HomeMy WebLinkAboutOrdinance 1084 - ORDINANCE NO. 1084 BE IT ORDAINED by the City Council of the City of North Richland Hills, Texas, that Ordinance #195 "Subdivision Ordinance" is heretofore ammended by adding the following: Section 1-03-E Paragraph 3 3. At the regularly scheduled Planning and Zoning Commission Meeting stipulated in Section 1-03-B, the Planning and Zoning Commission shall act on the preliminary plat in the following manner: (a) If all requirements of the Subdivision Ordinance for preliminary plat are met; then the Commission may grant approval or approval with numerated conditions (b) If all requirements of the Subdivision Ordinance for preliminary plat are not met; then the Commission may disapprove or may grant approval subject to all requirements being met at the time of submission of final plat and construction plans 3A. If a preliminary plat is disapproved by the Commission; then the subdivider may, after making corrections to the plat, resubmit plat to the Planning and Zoning Coordinator, who will place item on the Agenda of the next regularly scheduled meeting of the Planning and Zoning Commission. Section 1-04- E Paragraph 3 and 4 3. At the regularly scheduled Planning and Zoning Commission Meeting stipulated in Section 1-04-B, the Planning and Zoning Commission shall act on the final plat in the following manner: (a) If all requirements of the Subdivision Ordinance for final plat and construction plans are met; then the Commission may grant approval or approval with numerated conditions and then forward the same to the City Council for adoption. (b) If all requirements of the Subdivision Ordinance for final plat and construction plans are not met: then the Commission may dis- approve final plat and withhold forwarding to the City Council. 3A. If final plat is disapproved by the Commission then the subdivider may, after making correction to the final plat, resubmit plat to the Planning and Zoning Commission for reconsideration. Or if the subdivider feels that the Commission withheld approval of final plat unjustly; then the subdivider may request an appeal hearing by the City Council as per the following procedure: (a) Subdivider shall submit a request for an appeal hearing through the office of the Director of Public Works. - Page 2 Ordinance No. (b) The Director of Public Works shall review appeal request and forward request, with recommendations, to the City Secretary who will then, by proper procedure, place request for an appeal hearing on City Council Agenda. (c) City Council, at a regularly scheduled Council Meeting, shall consider appeal hearing request and by simple majority vote may grant or deny an appeal hearing. (d) If City Council grants an appeal hearing then the City Secretary shall place appeal hearing on Council Agenda at the time and date as directed by Council. (e) City Council, by three-fourths majority vote of the total Council, may overrule the Planning and Zoning Commission decision and direct the Public Works Director to have final plat recorded. 4 . After approval by the Planning and Zoning Commission and adoption of the final plat and plans by the City Council and the endorsement of the Mayor attested by the City Secretary, have been placed on the plat, the plat shall be sent for recording then retained by the Planning and Zoning Coordinator until after the subdivider has delivered to the Public Works Director three (3) properly executed copies of the City-Developer Agreement as contained herein. The City-Developer Agreement shall then be executed by the Mayor and City Secretary and one (1) copy, along with the original linen tracing of the plat shall be returned to the subdivider. One (1) other copy of the agreement with plat attached shall be transmitted to the City Engineer and the third copy shall be retained by the Planning and Zoning Coordinator in the permanent City files.
