The City Council of the City of North Richland Hills, Texas met as the Landscape Review Board on the 24th day of March 2014 immediately following the 7:00 p.m. Council meeting. Landscape Review Board Minutes March 24, 2014 Page 2 A.2 LRB 2014 -01 PUBLIC HEARING AND CONSIDERATION OF A REQUEST FROM M.J. WRIGHT & ASSOCIATES, INC. FOR A VARIANCE TO SECTION 114 -72(B) OF THE CODE OF ORDINANCES TO ALLOW FOR A REAR LANDSCAPE SETBACK OF LESS THAN THE REQUIRED FIFTEEN FEET AT 9128 BELSHIRE DRIVE. APPROVED Mayor Trevino opened the public hearing and called on the applicant to come forward and present the item. Austin Flemming representing MJ Wright & Associates located 8233 Mid - Cities Boulevard came forward. The project is located at 9128 Belshire Drive. The original proposal consisted of eight parking spaces and two separate drives in order to stay out of the 15 foot landscape buffer yard. Upon staff's recommendation, the parking lot will be consolidated into one single lot and extended into the landscape buffer yard with pervious paving towards the south of the site. Landscape will be installed on the rest of the site. He was available to answer any questions the Council might have. Mr. Clayton Comstock, Senior Planner, summarized the item. On behalf of J & J NRH 100 FLP, M.J. Wright & Associates, Inc. is requesting a Variance to Section 114- 712(b) of the Landscape Ordinance, which requires a minimum 15 -foot landscaped setback of commercial property from residential property. As part of the Site Plan Review process, the applicant submitted a Site Plan that did conform to all development standards. To meet both the minimum parking requirements and the 15 -foot landscape setback, the applicant had to provide two driveway curb cuts off of Belshire. The primary driveway was for 6 parking spaces and the second driveway was for just two parking spaces. The Development Review Committee had a number of concerns with a short, dead -end driveway for the sole purpose of two parking spaces. So at staff's request, the applicant combined all required parking spaces into one driveway, requiring only one curb cut on Belshire. The resulting design encroached approximately 12 feet into the 15 -foot landscape setback, whereby requiring the variance. The following factors help justify the variance proposal: 1. The applicant is providing grasscrete pavers for the two parking spaces and the portion of the drive aisle within and closest to the 15 -foot landscape setback. 2. The overall area of impervious pavement on site is significantly decreased. 3. One commercial driveway is eliminated on Belshire, whereby increasing safety related to driveway spacing and frequency close to a signalized intersection. 4. The applicant will continue to meet the landscape material requirements (i.e. number of trees) along the landscape setback area. 5. A 50 -foot gas pipeline easement exists immediately adjacent to the lot on the south. Because structures cannot be built in this easement, it effectively serves as a landscape setback on the residential side of the property line. There being no one wishing to speak, Mayor Trevino closed the public hearing and called for the motion. COUNCILMAN WELCH MOVED TO APPROVE LRB 2014 -01. COUNCILMAN WHITSON SECONDED THE MOTION. MOTION TO APPROVE CARRIED 7 -0.
