioner Steven Cooper, Mr Comstock explained that this request is not within the Smithfield TOD District, but is within Y2 mile of the future TEXRail Station. Chairman Shiflet opened the public hearing. Ben Johnson, 1712 Oak Knoll Drive, Colleyville came forward representing American Life Homes. He is in favor of this property being developed, as it is prime "transition" area. Melanie Hunt, 1233 Stegall, Keller came forward in favor of this property being developed. As a realtor, she feels that the area's upcoming transit plans and the "villa" type lot sizes are suitable for the target home buyer demographic. James Bellamy, 6912 Little Ranch Rd. North Richland Hills came forward in opposition. He feels that the development will create a loss of the rural character. The addition of 28 new drivers will cause more traffic problems. Additional homes will cause drainage problems as water flows towards the creek. John Cope, 6724 Meadow Road, North Richland Hills came forward in opposition as the density of this project would be impactful to the area. He feels that the development will create a loss of the rural character. Streets are not yet four -lane to accommodate additional traffic. March 20, 2014 Mack Garvin, 6908 Little Ranch Road, North Richland Hills came forward in opposition. Placing two homes on this property would be what he would consider as "transitional" development, not fourteen homes. Nancy Long, 6704 Meadow Road, North Richland Hills came forward in opposition. Nancy is in the process of preparing a petition against the rezoning proposal. As a resident, she was told that this part of the city would remain country. Darren Whitten, 6728 Meadow Road, North Richland Hills came forward in opposition. The appeal of his property is the rural character. R-2 zoning does not appear to be transitional. Similar zoning proposals in the past have been dis-allowed, so what would have changed to make this proposal different? William Bell, 6733 Meadow Road, North Richland Hills came forward in opposition. As a long term property owner, he loves his neighbors, just doesn't want them to be too close. Please consider the long term home owners. William Kathleen, 6733 Meadow Road, North Richland Hills wishes to record opposition, but not to speak. Carmella Miller, 7500 Chapman Road, North Richland Hills came forward in opposition. She lives at the end of Meadow Road. If this proposal goes through, her property value will decrease. With additional traffic, she will never get out of her driveway. Guy Shaver, 7405 North Forty Road, North Richland Hills came forward in opposition. He believes that traffic will be a problem. He believes drainage will be a problem. Neighbor, John Cope was asked to build a drainage pond at the bottom of his property, for just one residence. A proposal for 1 acre lots could still preserve the integrity of this rural area. Angel Whitten, 6728 Meadow Road came forward in opposition. She would have purchased this property two years ago, but it was priced for a developer, not a single home owner. We want to maintain the rural character. Yvette Pabon, 6812 Meadow Road, North Richland Hills wishes to record opposition, but not to speak. Ivanna Martinez, 6812 Meadow Road, North Richland Hills wishes to record opposition, but not to speak. Randall Shiflet closed the public hearing. Applicant Robert Flynn was requested to present responses to concerns raised at the Public Hearing. Robert Flynn, 7005 Whippoorwill Court, Colleyville came forward to present responses. If he were to put in a permit to put in only five lots along Chapman Road, the city would March 20, 2014 most likely not approve five driveways. This proposal is a perfect fit single family home demographic. DENIED Mike Benton motioned to deny ZC 2013-20. The motion was seconded by Mark Haynes and Steven Cooper. The motion to deny passed unanimously (7-0). C.2 ZC 2014-07 Public Hearing and Consideration of a request from Dyoungco Construction Services and Design, LLC for a Zoning Change from AG Agricultural to R1 Single Family Residential (0.74 acres) and R-1-S Special Single Family Residential (1.85acres) on 2.5934 acres located at 7100 Bursey Rd. Dwayne Young came forward to items C.2 and C.3. His request is to change the zoning of 7100 Bursey Road from AG Agricultural into two different types of zoning. Two lots would be zoned R-1 and one lot would be zoned R-1-S to allow the option of a future SUP request for a large accessory building. His intent is to convert this address into three parts. Two would be smaller R-1 home lots, using the revenue from sale of these homes to build his residence and accessory building on that same land. Clayton Comstock came forward and stated that agenda items C.2 and C.3 address the zoning and subdivision of a single property at 7100 Bursey Road into three properties. APPROVED Steven Cooper motioned to approve ZC 2014-07. The motion was seconded by Don Bowen. The motion passed unanimously (7-0). C.3 FP 2014-06 Consideration of a Request from Dyoungco Construction Services and Design, LLC for a final Plat of Lots 3-5. Block 1, Pearson Subdivision on 2.59 acres described as tract 1A4 of the Thomas Sprance Survey, Abstract No. 1399; being located at 7100 Bursey Road. APPROVED Don Bowman motioned to approve FP 2014-06. The motion was seconded by Mike Benton. The motion passed unanimously (7-0). March 20, 2014 M C.4 RP 2014-01 Public Hearing and Consideration of a request from Keith Hamilton for a Replat for Briar Pointe Villas on 1.998 acres located at 8326 Amundson Drive.
