Staff will) give a presentation and seek )input from Council on proposed changes to the
zoning ordinance regarding i masonry and architecture requirements for commercial
properties.
General) (Description:
In 2001, 1 City Council approved the current °Dimensionall Architecturall Standards" for
any new nonresidential bulildlings greater than 10,000 square feet. Some refer to lit as
the "Rig Box Ordinance," which places building articulation and ornamentation
requirements on larger buildings. 'li'yhat is not addressed by current commercial
architecture standards are buildings less than 114,400 square feet in size, otherwise
known as commercial "pad sites " —fast food restaurants, smaller retail buildings, etc.
The purpose of this discussion is to )introduce the following recommended changes:
1. (Remove the 114,400 square foot threshold for commercial architecture standards;
2. AVlow greater flexibility lin the masonry percentages and reintroduce stucco and
reinforced EIFS into the approved mix of materials, but at tolerable percentages;
3. Keep the same successful format of allowing applicants to choose from a. (list of
required architectural features, but add more options to choose from and
increase the number of features required,
4. Introduce a new "'choose from" category based on the basic LEIEID Core
Concepts of building shading, dayllighting, coon roofs, solar orientation, etc.
Staff's goal of this project is to find an appropriate balance between archlitecturall
flexibility and qualitative community standards. The above points will be discussed
more specifically during the work session.

Mayor Trevino called the work session to order at 5-30 p.m.
A.0 Discuss Items from Regular City Council Meeting
Council member Whitson inquired about the small section of property located at North
Tarrant Parkway for litem, C11 —RP 2013-11.
City Manager Mark Hindman informed Council the property complies with the City's
current ordinances.
A.1 Update on TEX Rail Final Environmental IImpact Statement Report
Director of Planning and Development John Pitstick provided Council with an overview
on the TEX Rail Environmental Impact Statement Report. City staff received the report
on May 16, 2014 and comments are due June 30, 20114. Mr. IPitstnck unformed Council
staff reviewed content that pertained to the City of North Richland HiUs. The initi4l TEX
Rail plan called for approximately 34 miles from southwest Forth, Worth to IDFW Airport.
In an effort to accelerate the project, the southwest segment was removed and the
minimum operable segment will be from downtown Fort Worth to the DFW Airport. The
project scope includes ten (10) stations—two deferred stations (Iron Horse and
Srnlithfield) in North Richland HiUs, DFW Airport station,, five new stations and parkung
areas,, and two existing stations. Mlr. IPitstick advised Council the followings litems are not
in the planned scope of services. two deferred stations, IDFW Airport station and
equipment maintenance facility. The stations located in North, Richland Hi[Is are
planned for 2019.
Mayor Trevino clarified that the two deferred stations in North Richland Hi[Is are not
definite unless the City commits to future financing.
Mr. Pitstick informed Council the primary concern is train horns and warning bells. By
2030, there lis a possibi[ity that trains will be running 17 hours a day. The final impact
statement shows 821 potentially impacted habitable structures (houses) within the
corridor. The City of North Richland Hills has 225 potentially limpacted properties wrath
moderate or severe noise impact.
Council member Rodriguez clarified the number of structures is what lis current today.
Mr. IPitstick informed Council that staff is workings on an update to the Code of
Ordlinances that will require all new buildings within 150 feet of railroad rights-of-way to
have additional building sound installation.
Mr. IPitstick commented that in order to address noise limpact the City lis seeking quiet
zones designations through lintersection improvements at Browning, IRufe Snow, Iron
Horse, Mid Cities, Holiday, Smithfield, Eden and (Precinct Line Road.
In response to Mayor Trevino's question, Mlr. Pitstick advised the construction cost for a
quiet zone is approximately $400,000 to $500,,000 per intersection. MIr. IPitstick informed
Council as part of the mitigation, the cost of the intersection improvements (quliet zones)
are included in the project and funded by The T. The City will be required to apply for
the quiet zones. Mr. Pitstick )informed Council upon completion of the TEX Rail and
quiet zones the number of )impacted properties in North, Richland IHlillls is reduced from
225 to four that will have moderate )impact to their property.
Mr. IPitstick advised Council the City's response to the TEX Rail environmental impact
study includes-
• encouragement to The "T" to facilitate active commuter rail service-,
• support transit oriented development wrath structured parking options-,
• noise rnlitigation—proactive quiet zone designations,, quad gates and median
barriers for Davis Boulevard,, noise barriers or buildling sound insulation for four
existing residential structures identified to have moderate noise impact upon
completion of quiet zone designations; and
• preservation of existing Cotton Belt train during TEX IRaill construction and
operation.
A.2 Presentation by (Parks Department regarding final design of public square
adjacent to Dolce Living development
Managing Director Vickie Loftice provided Council with a review of the final design as
proposed by Realty Capital and Oliver Wyndham. Ms. Loftice unformed Council that
Realty Capital lis providing for the design and construction of the public square. The
public square wfli be located adjacent to Stormy Plaza. Ms. Loftice advised that City
staffpllan6ing and development and parks and recreation —has been involved with the
project to ensure design and materials are appropriate given that the City will be
responsible for perpetual maintenance of the site. The sate has a large lawn area
available for m0ti-purpose use; plaza area will include four seat wafls; and a stage area
available for concerts, movies or performances.
A.3 Presentation on the Texas State Library's Special Pro'ect Grant awarded to the
Library
Director of Library Services Cecilia Barham informed Council the City received
notification from the Texas State Library that the North, RicKland (Hulls Library was
awarded a special project grant lin the amount of $74,785 to implement the state's first
full-service library makerspace. The proposed project—The Maker Spot—wifl be a
collaborative workspace for children, teen and adults to design and build projects. The
Maker Spot will provide access to the following resources- 3D printing, audio-visual
production and editing, electronics and robots, science (hands-on, collaborative lab),
and soft crafts.
Ms. Barham, advised that Council upon meeting grant requirements in the first year; the
City Library automatically qualifies for additional grant funding up to $75,000 for the
second and third year of the project. The proposed 2011412015 budget includes funding
for )improvements to the shell) space located upstairs in the library to locate the Maker
Spot. Ms. Barham, advised Council an item, will be placed on a future agenda for
Council to formally accept the grant.

Senior Planner Clayton Comstock presented item to Council. The property is the home
of the NRH Montessori School. The proposed repllat subdMdes the property into two
lots with one facing North Tarrant Parkway and the other facing Shady Grove. The
request includes a flag lot, which is a 15-foot section of land along North, Tarrant that
flares out to a 50-foot wndth and 20-foot depth, for the purpose of maintaining signage.
Per the City's Sign Ordinance, the business is required to have frontage along North
Tarrant Parkway to keep their current monument sign. The request complies with the
subdivision and zoning requirements. The Planning and Zo6ing Commission at their
June 19, 20114 meeting recommended approval with a vote of 4-0. Mr. Comstock
advised Council that City staff recommends approval of the request.
Council member Whitson expressed his concern with the request and asked staff lif the
City can consider a variance to place a sign without the flag lot.
Mr. Comstock advised Council the Development Review Committee (DRC) proposed
several options to the developer and property owner to address signage along North,
Tarrant Parkway. Mr. Comstock further commented that staff is revnewing the possibifity
of a revision to the sign ordinance to limit any future flag lot requests.
The applicant's representative, Spry Surveyors, was not in attendance to present the
request to Council.
City Attorney George Staples advised Council that plats could be approved by action of
law lif the governing body fails to act within 30 days of the Planning and Zo6ing
Cornmlission meeting.
Council member Welch made a motion to postpone RP 2013-11 to the next City
Council meeting (Jul] 14, 2014). Council member Whitson, seconded the motion.

longer the engineer of record he continues to have fiduciary connections with the
project.
Council member Welch completed and filed an affidavit of disqualification with the City
Secretary.

and drought plans to the Texas Commission on Environmental Quallity (TCEO). The
plans are required to be adopted and updated on a five -yeas basis to coincide with the
regional water planning process. Mlr. Cates advnsed that the proposed changes mirror
the recent changes approved by the City of Fort Worth.
Water Conservation (Plan - includes Best Management Practices (BMIIP's) that were
developed by the Texas Water IDevellopment. Board (TWIDB) Report 362. The BMIIP's
are voluntary for adoption and some of the BMP's are included in the city's plan as

Mr. Gates advised that the majority of the proposed Water Conservation plan would
remain the same with one major addition concerningi lawns and landscapes. Watering
for lawns and landscapes must follow the schedule below:
1. Residential addresses endings in an even number (0, 2, 4, 6, and 8) may water on
Wednesdays and Saturdays.
2. Residential addresses ending in an odd number (1, 3, 5, 7, and 9) may water on
Thursdays and Sundays.
3. AH non-residential (locations (apartment complexes, businesses, industrial, parks,
street and/or roadway medians, etc.) may water on Tuesday's and Friday's.
When outdoor water use is beings used on the designated clays, a person may only
water between the hours of 12 midnight to 10.00 a.m. and 6-00 p.m. to 11-59 p.m. on
such days.
The exception to the scheduled outdoor water days and hours is as follows:
"`Lawns and landscaping may be watered on any day, at any time, by handheld
hose,, drip irrigation, a soaker hose or tree bubbler. The lintent of this exception is
to allow for the protection of structural foundations, trees and other high value
landscape materials".
Drought Contingency/Emergency Water Management Plan — utilized by the regional
water-plan6ing group and requires the following:

questions. MIr. Curtis reminded Council that staff brought forward a Texas Department
of Transportation funding agreement in Aprill, which identified additional funding that
would be allocated to the project due to scope changes taken place over time. The
request before Council this eventing iis the next step to amend the engineenng
agreement to reflect additional changes to the project. The contract amount includes
the additional design changes due to expanded scope, additional right-of-way parcels
and additional right-of-way work, and the environmental changes. City staff is
recommending approval and to authorize the city manager to execute the agreement.

partnered with Tarrant County 9-1-1 to seek reimbursement funding through the P25
radio assistance program. If approved, annual funding from Tarrant County 9-1-1 is
anticipated to be $54,809. Over a three -year period, reimbursement funding is
anticipated at $164,427. City staff recommends approval of the lease agreement.

Summary.
The purchase of networking and telephone equipment for the new city hall building is
necessary to provide data, system, and internet connectivity for the delivery of internal
and external ser0ces without disruption.
General) (Description:
Information Ser0ces has been working diligently with Synetra and Cisco engineers over
the last few years to design a system for the new City IHlall facility. Together we have
produced a system, )infrastructure desugn that would not only meet the requirements for
the new city hall, but also position it for future success by takings advantage of Cisco's
modular technology. At the January 14, 2008 City Council meeting, Council approved
Cisco Systems as the City's standard network and telephone equipment. Cisco has
continued to maintain fits Ileadershlip role lin the technology market.
As a Cisco certified value reseller, Synetra participates in the State of Texas
Department of Information Resources (DIR) cooperative purchasing program. By
participating in the IDIIR cooperative purchasing program, the City meets all State
competitive bidding requirements for this purchase. The current DIR negotiated
discount is 35 percent. Staff has negotiated with Synetra to receive an additional 27
percent discount bringing the total discount for this purchase to 62 percent off of Gisco's
list phce.
This purchase includes three years maintenance, two years at no cost for an estimated
savungs of $62,,000. The manufacturer has informed the city that equipment wflll be
delivered over a three to six month period. The maintenance costs will begin upon the
city's acceptance of the complete delivery of all equipment,, which is anticipated lin
December 2014.
Recommendation:
Approve the purchase of Cisco network, telephone equipment and maintenance from
Synetra in the amount of $498,540.13.

CASE SUMMARY: Marvin Smith, is requesting approval of a Zoning Change from "AG"
Agricultural to "R-2" Single Family on 8.0 acres near the bend lin Douglas Lane adjacent
to Cross Timbers (Park. The applicant has indicated intent to develop a single family
residenti4l subdivision on the property. Following the IR-2 development standards, the
acreage under consideration could yield 21 or more single-familly residenti4l (lots. A
Preliminary Rlat is currently scheduled to appear at the Planning & Zoning Commission
meeting on July 17, 2014 if the zoning is approved by City Council. That Pre[iminary
Rlat is attached below to give perspective into how 21 lots may fit on the property if
rezoned "R-2."
OPEN SPACE/TREE PRESERVATION AREA: The proposed layout of 21 single
family lots indicates a large expanse of natural areas on the south, and west sides that
are primarily proposed as a tree preservation area and could be used if needed for
some drainage detention. If a drainage detention area is needed a special use permit
will be required.
EXISTING SITE CONDITIONS: The 8.0-acre property at 7601 Douglas Lane currently
has a single 1,420 square foot residence built in 1950.
PLATTING STATUS: Unplatted and described as Tract 2 in the John Condra Survey,
Abstract No. 311.
EXISTING ZONING: "AG" Aghcuftural
COMPREHENSIVE PLAN: The Comprehensive Plan depicts "'Low Density Residential"
for this area. The Low Density (Residential Land Use provides for traditional, low-
density, single-family detached dwelling units. Staff believes this change in zoning
would be consistent with the "Low Density Residential" category and the surrounding
uses.

Attorney confirmed that the vote could commence with only three members considering
the item if four (a quorum) were present at the meeting.

AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN AND THE
COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF (NORTH
RIICHLAND HILLS; AMENDING THE ZONING MAP OF THE CITY OF
NORTH RIICHILAND HILLS, TEXAS, AND REZONING A 8.00 ACRE
TRACT OF PROPERTY FROM AG (AGRICULTURAL) TO R -2 (SINGLE
FAMILY RESIDENTIAL) ZONING; ESTABLISHING A PENALTY;
PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE
DATE.
WHEREAS, notice of a hearing before the Planning and Zoning Commission was sent
to real property owners within 244 feet of the property herein described at
least 114 days before such hearing; and,
WHEREAS, notice of a public hearings before the City Council was published in a
newspaper of general circulation in the City at least 15 days before such
hearing; and,
WHEREAS, public hearings to zone the property herein described were held before
both the (Planning and Zoning Commission and the City Council, and the
Planning and Zoning Commission has heretofore made a
recommendation concerning the zone change; and,
WHEREAS, the City Council is of the opinion that the zone change herein effectuated
furthers the purpose of zonings as set forth in the Comprehensive Zoning
Ordinance and is in the best interest of the citizens of the City of North
Richland (Hulls; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RI+CHILAND
HILLS, TEXAS:
Section 1: THAT the Comprehensive Plan, the Comprehensive Zoning Ordinance
and the zonings map of the City of North Richland Hills are hereby
amended by rezoning i a 8.44 acre tract of (land located in the John Condra
Survey, Abstract 311, City of North (Richland Hills,, Tarrant County, Texas,
more particularly described in the legal description attached hereto as
Exhiblit A from AO (Agriculltural) to IR -2 (Singile Familly (Residential) zoning.
Section 2: Any person, firm or corporation violating any provision of the
Comprehensive Zoning Ordinance as amended hereby shall be deemed
guilty of a misdemeanor and upon final conviction thereof fined in an
amount not to exceed Two Thousand Dollars ($2,444.44). Each day any
such violation shall be allowed to continue shall constitute a separate
violation and punishable hereunder.
Section 3- The City Secretary is hereby authorized and directed to cause the
publication of the descriptive caption and penalty clauses of this ordinance
as an alternative method of publication provided by law.
Section 4- This ordinance shall be in full force and effect immediately after passage.

Vice Chairman Bill Schopper fills in when the Chairman has to be absent. Mr Schopper
filled in the Chairman role for ZC 20114-08 application.

ZC 2014-08 Public Hearing and Consideration of a request from Marvin Smith, for
a Zoning Change from "'AG" Agricultural to "R2" Single Family Residential on
8.00 acres located at 7601 Douglas Lane.
John Ritstick came forward to present staff's position on the Zoning Change application.
Marvin Smith is requesting to change the zo6ing from Agricultural to R-2 Residential.
The area in question shows a conceptual drawing for 21 residential lots.
Shane Thomas, 8004 Main Street; NRH; applicant representing Smart Buy Homes
presented. Mr. Thomas described the intent of custom residential single (1) story
residential homes with a minimum of 2,,700 square feet and two (2) story residential
homes with a minimum of 3,300 square feet. We will include walking trails and
greenbelt space.
Bill Schopper opened IPubllic Hearing for ZC 2014-08 Zoning Change application at
07.45 PM.
Randy Arnold-, 7504 Cimimiaron Drive; NRH; came forward in opposition. His property
is on the southwest end of this zoning change application area. Mr. Arnold's concern is
of proper drainage and appropriate fencing. The drainage issues have caused
considerable damage to his property.
Bill Schopper encouraged Mr. Arnold to address these issues with the developer and
the City Engineer, both present this evening during this public hearing.
Marvin Smith; 7600 IDougilas (Drive; NRH; came forward in approval. He addressed the
drainage concern. Mr. Smith confirmed that there will be a drainage flume from the
houses backings up to Gimmaron. Another flume would drain from Lincoln. Southwest
corner of that development is to be greenbelt. He described that the fencing will be
normal six (6) foot stockade. There are tough landscape requirements in place for
these homes. Each home is required to have three (3) car wood door garages.

CASE SUMMARY: Betty and Ed Rahso are requesting approval of a zoning change
from "R-2" Single Family to "R-1 " Single Famlily for a 0.1 527-acre, 30.50-foot sliver of
land between the homes at 6822 and 6904 Crane Road. The applicant is
simultaneouslly requestingi to combine this acreage iinto their existing lot at 6904 Crane
Road through and Amended Rlat (Case PIP 2014-01). The purpose of these two
requests is to properly zone and combine the two properties so that they may pull
building permits.
EXISTING SITE CONDITIONS I HISTORY: The 0.1527-acre area of the rezoning has
been owned and used by the adjacent lot at 6904 Crane Road for about 10 years but is
still officially platted as a portion of Lot 8, Block 6, Woodland Oaks Addition, whiich, is the
lot addressed as 6801 Brazos Bend Dhve adjacent to the east. It appears that the
original lintent was for that particular lot to maintain the original driveway access to
Crane Road for an original home that was in place prior to Woodland Oaks Addition
being developed. That property has since changed their driveway access to be off
Brazos Bend Drive, thus the strip is no longer necessary. The strip is zoned R-2
because lit was a portion of Woodland Oaks, whiich, is all zoned R-2.

RICHLAND HILLS; AMENDING THE ZONING MAP OF THE CITY OF
NORTH RICHLAND HILLS, TEXAS, AND REZONING A 0.1527 ACRE
TRACT OF PROPERTY FROM R-2 (SINGLE FAMILY RESIDENTIAL) TO
R-1 (SINGLE FAMILY RESIDENTIAL) ZONING; ESTABLISHING A
PENALTY; PROVIDING FOR PUBLICATION; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, notice of a hearing before the Planning and Zoning Commission was sent
to real property owners within 200 feet of the property herein described at
least 10 days before such hearing; and,
WHEREAS, notice of a public hearings before the City Council was published in a
newspaper of general circulation in the City at least 15 days before such
hearing; and,
WHEREAS, public hearings to zone the property herein described were held before
both, the (Planning and Zoning Commission and the City Council, and the
Planning and Zoning Commission has heretofore made a
recommendation concerning the zone change; and,
WHEREAS, the City Council is of the opinion that the zone change herein effectuated
furthers the purpose of zonings as set forth in the Comprehensive Zoning
Ordinance and is in the best interest of the citizens of the City of North
Richland Hills; NOW, THEREFORE,
BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND
HILLS, TEXAS:
Section 1 THAT the Comprehensive Rlan, the Comprehensive Zoning Ordinance
and the zonings map of the City of North Richland Hills are hereby
amended by rezoning a 0.1527 acre tract of land located in the Tandy K.
Martin Survey, Abstract 1055, City of North Richland Hills,, Tarrant County,
Texas, more particularly described in the legal description attached hereto
as Exhlibit A and the site plan as Exhlibit B from IR-2 (Single Farnfly
Reslident4l) to R-1 (Single Family (Residential) zoning.
Section 2- Any person, firm or corporation violating any provision of the
Comprehensive Zoning Ordinance as amended hereby shall be deemed
guilty of a misdemeanor and upon final conviction thereof fined in an
amount not to exceed Two Thousand Dollars ($2,000.00). Each day any
such violation shall be allowed to continue shall constitute a separate
violation and punishable hereunder.
Section 3- The City Secretary is hereby authorized and directed to cause the
publication of the descriptive caption and penalty clauses of this ordinance
as an alternative method of publication provided by law.
Section 4- This ordinance shall be in full force and effect limmediately after passage.

property. The purpose of these two requests is to properly zone and combine two
properties that allready appear to be one so that they may pull building permits. Staff is
supportive of both requests.

Miller Surveying, presented that this application is pretty much a clean -up plat. The
sliver of (land used to be lingressiegress to the property which is no longer necessary.

CASE SUMMARY: Betty Pariso is requesting approval of an Amended Plat to
exchange a 0.1527 -acre, 30.50 -foot sliver of land from one platted (lot to another, so that
the property owner may pull buildings permits that may straddle the existing lot lines.
SEE REPORT FOR ZC 2014-12 FOR ADDITIONAL DETAILS
PLATTING STATUS: The properties are currently platted as Lot 8, Block 6, Woodland
Oaks Addition and Lot 2, Block 1, Tidwell Addition. The Amended Plat changes Lot 2 to
a new Lot 9, Block 6, Woodland Oaks Addition.
AMENDED PLAT: State code allows the use of an Amended (or Amendingi) (Plat to
relocate one or more lot (lines between one or more adjacent lots if- the owners of all
those hots join in the application for amending the plat; the amendment does not attempt
to remove recorded covenants or restrictions; and the amendment does not lincrease
the number of lots (Section 2112.016(10), Texas Local Government Code). This case
meets these criteria and was therefore not advertised for a residential replat public
hearing.
EXISTING ZONIING: "'R-11" and "'R-2" Singille Family Residential. The accompanying
zoning change case ZC 2014-112 proposes to change the zonings of the 30-foot strip to
"R-1 " to be consistent with the new lot that it is beings platted unto.

CASE SUMMARY: Arcadia Land (Partners 25, Ltd is requestingi a Special Use Permit
for 19 single family cottage lots to replace 26 previously approved townhome (lots within
a new 76-lot phase of Hometown (located east of the Lakes on the north side of Bridge
Street. These 35'+ wide (lots would feature mostly 2-story 30-foot wide homes. The
codified minimum unit size is 1,200 square feet, but their conceptual plans attached
hereto call for units between 1,700 and 2,500 square feet. These example units are all
at least 3- bedroom, 2+ bathrooms,, with two examples of a 4-bedroom product. All front
building elevations must meet the minimum, architectural requirements set in the Town
Center Code.
TOWN CENTER REGULATING PLAN & ZONING: The area of the proposed Cottage
lots is within "'Tracts 3A & 313" the "N6ighborhood General" subzone of the Town Center
Zoning (District. The Neighborhood General subzone primarily consists of single-famfly
with the opportunity for Ilimlited office use in a house. Tract 3A/313 specifically stipulates
that no multi-familly units are permitted; but does allow 120 townhome units and no limit
on detached single-family units. Sections 118-471 (4a), Table of Allowed Building Types
in the Town Center Zoning Dlistrict also states that small lots less than 40 feet wide with
detached house (cottage) are permitted in the Neighborhood General and
Neighborhood Center subzones with City Council approval of a Special Use (Permit and
only east of the Lakes in place of townhiomes.
MINIMUM COTTAGE BUILDING STANDARDS: With the exception of the lot width,
the same lot and building requirements of standard single family lots apply to cottage
units as well. The Town Center Code places additional architectural requirements on
cottages above and beyond the minimum standards of single - family and townhome lots.
These additional requirements are in place to guarantee a higher level of quality and
craftsmanship lin the units. Staff had the applicant identify how and where each of the
front building elevations have met the followings requirements on the exhibits included
herein-
The following architectural features will be required as part of a special use permit on all
singille family detached cottage dwelling unit buildings on hots between 30 feet and Mess
than 40 feet in width, measured at the front building line.
• Front (or Charleston - style nude} porch
0 Porch roof or second story porch
Roof overhang of 1 foot minimum, on the street fagade unless the architecturall
style (i.e. French, Country) calls for a smaller overhang
• Finished or decorative soffit on roof overhang
• Cemientitious horizontal sidings construction must have a minimum 4 finch wide
rake boards, corner boards, and window and door trim.
• Brick construction must have Soldier course or arch over doors and windows and
along roof rake
Stucco/ElFS construction must have decorative or raised head and sill at
windows and doors and alongi roof rake on the street facade.
Finished floor elevation at least 3 six-inch risers above grade at building frontage.
Unless topography makes this unfeasible.
Windows- single or double hung, and divided light on the street fagade.
Casement windows are allowed when architecturally approphate.

DEVELOPER AGREES TO REDUCE TOWNHOMES BY 26 UNITS: The Town Center
zoning allows a maximum total of 120 townhome units within Tract 3A/ B. Rather than
these proposed 19 cottage lots beings in addition to those 120 townhome units, the
developer has agreed to a zonings ordinance text revision that will change "'120" to "94,"
whereby decreasingi the number of total permitted townhome lots by 26. If the proposed
SUP is approved, staff will follow up with a Zonings Ordinance Text Revision.
DRC—APPROVED CONCEPT PLAN: On April 4, 2012, the Dev6lopment Review
Cornmlittee approved the Concept Plan for the Home Town Canal District, which
included the area along Mid-Gities Boulevard that has developed with The (Enclave
apartments. Whine the lots were not detailed on the Concept Plan, the proposed
cottage lots fit into the land use pattern and street network for this phase and replaces
what would otherwise be developed as townhomes.
STAFF REVIEW: For the following reasons, staff has not seen any issue with this
proposal thus far and is recommending approval to the Planning & Zoning Commission
and City Council-
1. The request replaces 26 attached townhome lots with 19 detached single family
lots, a net reduction of 7 units. The appficant/owner has also agreed to reduce
the total number of townhomes entitled in this area of Home Town from 120 to
947
2. All proposed cottage lots are interior to the phase, meaning they do not front
Bridge Street. One would have to go into the neighborhood to see them. They
are surrounded by townhomes and larger single family lots;
3. This application adds diversity and options of product type. If approved, this
phase would feature 30 townhome lots, 19 cottage lots, and 27 standard
detached sling1e-family lots;
4. The cottage units would have to conform to the established minimum
architectural requirements; and
5. Because of (lot area and unit size, the cottage units will (likely be priced between
the townhomes and the more expensive garden homes, offering varying price
points in the neighborhood.
PLANNING & ZONING COMMISSION: The IPlanningi & Zoning Commission held a
public hearing and considered this litem at their June 19, 20114 meeting and voted 4-0 to
recommend approval.
STAFF RECOMMENDATION: Approval of Ordinance No. 3314.

lots less than forty (40) feet wide in the Home Town Canal District located in 'the
8700 block of Bridge Street.

FP 2014-02 Consideration of a request from Arcadia Land Partners 25, LTD for a
Final Plat of The Hometown, Canal District, Phase 4; being 76 single family
residential lots on 10.892 acres in the Hometown, Canal District, Phase 4; Ibeiing
76 single family residential lots on 10.892 acres in the 8700 block of Bridge Street.
Clayton Comstock came forward to present staffs position on the SUP and FP
applications. Both, C.6 and C.7 requests are addressing the same development. This is
located on the north side of Bridge Street, just across from Walker Creek Elementary.
The Town Center Regulating Plan shows this area to be in the N&ighborhood General
subzone with pocket parks located within the development. A Concept Plan meeting
the Regulating Plan was approved by staff in April 2012. That Concept Plan included
townhomes in the area of the proposed SUP for 19 "'Cottage Lots." A cottage lot is a
detached single family home lot less than 40 feet in width. These cottage lots will have
to meet Home Town architectural requirements plus additional requirements. This SUP
represents a net reduction of 7 units because these 19 cottage lots would take the place
of 26 townhome lots. The developer has also agreed to reduce the number of entitled
townhome lots from 120 to 94. Mlr. Comstock showed the architectural plans which
marked the additional requirements on each cottage home plan. Staff is supportive of
these requests with SUP approval.
Bill Gietema; 3500 Maple Ave; Dallas; as the applicant, representing Arcadia Realty
presented. (Rather than present his IPowerPoint presentation, Mlr. Gietema simply asked
if the Commission had any questions.
Chairman Randall Shiflet opened Public Hearing for SUP 2014-06 Special Use Permit

Sam Akins; 8600 Beetlenut Lane, NRH-, came forward in opposition. Mr. Akins has
safety concerns. Mr. Akins has concerns about the plat, the development and the
streets around Walker Creek Elementary. There are really only three entrances into the
Home Town development. Mlr. Akins has personally observed busses dropping off and
pickings up children in front of Walker Creek Elementary. The school has been built too
close to the street, wishing to have the street wider as part of this development.
Clayton Comstock clarified that Bridge Street currently does include two (2) travel lanes.
He announced that the development p[an does include one (1) additional parallel
parking lane on Bridge Street.

CASE SUMMARY: Arcadia Land Partners 25, Ltd is requesting approval of a Final (Plat
for The IHlometown Canal (District, (Phase 4; 75 single family residential lots and 5 open
space lots on 10.892 acres northwest of Bridge Street and across the street from
Walker Creek (Elementary School. This Final Plat is dependent on the concurrent
approval of the Special Use (Permit for 19 cottage lots. If approved, there would be a
diverse mix of thirty 30-foot townhome lots, four 40 -foot garden lots, nineteen 35 -foot
cottage lots, and twenty- three 45'+ single family lots.
COMPREHENSIVE PLAN: The Comprehensive (Plan designates this area for "Town
Center"' uses, which lis a mix of hligher- density and complementing uses planned under
a Traditional Neighborhood Development model.
TOWN CENTER REGULATING PLAN: The
114.892 acres are located within the
"Nleighborhood General" subzone within
"Tracts 3A & B" of the Town Center Zoning
District (IHomeTown). This tract specifically
stipulates that detached single family
residentiall is required fronting i the Lakes and
allowed without Ilimlits elsewhere. Multi - famlily
is prohibited, and a maximum of 120
townhomes is permitted.
The proposed plat also meets all the (ROW
locations, widths and labels all the appropriate
Town Center street types, lincluding the 5 -foot
sidewalks, continuous street tree parkways

HOMETOWN STANDARDS: Homes constructed within this development will have to
meet the private design guidelines and pattern book of the Town Center Architect. The
Town Center Zoning Disthct code also has certain architectural parameters,, including:
Unrestricted Materi4ls ' - At least 75 % of each, fagade (excluding doors and windows)
visible from any public right-of-way or adj6ining properties of new builcllings shall be
finished in one the following materials. No more than any combination of three of the
following different materials shall be used on any single facade:
Brick; stone; man-made stone, stucco utilizing a three-step process; or
cementitious horizontal siding, in a paintaUle finish and of traditional
dimensions with a 50-year warranty.
Masonry materials, with the exception of dry stack stone, shall be linstallled in
a craftsman hike manner that are a minimum of one inch thick, face to back,
and imbedded in a cementitious reinforced substrate.
Restricted Building Materials: these materials shall be only allowed up to 25% of
each fagade as an accent material,
Decorative wood (naturafly resistant to decay), metal, synthetic materials or
reinforced Exterior Insulating Finishing System (EIFS) or similar material over
a cementitious base, rock, glass block and tile.
�Roofingi materials (visiUle from any public right -of -way): copper, factory
finished painted metal, slate, synthetic slate, terra cotta, cement tile, glass
fiber and architectural grade asphalt shingles.
An enclosed garage or carport shall be designed and constructed of the same
material as the primary builclling.
Bellow are some of the applicable zo6ing standards that apply to this phase.
DRC -AP PROVED CONCEPT PLAN: Prior to any large tract developing in HomeTown,
a Concept Plan is required to be reviewed and approved by the Development (Review
Committee and the private Hom,eTown property owners association. The Concept Plan
included below shows this area planned for both attached and detached single family
residential and was approved April 4, 2012.
OPEN SPACE: Each major phase of development within HomeTown is required to
provide a minimum 5'% area in usable public open space for the purpose of servings that
particular neighborhood. This particular phase of the Canal District provides 1.145
acres of open space, or 10.5%.
PLATTING STATUS: Currently unplatted tracts within the Landon C. Walker Survey,
Abstract No. 1652. This area was included on the Prelimlinary Plat for The Hometown
Canal District approved by the Planning & Zoning Commission on April 19, 2012.
WALKER CREEK TRAIL RELOCATION: The existing Walker Creek Trail pavement
and underlying trail easement will be abandoned by this plat and relocated further west,
closer to the Lakes. The developer and the Parks Department will coordinate timing to
limit the impact on the trail network.
FUTURE IMPROVEMENTS WITH NEXT PHASE: A number of major infrastructure
improvements will be provided with the next phase of this development. In referencing
the approved Concept Plan provided below, the next phase of development will require
a pedestrian bridge to connect Ice House Drive with Riverdale Drive as well as major
drainage improvements that will create the "canal" of the Canal District.
UNIQUE FIRE PROTECTION: Residences that are only served by mews street
sections pose a potential access problem for Fire and (EMS emergency services. The
width of the mews street section is less than the 24' fire lane and only gives access to
the back of house. Gainingi access to a patient or performing a fire attack from the back
of a residence through the garage is often not ideal. Fire attacks on a typical street
section allows for placing apparatus on the street generally in front of the involved
residence. This could (Include the Ladder Truck or Qulint for aerial operations. Placing
an apparatus on a mews street directly behind the involved structure has a high
potential for subjecting the pump operator to a hazardous environment and makings the
apparatus an exposure to the heat, resulting in damage to the vehicle.
Though, not a substitute for typical access, the following are offered as partial mitigation-
• Install yard hydrants in strategic locations on the front of house access side that
can have pressure boosted by Fire Apparatus
• Where park trails are avalilable, increase the concrete thickness to allow for the
support of Fire Department vehicles.
• Suggest that the builder and home owner consider the increased need for fire
sprinklers.
• Plant no trees or vegetation near the street that would overhang and decrease
the width, of the street. Trees that could overhangs the street must be limbed up
to a height of 14'.
• Enforcement of no parking on the mews street sections must be maintained.
ROUGH PROPORTIONALITY DETERMINATION: The developer wfli be responsible
for 100% of all paving, water, sanitary sewer, and drainage infrastructure needed to
support the development in accordance with the City's design criteria as shown on the
infrastructure construction plans.
The above determination of proportionality is made pursuant to Section 21(2.904, Texas
Local Government Code by the undersigned professional engineer in the employ of the
City of North (Richland Hills, licensed by the State of Texas.
PLANNING & ZONING COMMISSION: The Planning & Zo6ing Commission
considered this litem , at their June 19, 2014 meeting and voted 4-0 to recommend
approval.
STAFF RECOMMENDATION: Approval of FP 2014-02, subject to approval of SUP
20114-06 on the same City Council agenda.

TR 2014-02 Public Hearing and Consideration of amendments to
Sections 118-1 and 118-631 of the North, Richland Hills Code of
Ordinances by defining electronic cigarettes and non-traditional
smoking irelated businesses and restricting cigar and cigarette shops
and non-traditional smoking related businesses to, certain zones with a
Special Use Permit - Ordinance No. 3311.
Presenter- John IPitstick, Director of Plan6ingi & Development
SUMMARY: North (Richland (Hulls adopted more restrictive public smoking regulations
similar to area cities on September 23, 2013 to eliminate smoking in public buildings
and restaurants with exemptions to allow smoking in restaurant patios, private offices
and adult smoking establishments. Ongoing concerns have been expressed over e-
cigarettes and establishing regulations for non-tradlitionall smoking. There has also
been an )increase in requests for vapor and hookah lounges within the city. In an effort
to clarify smoking regulations and to review adult smoking establishments one on one
as they come into the city, staff is recommending changes to the zonings ordinance to
require a special use permit for all new traditional and non-traditiondl smoking shops.
GENERAL DESCRIPTION. Current smokingi regulations have recently been updated
but have not included non-tradlitionall smoking businesses such as hookah lounges, e-
cigarette or vaping businesses. Many public institutions and cities are actively
regulating non-traditional smokingi and there are concerns as a result of the FDA
releasing )interim, reports that e-cigarettes still have nicotine which can have significant
health issues. City Council is also considering an ordinance revision to Chapter 42 to
prohibit the public use of electronic cigarettes anywhere smoking of tobacco is
prohibited.
To review and scrutinize new adult smoking businesses a draft ordinance has been
prepared that defines traditional and non-tradition4l smoking establishments and
requires special use permit approval in the LIR, C1 and C2 zoningi districts. A similar
regulation was passed a few years ago regarding payday loan businesses when we
were seeing an )increase in these types of businesses.

These existing adult smoking estabfishments will be grandfathered as a legal non -
conformingi use. Cigarettes and e-cigiarettes will continue to be allowed to be sold as a
secondary or accessory use lin most convenience stores. The SUP requirement will
allow the Planning & Zoning Commission and City Council the abi[ity to review new
adult smoking establishments as they are requested and its effect on adjacent property
and the community welfare.
ADDRESSING TRANSIT ORIENTED DEVELOPMENT DISTRICTS: Consideration of
lim,itingi smoking establishments through, special use permit approval has not been
addressed in the TOD Disthcts as part of this change. Initi4l changes for limiting
smoking establishments in standard zoning districts are beings brought forward wrath
recommended approvals by the IPlannling & Zoning Commission. Staff will revisit this
issue under the TOD Districts and brings forward similar restrictions as soon as possible.

marketed or sold as an electronic cigarette, an ellectronlic cigar, an electronic cigarillo,
an electronic pipe, an electronic hookah, or any other product name or descriptor. "E-
Cigarette," "electronic cigarette," or "ellectronic smoking device" does not include any
product specifically approved by the United States Food and Drug Administration for
use in the mitigation, treatment, or prevention of disease.
"Non-Traditional Smoking Related Business " - A retail establishment or other business
whose principal business is the offering of a service relatingi to, or the selling of, renting
or exhibitingi of products or devices known as water pipes, hookahs, electronic
cigarettes or 61ectromic vapiing devices, steam, stones, hookah pens or any comparable
devices. For the purpose of this definition, the term "principal" shall mean over 25% of
the volume of sales or rentals,, stock in trade or display areas generated from or devoted
to the products or devices describing herein."
Section 2- THAT the Comprehensive Plan, Comprehensive Zoning Ordinance and
Section 118-631 G. RETAIL AND SERVICE USES be amended to read
as set forth, in Exhibit A hereto.
Section 3- Any person, firm or corporation violating any provision of the
comprehensive zonings ordinance as amended by this ordinance shall be
deemed guilty of a misdemeanor and upon final conviction thereof fined in
an amount not to exceed Two Thousand Dollars ($2,000.00) . Each day
any such violation shall be allowed to continue shall constitute a separate
violation and punishable hereunder.
Section 4- It is hereby declared to be the intention of the City Council that the
sections, paragraphs, sentences, clauses and phrases of this ordinance
are severable and, if any phrase, clause, sentence, paragraph or section
of this ordinance shall be declared unconstitutional or otherwise linvallid by
the final judgment or decree of any court of competent jurisdiction, such
invafidity shall not affect any of the remainingi phrases, clauses,
sentences, paragraphs and sections of this ordinance, since the same
would have been enacted by the city council without the incorporation in
this ordinance of any such invalid phrase,, clause, sentence, paragraph or
section.
Section 5- The City Secretary is hereby authorized and directed to cause the
publication of the descriptive caption and penalty clauses of this ordinance
as an alternative method of publication provided by law.
Section 6- This ordinance shall be in full force and effect immediately upon passage.

John Plitstick came forward to present staff's position on the Change of Ordinances for
smoking establishments. 'V'i'e are moving forward to address and define e- Cigarettes.
'li'Ve have seen an increase in requests for adult smoking establishments. (Many public
and private businesses are restricting e- cigarettes. There are no current regulations
against the use by minors of e- cigarettes. This ordinance better defines non- traditionall
smoking related businesses. Under this ordinance, both traditional and non- traditionall
smoking establishments will require an SUIP. This does allow 'grandfathers" of 9
existing smoking businesses. Cigarettes and e- cigarettes would still be sold in
convenience stores to adults. Council is (looking at prohibiting e- cigarette sales to
minors and prohibiting i e- cigarettes anywhere smoking tobacco is currently prohibited.
Health chapter prohibits tobacco use by minors. This is staff - initiated.

CASE SUMMARY: Constant Capital Co., LLC is requesting i approval of a. Final Plat for
the Viflas at Hometown; 37 single family residential (lots and 2 open space (lots on 7.34
acres south of Bridge Street and Parker Boulevard adjacent to Walker's Creek Traill,
NIRH20, and the future second phase of the Dollce Living multifamily development.
Most of the proposed lots are 47 to 49 feet lin width, 103 to 113 feet in depth and about
4,944 to 5,590 square feet in area.
COMPREHENSIVE PLAN: The Comprehensive (Flan designates this area for "Town
Center"' uses, which lis a mix of hligher- density and complementing uses planned under
a Traditional Neighborhood Development model.
TOWN CENTER REGULATING PLAN:
The 7.34 acres are (located within the
"Nleighborhood General" and
"Nleighborhood Center" subzones within
"Tract 11" of the Town Center Zoning
District (Home Town). Tract 11
specifically stipulates that detached
single family residential is required
fronting the Lakes and allowed without
limits in the General and Center
Subzones.
The proposed Plat also meets all the
(ROW (locations, widths and labels all the
appropriate Town Center street types,

HOMETOWN STANDARDS: Homes constructed within this development will have to
meet the private design guidelines and pattern book of the Town Center Architect. The
Town Center Zoning Disthct code also has certain architectural parameters,, including:
Unrestricted Materi4ls ' - At least 75 % of each, fagade (excluding doors and windows)
visible from any public right-of-way or adj6ining properties of new builcllings shall be
finished in one the following materials. No more than any combination of three of the
following different materials shall be used on any single facade:
Brick; stone; man-made stone, stucco utilizing a three-step process; or
cementitious horizontal siding, in a paintaUle finish and of traditional
dimensions with a 50-year warranty.
Masonry materials, with the exception of dry stack stone, shall be linstallled in
a craftsman hike manner that are a minimum of one inch thick, face to back,
and imbedded in a cementitious reinforced substrate.
Restricted Building Materials: these materials shall be only allowed up to 25% of
each fagade as an accent material:
Decorative wood (naturafly resistant to decay), metal, synthetic materials or
reinforced Exterior Insulating Finishing System (EIFS) or similar material over
a cementitious base, rock, glass block and tile.
�Roofingi materials (visiUle from any public right -of -way): copper, factory
finished painted metal, slate, synthetic slate, terra cotta, cement tile, glass
fiber and architectural grade asphalt shingles.
An enclosed garage or carport shall be designed and constructed of the same
material as the primary builclling.
Bellow are some of the applicable zo6ing standards that apply to this phase.
DRC -AP PROVED CONCEPT PLAN: Prior to any large tract developing in HomeTown,
a Concept Plan is required to be reviewed and approved by the IDevellopment Review

SEPARATE GRAND AVENUE RIGHT-OF-WAY DEDICATION: Only half of the area
needed for Grand Avenue is under contract by Constant Capital Co., LLC. The other
half, owned by Arcadia, is prepared to be dedicated as right-of-way by separate
instrument so that the street's travel lanes can be fully built and access can be provnded
to this development. Street trees, on-street parkung, street lights and sidewalks will only
be provided on the south side of Grand Avenue under this development. The north
side's amenities wffl be installed at the time that phase develops.
ACCOMPANYING EASEMENT ABANDONMENT ORDINANCE: Attached hereto is
Ordinance No. 3315 which approves the abandonment of three different multi-purpose
easements for water, drainage,, sanitary sewer and gradingi totalingi 155 feet in wndth.
The D61ce Living mufti-famfly development needed these easements to facilitate their
construction, and their (location coincides with the Wermifllion Street" right -of -way to be
developed with the Villas at Hometown.
ROUGH PROPORTIONALITY DETERMINATION: The developer wfli be responsible
for 100% of all paving, water, sanitary sewer, and drainage infrastructure needed to
support the development in accordance with the City's design criteria as shown on the
infrastructure construction plans.
The above determination of proportionality is made pursuant to Section 2112.904, Texas
Local Government Code by the undersigned professional engineer in the employ of the
City of North (Richland Hills, licensed by the State of Texas.
PLANNING & ZONING COMMISSION: The Planning & Zo6ing Commission
considered this litem , at their June 19, 2014 meeting and voted 4-0 to recommend
approval.
STAFF RECOMMENDATION: Approval of FP 20114-04 and Ordinance No. 3315
approvingi the abandonment of three multi - purpose easements on the subject property.

Final (Plat applications. Bath C.3 and C.9 requests are addressing i the Villas at

which are just north of NRH20 water park. This plat is consistent with the Town Center
IRegWating (Plan and the Concept Plan for this area.

family residential lots on 17.397 acres located at 7001 Iron Horse
Boulevard.

CASE SUMMARY: Cambridge NRH Development, LLC lis requesting approval of a
Final Plat for Cambridge Place on 17.397 acres of land on the north, side of Iron Horse
Boulevard just east of Rufe Snow Drive. Cambridge Place consists of 60 single- family
resiidenti4l lots, 6 open space lots, a gins valve station lot and a formal dedication of the
existing "20' Hike & Bike Trail (Easemient" for the Cottonbelt Trail to the City of North
Richland Hills.
CURRENT ZONING: The City Council approved ZC 2013-25 for all three sections of
the Cambridge development on January 27, 2014, which includes 192 single family (lots
under "'R2" & "R3" standards. The following are applicable to the 60-lot Cambridge
Place phase-

masonry wall will be provided adjacent to Prestige Ameritech's facility. A mixture of
open -style fencing and fu[1-masonry walls will) be provided alongi Iron Horse Boulevard
(see approved examples below).

COMPREHENSIVE PLAN: Low Density Residential. The Land Use change from
Commercial to Low Density Residential was approved with, the zonings on January 27,
20114.
CURRENT PLATTING: The property lis currently platted as Lot SR113, Block 1, NRH
Industrial Park Addition situated in the J.C. Yates Survey, Abstract No. 1753. The
Preliminary Plat for Cambhdge was approved by the Planning & Zo6ing Commission
(PP 2013-09) on February 6, 2014.
THOROUGHFARE PLAN: Iron Horse Boulevard is designated as a "C4U" four-[ane
undivnded collector and has adequate right-of-way today, therefore none is dedicated by
this plat. Because of the dramatic shift lin land use along this stretch of Iron Horse
Boulevard,, it is possible that changes to the Thoroughfare Plan wflll be discussed in an
upcoming Comprehensive Plan update.
ROUGH PROPORTIONALITY DETERMINATION: The developer will be responsible
for 100% of all paving, water, sanitary sewer, and drainage infrastructure needed to
support the development in accordance wrath the City's design criteria.
LANDSCAPE PLANS FOR OPEN SPACES LOTS: A condition of the zoning approval
for Cambridge was for the developer to provide landscape plans prepared by a
Regfistered Landscape Architect for all open space lots and Ilandscapling to be installed
by the developer. Those landscape plans are attached and effectively commu6icate the
intent of the developer to landscape open space lots with grasses, trees, shrubs, beds,
etc. and provide street trees along Iron IHlorse Boulevard.
PLANNING & ZONING COMMISSION: The IPlannling & Zoning Commission considered
this item at their June 19, 2014 meetings and voted 4-0 to recommend approval.
STAFF RECOMMENDATION: The proposed Final Plat is consistent with the R-PD
Zoning and Preliminary (Plat for the property; therefore staff recommends approval of FP
20114-08 for Cambridge Place.

Clayton Comstock came forward to present staff's position on the two Final Plat
applications for the Cambridge development along (Iron IHlorse Boulevard. Cambridge
Place lis for 64 hots and Cambridge Village lis for 77 lots. The zoning changed from
industrial to single-family residential earlier this year. Both final plats are consistent with
the zoning. Part of the zoning approval was a deferral of landscape plans as well as an
alignment for the Liberty Way and Iron IHlorse Boulevard intersection. The landscape
plans have been submitted and the Iron IHlorse/Liberty Way alignment has been
approved by IPublic Works. The current "stralight shot" intersection will be repaved or
restriped to force traffic to slow down at that intersection until there is enough funding i to
permanently improve that intersection. Staff is supportive of both requests.

BoWevard just east of IRufe Snow Drive. Cambridge Villagie consists of 77 single-famfly
residenti4l lots and 5 open space (lots. Cumulatively, the open space lots add up to 1.9
acres, or 112.53% of the gross acreage of the development.
CURRENT ZONING: The City Council approved ZC 2013-25 for all three sections of
the Cambridge development on January 27, 2014, which lincIudes a total of 192 singille
family lots under "'R2" & "R3" standards. The following standards are applicaUle to the
77-lot Cambridge Vil[age phase.

COMPREHENSIVE PLAN: Low Density Residential. The change from Neighborhood
Service to Low (Density Residential was approved with, the zoning request on January
27, 2.414.
CURRENT PLATTING: The property is a portion of property currently platted as Lot
4131A, NRH Industrial Park Addition situated in the J.C. Yates Survey, Abstract No.
1753. The Preliminary Plat for Cambridge was approved by the Planning & Zoning
Commission (PP 2013-09) on February 6, 2014.
THOROUGHFARE PLAN: Iron Horse Boulevard is designated as a "C4U" four -(lane
undivided collector and has adequate right-of-way today, therefore none is dedicated by
this plat. Because of the dramatic shift lin land use along this stretch of Iron Horse
Boulevard, it is possible that changes to the Thoroughfare Plan wffl be discussed in an
upcoming Comprehensive Plan update. The development also has frontage—but no
direct intersection/access—on Liberty Way,, also a "C4U" on the Thoroughfare Plan. No
right-of-way is necessary with, this Final Plat for Liberty Way.
The ,intersection alignment of Liberty Way with, Iron Horse Boulevard was discussed
thoroughly during the zoning approval process and City Council requested to see a
solution to the alignment upon Final Plat. The rendering below shows the proposed
intersection, as designed by the City's traffic consultant and reviewed by the Public
Works Department. Numerous designs were generated and reviewed, including
"hooded" turns with medians. In the end, the simplest plan was recommended. This
plan will help slow eastbound Iron Horse to Liberty way turns as well as westbound
Liberty Way to westbound Iron Horse turns. The plan also shows the fully improved,
four-Mane section of Liberty Way. A more immediate revnsion wffl likely be made by
repaving and resthping for the existing two -Mane section of Liberty.
ROUGH PROPORTIONALITY DETERMINATION: The developer will be responsiNe
for 100% of all paving, water, sanitary sewer, and drainage infrastructure needed to
support the development lin accordance with the City's design chteria. The Subdivision
wfli also have an limpact on the existing public Rlight-Of-way ("ROW"). As such, the
developer wffl be responsiNe for the follownng.

$24,033.56
Such amount ($24,033.56) is roughly proportionate to the proposed SubdMsion.
Therefore, the developer will be required to either construct the required improvements
(per current minimum City standards) or assume 1100% of the amount ($24,033.56)
required for such infrastructure improvements. This cost is valid for six months from the
date of tissue of this memo.
The above determination of proportionality is made pursuant to Section 2112.904, Texas
Local Government Code by the undersigned professional engineer in the employ of the
City of North (Richland Hills, licensed by the State of Texas.
LANDSCAPE PLANS FOR OPEN SPACES LOTS: A condition of the zoning approval
for Cambridge was for the developer to provide landscape plans prepared by a
Regfiistered Landscape Architect for all open space (lots and Ilandscapling to be linstalled
by the developer. The landscape plans are attached and effectively communicate the
intent of the developer to landscape open space lots with girasses, trees, shrubs, beds,
etc. as well as provide street trees along Iron Horse and Liberty Way.
PLANNING & ZONING COMMISSION: The Planning & Zoning Commission
considered this litem at their June 19, 2014 meeting and voted 4-0 to recommend
approval.
STAFF RECOMMENDATION: The proposed Final Plat is consistent with the R-PD
Zoning and Preliminary IPlat for the property; therefore staff recommends approval of FP
20114-09 for Cambridge Village.

Summary.
The City of North (Richland (Hulls continues to examine and research health studies and
area cities regulations regarding smoking and lis bringing forward new regulations to
define electronic cigarettes, prohibit the sale and possession of electronic cigarettes to
minors and prohibit the use of electronic cigarettes anywhere smoking of tobacco is
prohibited. There is an accompanying zoning ordinance regulating traditional and non -
traditional cigarette shops through special use permits in the Local Retail, C -11 and C -2
zoning districts.
General) (Description:
There continues to be community support and City Council direction for restricting
traditional and non- tradlitional smoking i within the City of North Rlichlland W(i)lls with
exceptions for adult smoking i establishments and outdoor patios adjacent to restaurants.
Recent U.S. Food and (Drug Administration has also issued statements regarding
potential hazards of e- cigarettes in which carcinogens and toxic chemicals could be
present suggesting the same concerns with secondhand smoke may exist with
electronic cigarettes.
North (Richland IHlillls adopted more restrictive public smoking regulations similar to area
cities on September 23, 2013 but did not address electronic cigarettes at the time. This
newly proposed ordinance treats traditional and non - traditional smoking i identically by
prohibiting sane and possession to minors and prohibiting non - traditional smoking
anywhere smoking of tobacco is prohibited.
Staff also continues to receive requests for vapor and hookah lounges that are allowed
by right in commercial zoning districts. An accompanying i zonings ordinance will restrict
all smoke shops whether traditional or non - traditional to approved special use permits lin
the Local Retail, C -1 and C -2 zoning districts.
Electronic cigarettes are currently not regulated by the state or federal government.
This proposed new smoking regulation follows community support and addresses
health hazard concerns while still allownng adults the option to purchase and use
traditional and non-traditional cigarettes.

WHEREAS, the safety and efficacy of electronic cigarettes and other vapling devices is
still unknown and such devnces deliver an unknown mix of potentially
carcinogenic and toxic compounds, as evidenced by the following: a)
nicotine content labeling lis not accurate with some electronic cigarette
manufacturers-" b) nicotine related impurities content lin carthdges and
refills vary by electronic cigarette manufacturer 2 and c) the concentrations
of some metal and silicate particles in electronic cigarette aerosol were
higher than or equal) to the (levels contained in conventional cigarette

WHEREAS, the U.S. Food and (Drug Administration conducted laboratory analysis of
electronic cigarette samples and found them to contain carcinogens and
toxic chemicals to which users and bystanders could potentially be

exposed,, suggestingi that the same concerns present with secondhand
smoke from conventional cigarettes may exist with electronic cigarettes,
and

WHEREAS, it is unlawfUl to sell or furnish electro6ic cigarettes to minors,, however
minors are stifl able to obtain access to electro6ic cigarette products. A
national survey revealed that between 2011 and 2012, middle school
students who reported ever usingi electronic cigarettes increased from
1.4% to 27% and current use of electro6ic cigarettes increased from

WHEREAS, the City Council has further investigated and determined that the 2012
National Youth, Tobacco Survey shows that the use of electronic smoking
devices by U.S. high school students has doubled from the previous year
to 2.8%; and
WHEREAS, the City Council has further investigated and determined that medical and
phiarmiacologilicall experts have opined that electronic vaping devices
contain nicotine lin a Iliquid form that may escape from the devices and be
ingested by minors which may cause symptoms such as hyperactivity,
flushing, sweating, headache, dizziness, rapid heart rate, vomiting,
diarrhea, burning and irritation of the skin and, in severe cases, may result
in a coma or death; and,
WHEREAS, the City Council has further investigated and determined that studies have
shown that electronic smoking devices can serve as a "'gateway' to
smoking traditional tobacco products which are lilllegal for minors to
purchase or possess; and,
WHEREAS, the City Council has further investigated and determined that electronic
smoking devices are currently not regulated by the State of Texas or the
federal government; and,
WHEREAS, the City Council has determined that it lis lin the best interest and welfare
of the citizens of North, Rich[and Hi[Is to prohibit the possession and
purchase of electronic smoking devices by minors and the sale and
distribution of 61ectronic smoking devices to minors; and,

WHEREAS, it is the intent of the City Council, in enacting this Ordinance,, to provide for
the public health,,, safety, and welfare by discouraging the inherently
dangerous behavior of the use of electro6ic cigarettes and electronic
smokingi devices, around non-tobacco users, especially chilldren; by
protectingi the public from exposure to secondhand smoke and vapors
where they five, work and play- , by reducingi the potential for chifldren to
wrongilly associate smoking and tobacco use with a healthy lifestyle- , and by
affirming and promoting a healthy and nuisance-free environment in the
City;
NOW, THEREFORE, BE IIT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
NORTH RICHLAND HILLS,, TEXAS:
Section 1. Chapter 42 of the Nlorth Richland Hills Code of Ordlinances is hereby
amended by addingi a new Article V which shall read as follows:
"`Article V - Electronic cigarettes.
Sec. 42-215. Definitions.
(a) "E-cigarette" or "electronic cigarette" or "'electronlic smoking device" means
any electronlic or battery- operated device,, the use of which resembles
smoking, that can be used to de[iver an inhalable dose of nicotine or other
substances by delivering a vaporized solution. "E-Cigarette," "electronic
cigiarette,," or "61ectronic smoking device" lincludes any such electronic
smoking device, whether manufactured, 6stributed, marketed or sold as
an electro6ic cigarette, an electronic cigar, an electronic cigarilllo, an
electronic pipe, an electronic hookah, or any other product name or
descriptor. "E-Cigarette," "electronic cigarette," or "'electronic smoking
device" does not include any product specifically approved by the United
States Food and Drug Administration for use in the mitigation, treatment,
or prevention of disease.
(b) Minor shall mean a person younger than 18 years of age.
(c) Person shall mean an individual,, corporation, sole proprietorship, and any
other type of business entity recognized under Texas law.
Sec. 42-216. Sale or Distribution of Electronic Smoking Devices to Minors
Prohibited.
(a) A person commits an offense if the person sells, gives or causes to be
sold or given an electronic smoking device to a minor or to a person who
intends to deliver it to a minor.
(b) If the offense under this section occurs lin connection with a sale of an
electronic smokingi device at a business by an employee of the business,
the employee who committed the offense is subject to prosecution.
(c) It is a defense to prosecution under subsection (b) that at the time of the
sale, the minor presented the person with an apparently valid proof of
identification showing the minor was at least 18 years of age.
(d) A proof of identification satisfies the requirements of subsection (c) lif it
contains the name of the minor, a photograph, resembling the appearance
of the minor and was issued by a state or federal government agency.
(e) It is not a defense under this section that the minor purchased the
electronic smoking device from a vending machine or other self - service
merchandising mechanism lif the machine or mechanism was located on
the premises of the person.
Sec. 42-217. Possession of Electronic Smoking Devices by Minors Prohibited.
(a) A minor commits an offense if the minor possesses, purchases or
attempts to purchase an electronic smoking device.
(b) A minor commits an offense if the minor falsely represents himself or
herself to be 18 years of age or older for the purpose of purchasingi or
receiving an electronic smoking device.
(c) It shall be a defense to prosecution for a violation of this section if at the
time of the purchase,, the minor:
(1) was in the presence of an adult parent or legal guardian of the
minor;
(2) was in the course of scope of the minor's ern#loyment and the
purchase of the 61ectronic, smoking device was a part of the duties
of such employment; or
(d) was participating lin an inspection or test of compliance in conjunction with
local law enforcement
Section 42-218. Use of Electronic Smoking Devices Prohibited where Tobacco,
Smoking is Prohibited.
Use of any electronic smokingi device is prohibited lin all Vocations where tobacco
smoking is prohibited by (Division 2 of Article IV of this Chapter. Any person using such
electronic smokingi device in such a location shall be deemed in violation of this
provision."
Section 2- It is hereby declared to be the intention of the City Council that the
phrases, clauses, sentences, paragiraphis, and sections of this ordinance
are severable, and if any phrase, clause sentence, paragraph or section of
this ordinance shall be declared unconstitutional by the valid judgment or
decree of any court of competent juhsdliction, such unconstitutionality shall
not affect any of the remainingi phrases, clauses, sentences, paragraphs
and sections of this ordinance, since the same would have been enacted
by the City Council without the incorporation lin this ordinance of any such
unconstitutional phrase, clause, sentence, paragraph or section.
Section 3- Any person who violates, disobeys, omits, neglects or refuses to comply
wrath or who resists the enforcement of this Ordinance shall be fined not
more than Five Hundred Dollars ($500.00) for each offense.
Section 4- The City Secretary of the City of North (Richland Hifls is hereby directed to
pubfish the caption,, penalty clause, publication clause and effective date
clause of this ordinance.
Section 5- This ordinance shall be in full force and effect from and after its passage
and publication as required by law,
AND IIT IS SO ORDAINED.

Summary.
This item lis to award the bid for purchase and installation of new playground equipment,
shade structure, and fall surface material at Richfield (Park.
General (Description:
The currently approved capital projects budget includes available funding for the project
in the amount of $2011,484.
Competitive sealed proposals were received on May 13, 2014 from WeBuHdFun,
Grounds For (Play Inc.,.. IHlenneberger Construction Inc., Lea (Park & Play, P aygrounds
Today Inc., Recreation Consultants of Texas, and Total Recreation.
Selection criteria included quality and uniqueness of design, pllay value and aesthetics,
durability of equipment, ease of maintenance, parts avalilabillity, quality and performance
of previous work, warranty, key project personnel, and price. Based on an evaluation of
the selection criteria for all proposals,, a five member committee recommends awarding
the bid to 'li'yeBulildFun. Their proposal, in the amount of $201,3115, includes the design,
manufacture and installlation of a playground system including i subsurface drainage
rock, fall zone materiall, and shade elements.
WeBulildFun, a north Texas based company, has completed over 11,000 playground
installations,, most recently for the cities of Carrollton and Allen, and Six Flags Over
Texas.
Recommendation:
To Award the Bid RFP 114 -002 to WeBuHdFun for Purchase of new playgiround
equipment, shade structure, and fall surface materiall at Richfield (Park, in the amount of
$201,.315.
