ORDINANCE NO. 906
AN ORDINANCE CALLING AN ELECTION AUGUST 8, 1981, FOR THE PURPOSE OF SUBMITTING
PROPOSED NORTH RICHLAND HILLS CHARTER AMENDMENTS.
WHEREAS, the City Council is of the opinion that the proposed Charter
amendments herein submitted merit the consideration of the
citizens of North Richland Hills:
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF NORTH RICHLAND HILLS, TEXAS:
SECTION 1. An election is hereby called for August 8, 1981, at City Hall for
Voter Precincts 41, 49, 63, 72, 140, 191, 196, 209, 214, 215, and
238 between the hours of 7:00 a.m. and 7:00 p.m. The following shall
serve as Judge and Alternate Judge:
Judge: Beverly Riley
Alternate Judge: Aline Parker
Absentee voting by personal appearance shall commence on
July 15, 1981, at 8:00 a.m., and shall continue through
August 4, 1981, at 5:00 p.m. Such absentee voting shall
take place in the office of the City Secretary in the City
Hall by paper ballot. The election is to be conducted in
accordance with the election laws of the State of Texas, and
voting machines or paper ballots are hereby adopted as the
method of voting at such election.
SECTION 2. Notice of the election shall be given by publishing this
Ordinance on the same day in each of two successive weeks,
the date of the first publication to be not less than
fourteen (14) days prior to the date set for said election
all as provided by Article 1170, V.A.T.S. The election
shall be for the purpose of adopting or not adopting the
proposed Charter amendments.
SECTION 3. The ballot shall submit the following with provisions for
voting "for the proposed amendments" or "against the proposed
amendments."
SECTION 4. The Charter amendments to be voted upon are contained in
Exhibit "A" attached hereto and made a part hereof. They
are on file for inspection in the office of the City
Secretary.

EXHIBIT "A"
AMENDMENT NUMBER 1.
Article V, Section 2, is amended to read as follows:
"SECTION 2. QUALIFICATIONS
Each of the seven Councilmen and Mayor shall, on the date of election,
be at least 21 years of age, a citizen of the united States of America and
a registered, qualified voter of the State of Texas; shall reside and shall
have resided for at least one year preceding the election at which he is a
candidate, within the corporate limits of North Richland Hills; and shall
not be in arrears in the payment of any taxes or other liability due the
City, or be disqualified by reason of any provision of any other section of
this Charter. A member of the Council ceasing to possess any of the qualifi-
cations specified in this section or any other sections of this Charter, or
convicted of a felony before or while in office, shall immediately forfeit
his office. No Councilman shall hold any other public office except that of
Notary Public, member of the National Guard or any Military Reserve, or a
retired member of the Armed Services."

AMENDMENT NUMBER 2.
Article V, Section 6, is amended to read as follows:
"SECTION 3. DATE OF ELECTION; CANDIDATES TO RUN FOR PLACES; PLACES DESIGNATED
The regular municipal elections of the City of North Richland Hills
shall be held on the first Saturday of April of each year, and the same
shall be conducted and the results canvassed and announced by the election
authorities prescribed by the Election Code of the State of Texas, and said
Code shall control in all municipal elections except as otherwise herein
provided.
The Mayor and Councilman Places 2, 4, and 6 shall be elected for two
(2) year terms at the election in even-numbered years and Councilman Places
1, 3, 5, and 7 in the general election in odd-numbered years. Councilmen
elected to Places 1, 3, 5 and 7 in the general election to be held on the
first Saturday in April, 1982 shall serve for a period of only one (1)
year, until the general election of April, 1983. Thereafter, the two (2)
year term of office shall apply to all Council positions."

AMENDMENT NUMBER 3.
Sections 3, 3a, 5 and 6 of Article XVII are each respectively amended to read as
follows:
"SECTION 3. CIVIL SERVICE COMMISSION
There is hereby established in the City of North Richland Hills a Civil
Service Commission, which shall consist of five (5) members, to be selected
as follows. Members of the Commission shall be appointed by the Mayor of
the City of North Richland Hills and such appointment shall be confirmed by
a two-thirds (2/3) vote of the City Council of the City of North Richland
Hills before any such appointments shall be effective. Of the first five
(5) Commissioners so selected under the provisions of this Act to comprise
the Commission, two (2) shall be appointed for a term of one (1) year, and
two (2) shall be appointed for a term of two (2) years and one (1) shall be
appointed for a term of three (3) years, or until in each case a successor
is appointed, confirmed and qualified. Any vacancies in said Commission,
caused by death, resignation, removal or otherwise, or by failure of any
appointee to qualify within ten (10) days after appointment, shall be
filled in the manner hereinabove specified, and such appointment shall be
for the unexpired term of the retiring Commissioner or the appointee failing
to quali fy.
Each such Commissioner shall be of good moral character, a resident of
the City of North Richland Hills, shall have resided in said City for a period
of at least one (1) year, shall have attained the age of twenty-one (21) years,
and shall not have held any public office nor been a paid employee of the City
within the preceeding three (3) years."
"SECTION 3a. REMOVAL OF COMMISSIONERS
Civil Service Commission members may be removed by a two-thirds (2/3)
vote of the City Council for failure to remain qualified under the provisions
of Section 4 of this Article or failure to maintain interest in this Com-
mission as manifested by good attendance at meetings."
"SECTION 5. POWERS AND RESPONSIBILITIES
The Civil Service Commission shall formulate policies, procedures,
rules and regulations for conduct of all Civil Service business, operating
always within the bounds of the City Charter, the Constitution and laws of
the State of Texas and the Federal Constitution."

"SECTION 6. SECRETARY OF CIVIL SERVICE
There is hereby created the office of Secretary of Civil Service, which
Secretary shall be appointed and removed by a two-thirds (2/3) vote of the
City Council. The Secretary shall serve as Secretary to the Commission,
and shall perform all such work incidental to the Civil Service as may be
required by the Commission."

AMENDMENT NUMBER 4.
Sections 2, 8 and 12 of Article XVII are each respectively amended to read as follows:
"SECTION 2. DEFINITIONS
Any full-time employee of the City is entitled to City Civil Service
coverage except any employee directly appointed by the City Council, or any
supervisory personnel directly appointed by the City Manager."
"SECTION 8. CLASSIFICATION OF EMPLOYEES
All employees shall be classified as above provided and shall be under
Civil Service protection except the Chief or Head of such departments, and
persons appointed as second in command, by whatever name they may be known.
The appointment of the second in command shall be made by the Chief or Head
of such department with the approval of the City Manager. Said Chiefs or
Department Heads shall be appointed by the City Manager."
"SECTION 12. PROBATIONARY AND FULL-FLEDGED EMPLOYEES
A person who has received appointment to any department hereunder shall
serve a probationary period of twelve (12) months.
All positions in the City covered by this Article except that of Head of
the Department and second in command shall be classified by the Commission
and the positions filled from the eligibility list as provided herein."

AMENDMENT NUMBER 5.
Section 27, of Article XVII is hereby repealed, and Sections 14, Paragraph A, and
Sections 18 and 25a, of Article XVII are each respectively amended to read as
follows:
"SECTION 14, PARAGRAPH A. PROMOTIONS: FILLING VACANCIES
All promotional examinations shall be open to all employees who have held
a continuous position for two (2) years or more in the salary classification
immediately below the classification for which the examination is to be held;
except where there is not a sufficient number of members in the next lower
position with two (2) years service in that position to provide an adequate
number of persons to take the examination, then all employees in such clas-
sification will be eligible to take the examination. If, after extending the
examination to all employees in the classification immediately below the
position being tested, and there is still an insufficient number to take the
examination, the Commission may further extend the examination to the members
in the second lower position in salary to that for which the examination is
to be held."
"SECTION 18. APPEAL TO DISTRICT COURT
In the event any employee is dissatisfied with the decision of the Com-
mission, he may, within ten (10) days after the rendition of such final decision,
file a petition in the court of appropriate jurisdiction, asking that his order
of suspension, dismissal, or demotion be set aside. Such cases shall be advanced
on the docket of such court and shall be given a preference setting over all
other cases and shall be tried under the Substantial Evidence Rule."
"SECTION 25a. VACATIONS
Those employees having completed one (1) but less than three (3) years
of consecutive service with the City shall be entitled to two (2) weeks vacation
with pay each year; those employees having completed three (3) but less than
eight (8) years of consecutive service with the City shall be entitled to
three (3) weeks vacation with pay each year; those employees having completed
eight (8) but less than twenty (20) years of consecutive service with the City
shall be entitled to four (4) weeks vacation with pay each year; and those
employees having completed twenty (20) or more years of consecutive service
with the City shall be entitled to five (5) weeks vacation with pay each year.
For the purposes of this Section, a week shall be defined as a normal
work week for all employees in each of the designated classifications."

AMENDMENT NUMBER 6.
Article IX, Section 2, is amended to read as follows:
"SECTION 2. PERSONAL SERVICES
No contract shall ever be made which binds the City for personal services,
except for professional or City Manager services to be rendered for any stated
period of time, but all appointive employees shall be subject to peremptory
discharge, and when discharged shall only be entitled to compensation up to
and including the date of their discharge, any provision to the contrary in
this Charter notwithstanding.
Contracts for professional or City Manager services shall be for a term
of no longer than five (5) years, and shall contain express language providing
for termination without compensation beyond the date of occurrence of any of
the following: conviction of a felony or other crime involving moral turpitude;
violations of the provisions of the Charter or of any ordinance, rule, or of
special orders applicable to such person."

AMENDMENT NUMBER 7.
Article IX, Section 3, is amended to read as follows:
"SECTION 3. GOODS, MATERIALS, SERVICES OR SUPPLIES
The City or any agent of the City acting for it shall not make any con-
tract for goods, materials, services, or supplies for the current use of any
department of the municipality for more than one year, except as in this
Charter provided, unless said contract and the cost thereof has been included
in the annual budget of the City and unless an appropriation has been made
therefor, and no contracts or purchases shall exceed the amount appropriated.
All contracts shall be made upon specifications and competitive bids except
in those cases where such specifications and competitive bids are not required
by state law or in contracts for professional services, and no contract shall
be binding until it has been signed by a designated representative of the City.
Whenever the cost of any contracts charged to any appropriation equals the
amount of such appropriation, no person representing the City shall sign or
make any additional contracts chargeable to such appropriation. Any contract
for current expenditures, exceeding the amount set up in the budget or the
appropriation therefor shall be void."

el primer sabado de Avril de cada ano, y 10 mismo sera conductido y las resuldas
Anunciadas por la Autorida del Codigo de estado de Tejas, y qual codigo sera
controlado en la municipal elecciones.
El Mayor y hombres del Concilio lugar 2, 4, Y 6 seran electados por dos (2)
anos en la eleccion de numeros equales anos y hombre Concilio lugar 1, 3, 5, Y 7
en general eleccion en numeros de no eguales, hombre Concilio electado pa lugar
1, 3, 5, Y 7 en general eleccion sera detenida en el primer sabado en Avril, 1982
sera servido por uno (1) ano antes la eleccion general de Avril 1983 despues de

Aqui pues establesido en la Ciudad de North Richland Hills un servicio civil
comision, que consiste de cinco (5) miembros, sean selectaos como siguente.
Miembros de comision seran nombrar por el Mayor de Ciudad North Richland Hills
y qual nombrer seran confirmados por dos-tres 2/3 votos del Concilio de Ciudad
de North Richland Hills despues de ningunos sera effictivos. De los primeros

"SECCION 5. PODERES Y RESPONSABLIDA

servicio con la Cuidad tiene derecho ados (2) semanas vacasiones con pago cada
anio; enpliados que completan tres (3) menos ocho (8) anios de servicio con la
Ciudad tiene derecho a tres (3) semanas de vacaciones con pago cuda anio; los
enpliados que conpleton ocho (8) pero menos de vente (20) tiene derecho a quatro
(4) semanas de vacaciones con pago cada anio; y empliados que conpletan vente (20)
omas anios de servicio con la Cuidad tiene dericho a cinco (5) semanas con pago
cada anio.
Por la intencion de este seccion, una semana sera definera pa normal travajo
de semana pa todos los empliados en cada classificacion designado."

stado de tiempo, pero todos los enpliados selectados seran qual perentorio
descargao, y cuando sea discargao tendraderecho a compensacion asta el dia de
discarge.
Contratos de manigador de la cuidad de servicio, sera por el turno de no
mas de cinco (5) anios, y contiene a expresar su langua por terminacion sin
compensacion el dia de occuro de 10 sigiente convitido de una felona 0 crimen 0
voliacion de la ordenanza de carta de regIa.

o provision, de occuro de mingun departamento 0 municipal por mas de un anio
menos en carta echa, solamente que el contrato y el costo estan echos en el
presupuesto del la cuidad, ningun contrato sera echo en especision que no sea
requardo por la ley de el estado 0 en contratos profecionales. Minguno sera echo,
solomente que sea desesno por un representado de la cuidad. Minguna persona de
la Ciudad sanniar pa ser addicionales contratos, todo contrato que queste mas
de el presuspuesto sera invalido."

UNA ORDENANZA INVITA UNA ELECCION AGOSTA 8, 1981, POR LA INTENCION DE SOMETER PROPONER
NORTH RICHLAND HILLS CARTA ENMIENDA.
MIENTRAS QUE, el Concilio de la Ciudad es de opinion de propaner carta enmienda
sometirda merito de consideracion de los ciudadano de North Richland
Hills:
POR LO TANTO, QUE SEA ORDINAR POR EL CONCILIO DE LAS CIUDAD DE NORTH RICHLAND HILLS,
TEXAS:
SECCION 1. Una eleccion es invita en Agosto 8, 1981, en Ciudad corredor por votantes
distrito 41, 49, 63, 72, 140, 191, 196, 209, 214, 215, Y 238 media las
horas de 7:00 a.m. y 7:00 p.m. Los siguentes servir con juez y alterno
juez:
Juez: Beverly Riley
Alterno Juez: Aline Parker
Votos ausentes de personas seran comensao en Julio 15, 1981 alas 8:00 a.m.
y continuar asta Agosta 4, 1981 alas 5:00 p.m. Votando ausentos sea el
lugar en la officina de la Secretaria de la Ciudad en papel balota. La
eleccion sera conductida en a cuerdo con las layes de el estado de Texas,
y maquinas de votar y balota de papeles seran adoptado para votar en la
eleccion.
SECCION 2. Noticia de la eleccion sera dada para publicar las Ordenanza en el mismo
dia en las dos semanas se cesivo, el dia de primer publicacion sera no
menos de Catorze (14) dias predos de el dia listo por sequm eleccion todos
como propor cionar por Articulo 1170, V.A.T.S. La eleccion sera por la
intencion de adoptar 0 no adoptar la intencion Carta enmienda.
SECCION 3. El balota sera sumtida en los siquiente con proviciones para votando
"por el proponer enmiendas" 0 "acontra el proponer enmienda".
SECCION 4. La Carta enmienda sera votada Arriva son contener en exhibicion "A"
agarao de qui y aser pa ya estan en fila por enspecion en la officina de
la Secret aria de la Ciudad.
