ORDINANCE NO. 1099
WHEREAS, Article 6574c, Texas Civil Statutes, provides that any
incorporated city may adopt an ordinance providing for microfilming public
records if the ordinance contains certain prerequisites; and
WHEREAS, the City Council of the City of North Richland Hills
desires to reduce the cost of record storage and provide for the microfilming
of records:
NOW, THEREFORE, be it ordained by the City Council of the City of
North Richland Hills, Texas, that:
1.
The City Manager, or his designee, is hereby authorized to cause
public records of the City to be recorded on microfilm. Those records which
are hereby authorized to be recorded include:
(a) Ordinances, resolutions, minutes, contracts and such other
records as the City Manager, or his designee, in his judgement deems
as permanent records of the City.
(b) All records microfilmed shall be indexed.
(c) Microfilm used shall meet requirements of the United States of
America Standard Institute for archival quality, density, resolution
and definition.
(d) The City Managers designee or persons working under his super-
vision shall check and certify that each microfilm record is a true
and correct duplication of the original public record.
(e) The public shall have free access to any information micro-
filmed to which they are entitled under law.

A copy of the microfilm record may be issued and certified by the
City Secretary or his/her deputy or assistant acting as recordkeeper of the
City.
3.
Original public records which are microfilmed in compliance with
this ordinance may be destroyed as directed by the City Manager's designee
with the advise and consent of the City Attorney, save and except any original
public record in litigation, in which case such document may be destroyed only
after such litigation is final.
4.
Notice of proposed destruction or disposition of original public
records shall first be given to the State Librarian or State Archivist, by the
City Secretary and if such records are in his/her opinion, needed for the
State Library, the records shall be transferred thereto.

5.
If any portion of this ordinance is held to be invalid it shall not
affect the remaining valid portions of the ordinance.
6.
This ordinance shall be in full force and effect from and after its
passage and approval.
