Discuss items from the regular Planning and Zoning Commission Meeting Planning Manager Clayton Comstock asked that case number C.1 and D.1 be presented together since they reference the same development project. 4- Chairman Shiflet mentioned that he would present case number C.1 and D.1 together at the regular session. Planning Manager Clayton Comstock presented Item C.2: ZC 2015-13 Public Hearing and consideration of a request from Center Point Church for a Zoning Change from TOD Transit Oriented Development to C-1 Commercial for an approximately 0.65 acre portion of Lot 1, Block 1, Center Point Addition located at 7804 Mid Cities Boulevard. A portion of the property, zoned TOD, is on undeveloped land owned by the church and cm a. co adjacent road the widening project of Smithfield Road. The church's long-term plan is to expand their parking lot in this area. The TOD zoning was implemented in 2009 and , included the streetscape of Smithfield Road. If the zoning change were approved, a separate application for a fifteen- (15-) foot landscape variance would be considered to accommodate landscape buffer and the parking lot expansion. Caroline Waggoner is available to answer any questions about the Smithfield Road project. 2 Planning Manager Clayton Comstock presented C.3: RP 2015-03 Public Hearing and consideration of a request from Patrick O'Connor for a Replat for Lots 9R, 1 OR, and 11, 0 Block 1, Meacham Addition on 1.771 acres located at 7800 and 7804 Arthur Drive. This project is at the west end of Arthur Drive where it terminates at the right-of-way for the Cottonbelt Trail. This property is in TOD residential subzone. CD Planning Manager Clayton Comstock presented C.1: ZC 2015-06 Public Hearing and consideration of a request from Winkelmann and Associates, Inc. for a Zoning Change from C-1 Commercial to NR-PD Nonresidential Planned Development including Ln revisions to PD-69 on 34.879 acres located in the 9100 block of North Tarrant Parkway. In conjunction he presented D.1: AP 2015-05 Consideration of a request from cm Winkelmann & Associates, Inc. for an Amended Plat for North Tarrant Marketplace Addition on 2.450 acres at 9100 & 9120 North Tarrant Parkway. This project west of the new Kroger Marketplace and is currently zoned C-1. The property is owned by NewQuest Properties. The proposed zoning is NR-PD with a C-1 base district. The 4- request would accommodate the proposed fitness center and adjacent retail. The fitness center would be two and one-half (2'/2) feet shorter than Kroger building height, and have setbacks of one hundred seventy seven (177) feet and two hundred seventeen (217) feet from the adjacent residential. Surface drainage from this undeveloped property would be handled with an earthen drainage swale. The building walls would be brick and stone and match the existing Kroger Marketplace. The rear of June 18,2015 P&Z Minutes Page 2 Packet Pg. 9 B.1.a the structure would be tilt up concrete wall. The request includes a third monument sign of twenty one (21) feet in height. The revision to the NR-PD regulations are for a masonry wall variance between residential and commercial property and the additional monument sign with shared advertising throughout the development. Stipulations Ln include limitations on the drive-through window and a shared dumpster. Lighting has been an important issue at this property. Staff recommends reducing the light pole cm height to twenty (20) feet to comply with the lighting ordinance and consider consolidating or removing pole lights and utilizing building lighting instead. The approved plans for this development included a pole height of thirty (30) feet. Existing pole lights have internal light shields. The developer has volunteered to plant four (4) inch caliper trees rather than the required minimum three (3) inch caliper trees. NewQuest has not proposed cross access between the Kroger Marketplace and the Dollar-Flowers property. Staff has asked for cross access to help the traffic flow across North Tarrant Parkway and back onto the Dollar Flowers site for convenience and public safety. If cross access is provided, there could be consideration to eliminate the deceleration lanes on North Tarrant Parkway. cm co 5. He thanked staff working with the church on the Smithfield Road project. Of the three (3) phase master plan, phases one (1) and two (2) were completed before the TOD development. The church understands the intent of the TOD project and sees the proposed solution as a win/win situation. He asked that the Commission approve this request. The Commission had no questions for staff or the applicant. They purchased this property about six (6) months ago and intend to build on lot eleven (11) in the near future. Chairman Shiflet asked what is intended for Lot ten (10). Patrick O'Conner responded there were no plans at this time and it would likely be sold. cm The Commission had no questions for staff or the applicant. Chairman Shiflet asked for anyone wishing to speak on the item to come forward. 4- Kevin Murphy, 7813 Arthur Drive, came forward to discuss drainage concerns on Arthur Drive. He owns property at 7809 and 7816 Arthur Drive. Drainage has been an issue from Mid-Cities Boulevard, and the City has had to provide sand bags to protect his lot. The CPA commercial business was required to build a retaining wall for buffering. He asked about the responsibilities for future drainage at this property and commercial businesses on the north side of Mid-Cities Boulevard. June 18,2015 P&Z Minutes Page 6 Packet Pg. 13 B.1.a Chairman Shiflet asked Civil Engineer Caroline Waggoner, to come forward to speak on the drainage. She stated that Arthur Drive does not have curb and gutter or underground drainage systems. The CPA was required to build a detention pond and the flow is to the west. The City is aware of and will be working in the interim to help Ln address surface drainage along Arthur Drive. At some point, the drainage flow will be addressed to help move water south and west to the creek. cm Chairman Shiflet asked if the O'Connor's would be permitted to allow any more water to drain off the property than what is today. 4- Caroline Waggoner responded that they would not be permitted to block the flow of drainage from the north side of Arthur Drive towards the south. Clayton Comstock presented item C.1: ZC 2015-06 Public Hearing and consideration of Ln a request from Winkelmann and Associates, Inc. for a Zoning Change from C-1 Commercial to NR-PD Nonresidential Planned Development including revisions to PD- 69 on 34.879 acres located in the 9100 block of North Tarrant Parkway. In conjunction he presented D.1: AP 2015-05 Consideration of a request from Winkelmann & Associates, Inc. for an Amended Plat for North Tarrant Marketplace Addition on 2.450 acres at 9100 & 9120 North Tarrant Parkway. This project west of the new Kroger 4- Marketplace and is currently zoned C-1. The property is owned by NewQuest Properties. The proposed zoning is NR-PD with a C-1 base district. The request would accommodate the proposed fitness center and adjacent retail. The fitness center would be two and one-half (2'/2) feet shorter than Kroger building height, and have setbacks of one hundred seventy seven (177) feet and two hundred seventeen (217) feet from the adjacent residential. Surface drainage from the undeveloped portion of the property June 18,2015 P&Z Minutes Page 7 Packet Pg. 14 B.1.a would be handled with an earthen drainage swale. The building walls would be brick and stone and match the existing Kroger Marketplace. The rear of the structure would be tilt up concrete wall. The request includes a third monument sign of twenty one (21) feet in height. The revision to the NR-PD regulations are for a masonry wall variance Ln between residential and commercial property and the additional monument sign with shared advertising throughout the development. Stipulations include limitations on the cm drive-through window and a shared dumpster. Lighting has been an important issue at this property. Staff recommends reducing the light pole height to twenty (20) feet to comply with the lighting ordinance and consider consolidating or removing pole lights and utilizing building lighting instead. The approved plans for this development included 4- a pole height of thirty (30) feet. Existing pole lights have internal light shields. The developer has volunteered to plant four (4) inch caliper trees rather than the required minimum three (3) inch caliper trees. NewQuest has not proposed cross access between the Kroger Marketplace and the Dollar-Flowers property. Staff has asked for cross access to help the traffic flow across North Tarrant Parkway and back onto the Dollar Flowers site for convenience and public safety. If cross access is provided, there could be consideration to eliminate the deceleration lanes on North Tarrant Parkway. A drainage flume has posed a pedestrian cut through problem, but staff will work with the cm a. CO Thornbridge HOA to resolve this issue. Staff recommends approval of both applications with clarification on the cross access. E Steven Cooper asked about plans for pedestrian access. Clayton Comstock responded the plans include a four- (4-)foot sidewalk on the west U) side of the Whataburger driveway and the applicant may discuss the safety of cut- 2 through traffic from an adjacent property. 0 to Steven Cooper asked about clarification of the color of the wall behind the fitness center. 0 Clayton Comstock responded the wall plans did not specify wall color, but the applicant stated they would paint the wall an earth tone color. The proposed application does not include a wall adjacent to Thornbridge, but instead it preserves existing trees. Ln Michael Clark, applicant, with Winkelmann and Associates, 6750 Hillcrest Plaza, Suite 375, Dallas, 76250, presented the request and was available for questions. The PD cm standards ensure that landscaping and materials are similar to the Kroger property, and the rear drive has a hammerhead turnaround that meets the fire criteria. The fitness center does not have a drive behind it. The shared dumpster would be between Kroger and the fitness center. The building has a retaining wall to preserve more trees. Roof 4- drains will be discharged to an underground drainage system at the southwest corner of the property. The height of the poles can be lowered, and the building wall packs can illuminate the sidewalks. Chairman Shiflet asked about the existing and planned future lighting, which has to be looked at together as part of the PD. Ln Stan Beard, applicant, Director of Development and Construction with NewQuest cm Properties, came forward to discuss lighting. The Kroger lighting has been a problem for the neighbors and NewQuest is pushing Kroger to correct the issues. He stated the main request is the larger sign, and they will address the cross access connection. 4- Mike Benton asked for clarification about lowering the light pole height to twenty (20) feet. Stan Beard responded they are proposing to lower the poles to twenty (20) feet and to shield the light. 0 Chairman Shiflet asked if the lights include external shields to the south. cm CO Stan Beard responded that is correct. Stan Beard addressed the cross access connection. He stated NewQuest has agreements in place that place restrictions on land uses, and each tenant is able to add to the exclusives agreement to provide protection to their business interest from competitors. He stated NewQuest would not support the connection unless the Dollar- Flowers developer becomes a partner in the agreement. 2 Chairman Shiflet opened the Public Hearing at 8:29 p.m. for both items C.1 and D.1. 0 CD S Chairman Shiflet asked for anyone wishing to speak on the item to come forward. Ken Sapp, 8312 Thornway Court, spoke as a representative of Thornway HOA. He was allocated ten (10) minutes to present. He stated their support for the PD and for the elimination of the screening wall. He discussed the topography, drainage and the proposed swale, siltation, tree preservation and maintenance of that area, and lighting. Any accommodation on reducing the pole height and shielding the light would be supported. cm Doug & Elaine Wagner, 9013 Thornway Drive, came forward to speak. They did not indicate support or opposition. They requested clarification of the swale and fence, and stated they are not in favor of removing trees. They asked if there are windows on the 4- back side of the fitness center. The Wagner's submitted for the record a letter to Councilman Whitson asking consideration of maintaining property values when moving forward with the Kroger development project. Clayton Comstock clarified that the cross access proposal can be excluded from this motion as an amendment. He clarified that the PD addresses tree maintenance as lot 14 is subject to maintenance by the current property owner. If the Commission has an expectation of a specific maintenance schedule, that language would need to be cm a. co included in the motion. Bill Schopper asked if there are already ordinances in effect for maintenance. Clayton Comstock responded that there are nuisance standards for undeveloped property. 2 Kathy Luppy asked about moving trees closer to the property line to better block headlights and activity. Ln Michael Clark responded the retaining wall would be the same material as behind cm Kroger and would be painted an earth tone color. Stan Beard responded they have added many trees, with the intent to fill in the line of sight with trees. There is a concern about filling an area with trees that cannot be properly watered and maintained U) Chairman Shiflet asked if trees along the west property line would be behind the Dollar- Flowers anchor store and that the City and NewQuest discuss prior to City Council consideration. If approved, two Special Development Plans (SDP) would also be considered that would allow for immediate multifamily development adjacent to the planned station as well as the parking lot for the train station. General Description: The Transit Oriented Development (TOD) zoning district and form-based code was created in 2009 in response to plans announced by the Fort Worth Transportation Authority (The T) to operate a commuter rail line between downtown Fort Worth and DFW Airport. Future extensions to southwest Fort Worth and Plano are possible along the old Cottonbelt rail line. The intent of the TOD district is to support the development of the community's station areas into pedestrian-oriented, mixed-use urban development environments with convenient access to rail transit, shopping, employment, housing, and neighborhood retail services. The goal of each station area is to encourage an efficient, compact land use pattern; encourage pedestrian activity; reduce the reliance on private automobiles; promote a more functional and attractive community through the use of recognized principles of urban design; and allow property owners flexibility in land use while prescribing a high level of detail in building design and form. Presenter: Clayton Comstock, Planning Manager Summary: On behalf of Skeeter & Bucky, LP, MESA + Planning is requesting approval of a Special Development Plan (SDP) for the Iron Horse Transit Oriented Development (TOD) district to allow a multifamily development with limited variances to the TOD Code. Approval of this SDP would be contingent on the approval of the associated zoning change being considered on the same agenda. General Description: The applicant is requesting approval to construct a multifamily development built in two phases that would ultimately result in approximately 469 dwelling units on 7.26 acres (64 du/acre) immediately adjacent to the TEXRail station platform and commuter parking lot. The purpose of the Special Development Plan is to request variances to the TOD code in the areas of required mixed-use percentages, build-to-zones, required parking count, and structured parking. Mixed Use Criteria The TOD Core Character Zone requires that the first floors of all buildings be built to commercial standards and a minimum of 35% of the first floor building area occupied with commercial uses (retail, restaurant, office). While the applicant will build the first floor to commercial standards, they do not anticipate leasing to any commercial uses until the market can support and sustain such uses. Until such time, they would be used as residential units. The applicant is therefore requesting a variance to the minimum 35% commercial occupancy requirement of the TOD Core Character Zone. Additionally, the High Intensity Mixed Use Character Zone requires 100% of the first floor to be reserved for commercial occupancy, although the TOD code is somewhat unclear in this area. While the Schedule of Permitted Uses specifically prohibits "Residential Apartments and/or Condominiums," the Mixed Use Criteria within the Building Form & Development Standards shows a maximum 40% Packet Pg. 33 C.2 140L Im Rib "ArRok., NORTH KIC;HLA D HILLS allowance of first floor residential uses. Regardless of the percentage, however, the applicant seeks a variance to the commercial occupancy requirement of the TOD High Intensity Mixed Use Character Zone to allow for 100% residential uses. Build-to-Zone The TOD Core Character Zone requires that a minimum of 80% of a building's primary street frontage be built within zero to five feet of the property line along that street. This area is the Build-to Zone. The property, however, is encumbered with a 25-foot water & sanitary sewer easement on the southern half of the property along the Iron Horse Boulevard right-of-way and a 15-foot water easement on the northern half. These easements were put in place when the road, water, and sewer infrastructure were realigned between Boulder Drive and NE Loop 820 to accommodate the Sam's Club in the late 1990s. The easements necessitate the applicant to request a variance to the 0-5-foot Build-to Zone and allow a 25-foot setback. The applicant has agreed to treat the enlarged setback with enhanced hardscape and landscape elements that will align with the vision of the TOD code and possible future transition to commercial uses. Likewise, the High Intensity Mixed Use Character Zone requires that a minimum of 60% of a building's primary street frontage be built no greater than 20 feet from the property line. The same easements affect the High Intensity Mixed Use portion of the proposed development. Therefore, a 25-foot setback is all that is feasible, and the applicant requests a variance to allow a 25-foot setback Required Parkinq Count Both the TOD Core and High Intensity Mixed Use Character Zones require 1.5 parking spaces per multifamily dwelling unit. On-street parking adjacent to the property is allowed to be counted toward the required parking. While the Phase 1 Plan is adequately parked when the availability of on-street parking is considered, the Build-Out Plan is short on parking. With on-street parking not considered in both cases, the applicant is maintaining a 1.38 spaces/unit ratio and is requesting a variance to allow the parking reduction. Structured Parkinq The 2013 revision to the TOD code added a requirement for multifamily residential uses within the TOD Core Character Zone to have a minimum of 80% of the required parking in the form of structured parking, such as a structured parking garage or individual "tuck-under" garages at the rear of the first floor. While the applicant's Build-Out Plan achieves the 80% requirement with the use of two structured parking garages, the Phase 1 Plan has only 20 of 355 spaces (6%) in the form of individual tuck-under garages. If the SDP is approved, the approval of any more residential units over the 257 shown for Phase 1 would require the construction of one or both of the planned structured parking garages. General Description: On July 13, 2015, City Council approved an Interlocal Agreement with the Fort Worth Transportation Authority (The T) to begin rail service along the TEXRail commuter rail line with stops at the Iron Horse and Smithfield stations in 2018. In order to develop the train platforms and encourage ridership, surface parking lots will be required at each stop. As a primary use of the property, "transitional surface parking lots" are not permitted by right within the Transit Oriented Development (TOD) district. If the zoning change is approved for the Iron Horse TOD, this Special Development Plan (SDP) will allow a surface parking lot to support the rail station. Representatives from The T have worked closely with the City and the adjacent property owners to create a plan that screens the 4.49-acre, 363-space parking lot from Iron Horse Boulevard by placing buildings along the street frontage. Because it is less visible from the street, The T is requesting slight modifications to the TOD code as it relates to the landscaping of private parking lots. Further details will be presented at the meeting to the Planning & Zoning Commission and City Council. A "kiss-and-ride" drop-off area and bus and handicap-accessible parking areas closer to the station platform are also provided. There is also a significant elevation difference on the property between the street and the rail line. The likely use of retaining walls around the perimeter of the parking field will help separate the TEXRail parking from any other adjacent uses. Presenter: Clayton Husband, Principal Planner Summary: Safeway Consulting & Contracting, LLC, is requesting approval of a Preliminary Plat of Stone Ridge Estates. This 6.481-acre subdivision includes a total of 14 lots. The property is located on the north side of Shady Grove Road, west of Steeple Ridge Drive. General Description: The preliminary plat for Stone Ridge Estates includes 11 new single-family residential lots, one existing single-family lot, one excess/remainder lot, and one lot temporarily reserved for emergency access until a future can convert the lot to another single-family lot. The site has a reverse ell shape, with a narrow portion of the property extending north and parallel to the Steeple Ridge subdivision. Tree cover primarily exists along the common property line Steeple Ridge and in the northern portion of the tract. The narrow portion of the site consists of 11 lots fronting a dead-end street accessed from Shady Grove Road. An excess lot of about 2 acres at the end of the street is reserved for a possible future phase of the development. One lot at the southwest corner of the site has an existing house that is intended to remain when the property develops. That property is included in the plat because their back 21,828 square feet is included in the development plan for the development of two new lots (Lots 1 & 2, Block 2). There is another house at the southeast corner of the property that would be removed as part of the development. COMPREHENSIVE PLAN: This area is designated on the Comprehensive Land Use Plan as "Low Density Residential." This designation provides for the development of traditional, low-density single-family detached dwelling units. This proposed preliminary plat has an associated zoning change request to R-2 Single-Family Residential on the July 23, 2015 agenda. THOROUGHFARE PLAN: The subdivision will have access to Shady Grove Road, which is classified as a C2U Minor Collector roadway on the Thoroughfare Plan and was fully developed in this area in 2011 . The required 60 feet of right-of-way exists along this property's frontage, thus the dedication of additional right-of-way is not required from this property. STREET LENGTH: The layout of the subdivision includes a single dead-end street with a hammerhead turnaround. The street is mostly a single-loaded street with lots located on the east side of the street. Two lots are located on the west side of the street at the intersection with Shady Grove Road. The west side of the street also abuts the adjacent property with the intent for allowing future development in the area. The length of the street exceeds the maximum allowed length of 500 feet for a cul-de- sac; the overall length of the street is 809 feet. The hammer-head turnaround is created by a proposed emergency access easement located 600 feet north of Shady Grove Road on the west side of the street. The developer indicates that this easement would be converted to a residential lot in the event that additional street access is constructed to Clay Hibbins Road when the adjacent property develops. Since the developer does not own the property to the west where a connection to Clay Hibbins would be made, the DRC advised the developer that a variance from the subdivision standards would be required for the length of the dead-end street. Even with the added easement, the street still exceeds the maximum length allowed by the subdivision regulations. The developer has requested a variance from this standard to allow the design as proposed. EFFECT ON FUTURE DEVELOPMENT: The DRC is concerned about the future practicability of this subdivision connecting with the adjacent properties. The overall development pattern is unclear since the adjacent owners are not participating in the preliminary plat. While the west side of the proposed street abuts these properties with the intent of providing future access, the layout of the proposed subdivision may not provide for the most efficient development of the adjacent property. ROUGH PROPORTIONALITY DETERMINATION: The developer will be responsible for 100% of all paving, water, sanitary sewer, and drainage infrastructure needed to support the development in accordance with the City's design criteria. A drainage easement is provided on the northernmost lot to accommodate the location of the pond. However, the zoning ordinance requires separate approval of a Special Use Permit (SUP) for a detention pond. This SUP will need to be processed prior to the submittal of a Final Plat, and the application will need to include the engineering design of the detention pond as well as landscaping plans for the site. In the event the SUP is not approved, the preliminary plat may have to be redesigned. PLAT STATUS: The property is currently described as three unplatted tracts within the Thomas Peck Survey, Abstract No. 1209. ATTACHMENTS: See staff report for Case ZC 2015-11 for additional descriptive attachments. STAFF REVIEW: The plat does not meet the requirements of the subdivision regulations due to the street exceeding the maximum length allowed by the subdivision regulations. Therefore, staff recommends denial of PP 2015-04. However, the Commission may approve the Preliminary Plat subject to a variance from this standard, as requested by the applicant.
