Consideration of February 18, 2014 Gas Board of Appeals Meeting Minutes APPROVED Randall Shiftet motioned to approve the minutes of the February 18, 2014 Gas Board of Appeals minutes. The motion was seconded by Brian Crowson and it passed unanimously (4-0). Page 2 of 7; 02/18/2014 GBA minutes 4. GB 2014-03 Public hearing and Consideration of a request from Chesapeake Energy Corporation for a deviation from established work hours for gas well operations at the TCCD Gas Well Pad Site located at 828 W Harwood Rd. Work hours for gas well operations are established in Section 104-13 of the City of North Richland Hills Code of Ordinances. Chairman Duer summarized that there will be a need for 24 hour waste water hauling at this site. Delores Garza, 100 Energy Way, Fort Worth, TX 76102 came forward with a request for 24 hour water hauling from the existing gas well site. Chesapeake estimates 40 to 50 truck loads per day from the site. Chairman Duer opened the public hearing at 07:18pm. There were no persons for or against and the public hearing was closed at 07:19pm. The Gas Board opened for discussion. APPROVED Randall Shiflet motioned to approve GB 2014-03, the motion was seconded by Marty Kusmierski and it passed unanimously (4-0). 5. GB2014-04 Public Hearing and Consideration of a request from Chesapeake Energy Corporation for an appeal to the Gas Board to allow a permanent above -ground lift compressor at the TCCD Gas Well Site located at 828 W Harwood Rd. Chairman Duer opened the public hearing at 07:39pm. There were no persons for or against and the public hearing was closed at 07:40pm. APPROVED Randall Shiflet motioned to approve GB 2014-04, the motion was seconded by Brian Crowson and it passed unanimously (4-0). 6. GB2014-05 Public Hearing and Consideration of a request from Chesapeake Energy Corporation for an appeal to the Gas Board to allow a permanent above -ground lift compressor at the Little Bear Gas Well Site located at 7200 North Tarrant P kwy. Page 3 of 7; 02/18/2014 GBA minutes John Pitstick came forward. Staff recommends approval with no more than 3 dB increase in noise level compared to ambient. Julie Jones, Engineer, came forward representing Chesapeake Energy. Ms. Jones stated that Chesapeake is seeking permanent housing for a lift compressor that would operate on a temporary basis. Chairman Duer opened the public hearing at 07:49pm. Carl Orton, 7317 Continental Trail came forward as undetermined in favor or opposed. He expressed noise concerns. Heard are intermittent clanking, rumbling hum. Tom Duer asked what sounds are being heard. Randal Shiflet asked if tonight's appeal is actually going to decrease the decibles. Delores Garza answered yes. George Heil, 1619 Creekridge Drive; Keller, TX 76248 came forward in opposition. He sees vapors and hears sounds from the well. John Hoffman, 923 Holly Hills Court; Keller, TX 76248 came forward "not in opposition". He has concerns with the noise. He wishes to preserve the sanctity of the area. Eric Jones, 1007 Creek Hollow Drive; N Richland Hills, TX came forward as undetermined in favor or opposed. He is skeptical of what Chesapeake says and actually does. Stan Fortune, 1613 Creek Ridge Drive; Keller, TX 76248 came forward as undetermined if opposed or in favor. He has concern that if approved, will Chesapeake then put in 2, 4 or 8 more compressors. He expressed that 2 story homes would have greater noise exposure. Joilynn Abell; 1604 Creek Ridge Drive; Keller, TX 76248 wished to express opposition, but did not wish to speak. David Abel; 1604 Creek Ridge Drive; Keller, TX 76248 came forward in opposition. His experience with General Motors is that mandatory protective equipment is required for 85 dB and above. Tim Zoch; 1518 Sweatgum Circle, Keller, TX came forward in opposition. He is suspicious that Chesapeake will increase production with more well equipment.. The result could be more noise, traffic, trucks, water, mud and dirt. Chairman Duer closed the public hearing at 08:17pm. Randal Shifleet inquired about other neighborhood noise and about landscaping requirements around the site. John Pitstick responded that landscaping is required. Chairman Duer inquired about noise readings. Greg Lindsey stated that noise readings previously pulled were all well below ordinance and that they will measure additional readings. Chairman Duer stated that technology is increasing quickly for gas Page 4 of 7; 02/18/2014 GBA minutes equipment. Chairman Duer expressed concern with waste water being hauled. Randal Shiflet stated that above ground lift compressors didn't exist until three years ago. John Pitstick stated that any additional lift compressors would have to be approved. APPROVED Randall Shiflet motioned to approve GB 2014-05, the motion was seconded by Marty Kusmierski and it passed unanimously (4-0). 7. GB2014-06 Public Hearing and Consideration of a request from Chesapeake Energy Corporation for an appeal to the Gas Board to allow a permanent above -ground lift compressor at the Rick Gas Well Site located at 6409 Wuliger Way. Delores Garza, 100 Chesapeake Way, Fort Worth, TX 76102 came forward. Ms. Garza stated that Rick Gas Well is similar to Little Bear in that Chesapeake is seeking 12 foot metal housing for a lift compressor on the northern are of the site. John Pitstick came forward to state that 23 properties, both commercial and residential were notified of this hearing. Brian Crowson inquired if Tyson Foods generates noise in this area. John responded that staff has worked with Tyson regarding control measures. City residential code is 60 dB from 10pm to 7am and 75dB from 7am to 10pm. Brian inquired that Tyson's noise is louder than code. John replied that it is already louder at 70 dB from 10pm to 7am. Chairman Duer opened the public hearing at 08:43pm. Terry Willis; 6328 Pinehust Drive; N Richland Hills, TX came forward in opposition. Construction was noisy. He does not want more noise. He does not want to lose property value. He expressed concern over the lack of landscape maintenance surrounding this gas well site. Randal Shiflet responded that the photos submitted are not of Chesapeake Rick Site property. Gene Snow; 6308 Midway; N Richland Hills, TX came forward in opposition . He owns 10 acres. His concern was that money and noise is generated with trucks to hauling out salt water, when good money could be spent on wells to remove the salt water without hauling. Chairman Duer expressed that these issues should be addressed with City Counsel. Bill McDowell, 5616 Sawgrass Court; N Richland Hills, TX came forward in opposition. His concerns were that residents were told there would not be noise after the installation. It might have been a different matter had that been the case three years ago. Randal Shiflet inquired about the distance from Tyson commercial property. Shelly Lybyer; 6332 Pinehurst Drive; N Richland Hills, TX came forward in opposition. Chesapeake has not been good neighbors. Pipes and cables clang at night. The bigger noise issue is with trucks taking off. Shelly is opposed to more noise, which she Page 5 of 7; 02/18/2014 GBA minutes does not feel is always coming from the compressor. Her next door neighbor has changed home owners three times. Richard Glen; 6321 Pinehurst Drive; N Richland Hills, TX 76180 wishes to express opposition, but not to speak. Holly Willis; 6328 Pinehurst Drive; N Richland Hills, TX 76180 wishes to express opposition, but not to speak. Stephen McKeehan; 5612 Sawgrass Court, N Richland Hills, TX 76180 came forward in opposition. His back yard is 379 feet from the well bores. Noise is his concern. Chairman Duer closed the public hearing at 09:05pm. UNSUCCESSFUL MOTION TO VOTE Randall Shiflet motioned to approve GB 2014-06 with the enclosure no further west than mid point. The motion was not seconded. Randal Shiflet inquired why the enclosure could not be at the northeast corner of the pad site. Julie Jones responded that there were fire hydrants and truck traffic lanes that would be problematic for a location at the northeast corner. Chairman Duer inquired if a different entrance could be entertained. TIE VOTE Randall Shiflet motioned to approve GB 2014-06 with a different entrance. The motion was seconded by Chairman Duer and it was a tie vote (2-2)(Brian Crowson and Marty Kusmierski were opposed). Randal Shiflet inquired about the voting process. John Pitstick responded that there is not appeal to this board. The voting must continue until consensus is reached. TIE VOTE Randall Shiflet motioned to approve GB 2014-06 with stipulation that the enclosure be relocated to the northeast corner of the pad site. The motion was seconded by Chairman Duer and it wa a tie vote (2-2) (Brian Crowson and Marty Kusmierski were opposed). Marty Kusmierski inquired about the actual noise level. Julie Jones stated that the enclosures are hospital grade mufflers. Ms Jones stated that there is already a lot of noise in that area. Chesapeake has done everything that the board asked. Third party dB readings were conducted. The readings are at 3 dB above ambient. John Pitstick responded that Tyson is allowed at 70 dB. Marty restated that what she is hearing is that ambient noise is actually louder than the lift compressor. Chairman Duer stated that his observation at Graham Ranch wasn't too loud. Dolores Garza stated that Chesapeake wants to hear from customers if they have noise issues. Chairman Duer Page 6 of 7; 02/18/2014 GBA minutes r inquired if the compressor is making a sound that is lower than ambient could it be heard? Ms Jones responded that no, it would not be able to be heard. Mr Pitstick stated that current standard is 75db day and 60 dB night. APPROVAL Randall Shiflet motioned to approve GB 2014-06 with stipulation that the enclosure be relocated to the northeast corner of the pad site. The motion was seconded by Brian Crowson and it was unanimous (4-0). 8.
