5. Mayor Faram advised the Council that Mrs. Marjorie Isbell had been APPOINTMENT TO

7. Mr. Line stated the Council had postponed this request at the PLANNING & ZONING
July 12, 1982 Council meeting at the request of the Staff. PS 82-16, REQUEST

Mr. Ginsburg stated the Planning and Zoning Commission at the HEIGHTS NORTH
June 24, 1982 meeting voted 5-0 to approve this request. ADDITION FROM LOCAI
Mr. Ginsburg stated Gulf had developed this property to sell RETAIL TO LOCAL
gas and petroleum-related products. Mr. Ginsburg stated Gulf RETAIL-SPECIFIC
also had the public convenience in mind and tried to meet the USE - SALE OF BEER
demands. Mr. Ginsburg stated several of Gulf's outlets in the FOR OFF-PREMISE

Mr. Ginsburg stated he respectfully requested that the Council
grant the zoning request. Mr. Ginsburg stated the Specific Use
Permit would help them to use the land to fuller extent, be con-
venient to the public, greater revenues to the store in both food
and non-food products and help the taxing authorities.

Mr. Ginsburg stated he submitted his name as the person who would
be responsible for the license, if granted.
Councilman Hubbard asked Mr. Ginsburg if the permit would be in his
name.
Mr. Ginsburg stated the license would be in the name of TMM, Inc.
Councilman Hubbard stated the permit would have to be in an individ-
ual's name.
Mr. Ginsburg stated the permit would be in his name.
Mayor Faram asked Mr. Ginsburg if he was an attorney only represent-
ing Gulf.
Mr. Ginsburg stated yes.
Mayor Faram asked Mr. Ginsburg if there was an employee of the organiza-
tion that could be responsible as opposed to having the attorney's name.
Mr. Ginsburg stated the permit could be put in the name of Mike Sharp,
Manager for Majik Market.
Mr. Marty Cloin, Real Estate Director for Gulf, 424 Englewood Lane,
Hurst, appeared before the Council.
Mr. Cloin stated he was in favor of this request and hoped the Council
would act favorable on it. Mr. Cloin stated that for the record he
would like to read a letter from one of Gulf's neighbors to the north
of the property in question.
Mr. Cloin read the following letter:

Dear Members:
McDonald's is a neighbor to the applicant at this location, as well as
several other locations throughout the Metroplex. We have found Gulf
to be a very compatible neighbor and can report no disharmony

any of their stores located near us. We submit this for your in-
formation and advise you that we have no objection to the approval
of the subject application.

Mayor Faram called for anyone wishing to speak in opposition to this
request to please come forward.
There being no one else wishing to speak, Mayor Faram closed the
public hearing.
9. Councilman Hubbard moved, seconded by Councilman Fisher, to CONSIDERATION OF
approve P2 82-16, Ordinance No. 964, permit to be in the name ORDINANCE FOR

10. Mayor Faram opened the public hearing and called for anyone wishing PLANNING & ZONING

Mr. Michael Jones, Teague, Nall and Perkins, Engineering Firm, OF T. W. ALLEY, SR.
Fort Worth, appeared before the Council representing Mr. Alley. TO REZONE LOT 2,
BLOCK 4, UNIVERSITI
Mr. Jones stated that at the time this request was heard by the PLAZA ADDITION FRO
Planning and Zoning Commission he was unaware of Mr. Alley's TreAL RETAIL TO
intention to build a restaurant at the site and the request at COMMERCIAL
that time was for Specific Use-Commercial, Multiple Story Office
Building. Mr. Jones stated they would like to include in their
request specific use for a restaurant also.
Mr. Jones stated the request now was for rezoning from Local
Retail to Commercial with Specific Use for a multiple story office
building and a restaurant.
Mayor Faram asked when it was determined there was going to be a
restaurant in the building.
Mr. Jones stated the restaurant would be a separate building.
Mayor Faram asked Mr. Jones if he was asking the Council for a
zoning request that had never been considered by Planning and
Zoning Commission. Mayor Faram stated that if this was the re-
quest, then he would ask the Council to refer it back to the
Planning and Zoning Commission.

Mr. Jones stated the request was for commercial zoning.
Mayor Faram advised Mr. Jones the request was being altered to add
something that was not considered by the Planning and Zoning Com-
mission.
Mr. McEntire stated the request was not included in the publication.
Councilman Kenna stated the Planning and Zoning Commission could only
treat the request for commercial, all the discussion on the office
building was superfluous at that level. Councilman Kenna stated it
would be up to the Council to decide whether or not to put specific
use on the request for the zoning.
Mayor Faram stated his problem with the request was that the Council
was about to consider something that was not considered by the chief
recommending body, the Planning and Zoning Commission. Mayor Faram
stated he did not like the precedent being set by altering the result
coming before the Council.
Mr. McEntire stated the citizens were entitled to know what was being
considered tonight and it had never been published as a request for
ia restaurant.
Councilman Davis stated he was under the impression that the only re-
quest that came before the Planning and Zoning Commission was for the
commercial zoning. Councilman Davis stated he had been present at the
Planning and Zoning meeting when this request was heard and there was
some question among the members if a restriction could be put on the
request when the Council heard it. Councilman Davis stated if the
request was referred back to the Planning and Zoning Commission, they
could not put restrictions on it.
Mayor Faram stated the Commission could forward to the Council a recom-
mendation for restricted specific use. Mayor Faram stated that if the
process was started of bringing up something different than what was
being heard by the chief recommending body, then there would be a problem
and there would be no need for a Planning and Zoning Commission.
Mayor Faram stated he felt the Council should refer the request back to
the Planning and Zoning Commission and the applicant layout their full
plans and the Commission make a full recommendation to the Council.
Mayor Faram closed the public hearin<;.
Councilman Hubbard moved, seconded by Councilman Newman, to refer
F:, 82-15 back to the Planning and Zoning Commission.

Councilman Ramsey asked if the problem was the fact that someone
volunteered information on what the applicant could do with the
commercial property and the notes stated what they planned to use
the property for, was there a difficulty in giving the commercial
zoning to the entire piece of property. Councilman Ramsey asked
if the request was advertised that there was going to be a multiple
story office building built.
Mr. McEntire stated it was only advertised what zoning was being
requested. Mr. McEntire stated normally if there was going to be
some type of specific use it would be advertised as so.
Councilman Ramsey stated the applicant was not asking for specific
use, the Council was going to put the specific use on it tonight.
Mayor Faram stated the point was that evidence presented to the
Planning and Zoning Commission was for an office building and the
request for a restaurant had not been considered. Mayor Faram
stated he did not feel the Council would be right to consider
anything in a planning and zoning scope that had not been con-
sidered by the Planning and Zoning Commission.
Councilman Davis asked if it was not correct that the applicant
was not required to tell what was going to be built. Councilman
Davis stated the applicant did offer the information that an
office building was being planned for the property. Councilman
Davis stated the Council could still consider if that was the best
use for the property.
Mayor Faram stated the fact was that the request for a restaurant
had not been considered by the Planning and Zoning Commission.
Mayor Faram stated it may or may not have had some bearing on the
Planning and Zoning Commission's recommendation if the entire re-
quest had been put before the Commission. Mayor Faram stated he
did not like to see amendments come before the Council that had not
been considered by the Commission.
Motion to refer back to Planning and Zoning Commission carried by a
vote of 5-2; Councilmen Hubbard, Fisher, Davis and Newman and Council-
woman Hinkle voting for; Councilmen Kenna and Ramsey voting against.
11. Councilman Hubbard moved, seconded by Councilman Davis, to post- CONSIDERATION OF
pone action on this item until action was taken by the Planning ORDINANCE FOR
and Zoning Commission. PZ 82-15

Motion carried 6-1; Councilmen Kenna, Hubbard, Davis, Newman,
and Fisher and Councilwoman Hinkle voting for; Councilman
Ramsey voting against.

12. Councilman Kenna moved, seconded by Councilman Ramsey, to CONSIDERATION OF
approve Ordinance No. 965 establishing School Zone on Rufe ORDINANCE AMENDING

13. Mr. Line stated that in 1968 the Council vacated Town and CONSIDERATION OF
Country Estates Subdivision by metes and bounds. Mr. Line ORDINANCE VACATING
stated the plat was not vacated; therefore the streets were still PLAT OF TOWN AND
dedicated streets. Mr. Line stated the property was being sold COUNTRY ESTATES
and the title company had requested that all streets be vacated SUBDIVISION
as was the original intent in 1968. APPROVED

approve Ordinance No. 966.

14. Councilman Ramsey moved, seconded by Councilman Kenna, to post- CONSIDERATION OF

16. Mr. Line stated the bids received for doing the complete job, CONSIDERATION OF
Proposal C, was well within the Engineer's estimate. Mr. Line AWARDING CONTRACT
stated funds were available to complete the job. Mr. Line FOR PAVING AND
stated the Engineer and Staff recommended that Council proceed DRAINAGE ON ONYX
with Proposal C to construct the project in its entirety. DRIVE NORTH AND

Councilman Davis moved, seconded by Councilman Kenna, to APPROVED
approve Proposal C and award the contract to Austin Road
Company in the amount of $392,913.93.
Motion carried 7-0.
17. Councilman Hubbard moved, seconded by Councilman Fisher, to CONSIDERATION OF
approve final payment to C. R. Feazell in the amount of FINAL PAYMENT TO
$24,097.75, funds to be appropriated from General Fund Surplus. C. R. FEAZELL IN

18. Mrs. Claudine Williams, 5304 Susan Lee, appeared before the CITIZEN PRESENTATIC
Council.
Mrs. Williams stated that on March 27, 1982 her house was
flooded with sewage. Mrs. Williams stated that Mr. Alvarez
and his crew from the City's Utility Department came out to
her home. Mrs. Williams stated the sewer was unstopped at Lola
and Susan Lee. Mrs. Williams stated that Mr. Alvarez stated
the problem was the City's. Mrs. Williams stated the informa-
tion was relayed to the City's insurance carrier and they de-
clined the request to take care of the damages stating the
City was not liable. Mrs. Williams stated she wrote Mr. Line
a letter requesting the damages be paid and he advised her to
write a letter to Council because he could not authorize the
payment. Mrs. Williams stated she was unaware the request
had been placed on a previous agenda.
Mrs. Williams stated that at this time she was requesting that
the Council reimburse her for the damages which amounted to
$1,849.00.
Mayor Faram asked Mrs. Williams if she had insurance on her home.
Mrs. Williams replied yes.
Mayor Faram asked if she had physical loss damage that would
cover the damages.
Mrs. Williams stated yes.
Mayor Faram asked what the insurance would pay on the claim.
Mrs. Williams stated it would pay $1,800.
Mayor Faram asked Mrs. Williams if $1,849.00 was the amount
she had spent on repairs.
Mrs. Williams replied yes. Mrs. Williams stated she did not
feel this was her insurance company's responsibility and that
she should not be out the $100.00 deductible.
Mayor Faram asked Mrs. Williams exactly what she wanted the
City to pay.
Mrs. Williams stated she wanted the City to pay the estimate
of $1,849.00.
Mayor Faram asked Mrs. Williams if she had received the $1,800.00
from her insurance company.

Mrs. Williams replied she had not received anything from her
insurance company. Mrs. Williams stated she had turned the
claim in but had not taken the $1,800.00 and did not intend to.
Mayor Faram asked Mrs. Williams if she intended to turn her insurance
company payment down and let the City pay for it.
Mrs. Williams replied yes, she felt very strongly that it was not
her Insurance company's responsibility.
Mr. McEntire advised Mrs. Williams she paid a premium to her
insurance company for this protection. The City was not paying a
premium for the protection. The City's policy did not include
sewer damage because the City was not liable for it.
Councilman Davis asked if there was anyone else in her neighborhood
at the time her sewer backed up that had the same problem.
Mrs. Williams stated the neighbor next door sewer backed up, but it
did not come into the house.
Councilman Davis asked how many houses the backup affected.
Mrs. Williams stated she did not know.
Councilman Kenna asked Mrs. Williams if the sewer had ever backed up
before.
Mrs. Williams stated that to her knowledge it had not.
Councilman Fisher asked Mrs. Williams how long she had to vacate the
house.
Mrs. Williams stated she did not have to vacate the house, Blackman
Mooring removed the carpets.
Councilman Fisher stated that on the letter the Council received her
address was Grapevine. Councilman Fisher asked Mrs. Williams if she
had another residence.
Mrs. Williams stated her daughter lived in the house on Susan Lee.
Mrs. Hinkle asked Mrs. Williams if she accepted the claim from her
insurance company would it cause her premium to go up.
Mrs. Williams stated she did not know.
Mr. McEntire stated she was paying a premium for sewer backup and the
policy would not go up.

Councilman Ramsey asked Mrs. Williams if the house on Susan Lee
was basically rent property.
Mrs. Williams replied yes and no, she helped her daughter make
the payments.
Councilman Ramsey asked the Staff if they assumed at the time of
the backup the City was liable.
Mr. Line stated the City Attorney had advised the Staff the City was
not liable. Mr. Line stated the Staff felt they could not authorize
the payment and Mrs. Williams stated she wanted to appeal to the
Council.
Councilman Hubbard moved, seconded by Councilman Newman to deny the
claim.
Councilman Ramsey stated that on the advice of the City Attorney the
City was not liable and there was no history of problems in the area,
that was his problem with the claim.
Councilman Davis stated he was not in favor of paying the whole amount but
he would like for the Council to consider paying the deductible.
Mayor Faram advised Councilman Davis that with the permission of the
Council, he would depart from the rules and entertain a motion or an
addition to the motion. Mayor Faram asked if he had permission from
the Council to depart from the rules.
Mayor Faram stated there was an objection and would not be considered.
Motion to deny the claim carried by a vote of 6-1; Councilmen Hubbard,
Kenna, Davis, Fisher and Newman and Councilwoman Hinkle voting for;
Councilman Ramsey voting against.
19. Mayor Faram adjourned the meeting of July 26, 1982. ADJOURNMENT

BACKGROUND: This is a Mayor's appointment. The Park and Recreation Commission'
has had two vacancies for several months. Mr. Bowen is a former employee
and an excellent candidate for the Commission. He is recommended by
Councilman Hubbard and will be an asset to the Commission.

lots, one small one and one real large one;
he wants to make the small lot larger.
Mr. Stembridge said TESCO had requested •
additional easements and he had added them
to the plat. He said he had also complied
with the engineer's comments.

John Barfield came forward. He said these
lots are located on Davis Blvd. Mr. Barfield
said there are some duplexes there which are
leased out and these lots are on either side
of these that are presently build. He said
it was hard to find financing for a $130,000
unit, but you could easily get financing for
$65,000 per side. Mr. Barfield said he could
sell them by metes and bounds, but couldn't
get financing without replatting.
The Chairman opened the Public Hearing and
called for those wishing to speak in favor of
this replat to please come forward.

This property is located at the northeast
corner of N.E. Loop 820 and Rufe Snow Dr.
Steven Ginsberg, Attorney at 1930 Commerce
Bldg. , Ft. Worth, came forward to represent
Gulf Oil Corp. He said he was here along
with representatives of Gulf Oil and Majik
Markets to request this zoning change from
Local Retail to Local Retail-Specific Use-
so that beer may be sold for off-premise
consumption.
Mr. Ginsberg said while Gulf has developed
the property to sell gas and petroleum
related products, Gulf also has had the
public convenience in mind and tries to meet
the demand for non-petroleum products at
its sites. He said at many of Gulf's
outlets in the Metroplex a grocery-rtlated
product mix is sold including bread, milk,
groceries, cigarettes and other sundries.

Mr. Ginsberg said it makes good business
sense to fill the demand of the public for
convenience store products, and it makes
for a better and more profitable use of
the land involved in the site than merely
serving as a filling station.
Mr. Ginsberg said one other convenience
item is marketed at locations where it is
legal to do so is beer, sold pursuant to
State granted off-premise licenses. He
said they hope the Commission will approve
a Specific Use permit so that Gulf may
apply to the State for an off-premise beer
license.
Mr. Ginsberg said at other locations
throughout the Metroplex they know that
the sale of beer enhances sales of other
items, and the products go hand in hand in
increasing the value of the store and the
value as a tax base and employer of local
citizens. He said with an increase in
sales, the store remains competitive with
other locations which have the benefit of a
Specific Use permit in the marketplace.
Mr. Ginsberg said there are several other
operations on Rufe Snow that have the
Specific Use permit for off-premise beer
sales, one, Tenneco, being approximately
1,000 feet from Gulf's door. He said they
wish to have the same benefits granted to
Gulf that have been readily granted to
others so close on Rufe Snow. Mr. Ginsberg
said they are well beyond the school and
church footage cutoffs of State law.
Mr. Ginsberg said he respectfully requests
that-Planning and Zoning recommend to the
City Council the zoning change. He said it
will help them use the land to a fuller
extent and it will be convenient to the
public. Mr. Ginsberg said it will mean
greater revenues to the store in both food
and non-food products which will help the
taxing authorities and the Specific Use
permit will help the site remain competitive
with other locations which have been granted
the Specific Use permit.

as the person who will be responsible
for the license once it is granted.
Mr. Wood said since he is new at this,
he would like to know the distance from
schools and churches required and about
the property owners.
Ms. Calvert said it can not be within
300 feet of a school or church, and she
had to notify property owners within 200
feet of the property in question.

favor of this zoning request to please

Marty Cloin, 424 Englewood Lane, Hurst,
Real Estate Representative, came forward.
Mr. Cloin said they do an outstanding job
policing the store.
Mr. Cloin said he had a copy of a letter
from McDonalds he would like to read:
"Dear Members: McDonald's is a neighbor
to the applicant at this location, as well
as several other locations throughout the
Metroplex. We have found Gulf to be a
very compatible neighbor and can report no
disharmony resulting from their selling
beer for off-premises consumption at any of
their stores located near us. We submit
this for your information and to advise you
that we have no objection to the approval of

Planning and Zoning Commission could
restrict the zoning, they have to act on
what was requested.
Mr. Perkins said he felt the Planning and
Zoning Commission could put it in their
motion what they desire there.
Councilman Davis said that Ms. Calvert
always states in the council packets
what the Planning and Zoning Commission
recommends .

AFTER APPROPRIATE NOTICE AND PUBLIC HEARING THE FOLLOWING RECOMMENDATION IS
SUBMITTED TO THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS BY THE

The following described tract or parcel of land being a portion of Lot 2,
Block 4, University Plaza, an addition to the City of North Richland Hills,

Volume 388-123 in the Tarrant County Deed Records and being more particularly

RICHLAND HILLS, TEXAS, ESTABLISHING A PRIMA FACIE SPEED LIMIT
OF 20 MILES PER HOUR IN THE 4200 AND 4300 BLOCKS OF RUFE SNOW
DRIVE, A SCHOOL ZONE; PROVIDING FOR PENALTY FOR VIOLATION OF,
A FINE NOT IN EXCESS OF $200.00; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City of North Richland Hills, Texas has caused an engineer-
ing and traffic investigation to be made to determine a proper prima facie speed
limit for the 4200 and 4300 blocks of Rufe Snow Drive; and
WHEREAS, such investigation shows that the prima facie speed limit should
be 20 miles per hour, during school hours, 7:30 a.m. to 9:00 a.m. , and 2:30 p.m. to
4:00 p.m. ;
NOW, THEREFORE, be it ordained by the City Council of the City of North
Richland Hills, that:
1.
Ordinance Number 722 of the City of North Richland Hills, Texas be and
is hereby amended by adding the 4200 and 4300 blocks of Rufe Snow Drive to Section
3.04 of said Ordinance and establishing a 20 mile per hour speed limit in the 4200
and 4300 blocks of Rufe Snow Drive as a school zone, during school days, from
7:30 a.m. to 9:00 a.m. , and 2:30 p.m. to 4:00 p.m.
2.
Any person operating a motor vehicle upon said above-described section
of Rufe Snow Drive, in the City of North Richland Hills, Texas, at a speed in excess
of 20 miles per hour during said school zone hours, shall be deemed guilty of a
misdemeanor and fined not in excess of $200.00.
3.
This Ordinance shall be in full force and effect 10 days from passage
and publication.

BACKGROUND: In 1968 the City vacated the Town and Country Estates Subdivision
by metes and hounds. The plat was not vacated; therefore the streets are still
dedicated. Jo Beel's restaurant is presently on the southern end of this property.
The remainder of this property is being sold, and the Title Company has requested

that all streets be vacated in accordance with the original intent in 1968. A

PAVING AND DRAINAGE IMPROVEMENTS
In accordance with your instructions to us during your regular meeting
of May 24, 1982, we received bids for construction of the referenced
project on July 20, 1982. As you requested, bids were received from
contractors for three proposals, "A", "B", and "C" ; each proposal
representing varying degrees of flooding protection for the project
area residents. The individual bid tabulations are attached for your
review. As the tabulation indicates, bids were received from six
(6) contractors for each proposal . The low bid for each of the three
proposals was submitted by Austin Road Company as tabulated below:

Proposal "A" covers the total cost required to construct the minimum
length storm sewer line necessary to drain the depressed area on Dawn
Drive just north of the end of the existing curb and gutter. This does
not include any curb and gutter or paving improvements on Dawn Drive.
Proposal "B" covers the cost of extending the proposed storm drain to
Cartwell Street along with curb and gutter and paving construction on
Dawn Drive to Cartwell also. This storm drain extension is designed
to intercept stormwater from Harmonson Drive, part of which presently
drains into Diamond Loch near Cartwell Street. This will help alleviate
potential flooding of the Diamond Loch lake. Proposal "C" includes all
of the construction in "A" and "B" plus an extension of the curb and
gutter and paving improvements in Dawn Drive to Glenview Drive.

On the basis of the bids submitted, we would recommend that the contract

CONTRACTOR'S PARTIAL PAY ESTIMATE NO. 4 AND FINAL
Enclosed is one copy of Contractor's Partial Pay Estimate No. 4 and
Final , dated July 8, 1982, made payable to C.R. Feazell Contractor,
in the amount of $24,097.75, for materials furnished and work performed
on the referenced project as of July 6, 1982.
The quantities and condition of the project have been verified on-site
by your representative, Bill Rutledge, as indicated by signature on the
estimate, and we have checked the item extensions and additions.
This project includes construction of 8" and 6" water main relocations
and 8" sanitary sewer main relocations required to clear the right-of-
way for paving and drainage improvements on Glenview Drive between Booth
Calloway Road and Glenview Court.
In accordance with Section 3.2.11(a) of the Contract, the two (2)
year tens of Maintenance Bond will begin on this date, and therefore,
will terminate on July 9, 1984. The maintenance obligation includes
repair of all water line leaks and malfunctions of all valves, fire
hydrants, and other equipment furnished and installed under this
Contract. The maintenance obligation also includes sewer line breaks
or stoppage, and repair of damaged pavement surfaces due to trench
settlement. However, the Contractor is not responsible for maintenance
or damage caused by construction or similar physical activities by
others at the site of the damage.
The original time bid on this project was 65 calendar days for a
contract completion date of May 13, 1982. The Contractor had asked
for a time extension of about two (2) weeks due primarily to bad weather,
(see attached letter dated May 7, 1982) . The revised recommended com-
pletion date was set at June 1, 1982, although no formal approval of
time extension was granted by Council . Section 3.2.12 of the Contract
provides for liquidated damages of $100.00 per day for each day of

delay in substantial contract completion beyond the contract completion
date. The paving and drainage construction project was awarded to
Chisholm Trail Construction Company on June 22, 1982, but we understand
that the work order date has been set for July 22, 1982. Since
C.R. Feazell 's work was substantially completed before the paving work
order date, we do not feel liquidated damages were incurred, nor should
they be assessed.
We understand that a damage claim may be filed by Mobil Pipe Line Company
against C.R. Feazell for the gas line break which occured on April 16, 1982,
(See our letter dated July 8, 1982) . In accordance with the provisions of
Section 5.08 of the General Conditions of the Contract, the Owner may
withhold final payment pending resolution of all outstanding claims.
After satisfactory evidence of payment of all such outstanding claims
we would recommend that the final payment in the amount of $24,097.75
be made to C.R. Feazell Contractor, 3644 Garner Blvd. , Arlington,
Texas 76013.

GLENVIEW DRIVE UTILITY ADJUSTMENTS
In accordance with the provisions of Item 3.1.04(a) of the Contract
Documents, the Contractor has submitted a letter requesting an extension
in contract completion time due primarily to bad weather. The original
contract completion time bid was 65 calendar days for a completion date
of May 13, 1982. The Contractor estimates about two (2) more weeks of
work will be required beyond the scheduled completion date.
Since the work on this project has been progressing as well as can be
expected in view of the numerous days of inclement weather, we would
recommend a contract completion time not to exceed 19 calendar days for
a revised completion date of June 1, 1982.

This is a request for an extension of time on project #3-544, Utility
Adjustments on Glen View Dr. (Booth Calloway Rd. to Glenview Ct.)
North Richland Hills, Texas. We were unable to start the project
on March 10th because of all the bad weather and getting material .
We have not had a full week of work on project #3-544 because of
weather and the days we lost on Mobil 's Pipeline. We have worked
every possible day and will continue to until finished. The City
of North Richland Hills and us agreed not to work after rain due
to mud getting on Glenview Dr and safety factors with traffic
sliding on Glenview Dr.
This consideration will be greatly appreciated.

On March 27, 1982 my house at 5304 Susan Lee Lane, Ft, Worth,
Texas was flooded with back-up sewage from the lines of the City
of North Richland-Hills,
City Manager, Mr, Rodger Line, and Assistant City Manager, Mr.
Dennis Harvath , are aware of the situation and have been working with
me. However, the claim for damages to my property was denied by
Crawford and Company, General Adjuster, David W. Shelton,
At this time, I am informing you of this claim denial by your
insurance carrier and requesting the City of North Richland Hills
to assume the obligation of debt to me for replacing and repairing
property damage.
Enclosed you will find copies of the adjuster's estimate of
damage and letter of denial . Please note the carpet depreciation
for three years of use. Also, the carpet value was estimated at
$16.95 per sq. yard--the price of the carpet when purchased in 1979.
This problem has been most perplexing, an intolerable sit-
uation, a tremendous inconvenience and expensive to me and my
daughter, Carol Souther, who resides in this house,
I would appreciate your assistance and prompt action on this
request,

sulting from an alleged sewer back-up, we have made a full in-
vestigation of this matter and have found no evidence of negligence
on the part of the City of North Richland Hills. At the direction
