HomeMy WebLinkAboutOrdinance 3291ORDINANCE NO. 3291 AN ORDINANCE AMENDING THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF NORTH RICHLAND HILLS BY AMENDING ARTICLE IV, DIVISION 14 OF CHAPTER 118 OF THE NORTH RICHLAND HILLS CODE OF ORDINANCES; REMOVING THE MID - CITIES OVERLAY ZONE AND CREATING IN ITS PLACE A FREEWAY CORRIDOR OVERLAY DISTRICT; PROVIDING REGULATIONS FOR THE FREEWAY CORRIDOR OVERLAY DISTRICT; AMENDING ARTICLE V, DIVISION 3 OF CHAPTER 118 OF THE NORTH RICHLAND HILLS CODE OF ORDINANCES; CONSOLIDATING AND REVISING LAND USE TABLES AND SPECIAL LAND USE REGULATIONS; PROVIDING FOR SEVERABILITY; PROVIDING A PENALTY FOR VIOLATIONS; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR PUBLICATION IN THE OFFICIAL NEWSPAPER. WHEREAS, it is the goal of the City Council to provide quality community development and revitalization, safety and security, a positive city image, a sense of community and local and regional leadership; and WHEREAS, the 2001 City Image Study and the 2005 Loop 820 Corridor Plan recommended specific commercial property standards for properties along Interstate Loop 820 and State Highway 183; and WHEREAS, the North Tarrant Express construction project provides an opportunity to implement those two plans and define the character of North Richland Hills through this Freeway Corridor; and WHEREAS, the City Council has received the recommendations of the Planning and Zoning Commission concerning the matters herein dealt with, which recommendations were made after the holding of a public hearing before said Commission on such matters; and WHEREAS, notice has been published of the time and place of a public hearing held before the City Council concerning the changes herein made, which public hearing has been duly held; and, WHEREAS, the City Council has determined that the amendment to the Comprehensive Zoning Ordinance herein made is in the best interest of the health, safety and general welfare of the citizens of the City of North Richland Hills; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF NORTH RICHLAND HILLS, TEXAS: Ordinance No. 3291 Page 1 of 13 SECTION 1. That Section 118 -1 of the Code of Ordinances of the City of North Richland Hills, Texas, is hereby amended by adding or revising the following definitions: "Sec. 118 -1. Definitions. Alternative financial establishment means a check cashing business, payday advance or loan business, money transfer business, precious metal dealer, bail bonds business or car title loan business. Freeway Corridor Overlay. The Freeway Corridor Overlay District includes the entirety of all properties which adjoin or are located within 200 feet of the ultimate Right -of -Way for Northeast Loop 820 (IH -820) and Airport Freeway (SH 121/SH 183), and are not planned for single - family residential, parks /open space, stormwater drainage easement use or Transit Oriented Development (TOD) as shown on the City's Comprehensive Land Use Plan." SECTION 2. That Chapter 118, Article IV, Division 14 of the Code of Ordinances of the City of North Richland Hills, Texas, (Mid- Cities Overlay Zone) is hereby removed and replaced with the following: "DIVISION 14. FREEWAY CORRIDOR OVERLAY DISTRICT Sec. 118 -551. Purpose and applicability. (a) Purpose. It is the purpose of this Article to provide standards for the Freeway Corridor Overlay District in order to mitigate the negative effects of the Interstate Loop 820 and State Highway 121/183 such as noise, aesthetics, glare of lights, and to protect public and private investment. It is also the intent of this section to implement the recommendations of the 2001 City Image Study and the 2005 Loop 820 Corridor Plan. (b) Applicability. The standards and regulations set forth in this subdivision are superimposed and shall supersede the standards and regulations of any underlying zoning district which are in conflict and shall apply in the following circumstances: (1) When an existing building is proposed for remodeling, alteration, addition, or expansion, in which the value of the proposed construction exceeds 50 percent of the current appraised value of the existing structures, excluding the value of the land; (2) When an existing building is proposed for an addition that will increase the square footage of the existing building by 30 percent or greater; Ordinance No. 3291 Page 2 of 13 (3) Upon all new construction; or (4) As a requirement of the approval of a special use permit or planned development. Sec. 118 -552. Permitted uses. Uses permitted within this Freeway Corridor Overlay District shall be those that are permitted in the base district provided in Article V, Division 3, Sec. 118 -631 of this chapter, Table of Permitted Uses unless otherwise noted by that table. Sec. 118 -553. Lot and area requirements. The lot and area requirements of the base district shall apply in the Freeway Corridor Overlay District. Sec. 118 -554. General conditions. The following general conditions shall be required of all development located in the Freeway Corridor Overlay District. If not addressed in this division, the general conditions of the base district shall apply. (1) Screening and fencing standards. Article VIII of this chapter shall apply to the Freeway Corridor Overlay District, except that required masonry screening walls adjacent to residential uses shall be a minimum of eight (8) feet in height and shall have an element of Lueders Limestone (i.e. columns, part or all of wall). Sec. 118 - 555 - 118 -560. Reserved." SECTION 3. That Section 118 -631 of the Code of Ordinances of the City of North Richland Hills, Texas, (Table of Permitted Uses) is hereby amended as follows: "Sec. 118 -631. Table of permitted uses. (a) Table of permitted uses. The following table presents the zoning district classifications and the permitted uses within those classifications. Uses are listed in accordance with permitted uses (P), uses permitted by a special use permit (S), ancillary uses (A) and prohibited uses (blank or NP). In the case of any special overlay district, a (B) designation defaults to the base zoning district of the property within the overlay. Ancillary uses shall be regulated by Section 118- 727 Customary home occupations. Procedures and conditions requiring a special use permit are contained in section 118 -201 et seq. Special land use regulations referenced under "Conditions" below shall comply with those requirements established in section 118 -633. (c) Special land use regulations for the Town Center District must comply with those requirements established in section 118 -633 unless otherwise provided for in section 118 -471, "North Richland Hills Town Center Development Standards ", section 118 -470, "Town Center Parking Standards ", or city approved, properly filed, conditions, covenants, and restrictions for property zoned to the TC district. Ordinance No. 3291 Page 11 of 13 SECTION 4. That Section 118 -632 of the Code of Ordinances of the City of North Richland Hills, Texas, (Town Center Permitted Uses) is hereby removed in its entirety. SECTION 5. That Section 118 -633 of the Code of Ordinances of the City of North Richland Hills, Texas, is hereby amended as follows: "Sec. 118 -633. Legend for section 118 -631; special land use regulations. (9) Auto or truck dealer (new). The display of vehicles shall be exempt from the outdoor display restrictions contained in Section 118 -396. Use limited to internet sales only within the Core Subzone of the Town Center District. (20) Detention /retention pond. See Sec. 118 -729. Detention /retention pond criteria. (22) Multi - Family in Town Center. Multi- family is not permitted in Tracts 2, 3a, 3b, 5, 6a or 6b of the Town Center Zoning District. See Sec. 118 -472. Town Center density restrictions. (23) Townhomes in Town Center. Townhomes are not permitted in the General Subzone east of the Lakes." SECTION 6. Severability. It is hereby declared to be the intention of the City Council that the phrases, clauses, sentences, paragraphs and section of this ordinance are severable, and if any phrase, clause, sentence, paragraph or section of this ordinance shall be declared unconstitutional by the valid judgment or decree of any court of competent jurisdiction, such unconstitutionality shall not affect any of the remaining phrases, clauses, sentences, paragraphs and sections of this ordinance, since the same would have been enacted by the City Council without the incorporation in this ordinance of any such unconstitutional phrase, clause, sentence, paragraph or section. SECTION 7. Penalty. Any person, firm or corporation who violates, disobeys, omits, neglects or refuses to comply with or who resists the enforcement of any of the provisions of this ordinance shall be fined not more than Two Thousand Dollars ($2,000.00) for each offense. Each day that a violation is permitted to exist shall constitute a separate offense. Ordinance No. 3291 Page 12 of 13 SECTION 8. Savings. All rights and remedies of the City of North Richland Hills are expressly saved as to any and all violations of the provision of any other ordinances regulating solicitation or canvassing activities that have accrued at the time of the effective date of this ordinance; and, as to such accrued violations and all pending litigation, both civil and criminal, whether pending in court or not, under such ordinances, same shall not be affected by this ordinance but may be prosecuted until final disposition by the courts. SECTION 9. Publication. The City Secretary of the City of North Richland Hills is hereby directed to publish the caption and penalty of this ordinance in the official City newspaper.
