HomeMy WebLinkAboutOrdinance 3370 ORDINANCE NO. 3370 ZONING CASE SUP 2015-04 AN ORDINANCE AMENDING THE COMPREHENSIVE PLAN AND THE COMPREHENSIVE ZONING ORDINANCE OF THE CITY OF NORTH RICHLAND HILLS; AMENDING THE ZONING MAP OF THE CITY OF NORTH RICHLAND HILLS, TEXAS, BY GRANTING A SPECIAL USE PERMIT FOR A LAUNDROMAT AT HARWOOD PLAZA SHOPPING CENTER, LOCATED AT 8409 BOULEVARD 26; ESTABLISHING A PENALTY; PROVIDING FOR PUBLICATION; AND PROVIDING AN EFFECTIVE DATE. WHEREAS, notice of a hearing before the Planning and Zoning Commission was sent to real property owners within 200 feet of the property herein described at least 10 days before such hearing; and, WHEREAS, notice of a public hearing before the City Council was published in a newspaper of general circulation in the City at least 15 days before such hearing; and, WHEREAS, public hearings to zone the property herein described were held before both the Planning and Zoning Commission and the City Council, and the Planning and Zoning Commission has heretofore made a recommendation concerning the zone change; and, WHEREAS, the City Council is of the opinion that the zone change herein effectuated furthers the purpose of zoning as set forth in the Comprehensive Zoning Ordinance and is in the best interest of the citizens of the City of North Richland Hills; NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF NORTH RICHLAND HILLS, TEXAS: Section 1: THAT the Comprehensive Plan, the Comprehensive Zoning Ordinance and the zoning map of the City of North Richland Hills are hereby amended to allow for a Special Use Permit for a laundromat at Harwood Plaza Shopping Center located at 8409 Boulevard 26, City of North Richland Hills, Tarrant County, Texas, more particularly described as Lot 1R1, Block 1, Walker Branch Addition, North Richland Hills, Tarrant County, Texas and approving a site plan attached hereto as Exhibit A. Section 2: This change is subject to the following conditions placed by City Council: Ordinance No. 3370 Page 1 of 4 h. Laundry carts: Maximum 15 laundry carts on-site. All carts must be kept within the enclosed space of the laundromat business. Section 3: Any person, firm or corporation violating any provision of the Comprehensive Zoning Ordinance as amended hereby shall be deemed guilty of a misdemeanor and upon final conviction thereof fined in an amount not to exceed Two Thousand Dollars ($2,000.00). Each day any such violation shall be allowed to continue shall constitute a separate violation and punishable hereunder. Section 4: The City Secretary is hereby authorized and directed to cause the publication of the descriptive caption and penalty clauses of this ordinance as an alternative method of publication provided by law. Section 5: This ordinance shall be in full force and effect immediately after passage. AND IT IS SO ORDAINED. PASSED AND APPROVED on this 24th day of August, 2015. Building lighting. All wallpack lights on the rear of both buildings will be replaced with conforming fixtures. Additional fixtures will be installed to increase the safety of the rear alley. The use of LED or neon strip lighting is prohibited on all parts of the building. b. Dumpster enclosure. An opaque metal gate/screen will be installed on the two dumpster enclosures on the site. Gates will remain closed during non-pickup times. This applies to both dumpster areas on the property. c. Color of conduit. The conduit on the exterior of both buildings will be painted to blend in with the wall material of the buildings. d. Awnings. All the awnings on both buildings will be replaced. Details on the color and material for the replacement awnings will be provided prior to installation. e. Signs. The two leasing signs near the intersection of Boulevard 26 and Emerald Hills Way will be relocated to conform to the Sign Ordinance standards. f. Fence Section. The removal of the wood fence section between Emerald Hills Way and the building line. Laundromat Operations & Security a. Staffed with three employees to help customers b. Clean and safe premises c. Monitored security system with six cameras with DVR recording 24/7 d. Card operated machines (not coin operated) e. Open 7 days a week from 7:00 a.m. to 9:00 p.m. f. Wash-and-Fold Services g. Amenities Include: Wi-Fi internet access, two televisions, one vending machine, one soda machine, and three arcade machines. Ordinance No. 3370 Page 2 of 4
