Presenter: Clayton Comstock, Planning Manager Summary: On behalf of NewQuest Properties, Winkelmann & Associates, Inc. is requesting a zoning change from C-1 Commercial to NR-PD Non-Residential Planned Development on approximately 8 acres in the 9100 block of North Tarrant Parkway. This is Phase 2 of the North Tarrant Marketplace development (Kroger Marketplace, Chick-fil-a, etc.); so the zoning change also includes and revises NR-PD No. 69 previously approved on 26.94 adjacent acres for a new NR-PD zoning boundary of 34.879 acres. This Phase 2 addition would add a 37,000 square foot fitness center and an 8,050 square foot retail strip building to the west of the existing Kroger Marketplace. General Description: CURRENT ZONING: The 27-acre Phase 1 of the property was zoned NR-PD No. 69 in 2013. The NR-PD allows all uses permitted within the "C-1" Commercial Zoning District as well as special provisions for limited auto-related uses, seasonal outdoor sales, and gasoline sales. The remaining 8 acres was zoned "C-1" Commercial sometime between 1977 and 1984. For reference, the adjacent Thornbridge neighborhood was developed in the mid-1990s. COMPREHENSIVE PLAN: The Comprehensive Plan depicts "Retail' uses for the area. The "Retail' designation has appeared since the 1992 Comprehensive Plan, which also provided the following recommendation: Develop the triangle area defined by Precinct Line Road, Davis Blvd, and North Tarrant Parkway as retail commercial. The inner area of the triangle should be encouraged to develop as a major retail center. The outer areas (south of North Tarrant Parkway and west of Davis) should be encouraged to develop as either retail commercial or office professional. It is also important to limit commercial development along these outside Packet Pg. 14 C.1 140L Im Rib "ArRok., NORTH KIC;HLA D HILLS corridors to depths not exceeding 300 to 400 feet. Deeper development will create possible conflicts in land uses and potential to land-lock properties. The proposed uses and development pattern are consistent with the "Retail" land use designation. SURROUNDING ZONING / LAND USE: North: PD Planned Development (Wal-Mart) / Retail West: C-1 Commercial / Retail South: R-2 Residential & AG Agricultural / Low Density Residential East: City of Colleyville PLAT STATUS: A Final Plat for North Tarrant Marketplace was filed on April 1, 2014 (Case FP 2014-09). That plat does not include the proposed Phase 2 (fitness center) portion of the development, so platting would need to occur prior to any Phase 2 construction. DEVELOPMENT TENANTS: The developer has announced many of the tenants that have already signed leases and/or are likely coming soon. Masonry wall variance. A 6-foot masonry screening wall was required behind the Kroger Marketplace. The applicant is requesting to waive the masonry screening wall requirement on the remaining phase since the fitness center building will be located at least 177 feet away from the closest residential property line. They are also proposing tree preservation and new landscaping that will help screen the building. The applicant also contends that installation of a new masonry wall along the property line would result in the loss of the trees that most benefit the residents. 2. Signage. Previous approval was given to allow monument signage that exceeds the City's height and area standards. Two large development signs of 21' in height and two oversized monument signs of 8'6" were � ? allowed. This revision proposes one additional °a 21 sign at the developments northwesternmost entrance that would serve the fitness center and new strip center uses as Y ✓rl well as one of the pad sites along North Tarrant Parkway. A new NR-PD provision also allows � for all signs to be shared among the tenants in the development (i.e. the fitness center use could have signage on Precinct Line even though they do not have lot frontage or are visible from Precinct Line). The NR- PD revision results in the net loss of one sign structure. 3. Drive-thru Limitation. The developer's Site Plan depicts a drive-thru lane on the eastern wall of the strip retail building attached to the fitness center (see plan at right). TRAFFIC & ACCESS: With the development of Phase 1, the City and the developer coordinated the installation of one new median opening and associated left turn lanes as well as a new traffic signal along North Tarrant Parkway. At that time, staff also indicated the City's desire to have a cross access connection to the undeveloped commercial property to the west (platted as Davis-North Tarrant Parkway Addition). No connection was planned, with the understanding that it would likely be addressed with this phase. The original Traffic Impact Analysis from 2013 provided some generalized assumptions on the retail uses that would be occupying the center. The updated Traffic Impact Analysis dated May 21, 2015 and submitted to NRH on June 5, 2015 included some new information. The updated TIA showed an overall 97% increase in site-generated traffic, resulting in a significant increase in right-turn movements at three of the four driveways on North Tarrant Parkway. With a 45mph speed limit, the threshold for triggering the need for a deceleration lane is 60 turns per hour. The updated TIA increases turns by almost 50% over the previous pre-development estimates, which already was near 60 turns or exceeded 60 turns per hour in some cases. The main driveway is predicted to experience 205 right turns in the PM peak, with Driveway 4 showing 123 turns. Exceeding this threshold by 240% and 105% in these cases is a concern as this impacts North Tarrant Parkway in an area that already has significant through traffic. In light of this updated TIA, the City will require for the developer to either escrow funds for the construction of deceleration lanes at Driveways 4, 5 & 6 or develop a plan to show how the right turns can be mitigated to acceptable numbers. If funds are escrowed, the funds must take into account the costs needed to design and construct the deceleration lanes including all needed modifications to street lighting (City owned), irrigation, landscaping (tree replacement), signal modification, and sidewalks. The escrowed funds will be used when the site reaches full development and the level of service along the corridor worsens as a result. In the event that the funds are not used, the City/Developer agreement will stipulate that they be returned at the end of a 20-year time period. The other option would be to develop the site in a way to mitigate the number of turns off of North Tarrant Parkway. This most likely will involve cross access through the site to provide better ingress and egress from Davis Boulevard and Precinct Line Road. A TIA will be required to show how the traffic would be mitigated. If this option is selected Packet Pg. 17 C.1 140L Im Rib "ArRok., NORTH KIC;HLA D HILLS and justified through a TIA, then no escrow would be required since the deceleration lanes would not be necessary. In an effort to keep the project moving forward staff will be proposing that the following wording be considered by City Council as they consider the PD zoning request: Understanding the developer's concerns for protecting their contractual exclusivity restrictions with their primary tenants, staff believes that a workable solution would be to require a cross access connection be made in the future once one is developed on the other side and uses on that property were restricted to satisfy the developer's primary lease. As such, staff recommends that the Planning & Zoning Commission and City Council consider adding the following stipulation to the NR-PD zoning if approved: The developer shall escrow funds for the construction of deceleration lanes at Driveways 4, 5 & 6. The funds shall account for the costs needed to design and construct the deceleration lanes including all needed modifications to street lighting (City owned), irrigation, landscaping, tree replacement, signal modifications, sidewalks, and other related improvements and modifications. In the event that a paved 24-foot wide vehicular driveway stub is provided to the western property line of Lot 12 from the Davis-North Tarrant Parkway Addition and that property owner has agreed to exclude grocery and gasoline sales within the Davis-North Tarrant Parkway Addition through either deed restriction, zoning, or other legal method, Lot 12 shall connect with an equivalent 24-foot vehicular drive lane to allow the free flow of traffic between the developments. If such cross access is provided and after full development of the North Tarrant Marketplace center, traffic patterns can be further assessed and the City may reevaluate the need for the deceleration lanes. If it is determined by the City Engineer that any or all of the deceleration lanes are not required, the appropriate escrow funds shall be returned. RESIDENTIAL BUFFER TREE PRESERVATION & NEW PLANTING: Much of the site for the new Phase 2 was already graded with the development of the Kroger, whereby removing much of the natural grade and vegetation. Addition grading and tree removal will be required; however the applicant has provided a � natural buffer ranging from 177 feet on the eastern end of the property to 304 feet on the Y` western end. The project engineer has proposed a retaining wall that is intended preserve approximately 50 large existing trees in that buffer area. EXHIBIT B Nonresidential Planned Development (NR-PD District No. 69) Land Use and Development Regulations North Richland Hills,Texas This Nonresidential Planned Development (NR-PD) District shall adhere to the conditions of the North Richland Hills Codes of Ordinances, as amended, and adopt a "base district" of"C-1" Commercial District.The following regulations shall be specific to this NR-PD District.Where these regulations conflict with, or overlap another ordinance, easement, covenant or deed restriction,these regulations shall prevail. ZONING 1. Permitted Land Uses. Used in this NR- PD shall be those permitted in the "C-1" Commercial District and shall also include the following: a. Seasonal sales. The Church does not have any immediate development plans. The zoning change request is associated with a capital improvements project for Smithfield Road and the right-of-way required from the Church for the project. General Description: EXISTING CONDITIONS: The 8.489-acre property was purchased and platted by Center Point Church in 2003. The 22,278 square foot building and its associated parking was completed in two phases in 2005 and 2008 but only takes up a little more than half of the lot area. The Church has plans for future expansion of a Worship Center addition and additional parking. SURROUNDING ZONING / LAND USE: North: TOD / TOD West: C-1 Commercial / Neighborhood Service South: R-4-D Duplex & R-2 Single Family / Low Density Residential East: TOD / TOD PLAT STATUS: Lot 1, Block 1, Center Point Addition (NRH Case No. PS 2003-05) was filed May 8, 2003. COMPREHENSIVE PLAN: The Comprehensive Plan shows this 50-foot strip along Smithfield to be planned for "Transit Oriented Development" (TOD) and the remainder of the Church property to be the "Retail' designation. EXISTING ZONING: Transit Oriented Development (TOD) District. In 2009, the City of North Richland Hills rezoned a large portion of the Smithfield area into the Transit Oriented Development Zoning District to prepare for the eventual arrival of a commuter rail station. A 50-foot strip of land on the west side of Smithfield Road on the Center Point Church property was included in the rezoning for the purpose of establishing the urban streetscape on both sides of Smithfield Road in that area. If development had occurred on the west side of Smithfield, they would be required to adopt the same sidewalks, street trees and other TOD elements along the street. Since, however, the City is proceeding with installing those improvements as part of the Smithfield Road CIP Project described below, there is no foreseeable reason to keep the 50-foot strip in the TOD District. SMITHFIELD ROAD CIP PROJECT: The City of North Richland Hills is currently undergoing design and completing the right-of-way acquisition for a Capital Improvements Project that will reconstruct, widen and redirect Smithfield Road between Mid-Cities Boulevard and Davis Boulevard. The project includes intersection improvements at Mid-Cities and Smithfield as well as redirecting Smithfield on the south side to intersect with Davis at the Bridge Street signalized intersection. Between the two intersections, the roadway will be widened to four lanes and sidewalks and street trees will be provided. IMPACT ON CENTER POINT CHURCH: Through the right-of-way acquisition process, officials at Center Point Church notified the City that the Church had plans already prepared for the expansion of their campus and parking lot. The concern was that the right-of-way taken along Smithfield Road could cause a loss in parking spaces if the City held firm to the required minimum landscape setback. City staff and the Smithfield Road design engineer were able to accurately identify that the ROW acquisition will result in a reduced landscape setback width, but that the proposed parking stalls themselves are not impacted. To accommodate this landscape setback reduction and avoid a higher acquisition cost, an elected or appointed board or commission of the City would have to officially grant some sort of variance. PROPOSED ZONING: "C-1" COMMERCIAL. The remainder of the Center Point Church property is zoned "C-1" Commercial, so the proposed rezoning would eliminate the split-lot zoning that was created in 2009. Additionally, most of the City's landscape regulations are located within a chapter of the City Code that is separate from the Zoning Code. The Transit Oriented Development (TOD) Zoning District, however, has specific public and private landscape and streetscape provisions. A landscape variance on property in the TOD would therefore require Zoning Board of Adjustment approval or City Council approval of a Special Development Plan after Planning & Zoning Commission consideration. If rezoned to "C-1" Commercial, a Landscape Review Board case could accomplish the same result. Presenter: Clayton Husband, Principal Planner Summary: Winkelmann & Associates, Inc. is requesting approval of an Amended Plat for North Tarrant Marketplace Addition for the purpose of relocating a lot line to accommodate the development of a fast-food restaurant. The property is located on the south side of North Tarrant Parkway between Davis Boulevard and Precinct Line Road. General Description: This amended plat would move the common lot line approximately 35 feet to the west to accommodate the development of a restaurant on proposed Lot 11 R. The lots are part of a larger retail center anchored by Kroger Marketplace. This plat does not increase the number of lots or alter or remove any recorded covenants or restrictions, if any, on the property. The plat is administratively complete and meets the requirements of the subdivision regulations. CURRENT ZONING: NR-PD Non-Residential Planned Development No. 69.
