Councilman Hubbard moved, seconded by Councilwoman Hinkle, to CONSIDERATION OF approve the minutes of the regular meeting August 23, 1982. MINUTES OF THE REGULAR MEETING Motion carried 5-0. INC. , FOR WATER SERVICE AT 7724 Motion carried 5-0. PRECINCT LINE ROAD 11. Mr. Line stated the only change in the ordinance was to simplify CONSIDERATION OF efforts to control weeds and grass. At the present time the ORDINANCE AMENDING notification was required each time the grass or weeds were over ORDINANCE NO. 641 12 inches high. The amendment would require notification only APPROVED once each year. ORDINANCE NO. 973 Councilman Hubbard moved, seconded by Councilman Fisher, to approve Ordinance No. 973. Motion carried 5-0. 12. Mr. Horvath stated that at the present time the computer was CONSIDERATION OF operating at maximum capacity. Mr. Horvath stated the staff AWARDING BIDS ON had anticipated this would happen so bids were taken to double COMPUTER SYSTEM the size of the storage system. Mr. Horvath stated only one APPROVED bid was received, that being IBM in the amount of $30,910. Mr. Horvath stated the staff recommended the Council award the bid to IBM. Councilman Fisher asked if the City was locked-in with IBM on the storage system. Mr. Horvath stated there were other companies that sold IBM equipment, but he did not know if they could bid on the internal storage system. Councilman Hubbard moved, seconded by Councilwoman Hinkle, to accept the bid of IBM in the amount of $30,910. Motion carried 5-0. 13. Mr. Line stated the City staff recently discovered that a CONSIDERATION OF water line had been uncovered by heavy rains. September 13, 1982 Page 4 Councilman Davis asked if there was any particular reason why the City could not have repaired the line. Mr. Line stated the City did not have the capability or the manpower. Councilman Fisher moved, seconded by Councilman Davis, to ratify staff action and approve payment to Leonard Hazel in the amount of $12,652.10. Motion carried 5-0. 14. Councilwoman Hinkle moved, seconded by Councilman Newman, to CONSIDERATION OF approve payment to Austin Road Company in the amount of PAYMENT TO AUSTIN $42,404.84, Rufe Snow Drive, Phase I. ROAD COMPANY IN THE AMOUNT OF Councilman Fisher asked if this was the final payment. $42,404.84 - RUFE SNOW DRIVE, PHASE Mr. Line stated there was some cleanup work to be done and APPROVED some retainage that had been held that would have to be paid. Motion carried 5-0. 15. Mayor Pro Tem Ramsey stated that at the Council meeting of CONSIDERATION OF July 26, 1982, a permit was approved for the sale of beer for NAME CHANGE ON off-premise consumption at the Gulf Station located at 5100 PERMIT FOR THE Rufe Snow Drive in the name of Mike Sharp, as requested. Mayor SALE OF BEER FOR Pro Tem Ramsey stated the legal name should have been Duane OFF-PREMISE CON- Sharp. SUMPTION, 5100 RUFE SNOW DRIVE Councilman Hubbard moved, seconded by Councilwoman Hinkle, to APPROVED approve the name change on the permit to Duane Sharp. Motion carried 5-0. 16. Mr. Horvath stated the Council had received a five year Master PRESENTATION OF Plan for the parks. Mr. Horvath stated this plan represented MASTER PLAN FOR a year's work by the Park Board and Council representative to CITY PARKS the Board in preparing the plan. Mr. Horvath stated the staff wanted to present the plan to the Council tonight and hopefully have it on an agenda in October for Council approval. Mayor Pro Tem Ramsey stated that in reviewing the plan, Mr. Horvath, ex Mayor Pro Tem Dave Freeman, Councilman Hubbard, and the Park Board did a great job in preparing the plan. Mayor Pro Tem Ramsey stated the City's Engineering firm also helped with the plan and felt everyone was to be congratulated. September 13, 1982 Page 5 17. City Attorney McEntire presented the following resolution: CONSIDERATION OF APPLICATION BY BE IT RESOLVED by the City Council of the City of North TEXAS ELECTRIC Richland Hills, Texas, that: SERVICE COMPANY FOR CONSOLIDATION 1. OF COMPANIES RESOLUTION NUMBER The City Attorney be and is hereby authorized to file such 82-25 objections and protests as he deems advisable and proper to the application of Texas Electric Service Company for con- solidation which was filed with this City on or about September 8, 1982. Councilman Davis moved, seconded by Councilman Hubbard, to approve Resolution Number 82-25. Motion carried 5-0. 18. Mr. Harold Mclnroe, Vice President, First Southwest Company, CONSIDERATION OF appeared before the Council. ORDINANCE APPROV- ING THE SALE OF Mr. Mclnroe stated he was very pleased to advise the Council $4,500,000 IN that three bids were received for the bonds. Mr. Mclnroe GENERAL OBLIGATION stated that Underwood Neuhaus was low bidder at 9.896807% RESOLUTION NO. and he recommended the Council accept the bid and sell the 82-26 bonds. - ORDINANCE NO. 974 City Attorney McEntire presented the following resolution: 1. The low bid of Underwood Neuhaus (9.896807%) for the $4,500,000.00 in General Obligation Bonds be and is hereby approved and accepted. Councilman Hubbard moved, seconded by Councilman Davis, to approve Resolution No. 82-26. Motion carried 5-0. Mr. Line stated he would like to point out to the Council that the Capital Improvement Program they had been considering and the finan- cial projections contained in it were based on what seemed to be a realistic estimate at that time on the terms of the interest cost of 12.5 percent. Mr. Line stated the bond market had improved sub- stantially since this particular issue was planned. Mr. Line asked Mr. Mclnroe if he could make a rough estimate of how much interest savings there would be between 12.5 percent and 9.896807 percent of the life of the bonds. Mr. Mclnroe stated about $838,325.00 had been saved in interest. September 13, 1982 Page 6 Mr. Mclnroe presented the following preamble of the ordinance approving the sale of bonds: AN ORDINANCE by the City Council of the City of North Richland Hills, Texas, authorizing the issuance of $4,500,000 "City of North Richland Hills, Texas, General Obligation Bonds, Series 1982," dated October 1, 1982; prescribing the form of the bonds and the form of the interest coupons; levying a continuing direct annual ad valorem tax on all taxable property within the limits of said City to pay the interest on said bonds and to create a sinking fund for the redemption thereof and providing for the assessment and collection of taxes; enacting pro- visions incident and related to the subject and purpose of this ordinance; and providing an effective date. Councilman Davis moved, seconded by Councilwoman Hinkle, to approve Ordinance No. 974. Councilman Davis stated he would like to congratulate the staff and past Council for enabling the City to build a firm financial base that the City was able to get competitive bids of this nature where it saved the citizens over $800,000. Mayor Pro Ten Ramsey stated he would like to thank Mr. Mclnroe himself and on behalf of the Mayor for his professional way that he handled the bond rating in New York and all of the work he had done. Mr. Mclnroe stated he would like to thank the staff for their help in putting this issue together. Mr. Mclnroe stated the City of North Richland Hills was well represented in New York. Motion to approve Ordinance No. 974 carried 5-0. 19. Mrs. Jane Bigham, Program Coordinator, the Women's Center, CITIZEN PRESENTA- appeared before the Council. TION - MS. JANE BINGHAM, THE Ms. Bingham explained the operations of the Center to the WOMEN'S CENTER Council. Ms. Hingham stated the Center did counseling RE: FINANCIAL for the cities in the area. Ms. Bingham stated the Center SUPPORT had two full time employees and about 138 volunteers. APPROVED Ms. Bingham stated the Center was in need of another staff member and would ask that the City of North Richland Hills help pay for that person. Ms. Bingham stated the Center was requesting that North Richland Hills donate $1,000.00 to the Women's Center. September 13, 1982 Page 7 Mayor Pro Tem Ramsey stated he was on the Board of Trustees of the Humanity at Bell Helicopter Company and had the experience of personally visiting the Center. Mayor Pro Tem Ramsey stated the Center had a super operation and the enthusiasm that the volunteers had was something to really behold. Mayor Pro Tem Ramsey stated he felt the Center was certainly a worthwhile and needed organization in the North Richland Hills community. Councilman Hubbard moved, seconded by Councilman Davis, to approve a donation of $1,000.00 to the Women's Center, to be appropriated from the Reserve for Contingency Fund. Motion carried 5-0. Mayor Pro Tem Ramsey advised that the applicant on Item 10 was not present. Councilman Hubbard moved, seconded by Councilwoman Hinkle, to defer action on this item until the next regular scheduled Council meeting. Item Number 5 was also postponed. Motion carried 5-0. 20. We think this is an important item and need not be lumped with any other project. Eggert The following is information obtained from the Police Department and Municipal Court in regard to our contact with Mr. Peter H. Eggert who resides at 7804 Daniel here in North Richland Hills. Mr. Eggert has filed a number of reports with the Police Depart- , ment against his neighbors but did not follow through in Municipal Court by filing formal complaints. He did ask for extra patrol around his home. The reports were: 1 . 11-02-80 Assault by threat - neighbor 2. 11-02-80 Theft of chain and lock 3. 09-25-81 Criminal Mischief (paint on car) 4. 10-25-81 Criminal Mischief (paint on car) In Municipal Court Mr. Eggert has filed numerous dog complaints. The latest was against his neighbor, James MacCammond, for dog at large. This case was heard on June 21 , 1982, at which time Judge David Casey suspended a fine if there were no more complaints filed within 60 days and at the end of this time the case would be dismissed. Mr. Eggert was extremely upset with this decision and was very verbal about it to the entire court room of people. Names and dates of the other cases cannot be given as they are filed under the defendants name, not the affiants. On July 4th, Don Andrews , Assistant Fire Marshall , issued Mr. Eggert a citation for using fire works in the city. This has been c -2- set for court on our August 23rd docket with a plea of not guilty. Personally speaking, Mr. Eggert appears to have a chip on his shoulder. He said there was more demand for duplexes than single family. Mr. Tucker asked if he plans to sell the duplexes. Mr. Collins said he does. He said he is presently building some duplexes on College Circle and Abbott Street which are the same type as he plans for tlaroaks. The Chairman opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. There being no one wishing to speak in favor of this request, the Chairman called for those wishing to speak in opposition to this request to please come forward. Marvin Smith, 7609 Douglas Lane, came forward. He said he has lived on this street for 35 years. He said he was representing himself and his father. Mr. Smith said he was not totally opposed to this request. He said they are not opposed to duplexes, but they do not want duplexes on Lots 9 through 15 of Block 15. Mr. Smith said he owns 20 acres on the other side of these lots and he plans to build some 4000 or 5000 sq. ft. homes. He said he feels they need a little cushion between the duplexes and his property. Mr. Smith said his home is just about 600 feet from this property and he plans to build 2 or 3 more large homes. Mr. Smith said the 2100 sq. ft. duplexes would only be 1250 sq. ft. per side. He said people do not keep duplexes up and there is always trash everywhere. Mr. Smith said he is definitely opposed to duplexes on Lots 9 through 15, Block 15. Page 4 P & Z Minutes August 26, 1982 Mr. Smith said when he had this property zoned, he planned to build 1600 sq. ft. homes, but with the economy the way it was, he sold it. Mr. Smith asked if there was a require- ment for duplexes to have carports or garages. Mrs. Calvert said there was not. Mr. Wood asked if there was any duplex zoning in this area. Mr. Tucker said there was not. Mr. Tucker asked Mr. Collins if he saw any problem with using Lots 9 through 15 for a buffer. Mr. Collins said he could make a buffer, but he did not see the difference in 1600 sq. ft. houses and 2100 sq. ft. duplexes. Mr. Bowen said the City Engineer made a comment in his letter regarding this area being located in the watershed which drains through Morgan Meadows Addition, and that the City Council had denied development in Foster Village, Section 11 , which is adjacent to this property, until such time that the drainage problem in Morgan Meadows is resolved. He said he knew this information pertains to platting and not zoning, but since this property is already platted, he felt this should be mentioned. Mr. Bronstad said this area would drain to Windcrest Addition and Windcrest Addition to Morgan Meadows Addition. Mr. Bowen said he felt this should be checked into. Mr. Tucker said this is a zoning request, not platting. Doug Long, Consulting Engineer, came forward. He said he had a report from the Page 5 P & Z Minutes August 26, 1982 City Engineer regarding an August, 1980 meeting which Mr. Smith, Jim Harris with Foster Village, and several others attended. He said the report stated they were meeting with haste to correct this channel . Mr. Long said he did not know this addition was shut down. He said he knew the city has been doing work in Morgan Meadows. Mr. Long said they might come back with a replat of this area for single family attached. Mr. Tucker asked Mr. Collins if he plans to sell each side to different owners. Mr. Collins said he plans to sell the whole duplex. Mr. Collins asked when this ban on development in this area was made. He said he bought this property with the idea it was ready to be developed. Mr. Tucker asked Mrs. Calvert if she knew about this. Mrs. Calvert said she was not sure just what the date was , but she could find out for him. Mr. Smith said he went to a meeting with the City Manager, Jim Harris with Foster Village, Doug Long, and Allen Bronstad, but was never told he could not develop this property. He said he and Jim Harris agreed to cut a ditch down to Chapman Road. Mr. Smith said the city was going to start immediately to get the needed easements. He said he and Jim Harris were willing to participate. He said the City Engineer said it would cost about $100,000, but they thought they could dig it for about $25,000. Mr. Smith said that was the last he ever heard of it, but he was never told he could not develop this property. It is designed to eliminate the expense and red-tape of the normal platting process for single lots. It Could be used for vacant tracts but I don't think we should allow this because it would invite abuse by some builders and would not be fair to the developers. I will have the recommendation of the Planning, and Zoning Commission at Monday night's meeting. I recommend approval ds it eliminates the problem we have when someone wants a remodeling permit on unplatted lots. It will also save an individual about $800-1,500. He said there was more demand for duplexes than single family. Mr. Tucker asked if he plans to sell the duplexes. Mr. Collins said he does. He said he is presently building some duplexes on College Circle and Abbott Street which are the same type as he plans for Ilaroaks. The Chairman opened the Public Hearing and called for those wishing to speak in favor of this request to please come forward. There being no one wishing to speak in favor of this request, the Chairman called for those wishing to speak in opposition to this request to please come forward. Marvin Smith, 7609 Douglas Lane, came forward. He said he has lived on this street for 35 years. He said he was representing himself and his father. Mr. Smith said he was not totally opposed to this request. He said they are not opposed to duplexes, but they do not want duplexes on Lots 9 through 15 of Block 15. Mr. Smith said he owns 20 acres on the other side of these lots and he plans to build some 4000 or 5000 sq. ft. homes. He said he feels they need a little cushion between the duplexes and his property. Mr. Smith said his home is just about 600 feet from this property and he plans to build 2 or 3 more large homes. Mr. Smith said the 2100 sq. ft. duplexes would only be 1250 sq. ft. per side. He said people do not keep duplexes up and there is always trash everywhere. Mr. Smith said he is definitely opposed to duplexes on Lots 9 through 15, Block 15. Page 4 P & Z Minutes August 26, 1982 Mr. Smith said when he had this property zoned, he planned to build 1600 sq. ft. homes, but with the economy the way it was, he sold it. Mr. Smith asked if there was a require- ment for duplexes to have carports or garages. Mi = . Calvert said there was not. Mr. Wood asked if there was any .duplex zoning in this area. • Mr. Tucker said there gat not. Mr. Tucker asked Mr. Collins if he saw any problem with using Lots 9 through 15 for a buffer. Mr. Collins said he could make a buffer, but he did not see the difference in 1600 sq. ft. houses and 2100 sq. ft. duplexes. Mr. Bowen said the City Engineer made a comment in his letter regarding this area being located in the watershed which drains through Morgan Meadows Addition, and that the City Council had denied development in Foster Village, Section 11, which is adjacent to this property, until such time that the drainage problem in Morgan Meadows is resolved. He said he knew this information pertains to platting and not zoning, but since this property is already platted, he felt this should be mentioned. Mr. Bronstad said this area would drain to Windcrest Addition and Windcrest Addition to Morgan Meadows Addition. Mr. Bowen said he felt this should be checked into. Mr. Tucker said this is a zoning request, not platting. Doug Long, Consulting Engineer, came forward. He said he had a report from the Page 5 P & Z Minutes August 26, 1982 City Engineer regarding an August, 1980 meeting which Mr. Smith, Jim Harris with Foster Village, and several others attended. He said the report stated they were meeting with haste to correct this channel . Mr. Long said he did not know this addition was shut down. He said he knew the city has been doing work in Morgan Meadows. Mr. Long said they might come back with a replat of this area for single family attached. Mr. Tucker asked Mr. Collins if he plans to sell each side to different owners. Mr. Collins said he plans to sell the whole duplex. Mr. Collins asked when this ban on development in this area was made. He said he bought this property with the idea it was ready to be developed. Mr. Tucker asked Mrs. Calvert if she knew about this. Mrs. Calvert said she was not sure just what the date was, but she could find out for him. Mr. Smith said he went to a meeting with the City Manager, Jim Harris with Foster Village, Doug Long, and Allen Bronstad, but was never told he could not develop this property. He said he and Jim Harris agreed to cut a ditch down to Chapman Road. Mr. Smith said the city was going to start immediately to get the needed easements. He said he and Jim Harris were willing to participate. He said the City Engineer said it would cost about $100,000, but they thought they could dig it for about $25,000. Mr. Smith said that was the last he ever heard of it, but he was never told he could not develop this property.
