RICHARDSON SURVEY, EMBER OAKS ADDITION, FROM "C1" COMMERCIAL TO "R-3PD" RESIDENTIAL, AND APPROVING A PD SITE PLAN THEREFOR (PZ 2002-08); ESTABLISHING A PENALTY; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. 6 8 10 WHEREAS, notice of a hearing before the Planning and Zoning Commission was sent to real property owners within 200 feet ofthe property herein described at least 10 days before such hearing; and, 12 14 WHEREAS, notice of a public hearing before the City Council was published in a newspaper of general circulation in the City at least 15 days before such ~earing; and, 16 18 WHEREAS, public hearings to zone the property herein described were held before both the Planning and Zoning Commission and the City Council, and the Planning and Zoning Commission has heretofore made a recommendation concerning the zone change; and, 20 22 WHEREAS, the City Council is ofthe opinion that the zone change herein effectuated furthers the purpose of zoning as set forth in the Comprehensive Zoning Ordinance and is in the best interest of the citizens ofthe City of North Richland Hills; NOW, THEREFORE, 24 26 28 BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: 30 Section 1: THAT the Comprehensive Plan, the Comprehensive Zoning Ordinance and the zoning map ofthe City of North Richland Hills is hereby amended by rezoning a 5.151-acre and a 4.337-acre parcel ofland described, respectively, on Exhibits "A"and "B" hereto, from C-I Commercial zoning to R-3 PD Residential zoning, and approving the site plan for such property. 32 34 36 Section 2: The permitted uses and development regulations for this R-3 Planned Development District shall be those for R-3 zoning districts, except that minimum dwelling unit size shall be 2,000 square feet on at least 50 % ofthe lots and the minimum dwelling unit size on the remainder shall be 1,800 square feet. 38 40 Section 3: Any person, firm or corporation violating any provision of the Comprehensive Zoning Ordinance as amended hereby shall be deemed guilty of a misdemeanor and upon final conviction thereof fined in an amount not to exceed Two Thousand Dollars ($2,000.00).
